Calgary, AB T2P 5H1 Facsimile Dear Ms. Homer, Mr. Thrasher, and Mr. Denstedt: NOVA Gas Transmission Limited (NGTL) Application for the 2017 NGTL System Expansion Project (Application) Notice of Public Hearing and Application to Participate On 31 March 2015, NGTL applied to the National Energy Board (Board or NEB) for approvals to construct and operate the 2017 NGTL System Expansion Project (Project), a proposed expansion of the NGTL System consisting of approximately 230 kilometres of pipeline in five new and separate section loops as well as two compression unit additions located in various areas in northern Alberta. The Project is a designated project pursuant to section 2(b) of the Canadian Environmental Assessment Act, 2012, for which the Board is the responsible authority. As described in a separate letter dated 29 May 2015, the Board determined the Application complete to proceed to assessment. The Board will hold a public hearing in which the Application will be reviewed by a Panel made up of three Board Members, who will consider all evidence filed and on the record for the Application, before making the Board s recommendation and decisions. Further information about the hearing will follow once the Board s Application to Participate (ATP) process has ended. In consideration of the Application, the Board is releasing its List of Issues for the Project which is attached to this letter as Appendix A. It can also be found on the Board s webpage for the Project. /2
2 - 2 - Those who wish to participate in the Board s hearing must apply to participate using the online ATP form. Applicants must clearly, and in sufficient detail, describe their interest in relation to the Issues the Board will consider for the hearing, which will be included on the ATP form. The Board must hear from anyone clearly demonstrating they are directly affected by the Project, and may hear from those with relevant information or expertise. The Board will allow participation in the environmental assessment by those with relevant information or expertise to contribute. The online ATP form will be available on the Board s website for a period of 3 weeks; starting 18 June 2015 and ending on 9 July 2015 at 4:00 pm (local time, Calgary, Alberta). Interested applicants must adhere to all deadlines. Further information about the Board s hearing and ATP processes can found on the Board s website. 3 Ensure the published notification meets the requirements of the Government of Canada s Federal Identity Program (for assistance please contact [email protected]). The Notice must be published as provided as it includes : a map of the proposed Project; the NEB logo (English or French); and the Canada wordmark. The Board also directs NGTL to make copies of the Application available for public viewing at various locations along the proposed Project route. The Board directs NGTL to make a list of these locations available on its Project s website. The Board directs NGTL to file a letter with the Board following the distribution and publication of the Notice (Appendix B), confirming that all directions in this letter were followed. The need for the Project. 2. The economic feasibility of the Project. 3. The potential commercial impacts of the Project. 4. The implications of relief requested under Part IV of the National Energy Board Act, including the distribution of long-term potential tolling and financial risks associated with the Project. 5. The potential environmental and socio-economic effects of the Project, including those to be considered under the Canadian Environmental Assessment Act, The appropriateness of the general route and land requirements for the Project. 7. Potential impacts of the Project on Aboriginal interests. 8. Potential impacts of the Project on landowners and land use. 9. The engineering design and integrity of the Project. 10. Contingency planning for spills, accidents or malfunctions, during construction and operation of the Project. 11. Safety and security during construction and operation of the Project, including emergency response planning and third-party damage prevention. 12. The terms and conditions to be included in any recommendation or approval the Board may issue.
