2 Professional Indemnity Exclusion (Applicable to Sections B & C of the Policy) Notwithstanding anything to the contrary contained in this Policy, the indemnity provided by this Policy shall not apply to legal liability arising by virtue of any negligence act error or omission malpractice or mistake committed or alleged to have been committed in the provision of professional services by or on behalf of the Insured. Professional services includes but is not limited to the preparation or approval of maps plans advice opinions reports computer programmes surveys drawings formulae designs or specifications and supervisory consultancy inspection engineering or project management services whether for a fee or otherwise. All other terms, conditions, exclusions and limitations in this policy remain unchanged Personal Protective Equipment Condition (Applicable to Section A of the Policy) It is a condition of this Policy that the use or wearing of Personal Protective Equipment by any Person Employed is rigorously enforced and that Personal Protective Equipment is supplied to the Person Employed and that a formal record is maintained confirming receipt of such equipment. Skip Exclusion (Applicable to Sections B & C of the Policy) This Policy does not indemnify the Insured in respect of any liability arising from or in any way connected to the use of skips or other containers when such skips or containers are left on a public highway. Waste Disposal Conditions (Applicable to Sections B & C of the Policy) It is a condition precedent to liability that all waste is disposed of at licensed waste sites Bona Fide Subcontractors Condition (Applicable to Sections A B & C of the Policy) It is a condition of this Policy that all bona fide subcontractors engaged by the Insured have in full force and effect throughout the duration of their contract with the Insured insurances as follows 1 Employers Liability insurance in respect of their liability at law for Injury to any person in the employment of the subcontractor including any labour master or labour only subcontractor or person supplied or employed by them 2 Public/Products Liability insurance in respect of their liability at law for Injury or Damage with a Limit of Indemnity of not less than the limit of indemnity any one occurrence or series of 2 of 8

3 occurrences arising out of one original cause provided under this policy It is further a condition that i. such insurances contain an Indemnity to Principals Clause ii. the Insured shall have obtained and retained a copy of written evidence of such insurances For the purposes of this Endorsement the term bona fide subcontractors means any subcontractor engaged by the Insured supplying labour and or materials for the purpose of the contract It is further condition that the Insured will not assume by any agreement any liability or potential liability that would not have attached to the Insured in the absence of such agreement including but not limited to the assumption of any liability or potential liability on behalf of any bona fide subcontractor or the waiver of any rights of recourse against any bona fide subcontractor Haulage Restrictions (Applicable to Sections B & C of the Policy) This Policy does not indemnify the Insured in respect of liability for a) Injury or Damage caused by or in any way connected with the wrongful delivery of or the contamination in transit of any load b) Injury or Damage caused by or in any way connected with the carriage of hazardous and/or notifiable goods substances or waste materials c) freight forwarders and/or warehouseman s liability Hazardous Locations Exclusion (Applicable to Sections A B & C of this Policy) This Policy does not indemnify the Insured in respect of liability caused by or arising from any work in or in connection with a) towers steeples chimney shafts blast furnaces dams canals viaducts bridges or tunnels b) aircraft airports railways ships vessels air cushioned vehicles watercraft docks piers jetties wharves breakwaters or sea walls c) collieries mines quarries chemical works gas works oil refineries power stations nuclear installations or establishments d) work underground or underwater offshore installations bulk oil petrol gas or chemical storage tanks or chambers of 8

4 Heat Work Away Exclusion (Applicable to Section B of the Policy) This Policy does not indemnify the Insured in respect of liability arising out of or in way connected with any work involving the use or application of heat away from the premises of the Insured. However this exclusion shall not apply to the use of electric soldering irons and electric hot air guns provided that such equipment complies with British Standard BS3456 if applicable and is thermostatically controlled. Inefficacy Exclusion (Provision of Services) (Applicable to Section B & C of the Policy) This Policy does not indemnify the Insured in respect of liability arising from the failure of any Product or service to fulfil the purpose for which it was designed or to perform as specified warranted or guaranteed EL Certificate 4 of 8
