2 Dear Student Leaders of Texas: As students, you are about to partake in a historical event in Texas. February 17, 2005 will mark the first ever Texas Community College Student Day. You will be joined by hundreds of your peers from every corner of the state; uniting for a common goal of increasing awareness of the importance of our schools - the community and technical colleges of Texas. There has never been a group of community college students this large that has taken on the charge of being heard in Austin as one cohesive group. We will also be joined by college faculty members, and college presidents who carry our same message. In the enclosed packet, you will find blue ribbons (to be worn on your shirt/jacket). This will serve two purposes - a unified identification system, and your ticket into lunch. Additionally, you will find copies of a special section of Texas Monthly and a community college fact sheet. These are to be left with legislators that you visit to remind them of the importance of community colleges to the Texas economy. Finally, there are supplementary materials in the packet that will further describe what we are specifically asking for, communication advice, a capitol map, a todo list and an agenda of the day. I applaud each of you in your efforts and commitment to your fellow 1.1 million Texas community and technical college students. 4 Keynote Speaker - Senator Todd Staples Occupation: Small Business Owner Education: Texas A&M University, B.S Legislative Experience: Texas House: , Texas Senate: present Hometown: Palestine, Texas Party: Republican Born and raised in East Texas, Todd Staples was re-elected to serve his second term in the Texas Senate in Staples served as Mayor Pro Tem of Palestine before being elected to the Texas House of Representatives in Senator Staples represents all or part of 16 counties. Senator Staples is well-regarded for his conservative approach, fiscal responsibility and strong work ethic. Staples' legislative priorities encompass balancing the budget without tax increases, prioritizing spending to ensure education funding remains the first priority, implementing tort reform measures to curb escalating insurance costs, enhancing property taxpayers' rights, creating economic development opportunities for local communities, attracting and retaining highly qualified teachers and state employees and protecting natural resources for future Texans. Moreover, Senator Staples continues to address the needs and issues of Senate District 3, such as funding for community colleges and universities and environmental concerns affecting timber and agricultural resources. During the 78th Legislative Session, Staples authored legislation to give major relief to taxpayers and school districts across Texas. Among the bills passed were Senate Bill 340, addressing tax equity and tax fairness by providing penalties to those who do not abide by current property rendition laws; Senate Bill 1646, resolving the timber capitalization rate and providing a fair and balanced timber valuation process; and Senate Bill 671, implementing a "grace period" for school districts that would have received reduced state funding if their Property Value Study indicated a higher total value of property than was appraised locally. Staples currently chairs the Senate Committee on Infrastructure Development and Security and the interim Select Committee on Workers' Compensation in addition to serving on several other committees: Education, Finance, Natural Resources, the Subcommittee on Higher Education, the Joint Select Committee on Public School Finance, the Select Interim Committee on Water Policy, the Joint Study Commission on Water for Environmental Flows and the Texas Commission on Environmental Quality's (TCEQ) Permitting Process Study Committee. Staples also chaired the Republican Caucus during the 78th Legislative Session. The recipient of many awards, Staples was most recently inducted into the Texas A&M Tyrus R. Timm Honor Registry of Former Students in Agricultural Economics. In 2003, Senator Staples was presented the Civil Justice Leadership Award by Texans for Lawsuit Reform, the Texas Association of Business "Fighter for Free Enterprise," and he was named a "Champion for Children" by the Equity Center for his work on behalf of school children. In 2002, Staples received Deep East Texas Legislator of the Year, the Independent Colleges and Universities of Texas "Legislative Champion" and was recognized by the Texas County and District Attorneys Association. Additionally, Staples has repeatedly been named among Texas' Top 10 Conservative Legislators, is a recipient of the Family Law Association Award for Efforts in Family Law and Juvenile Justice, was recognized by the Texas Water Conservation Association, is a member of the Texas Association of REALTORS Legislative Hall of Fame and served on a Conservative Coalition Task Force to meet government needs during the 2003 budget crunch without increasing taxes. Todd Staples attended Trinity Valley Community College and graduated with honors from Texas A&M University where he earned a B.S. in Agricultural Economics. Upon graduation, he returned home to start the real estate appraisal and brokerage firm he operates today. Staples is also a member of the Popp & Ikard property tax law firm focusing on valuation issues in mediation and arbitration, and he and his father are partners in a cow-calf operation. A member and deacon of Norwood Heights Baptist Church, Senator Staples and his wife, Janet, have four children. 1

6 Effective Communication with Elected Officials To communicate effectively you must be two things: appropriate and knowledgeable. Appropriate: Be polite to everyone at all times. Dress, speak and behave in professional way at all times. Explain your perspective, but avoid abrasive, combative gestures, tones or language. When talking to legislators and/or their staff get to the point quickly and keep the conversation brief. These are very busy people. Write notes summarizing what the legislator/staff person asks or says about community colleges. Provide information when and if you have that information, but avoid guessing. If you do not know the answer to a question they ask, write down the question with the legislator s name, and give it to the trip coordinator for your college. They will then find the information the legislator requested. Make appointments in advance whenever possible. Always thank them for their time and consideration of your perspective. Never give up if your message seemed ill received the first time. Write, or call again to give the legislator updates and to find out if their perspective changed. Most people take time and multiple exposures to an idea before embracing change. Knowledgeable: Learn something about the legislator so you can connect on a personal level. Read the overview materials in this packet. Discuss when and why changes occurred so that you are comfortable talking about this topic. Consider the impact funding changes will have on your college experience, your community and the state as a whole. You might personalize this information for the legislator; e.g., In my case, this would mean... Ask each other questions so that you will be prepared to answer any questions the legislators/staff pose. Keep in mind that almost every legislator has a community college in their district. Although many of legislators may have attended a major university, they often take pride in their community college. 3
7 Points to Ponder: Community Colleges Community Colleges are being crippled by budget cuts that have occurred over the last 3 years. It s bad for Texas because it takes away the opportunity for higher education for the majority of its citizens. This has a direct impact on the economy and the need for a trained workforce. Students cannot afford to make up the slack with ever increasing tuition and local taxpayers cannot be expected to continue to bear more than their fair share. The state must make funding for community colleges a top priority by adding $357.9 million to their budget, and fully funding employee benefits so colleges can hire faculty and expand the number of courses. 1. STUDENTS ARE HURT BY COMMUNITY COLLEGE FUNDING CUTS Over the last three years state funding cuts have caused many changes in community colleges. Tuition has increased significantly. The number and variety of course offerings have declined. 4
8 Fewer support materials and copies of important information are available to students. Fuller classes result in less interaction and support from professors. Hiring delays at many colleges mean it is harder to get help from counselors, librarians and tutors. Many students have had to delay or prolong their college educations because they can not get into classes that fit around their family or work schedules. Proposed state funding for community colleges would throw budgets back to 1995 levels. This lower funding rate does not take into consideration the increased number of community college students or the growing cost of equipping colleges with the latest technologies to ensure up-to-date instruction. In response to state funding cuts, community colleges were forced to increase local taxes as well as tuition. In the last two decades the state of Texas has shifted more and more of the burden of higher education to local tax payers and students. Students cannot afford to take up the slack with ever increasing tuition and local taxpayers cannot be expected to continue to bear more than their fair share. Education is an investment in the future of our state, and one the state must fund if Texas is going to grow economically in the years to come. Every time the legislature overlooks community colleges, it is limiting our hopes for a brighter tomorrow. 2. MORE STUDENTS ARE ATTENDING COMMUNITY COLLEGES More than a million students attend Texas community colleges. Deregulation of university tuition forced more students into community colleges. Already operating on smaller budgets, this increased student population combined with decreases in funding endangers our community college system. The 79 th Legislature must adjust community college funding to reflect the growing number of students. 3. TUITION AT COMMUNITY COLLEGES HAS GONE UP Since 2002 when state funding for community colleges started its downward plunge, tuition and fees have increased 64%. How much more can students afford? How many years of good wages will we lose as we delay completion of our degrees due to rising costs? How many millions of dollars will the state lose in sales taxes for items we can not buy because of our reduced income potential? 4. GRANTS & SCHOLARSHIPS COVER LESS OF COLLEGE COSTS Grants and scholarships have failed to keep pace with skyrocketing costs of tuition, student service fees, books and the cost of living. While community college tuition and fees have increased 64% in the last three years, the maximum award for Pell Grants have not increased one dime. Even if scholarships and grants increase, they are pointless if community colleges have to reduce faculty, limit course offerings, or possibly close their doors. 5

If the state does not increase community college funding, colleges will have to increase tuition to the point that it will create a barrier for many of us. As students, if we earn a certificate or associates degree, we vastly increase our earning power over our entire lifespan. This expanded income translates into greater spending and a larger tax base for the whole state. Texans with educations beyond high school are also healthier, less likely to commit crimes or draw welfare or unemployment. Expanded funding for Texas community colleges is essential to the economic health of our state. Use every opportunity to make our government officials aware of the services community colleges provide and the wisdom of supporting our community colleges. 6. HOW CAN WE KEEP OUR COMUNITY COLLEGES STRONG? To enable opportunity and growth for Texas, we must stop the downward spiral of community college funding and restore hope for our futures. A. Add $357.9 million to the community college funding to restore the state s commitment to keep higher education affordable for a brighter future for all Texans. B. Fully fund employee benefits so that community colleges can hire faculty and offer courses. Without this, students will not have access to higher education and skilled workers will not enter the Texas workforce. 6
10 Community College A Wise Investment 514,548 students took credit classes in the fall of 2003 compared to 472,818 at public Texas universities. Community Colleges educate 45% of all Texans enrolled in post secondary education. Community College transfer students are more successful than students who begin college at universities. Compared to students who enroll in universities their freshman year, community college students are more likely to graduate, and are more likely to graduate in less time. Community Colleges serve a broad cross section of Texans and have made great strides in Closing the Gaps to make college accessible to more Texans. Average earnings for someone with a 1-year certificate are $26,353 or 16% more than someone with just a high school diploma. Average earnings for someone with an associate degree are $30,974 or 36% more than someone with just a high school diploma. The support of state and local government in a two-year community college associates degree for one student will earn 15.9% return on our investment with a payback period of 8.2 years. After the first 8 years, students expanded earning and spending will contribute to an ever larger tax base for the remainder of their career. Community College Students are hard workers who are already working and stretching their dollars as far as they can. 72% of community college students work while attending college. Ninety-five percent of community college students remain in the state, therefore keeping the return on the taxpayer s investment in the state. 63 Legislative Process in Texas Introducing a Bill A bill may be introduced by any member of the legislature in the member's own chamber, and the steps in a bill's progress in each house are basically the same. A bill passed by one house must proceed to the other for final passage before going to the governor for approval or veto. To introduce a bill in the House of Representatives, a state representative must first submit the required number of copies of the bill for filing to the chief clerk of the house, who sequentially numbers each document according to the order in which it is received. The house rules of procedure permit unrestricted introduction of bills during the first 60 calendar days of each regular session. After the 60-day deadline, the introduction of any bill other than a local bill or a bill relating to a matter declared by the governor to be an emergency requires the consent of at least four-fifths of those members present and voting. To introduce a bill in the senate, a senator must first submit the required number of copies of the bill to the secretary of the senate, who sequentially numbers each document according to the order in which it is received. The Role of Committees The size of the legislature and the volume of work confronting it each session make thoughtful deliberation on the many proposed measures by the entire membership impossible. The committee stage in the deliberative process is at the core of legislative politics since the fate of bills under consideration hinges on committee action. A large percentage of all legislation is never reported out of committee. Thus, committee action is the first crucial step in the process by which a bill becomes law. Referral to a Standing Committee The Texas Constitution provides that no bill may be considered on the floor of a chamber by its members unless the bill first has been referred to a committee and the committee has issued its report on the bill. When a bill is introduced or received from the opposite chamber for consideration, it is read for the first time by its caption and referred by the speaker or lieutenant governor to an appropriate committee. Known as standing committees, these bodies are created in the rules of the respective houses at the beginning of each regular session and typically consist of seven to 15 members. In the house rules, each committee is assigned jurisdiction over a specific subject matter, and the speaker refers legislation to house committees based on those subject matter jurisdictions. In its rules, the senate does not provide subject matter jurisdictions for its committees. Although the 56
64 lieutenant governor is free to refer legislation in the senate to any standing committee, unofficial subject matter jurisdictions are usually established and followed to prevent duplication of effort by committees. In the House of Representatives, the membership of committees is determined in part by seniority and in part by appointments by the speaker. Each representative sits on at least one committee, and most representatives sit on two or three committees. The house typically has approximately 30 standing committees. In the senate, the membership of committees is determined entirely by appointment by the lieutenant governor. Senators typically sit on three or four committees each. The senate typically has approximately 10 standing committees. Immediately after a bill has been referred to committee, a determination must be made as to whether a fiscal note or other impact statement is required and, if so, a copy of the bill is sent to the Legislative Budget Board for preparation of the note or statement. In preparing the note or statement, the Legislative Budget Board may consult the state agencies affected by the legislation. In the house, the fiscal note must be attached to the affected bill before a public hearing on the bill may be held, and if the bill is reported from committee, the fiscal note must be attached to the bill when it is printed and distributed to the members of the house. With regard to other impact statements, a bill may proceed through the legislative process before the impact statement is completed, but a copy of the impact statement must be distributed to the members as soon as it has been completed. Senate practice is for a copy of the fiscal note to be provided to the committee members before the bill is reported from committee and to be included as part of the senate committee report. A bill requiring extensive analysis is often assigned to a subcommittee of the standing committee to which the bill has been referred. Subcommittees are appointed by the committee chair from the standing committee's membership. After careful scrutiny of the bill under consideration, the subcommittee makes a report to the full committee. The Committee Process All committee business is required to be conducted in open meetings. No official action or vote may be taken except in a meeting that is open to the public. The house rules permit a house committee or subcommittee to meet: (1) in a public hearing where testimony is heard and where official action may be taken on bills, resolutions, or other matters; (2) in a formal meeting where the members may discuss and take official action without hearing public testimony; or (3) in a work session for discussion of matters before the committee without taking formal action. The senate rules do not provide for different types of meetings. Therefore, testimony may be heard and official action may be taken at any meeting of a senate committee or subcommittee. Although a committee is not required to solicit public testimony on any bill referred to it, public testimony is almost always solicited on bills of outstanding importance, allowing citizens the opportunity to present arguments on different sides 57

66 of an issue. In the senate, a public hearing must be held on a bill before it can be reported from committee. A house committee or subcommittee holding a public hearing during a legislative session must post notice of the hearing at least five calendar days before the hearing during a regular session and at least 24 hours in advance of the hearing during a special session. If a house committee or subcommittee is convening for a formal meeting or a work session, written notice must be posted and transmitted to each member of the committee two hours in advance of the meeting or an announcement must be filed with the journal clerk and read in the house while the house is in session. A senate committee or subcommittee must post notice of a meeting at least 24 hours before the meeting. Committee Reports After considering a bill, a committee may choose to take no action or may issue a report on the bill to the house or senate. The committee report, expressing the committee's recommendations regarding house or senate action on a bill, includes a record of the committee's vote on the report, the text of the bill as reported by the committee, a detailed bill analysis, a fiscal note or other impact statement, and other attachments as necessary. The required parts of the committee report are assembled and printed and distributed to the members as a single document. Committee reports are advisory only and may take several forms. The committee may recommend passage of the bill without amendments, or it may recommend amendments to the bill or even substitute a new bill for the original document. In the house, all committee reports are referred to the chief clerk, who forwards them to the printer. After being printed, a copy of the house committee report printing (which includes bill text, the committee's recommendation and vote on the bill, the bill analysis, the fiscal note, and other necessary impact statements and attachments) is placed in the post office box of each member of the house. The chief clerk then delivers a certified copy of the committee report to the appropriate calendars committee (the Committee on Calendars or the Committee on Local and Consent Calendars) for placement of the bill on a calendar for consideration by the full house. Calendars committees are given wide discretion in scheduling bills for floor action. The senate rules also require committee reports to be printed. After being printed, a copy of the senate committee report printing (which includes bill text, the committee's recommendation and vote on the bill, the bill analysis, the fiscal note, and other necessary impact statements and attachments) is placed in the bill book on each senator's desk in the senate chamber. Except for the role of the Committee on Administration in scheduling local and noncontroversial bills for consideration, there is no equivalent to a calendars committee in the senate. The senate's regular order of business lists all bills and resolutions that have been reported favorably from committees in the order in which they were reported to the senate. For all practical purposes, the regular order of business is merely a listing of bills that are eligible for consideration, because the senate rules provide that a bill on the regular order of business may not be brought up for floor consideration 59
67 unless the senate sponsor of the bill has filed with the secretary of the senate a written notice of intent to suspend the regular order of business for consideration of the bill. Floor Action The first real floor consideration of a bill occurs on its second reading. After it is read the second time, again by caption only, the measure is subject to debate and amendment by the entire membership of the chamber. On second reading, a bill may be amended by a simple majority. If no amendment is made, or if those proposed are disposed of, the final action on second reading of a bill is a vote on its passage to engrossment, if the bill is being considered in the chamber in which it was introduced, or passage to third reading, if the bill is being considered in the opposite chamber. The bill is then laid before the body for a third reading and final passage. A bill may be amended again on third reading, but amendments at this stage require a two-thirds majority for adoption. Although the Texas Constitution requires a bill to be read on three separate days in each house before it can have the force of law, this constitutional rule may be suspended by a fourfifths vote of the house in which the bill is pending. In such cases, the bill is given an immediate third reading following the vote to pass the bill to engrossment or third reading. The senate routinely suspends this constitutional provision in order to give a bill an immediate third reading. The house, however, rarely suspends this provision, and third reading consideration of a bill in the house normally occurs on the day following second reading consideration. After a bill has been read a third time, it is voted on for final passage. If the bill receives a simple majority vote, it is considered passed, and the chief clerk of the house or the secretary of the senate, as appropriate, certifies the bill's final passage, noting on it the date of its passage and the vote by which it passed. When the bill is passed in the originating chamber, the bill is engrossed, and an exact and accurate copy of the bill, with all corrections and amendments incorporated into it, is prepared and sent to the opposite chamber for consideration. When the bill is passed in the opposite chamber, a new copy of the bill is not prepared. Rather, the bill is immediately returned to the originating chamber with any amendments simply attached to the bill. Governor's Action Upon receiving a bill, the governor has 10 days in which to sign the bill, veto it, or allow it to become law without a signature. If the governor elects to veto the bill and the legislature is still in session, the bill is returned to the house in which it originated with an explanation of the governor's objections. A two-thirds majority in each house is required to override the veto. If the governor neither vetoes nor signs the bill within the allotted time, the bill becomes law. If a bill is sent to the governor within 10 days of final adjournment, the governor has until 20 days after final adjournment to sign the bill, veto it, or allow it to become law without a signature. 60
