Corporate Headquarters, Polson, MT Full time position with full benefits to be offered at time of employment This position will report to the Energy Keepers, Inc. Plant Manager Under the direction of the Plant Manager, the Operations Compliance Manager is responsible for technical support and management of the Kerr Safety, Environmental, and WECC/NERC Regulatory Compliance programs; on-going performance trending and analyses; assess performance; and identify and implement/recommend appropriate changes and improvements. Through regular communications, establishes a collaborative working relationship with Federal, State, Tribal, Consultants, Contractors, and EKI personnel. Identifies and analyzes problems; distinguishes between relevant and irrelevant information to make logical decisions and develop solutions. Is able to communicate effectively with all levels and types of organizations and audiences and uses partnerships to achieve collaborative solutions and resolve complex problems. Uses project management, conflict management, mediation, team building, and negotiation tools to achieve results in a collaborative spirit. Analyzes diverse viewpoints to make planning decisions and solve work problems. Work is performed in support of hydropower generation with oversight of compliance efforts and consists of a variety of duties utilizing different and unrelated processes and methods involving equipment and facilities. 2 Is assigned long term, continuing responsibility for assuring the compliance to all applicable Western Electricity Coordinating Council (WECC)/North American Electric Reliability Corporation (NERC) Reliability Standards. Is the primary technical expert for reliability compliance for the Kerr Project/EKI. This includes assisting in the preparation of EKI reliability compliance and mitigation plans, coordinating and implementing EKI s overall WECC/NERC Reliability Compliance Program. Oversee and manage Operations Regulatory Compliance performance, analyses and reporting. Coordinate/conduct/document employee safety, environmental, and reliability-related training as required by established programs to all appropriate EKI personnel and Departments. Oversees Safety, Environmental, and Reliability Compliance Manual implementation and effectiveness. Develop, implement, and manage appropriate Compliance Program procedures including the development of detailed WECC/NERC compliance procedures and processes. As appropriate, recommend the use of specialized consultants and, when approved, manage compliance-related and support contracts. In coordination with the Dam Safety Compliance Manager, develop and support effective independent assessments of the Safety, Environmental, and WECC/NERC Reliability and Critical Infrastructure Programs. Aggressively identify and implement/recommend implementation of processes to integrate compliance requirements into new and existing procedures to ensure compliance while minimizing the effect on operations. Provides input to the Annual Budget process and executes the approved Budget. Manage the Compliance Lessons Learned process. Ensure that the Plant Manager, Power Plant Maintenance Engineer, and appropriate Operations personnel are aware of industry Best Practices. Review and comment on all Operations Compliance-related Incident Reports. Manage the root-cause analysis program. Conduct/support detailed technical analysis of data to identify and communicate abnormal Compliance conditions, assist in root-cause investigations, recommend effective corrective actions, and identify potential results. Monitor and recommend plans for compliance with Safety, Environmental, and WECC/ NERC regulatory changes that will affect the Kerr Project. Conduct assigned assessments/manage the Operations Assessment program; ensure appropriate follow-up. Page 2" of 6"

3 Responsible for reviewing and evaluating asset PM adequacy in regards to Safety, Environmental, and WECC/NERC program compliance as requested by the Maintenance Department. Serves as the Reliability Compliance Coordinator for the Kerr Project/EKI and provide program management for ensuring compliance with WECC/NERC, Regional and National Bulk Electric System Reliability Standards approved by FERC. Plans, develops, and coordinates implementation of the Kerr Project Reliability Compliance Program. Serves as the Kerr Project Point of Contact (POC) and technical authority for all reliability compliance matters with operations, maintenance and management groups at the Project. Provides site-specific technical data and advice to the Plant Manager and Power Plant Maintenance Engineer on equipment and procedures as they relate to compliance issues and requirements. Represents the Kerr Project/EKI at meetings and conferences concerning reliability compliance and related technical matters, staying informed of reliability compliance requirements and issues and providing feedback. Implements EKI policy in managing the Kerr Project/EKI Reliability Compliance Program. Prepares EKI policy documents, memoranda of instructions, circulars, Standing Operating Procedures (SOPs), etc., pertaining to the reliability compliance program at the Kerr Project. Performs spot inspections of activities for reliability compliance at the Kerr Project. Assists in the preparation of reports to Plant Manager and CEO on progress and status of reliability compliance. Reviews and prepares responses to audits, inspections, and surveys related to Kerr Project/ EKI Reliability Compliance. Assesses the status of Project operations and maintenance to maintain compliant status. Analyzes, documents, and presents preliminary findings and develops a plan of action to close gaps between current Project operations and future regulatory requirements of discovered non-compliance. Works with applicable Subject Matter Experts (SME) to develop mitigation plans to resolve operational deficiencies. Develops procedures and processes for the control and archiving of documentation associated with Safety, Environmental, and Project Reliability Standards compliance. Conducts compliance surveys to determine the nature and condition of existing facilities and to determine and improvements for reliability compliance. Review and archive WECC/NERC Reliability Standards compliance documentation. Page 3" of 6"

4 Develops and executes Kerr s/eki s WECC/NERC Compliance Quality Assurance (QA) program to ensure Kerr Project Compliance with the Reliability Standards and that auditable supporting documentation demonstrates compliance has been prepared and archived. Perform QA spot checks to determine status of reliability compliance of the Project. Assists in the development and maintenance of a document control process that includes configuration control on using software systems for the Kerr/EKI overall reliability compliance assurance and reporting. Assist maintenance personnel with integrating compliance requirements with preventive maintenance work orders in CMMS and tracking systems used to ensure maintenance required by Safety, Environmental, and WECC/NERC standards is accomplished on time. Identifies, establishes, and implements internal performance measures, reliability information tools and internal procedures for tracking, evaluating, and reporting on the Kerr Project/EKI reliability actions and responsibilities including compliance with regulatory requirements. Responsible for providing program management to ensure the Kerr Project/EKI complies with WECC/NERC and Regional and National Bulk Electric System Reliability. Responds to the Kerr Project/EKI compliance-related requests and ensures investigation and reporting of non-compliance issues. Suggest and promote appropriate applications of technology to facilitate meeting program goals. Performs other duties as assigned. RESPONSIBILITIES OF OPERATIONS COMPLIANCE MANAGER This position operates from established and well-known procedures performing duties independently under general direction and minimum supervision. Decisions are made within prescribed operating procedures and guidelines. The position encounters recurring work situations of high complexity, with occasional variations from the norm and has partial project budgetary preparation and compliance accountability. Contacts are normally made with others inside and outside EKI, with vendors, contractors, regulatory agencies, and the Community; and are usually made on own initiative concerning matters requiring explanation, discussion, interpretation or approvals. Supervision normally consists of discussions regarding program requirements, scope of assignments and results to be achieved. Works independently using initiative, judgment and resourcefulness; determines the most appropriate principles, practices, and methods to apply Page 4" of 6"

5 in all phases of assignments. Incumbent resolves most of the conflicts that arise; and keeps the supervisor informed of progress and of potentially controversial matters. The supervisor reviews completed work for soundness of overall approach, effectiveness in meeting requirements or producing expected results, the feasibility of recommendations, and adherence to requirements. Work is reviewed in terms of adequacy and quality of work, attainment of objective, meeting schedules and demonstrated compliance with Kerr s/eki s overall WECC/NERC Reliability Compliance Program. Analyzes changes in programs, technological developments, events that cannot be predicted, or conflicting requirements to decide what needs to be done and how to do it. Assesses unusual conditions; varies approach to assignments and decides how to perform assignments based on incomplete or conflicting data. Applies seasoned judgment and skill to interpret considerable data, plan work or modify methods and/or techniques used; and may develop new techniques involving facility operations. SPECIFIC SKILLS and KNOWLEDGE Must have a demonstrated capability to evaluate compliance performance, identifies potential improvements, and determine/apply Best Practices in compliance areas is preferred. Strong abilities to communicate both orally and in writing, knowledge of word processing, spreadsheet, and project management software are required. The position requires professional electrical engineering knowledge and substantial interaction between work groups in various trades, organizational units, and various federal agencies. The position requires knowledge of and skill in applying principles, concepts and methods of equipment, facility and/or operations associated with hydropower generation with oversight ensuring compliance. The incumbent is the technical authority on Safety, Environmental, and WECC/NERC matters regarding operations, maintenance and management groups on the Kerr Project. EDUCATION and EXPERIENCE Bachelor of Science Degree in an Engineering or Science discipline with three years experience in power plant or similar technology plants including WECC/NERC Compliance program, environmental, safety, maintenance and operations is required. Engineering expertise and Page 5" of 6"

6 experience in electrical and/or control systems is strongly preferred. Registration as a Professional Engineer in Montana is preferred. Experience with project scheduling and budgeting is preferred. OTHER REQUIREMENTS A valid state drivers license WORKING CONDITIONS Physical requirements include: Possibility of working on feet for extensive periods; Requiring stair and ladder climbing; and Routinely lifting 50 pounds. Work is performed both at EKI Offices and at the Kerr Power Plant and Dam requiring protective clothing and equipment (e.g., hard hats, safety glasses, air masks, ear protection, chemical suits, hot gloves, high voltage protective equipment, etc.). Work with hazardous materials may be required. Normal working hours are 8:00 a.m. to 4:30 p.m. Monday through Friday. Work is performed both at EKI Offices and at the Power Plant and Dam requiring protective clothing and equipment. Extended hours may be required based on specific requirements. All employees will participate in the Fitness for Duty Program and are subject to background checks for security clearance and credit checks for positions with fiscal responsibility. This program includes pre/post-employment physical examinations and drug screening. Energy Keepers, Incorporated, is an Indian Preference Employer.
