2 Employment law developments The year 2014 saw significant employment law reform including a new system of mandatory ACAS Early Conciliation (EC) and the introduction of Shared Parental Leave. It was also the year in which the impact of the new system of tribunal fees was first felt, with statistics showing that the number of tribunal claims decreased by around 80%. In 2015 there will be further changes in employment law. We will keep you updated on key legal development via our blog and also on If you subscribe to our mailing list ( employment@morrlaw.com) you will receive our regular e-bulletin updates and invitations to our 2015/16 seminar programme. Shared Parental Leave (SPL) 2015/16 is very much the year of Shared Parental Leave. Parents whose baby s expected week of childbirth (EWC) begins, or whose child is placed with them for adoption, on or after 5 April 2015 may be eligible. Mothers/adopters may still choose to take maternity/adoption leave but they and their partners can opt for SPL instead, the key feature of which means that eligible parents can share up to 50 weeks of leave and up to 37 weeks of Statutory Shared Parental Pay between them. Morrisons employment team have prepared an HR toolkit, which includes all necessary policies and forms, to ensure that employers are compliant with the law. Tribunal deadlines (unless extended by EC) Unfair dismissal Three months less one day from date of dismissal. Discrimination Three months less one day from act of discrimination. Statutory redundancy pay Six months less one day from effective date of termination. Equal pay Six months less one day from the last day of employment (standard case only). Time limit for responding to ET1 claim form 28 days from date ET1 sent by the employment tribunal. 3 Employment tribunal fees Type A and type B claims Type A claims are set out on a prescribed list and include, for example, unlawful deductions from wages. Type B are all other more complex claims, most commonly unfair dismissal and discrimination. Fee type Type A claims Type B claims Issue fee Hearing fee Multiple-claimant claims incur greater fees. The payment is free of tax and national insurance deductions. To calculate entitlement: 1. Find on the grid the multiplier based on the employee s length of service and age: 2. Multiply this by 475 (Maximum Statutory Weekly Pay, from 6 April 2015) or the employee s gross weekly pay if lower. For example an employee aged 47 with two years service earning 25,000 is entitled to 1,425 i.e. 3 x 475.
