1 ACADEMIC AFFAIRS COUNCIL AGENDA ITEM: 8.G DATE: September 7, 2006 ****************************************************************************** SUBJECT: Terminal Degree Definition Review and Addition to Table AAC is considering revising the terminal degree definition. AAC had reviewed the current definition below and asked the General Counsel 3 questions relating to faculty. The current definition is included below. DSU is requesting to add the terminal degrees of JD, PhD in Chemistry, PhD in Physics, and PhD in Math to Scientific Forensic Technology. This request has been added to the terminal degree table in blue highlight (Attachment I). Faculty members are determined to possess a terminal degree when, in the judgment of the campus, they have earned the highest academic degree typically granted in their field of specialization, or a campus justified related field, and, their primary faculty assignments for the contract period are related to this degree. Questions for BOR General Counsel: 1. This definition has not been updated since the BOR adopted the Terminal Degree Inventory that specifies the terminal degree by discipline for each university. Should the definition refer to the BOR approved Terminal Degree Inventory? I believe that this would be a sensible approach. To the extent that institutional curricula have become more closely integrated, both with respect to facilitated inter-institutional transfer and with respect to joint programming, and to the extent that relationships with the technical institute general education programs have increased the political stakes in attending to faculty credentialing issues, the need for consistent approaches across institutions to decisions about acceptable levels of academic preparation. ****************************************************************************** RECOMMENDED ACTION Discussion and recommendation.
2 2. AAC is considering separating the definition from the statement related to faculty assignments. Do you have any issues that need to be considered if this is done? The purpose for separating out these considerations is not immediately obvious to me. I certainly can understand why a JD may be accepted as an appropriate terminal degree for a business law professor or, possibly even a political science professor, but I don t see why that degree should fit the bill for an English professor, an historian or a mathematician, absent circumstances related to the assignment legal writing is a specialty, as is legal history, but lawyers, however calculating they may be, have little in their professional preparation to ready them for mathematical reasoning that would render the decision appropriate. 3. Are there any COHE contract issues that need to be considered when revising the definition? The question of terminal degree status arises in two portions of the COHE agreement: 12.1 MINIMUM RANK QUALIFICATIONS FOR EMPLOYMENT AND PROMOTION The rank qualifications which are set forth below are minimums for employment and promotions. All references to teaching or research experience in rank qualifications listed below are to full-time academic year appointments or to their equivalents. Where part-time experience is to be recognized, it shall be recognized on a pro-rata basis. For purposes of this article, one year of full-time successful service with the Agricultural Cooperative Extension Service is equivalent to one year of successful college teaching or research experience. INSTRUCTOR: (Nontenurable) 1. Earned master's degree; or 2. Other degrees or qualifications recognized under academic program or discipline accreditation standards. ASSISTANT PROFESSOR: (Nontenurable) 1. Earned master's degree and three (3) years of successful college teaching or research experience in appropriate fields (or appropriate equivalent experience). For faculty unit members whose initial appointment is for the fiscal year or thereafter, thirty (30) additional semester hours of graduate credit will be required; or
3 2. Earned doctorate or a postgraduate degree, other than a doctorate, recognized by the Board as a permitted terminal degree for the faculty unit members' discipline at the institution. ASSOCIATE PROFESSOR: (Tenurable) 1. Earned doctorate and five (5) years of successful college teaching or research experience in appropriate fields (or appropriate equivalent experience); or 2. A postgraduate degree, other than a doctorate, recognized by the institutional administration as terminal for the faculty unit members' discipline, and six (6) years of successful college teaching or research experience in appropriate fields (or appropriate equivalent experience); 3. Evidence of scholarship. PROFESSOR: (Tenurable) 1. Earned doctorate and ten (10) years of successful college teaching or research experience in appropriate fields (or appropriate equivalent experience); or 2. A postgraduate degree, other than a doctorate, recognized by the institutional administration as terminal for the faculty unit members' discipline, and twelve (12) years of successful college teaching or research experience in appropriate fields (or appropriate equivalent experience); 3. Evidence of scholarship SALARY ADJUSTMENT AFTER RECEIPT OF TERMINAL DEGREE Faculty unit members who, while employed by an institution on a tenure track or tenure contract, earn a terminal degree appropriate for their assigned teaching or research responsibilities will be awarded a salary adjustment. The adjusted salary will not exceed the average salary in the discipline and at the rank among persons who hold appropriate degrees and rank. The adjustment will take effect during the academic year following that in which the degree is awarded. When determining the total salary increase for the year in which the market based salary adjustment will be given effect, the adjustment will be made prior to determination of any other form of salary adjustment for the fiscal year. Although the verbiage scarcely provides a model of consistent usage, it does make it clear that the responsibility for determining whether a particular degree should be accepted as equivalent to a discipline-specific terminal degree is not subject to negotiation with COHE, though the decision is to be made with due consideration to the circumstances at the affected institution and to the individual unit member s assignment.

South Dakota School of Mines & Technology We do not hire on a tenure track contract unless the person has an earned doctorate. Doctor of Music Arts (D.M.A.) Doctor of Education (Ed.D) The degrees and discipline areas shown in the table are those of our current permanent faculty. Part-Time faculty are hired in various disciplines within the liberal arts on an as needed basis. Among our non-tenure track people in the areas of physical education, library, and art, we have considered the following to be terminal degrees for purposes of promotion: Master of Arts (M.A.) Master of Science (M.S.) Master of Library Science (M.L.S.) Master of Fine Arts (M.F.A.) With the exception of our professional librarians, these positions are all ones with substantial soft money support. South Dakota State University Degrees regarded by South Dakota State University as terminal degrees for appointment, promotion, and tenure purposes are as follows: Master of Fine Arts (MFA) Master of Landscape Architecture (MLA) Master of Library Science (MLS) when combined with a second masters degree Master of Social Work (MSW) (in the past; would be reevaluated with new appointments) Doctor of Philosophy (Ph.D) Director of Education (Ed.D) Doctor of Veterinary Medicine (DVM) Doctor of Medicine (MD)

In both areas the combination of academic degree and work experience is more relevant than looking solely at the doctorate as the terminal degree.
