2 NURSING HOME ABUSE AND NEGLECT A GROWING EPIDEMIC In 2003, over 20,000 complaints of nursing home abuse and negligence were reported throughout the United States. This epidemic of inadequate care is on the rise as our population ages. However, there are federal and state laws in place to protect the safety, rights and quality of life for all nursing home residents. 5 COMMON TYPES OF NURSING HOME ABUSE AND NEGLECT: PRESSURE SORES Pressure sores (also known as bedsores, pressure ulcers or decubitus ulcers) are lesions on the skin that typically form due to constant pressure on bony parts of the body. This pressure decreases the blood flow to those areas, causing the tissue to die. Bedsores can occur anywhere, but are commonly found on the following body parts: Sacrum Coccyx (Tailbone) Ankles Elbows Heels PRESSURE ULCERS ARE OFTEN PREVENTABLE. Nursing homes and hospitals are obligated to assess each resident to determine if they are at risk for bedsores. When a resident is at risk for pressure sores, nursing home staff must develop a care plan to prevent sores from forming or worsening and then implement that plan. Conscientious staff must frequently reassess plans to make necessary changes, dependent on each resident. Nursing home residents at certain stages of incapacity are at risk for developing pressure sores. There are numerous risk factors. Some of the most common include: Immobility (often as a result of fractures sustained during falls) Poor Nutrition And Hydration Peripheral Vascular Disease Diabetes All long-term care facilities are required to have measures in place to prevent the development or worsening of bedsores. When a resident develops bedsores because nursing home staff failed to take all possible steps to prevent them, families may be able to hold the facility accountable. 5
6 COMMON TYPES OF NURSING HOME ABUSE AND NEGLECT: NURSING HOME FALLS FALLS IN NURSING HOMES According to the Centers for Disease Control and Prevention, 1,800 nursing home residents die from fall-related injuries every year, and those who survive often suffer debilitating injuries from which they never fully recover. Nursing home falls are common because residents are typically older and have difficulty walking due to muscle and bone density loss, medication side effects, poor vision and gait problems. However, nursing home falls are often preventable if employees take the proper steps to supervise and protect residents under their care. Nursing home staff play an important role in protecting the safety of residents as they move about the facility. When a patient is admitted into a nursing home, staff must assess his or her risks for falls and identify and implement interventions to address these risks. Reassessments should occur after any fall or change in medical condition. Residents at risk should be monitored closely and receive assistance with transfers to prevent them from falling. Bed rails, nonskid footwear, appropriate wheelchairs and comfort chairs with wheels locked at bedside, walkers and canes can be used to help prevent falls. Falls in nursing homes may lead to serious injuries including: Brain Injuries Skull or Facial Fractures Fractured Limbs Hip Fractures Oftentimes these injuries result in further medical issues and permanent disability. For older people, fall injuries can greatly reduce their quality of life and cause their overall medical condition to deteriorate rapidly. Although some falls are unavoidable, falls in nursing homes are often a sign of nursing home negligence and understaffing. When nursing staff cannot properly supervise and monitor residents, fallrelated injuries are more likely to occur. 6
7 COMMON TYPES OF NURSING HOME ABUSE AND NEGLECT: PHYSICAL OR SEXUAL ABUSE Nursing home residents are easy targets of physical or sexual abuse because of their dependence on others. Many residents cannot communicate, and therefore cannot report abuse themselves. Maltreatment of the elderly is absolutely unacceptable, and deserves severe punishment to both the perpetrator and the nursing home that allowed the abuse to occur. Physical abuse encompasses both sexual assault and any form of physical assault or maltreatment. A resident may not be able to speak for themselves, but their physical condition can reveal warning signs of nursing home abuse. Signs of physical or sexual abuse include: Along with physical signs, victims of abuse may become withdrawn or anxious. Abuse may occur between two residents or between a nursing home staff member and a resident. No matter who the abuser is, nursing homes are responsible for protecting the safety and well-being of residents under their care and can be held accountable when employees or other residents cause serious harm to a resident. 8 COMMON TYPES OF NURSING HOME ABUSE AND NEGLECT: MEDICATION ERRORS Misadministration of medicine and medication errors are frequent and serious problems at nursing homes. Residents are often given the wrong medication or not given the medication in the dosage or frequency as required by the physician s order. This occurs as a result of carelessness on the part of the staff, lack of supervision of the nurses administering medications or not having enough properly trained and supervised to staff to administer medications. Studies have shown delayed or missed doses of medication and the administration of the wrong dose or the wrong medication are the two most common medical mistakes made in the medical setting. Studies also show that nursing home medication error occurrences are widely underreported. It is estimated that only 1.5% of all medication errors are actually reported. Medication error risks in nursing homes can be considerable because most patients are required to take a number of prescriptions and already have compromised physical health conditions. OVERMEDICATION Nursing home residents are often given antipsychotic medications despite having no diagnosis to call for their use. Medicare statistics showed that in 2010, over 17% of people living in nursing homes were receiving antipsychotic medications on a daily basis at doses that exceeded the recommended level. When nursing homes are understaffed, employees may overmedicate residents to sedate, manage or control them. Signs of overmedication include: Personality Changes Lethargy or Exhaustion Oversleeping Confusion Withdrawn or Reclusive Behavior Antipsychotics are often prescribed to treat younger residents who suffer from mental illnesses. However, when nursing homes administer antipsychotics to elderly residents who suffer from dementia, it is considered an off-label use. The use of these medications in elderly residents commonly causes lethargy and can lead to other serious medical issues. 8
9 COMMON TYPES OF NURSING HOME ABUSE AND NEGLECT: DEHYDRATION/MALNUTRITION Maintaining appropriate nutritional and hydrational status is important in the nursing home setting. Residents who do not receive adequate nutrition and hydration in their diets are more at risk for the development of pressure ulcers, infection, muscle weakness leading to immobility and falls. Malnutrition and dehydration also make it more difficult for existing pressure ulcers and infections to heal. Elderly nursing home residents are at risk for dehydration because they have less water content in their bodies and decreased thirst. It is important for nursing home staff to assess these risks, and develop and implement plans to monitor those in their care. Nursing home staff should be watchful of residents fluid intake to ensure they are properly hydrated. There are a variety of factors that can lead to malnutrition. Depression is a potential cause of malnutrition because individuals suffering from depression have a tendency to eat less and in turn to do not receive appropriate vitamins and minerals to prevent malnutrition. Other causes of malnutrition include difficulty swallowing and adverse drug effects such as vomiting and diarrhea. Nursing homes often fail to take steps to prevent malnutrition by not monitoring resident food intake and output, not providing a comfortable environment to promote eating and not providing food that is appetizing. CHOKING Nursing home residents often have medical problems or take medications that make it difficult to properly chew or swallow food. Due to this, many are at high risk for choking and require special food preparation or diets to ensure that they receive the proper nutrition. Residents who are at risk should also be closely monitored during mealtimes. Choking, by depriving oxygen to the brain, can cause brain damage, and even death. While such an injury may appear to be accidental, in some instances choking is a result of nursing home negligence. This includes giving residents the wrong foods or failing to monitor them as they are eating. When this is the case, it is important that nursing homes are held accountable for their fatal mistakes. 9
10 COMMON TYPES OF NURSING HOME ABUSE AND NEGLECT: WANDERING/ELOPEMENT Elopement and wandering are related concepts. Elopement refers to a resident s ability to leave the nursing home unsupervised and unnoticed, putting their safety in danger. Wandering refers to aimless movement throughout the facility where the resident puts his or her safety at risk due to an inability to appreciate danger. Elopement and wandering are risks that the nursing home staff must recognize and plan for in order to prevent residents from leaving the facility or entering into an unsafe area. Staff must provide each resident with the appropriate level of supervision to prevent elopement and wandering behavior. Exit doors should be alarmed to notify staff when residents leave the facility unsupervised, and the staff must know how to appropriately respond to alarms. Failure to do prevent elopement and wandering puts residents at risk for falls, exposure to harsh weather and other significant danger. 10
11 NOTABLE NURSING HOME VERDICTS AND SETTLEMENTS Our attorneys have recovered over $175 million in verdicts and settlements for nursing home residents. HCR MANOR CARE HOMEWOOD A $2.9 million Cook County record nursing home jury verdict against a suburban Homewood nursing home for the family of a deceased 57-year-old resident who was suffocated due to the home s negligent care of her tracheostomy tube. J.M. for M.M. v. KINGSLEY PLACE, et al. A $2.3 million settlement against an assisted living facility for the family of an 88-year-old resident who developed severe and infected bedsores, which ultimately brought about her death. Her doctor was criminally indicted for his conduct and charged with involuntary homicide. P.C. for A.R. v. RIDGEVIEW PAVILION, et al. A $1.5 million settlement against a nursing home for violating the Nursing Home Care Reform Act by failing to monitor a resident s cigarette smoking, leading him to suffer severe burns and death. J.F. v. WEDGEWOOD PAVILION NURSING HOME A $1.4 million verdict against a nursing home for its failure to manage a resident s aggressive behavior. This resident became involved in a clash with a fellow resident who, during the altercation, fell and suffered a hip fracture, which led to his death. JANE DOE V. CONFIDENTIAL NURSING HOME A $1.4 million settlement against a nursing home located in a northern suburb for injuries sustained as a result of a pressure ulcer. C.M. for H.M. v. WINCHESTER HOUSE A $1 million record Lake County settlement for an 83-yearold nursing home resident who fell several times while a resident at the nursing home, with the last fall contributing to her death. Despite her risk for falls, the nursing home neglected to implement changes in her care plan to prevent further falls from occurring. 11
