Location of Bid Opening: Board of School Commissioners of the City of Indianapolis. 120 East Walnut Street, Room 117,lndianapolis, IN B. Bids will be received in the Purchasing Department (Room 117) until the following date/time and shah be submitted on forms provided in this Project Manual: Thursday, August 11,2011 at 11:00 a.m. Local Time. Bids will be publicly opened and read aloud. C. Work shall be performed under a Single unified Contract. Bid Package #5 Masonry Restoration, Courtyard Water Infiltration Remediation and Demolition of Smoke Stack at Lone Hall. D. The Construction Manager will be on-site during construction. E. Bids shall be executed in accordance with Indiana Board of Accounts Form No. 96 (Current Revised) - "Contractor's Bid for Public Works," with a financial statement complying with Section III of Form No. 96, a satisfactory Bid Bond (amount of not less than five percent (5%) of the total price and delivered in a sealed envelope showing the Bidder's name and address), or certified check pursuant to lc. 36- I -9-36, payable to: 1. The Owner reserves the right to accept or reject any Bid, to waive any informalities or errors in bidding for a period of sixty (60) calendar days after the Bid opening. P. The Bidder receiving the award shall furnish an approved one hundred percent (100%) Performance Bond and a one hundred percent (100%) Labor and Materials Payment Bond which cover faithful performance of the Contract and the payment of all obligations arising thereunder. Certificates of said bonds shall be filed with the submission of the Contract to the Owner and remain in full force and effect for twelve (12) months from the date of acceptance of the Work. Q. The Contract to which the Owner will be a party will contain a provision prohibiting the other party to the ContraCt, and their subcontractors, from engaging in employment practice that constitutes a discrimination against a person because of the person's race, color, sex, religion, national origin or ancestry. Contractor shall provide an affidavit with each billing, assuring the Owner that this provision has not been violated. R. The project may be partially financed with bonds, including but not limited to, Build America Bonds (IRC Section 54AA), Qualified Zone Academy Bonds (Section 226(a) of the Taxpayer Relief Act of 1997), or Qual ified School Construction Bonds (IRC Section 54F) that are funded by federal or state programs. Successful bidders will be responsible for compliance with apphcable laws governing these programs including, but not limited to any applicable regulations promulgated after the time that bids are submitted; Davis-Bacon Act requirements; and federal whistleblower statute requirements. Bidders must affirmatively state their agreement comply with all applicable laws and regulations governing the receipt and use of federal and state funds in their bid response. The bid documents and construction contracts will be appropriately updated as the use of federal and state funds, as well as the laws and regulations governing those funds, are more definitively determined. S. Where trade names, brand names, or manufacturers' names are used in this Project Manual, it is for the purpose of establishing kind and quality and not for the purpose of limiting competition. Bidders may offer items or materials equal in quality and having the same durability and efficiency, if the Bidder first receives written approval from IPS seven (7) days prior to the date/time of the Bid opening and complying with requirements indicated in Division 00 Section, "Instructions to Bidders." The Bidder shall identify such substitutions by name, kind, and type with the Bid. T.
