PUBLICATIONS REENTERING SURVIVORS: INVISIBLE AT THE INTERSECTION OF THE CRIMINAL LEGAL SYSTEM AND THE DOMESTIC VIOLENCE MOVEMENT (accepted by the Berkeley Journal of Gender, Law & Justice) Inspired by the more practical piece below, this piece explores that the exclusion of formerly incarcerated women from the domestic violence movement. By analyzing the historical roots of the tough on crime movement as it pertains to both the criminal legal system and the domestic violence movement, this piece documents the structural and physical harms done to women at the intersection of these systems. CIVIL PROTECTION ORDERS: INCREASED ACCESS AND NARROWED ENFORCEMENT (forthcoming in the University of the District of Columbia Law Review) This brief piece was invited by the University of the District of Columbia Law Review and analyzes the D.C. Court of Appeals shifting jurisprudence regarding private prosecutions of violations of civil protection orders. The piece tracks how the broadening of eligibility for protection orders occurred alongside a narrowing of how violations of these orders could be prosecuted. 1
2 VICTIMIZED AGAIN: HOW THE REENTRY PROCESS PERPETUATES VIOLENCE AGAINST SURVIVORS OF DOMESTIC VIOLENCE, National Clearinghouse for the Defense of Battered Women (2013) This piece explores the ways in which post-conviction community supervision interacts with domestic violence. Using Washington, DC as a case study, it illustrates the often reciprocal relationship between community supervision and domestic violence and recommends best practices for practitioners in both fields. 5 RESEARCH AGENDA My recent research has focused on the intersection of criminal law and domestic violence, examining the ways in which parole and probation undermine reentering women s safety while the lack of appropriate domestic violence services for reentering survivors threatens their liberty. My first piece, Victimized Again: How the Reentry Process Perpetuates Violence against Survivors of Domestic Violence, was solicited by the National Clearinghouse for the Defense of Battered Women after I led a webinar training for the Clearinghouse focusing on legal strategies for practitioners providing services to justice-involved survivors. Thinking through the practical realities of working with this population inspired me to approach the intersection of criminal law and domestic violence from a scholarly perspective. My current work in progress, tentatively titled Reentering Survivors: Invisible at the Intersection of the Criminal Legal System and the Domestic Violence Movement, analyzes the effects of the adoption of tough on crime policies by both the criminal legal system and the domestic violence movement. This piece exposes the structural invisibility of reentering survivors, illustrating the ways in which the criminal system ignores how women s experiences of violence impact criminality while punishing women whose abuse interferes with the requirements of their parole or probation. It also highlights the historical and pervasive exclusion of justice-involved women from the domestic violence movement s conception of a worthy victim, underscoring the lack of services and sympathy available to reentering women. Both independently and cumulatively, the philosophies of the criminal legal system and the policies of the domestic violence movement interfere with women s abilities to successfully and safely reintegrate into the community. I plan to continue researching the ways in which state control and domestic violence intersect. I want to expand on my current work in three ways: empirically, theoretically, and pedagogically. Because women experiencing post-incarceration domestic violence have received little, if any, scholarly attention, I hope to conduct empirical research among formerly incarcerated survivors to examine how reentry and domestic violence interact. While there have been studies documenting the pre-incarceration rates of domestic violence among female prisoners, there is little data concerning domestic violence occurring during reentry and none addressing the relationship between domestic violence and parole and probation. My goal is to use data illuminating this relationship to make concrete recommendations on how to reform parole and probation to best meet the needs of reentering women and their communities. Building on my current research examining the relationship between the post-conviction criminal system and domestic violence, I intend to analyze the role of state control in women s lives more broadly. I plan on focusing future scholarship on the relationship between violence against women and state agencies overseeing, for example, child welfare, public assistance, and mental health. Exploring how systems interact to create additional challenges for survivors would allow me to propose systemic reforms promoting the safety of survivors and their families. I am also interested in approaching these topics from a pedagogical perspective, exploring how to effectively and explicitly teach students about intersectionality and state control. These issues are compelling on their own and they also provide a jumping-off point for students to learn about how the legal system can exclude populations that do not fit easily into preconceived notions of who is deserving or worthy of state-sanctioned support. I hope to use these broader implications of my research to engage students on how our legal system conceptualizes its beneficiaries and how to reform the system s recognition of and response to those that fall outside its traditional purview. 5
