4 DATA RETENTION POLICY 1. INTRODUCTION 1.1 This Guidance has been adapted from that issued by the Record Management Society of Great Britain. The original guidance was issued to support local authorities in the areas of Data Protection, Freedom of Information and the Local Government Act. 1.2 The Guidance is intended to be independent of any particular format of record that might be historically created (e.g. card, register) or media (e.g. paper, electronic) and prolong the Guidance s period of application. 1.3 The Guidance is are intended to cover the continuum of records and information from creation through to destruction or for retention for historical or research purposes. 1.4 Records sentenced for destruction under the Guidance may be destroyed in accordance with the provisions of the Guidance. Backup copies stored on alternative media (server/microfilm/paper) should also be destroyed. This is vital to ensure compliance with the requirements of Data Protection and Freedom of Information legislation. 1.5 Records for archival should be dealt with as below in consultation with the Archivist/Local History Officer at Norfolk County Record Office who will provide further information on transfer procedures. The identification of classes of records here as suitable for archives are for guidance only. (1) Records identified in this schedule as permanent are marked Offer to Archivist. The Archivist may choose to select a sample of the records for permanent preservation in the archives; the remainder should be destroyed as specified in the Guidance. The sample may be random, selective or purposeful. (2) Offer to Archivist for review is used to indicate record classes where the Archivist will not usually be interested in retaining the class of records, but may wish to retain those concerning high profile or controversial policies/projects. NB Records no longer required for administrative use may still retain sensitive information. The Archivist should be informed of sensitivity at the time of transfer of the material to the archives, and an appropriate closure period agreed. The closure period should comply with Freedom of Information legislation and the authority s policy. 1.6 This Data Retention Guidance has been produced to assist officers within Broadland District Council with the management, retention, and disposal of documents. July 2015
5 DATA RETENTION POLICY 1.7 The Council accumulates a vast amount of information and data during the course of its everyday activities. This includes data generated internally in addition to information obtained from individuals and external organisations. This information is recorded in various different types documents. 1.8 Records created and maintained by the Council are an important asset and as such measures need to be undertaken to safeguard this information. Properly managed records provide authentic and reliable evidence of the Council s transactions. This is vital in the short term to ensure that the Council has evidence to demonstrate accountability to stakeholders and regulatory bodies. In the longer term records can be used to highlight areas of good practice to be followed and provide a history to ensure that previous mistakes are not repeated. 1.9 Documents may be retained in either hard paper form or in electronic forms (either standard office software or on a specialist system such as debtors or Council Tax). For the purposes of this guidance, document and record refers to both hard copy and electronic records Retention of specific records may be necessary for one or more of the following reasons: To fulfil statutory or other regulatory requirements. To evidence events or agreements in the case of disputes. To meet operational needs. To ensure the preservation of documents of historic or other value It is imperative that documents are retained for an adequate period of time. If documents are destroyed prematurely the Council and individual officers concerned could face one or more of the following consequences: Difficulty in defending any claim brought against the Council. Operational difficulties. Reputational damage. Prosecution for not complying with legislation In contrast to the above the Council should not retain documents longer than is necessary. Timely disposal should be undertaken to: Ensure compliance with the fifth Principle of the Data Protection Act 1998 so that personal information is not retained longer than necessary. Ensure the most efficient use of limited amounts of storage space. July 2015
6 DATA RETENTION POLICY Reduce the time taken to deal with requests under the Freedom of Information Act Best Practice guidance on document retention recommends that large organisations have a system for the timely and secure disposal of records that are no longer required for business purposes. In January 2005 the full requirements of the Freedom of Information Act 2000 came into force, and the provisions of the Act require that the Council has clearly defined guidelines for disposing of records and that these are well documented. Any information requested under the Freedom of Information Act must be provided within 20 days (unless the information falls within one of the exemptions). Service Managers must therefore have robust filing and postal tracking systems in place to ensure that information is provided within the prescribed deadlines. a. SCOPE AND OBJECTIVES OF THE GUIDANCE 2.1 The aim of this guidance is to provide a working framework to govern management decisions on whether, in given circumstances particular documents (or sets of documents) should be either: (a). (b) Retained and for how long; or Disposed of and if so by what method. 2.2 There are some records that do not need to be kept at all or that are routinely destroyed in the course of business. This usually applies to information that is duplicated, unimportant or only of a short-term value. Unimportant records or information includes: (a) (b) (c) (d) (e) (f) (g) With compliments slips. Catalogues and Trade Journals. Telephone Message Slips. Non Acceptance of Invitations. Trivial electronic mail messages that are not related to Council business. Requests for stock information such as maps, plans, or advertising material. Out of date distribution lists. 2.3 Duplicated and superseded material such as stationery, manuals, drafts, forms, address books and reference copies of annual reports may be destroyed. July 2015
7 DATA RETENTION POLICY 2.4 Records should not be destroyed if the information can be used as evidence, to prove that something has happened. (If you are in doubt what information is required consult the Head of Democratic Services and Monitoring Officer for advice). b. ROLES AND RESPONSIBILITIES FOR DOCUMENT RETENTION AND DISPOSAL 3.1 Corporate responsibility for the implementation and review of this Policy lies with the Deputy Chief Executive. Heads of Service are responsible for determining whether to retain or dispose of documents that fall within the remit of their service. Service Managers should undertake a review of documentation at least on an annual basis to ensure that any unnecessary documentation being held is disposed of. 3.2 Heads of Service may delegate the operational aspects of the guidance, however they must ensure that any delegated officer is fully aware of the contents of this Guidance in addition to the operational requirements of the service. 3.3 Where a Head of Service is in any doubt about the legality of either retaining or disposing of particular documents they should consult Norfolk County Council Legal Services for advice. c. DOCUMENT RETENTION AND DISPOSAL PROTOCOL Any decision taken whether to retain or dispose of a document should be undertaken in accordance with the following protocol: 4.1 DOCUMENT RETENTION PROTOCOL Systems (1) Each Head of Service should have in place an adequate system for documenting the activities of their service. This system should take into account the legislative and regulatory environments in which they work. (2) Records of each activity should be complete and accurate enough to allow employees and their successors to undertake appropriate actions in the context of their responsibilities to: Facilitate an audit or examination of the business by anyone so authorised. 8 DATA RETENTION POLICY Protect the legal and other rights of the Council, its residents, contractors and clients and any other persons affected by its actions. Provide authenticity of the records so that the evidence derived from them is shown to be credible and authoritative. (3) To facilitate this the following principles should be adopted: (a) (b) (c) (d) (e) (f) Records created and maintained should be arranged in a record keeping system that will enable the Council to obtain the benefit from the quick and easy retrieval of information. Record systems utilised within services whether paper or electronic, should include a set of rules for referencing, titling, indexing, and if appropriate security marking documents and records. These should be easily understood and enable the efficient retrieval of information. The movement and location of records should be controlled to ensure that a record can easily be retrieved at any time, and that any outstanding issues can be dealt with, and that there is an auditable trail of record transactions. Storage accommodation for current records should be clean and tidy, and prevent damage to the records. Equipment used for current records should provide storage, which is safe from unauthorised access, meets fire regulations, but also allows maximum accessibility to authorised officers when required. Documents that are no longer required for operational purposes should be placed in a designated records centre rather than in offices. Services should ensure that a contingency or recovery plan is in place to provide protection for records, which are vital to the continued functioning of the Council Retention period (1) The retention schedules in Appendix 1 provide guidance on the recommended retention periods for specific classes of documents and records. These schedules have been compiled from recommended best practice from the Public Records Office, The Records Management Society of Great Britain and in accordance with relevant legislation. 9 DATA RETENTION POLICY (2) When a retention period has expired (in accordance with the retention schedules set out in Appendix 1) for a particular document, a review should be undertaken before a final decision is made to dispose of the document. This review should be undertaken by the Head of Service (or their delegated officer). (3) Whenever there is a possibility of litigation, the records and information that are likely to be affected should not be amended or disposed of until the threat of litigation has been removed. 4.2 DISPOSAL PROTOCOL Considerations prior to disposal Documents should only be disposed of if management have reviewed them in accordance with the following Five Key Considerations for Document Retention Has the Document been appraised? Is retention required to fulfil statutory or other regulatory requirements? Is retention required to evidence events in the case of dispute? Is retention required to meet the operational needs of the service? Is retention required because the document or record is of historic interest or intrinsic value? Guidance in relation to these considerations are detailed in Appendix 1. Documents must not be destroyed unless management have undertaken this task Methods of disposal (1) When documents are authorised for disposal, measures should be undertaken to ensure that they are disposed of in an appropriate manner. The method of disposal should be appropriate to the nature and sensitivity of the documents concerned. (2) Documents can be disposed of by any of the following methods: For Non Confidential Records: Place in the Waste Recycle Bin for collection and disposal. Disposal of low volume day to day Confidential Records (includes copies no longer required). Shred documents within the work area or place in the confidential waste bins. July 2015
10 DATA RETENTION POLICY Large-scale disposal of Confidential Waste can be shredded by arrangement with the Facilities Management Team. Preferably in the presence of a representative from the service concerned. Deletion of Computer Records. Transmission of records to an external body such as the County Records Office. (3) The following principles should be followed when disposing of records: All records containing personal or confidential information should be destroyed at the end of the retention period. Failure to do so could lead to the Council being prosecuted under the Data Protection Act 1998, the Freedom of Information Act or cause reputational damage. Where computer records are deleted steps should be taken to ensure that data is virtually impossible to retrieve as advised by the Information Commissioner. Where documents are of a historical interest it may be appropriate that they are transmitted to external bodies (such as the County Records Office) for archiving. It should be ensured that the security arrangements of any external body used to dispose of records comply with the requirements of this guidance. Back up copies of documents should also be destroyed (including electronic or photographed documents unless specific provisions exist for their disposal) Recording disposals Records should be maintained of all disposals. These records should contain the following information: The name of the document destroyed. The date the document was destroyed. The method of disposal. The name and job title of the officer who authorised disposal. July 2015

DATA PROTECTION ACT 1998 OBLIGATION TO DISPOSE OF CERTAIN DATA 5.1 The Data Protection Act 1998 ( Fifth Principle ) requires that personal information must not be retained longer than is necessary for the purpose for which it was originally obtained. Section 1 of the Data Protection Act defines personal information as: Data that relates to a living individual who can be identified; (1) from the data, or (2) from those data and other information which is in the possession of, or is likely to come into the possession of the data controller. It includes any expression of opinion about the individual and any indication of the intentions of the Council or other person in respect of the individual. 5.2 The Data Protection Act provides an exemption for information about identifiable living individuals that is held for research, statistical or historical purposes to be held indefinitely provided that the specific requirements are met. It is the responsibility of the Archivist to do so. 5.3 Service Managers are responsible for ensuring that: (1) They comply with the eight principles of the Data Protection Act 1998, namely: Personal data is processed fairly and lawfully and, in particular, shall not be processed unless specific conditions are met. Personal data shall only be obtained for specific purposes and processed in a compatible manner. Personal data shall be adequate, relevant, but not excessive. Personal data shall be accurate and up-to-date. Personal data shall not be kept for longer than is necessary. Personal data shall be processed in accordance with the rights of the data subject. Personal data shall be kept secure by means of appropriate technical and organisational means. Personal data shall only be transferred outside the European Economic Area if there is adequate protection. July 2015
12 DATA RETENTION POLICY (2) External storage providers or archivists that are holding Council documents must also comply with the above eight principles of the Data Protection Act SCANNING OF DOCUMENTS 6.1 In general once a document has been scanned on to a document image system the original becomes redundant. There is no specific legislation covering the format for which local government records are retained following electronic storage, except for those prescribed by the Inland Revenue and Customs & Excise. 6.2 As a general rule hard copies of scanned documents should be retained for three months after scanning. 6.3 Original documents required for VAT and tax purposes should by retained for six years unless a shorter period has been agreed with Customs and Excise or the Inland Revenue (for the latest guidance from these bodies please contact the Head of Finance and Revenue Services). 6.4 Service Managers are responsible for: (1) Ensuring that scanned documents are legible and provide a true copy of the original. (2) Ensuring that scanned documents are retained in accordance with the document retention schedules as detailed in Appendix 1. (3) Ensuring that scanned documents can be located and retrieved promptly when required for either: Operational purposes. A subject access request under the Data Protection Act A request under the Freedom of Information Act Legal proceedings. 7. REVIEW OF DOCUMENT RETENTION GUIDANCE 7.1 The Deputy Chief Executive will review, update and where appropriate amend this guidance on a regular basis (at least every 3 years in accordance with the Code of Practice for the Retention of Documents issued by the Lord Chancellor). The appropriate evidence must support any such request. 7.2 This guidance has been compiled from various sources of recommended best practice; any constructive comments are welcome regarding any potential revisions or amendments to the system.
