The Regency Campus Our Facility and Equipment Each Regency campus is a total expression of Regency's image and educational philosophy. This philosophy is based on rewards for excellence, personalized guest attention and intense hands-on service and retail product knowledge. Each campus contains a modern Performance Floor where students, once they qualify, perform services on guests in a high-end salon-like setting. In addition, the campus contains a reception area, two classrooms, service areas for performing hair, nail and skin services, student lounge, student support kiosks and staff offices. Equipment in the facility includes, but is not limited to, salon work-stations with styling chairs, shampoo bowls, hair dryers, nail tables, pedicure stations and esthiology beds and associated equipment. We also provide students with a break room and lockers, for their personal convenience. Smoking of any type, including e-cigarettes, is not permitted in the campus. Smoking is only permissible in designated areas outside of the building. Our Accreditation and Licensure 1

Admissions The Admissions Process The Campus Tour We recommend that each prospective student tour the campus. It s the best way to experience what makes the Studio Luma way to learn cosmetology different. And, why that matters. On the tour, watch how our teachers and students use each part of the campus. Then get to know us. Meet with the campus staff and ask questions. Admissions Requirements Regency generally begins new students every 4 weeks and accepts applications on an ongoing basis. You may begin the application process by requesting information through our website at or by visiting the campus. Regency representatives will discuss the admissions process and requirements with you and encourage you to schedule a campus tour. Our representatives will guide you through these steps: Submit documentation showing that you are at least 16 years of age (birth certificate, driver s license, state issued ID or passport) Submit documentation demonstrating award of a high school diploma or an equivalent educational attainment (high school diploma or transcript, GED certificate) 1 Sign a completed Enrollment Agreement (once you have selected a start date). 2 Complete any forms required by state rules or regulations. Once you have enrolled, in certain states you will be required to secure a student and/or apprenticeship license in order to participate in the program. Please see the State Appendix for applicable requirements, if any, in your state. Financial Aid Application Information While in the campus, you will be given information about completing the Free Application for Federal Student Aid (FAFSA) and who to contact with any questions about the financial aid application process. 6 state or federal law. Rather, we make admissions decisions based on merit, including each applicant s interest, aptitude and ability. Transfer Students Regency does not recruit students admitted to or currently attending another school offering a similar program of study, but we do accept applications from prospective transfer students. If you wish to request transfer credits based on prior enrollment in a third-party cosmetology program, you must provide an official transcript from that prior cosmetology program prior to enrollment with Regency. 3 The transcript must include a detailed listing of all hours, courses, tests, and practical services completed, as well as of grades received, in your prior program. The required documentation must be fully received and a determination issued before you enroll with Regency. This section sets forth Regency s general policy governing admission as a transfer student. However, this policy varies in certain states due to the requirements of state law. Upon submission of your transcript from your prior cosmetology program, Regency will provide you with information regarding any additional or different requirements that may apply in your state. Prospective transfer students are responsible for identifying and fulfilling all applicable state requirements for transfers. We will review the transcript and grant you transfer credit where, in our judgment, your prior experience satisfies our program requirements. Regency will accept up to one-half of the program hours required by the state in which you wish to attend our cosmetology program. We may accept more than one-half of the program hours if we have entered into a teach-out agreement with another school, and we will generally accept 100% of hours earned from other campuses doing business as Regency Beauty Institute. 4 Regency s curriculum consists of courses and classes, with each course consisting of four classes. Course requirements and guest service eligibility are determined at Regency s discretion based on the number of transfer hours granted. o If you are granted less than 320 hours of transfer credit, you must complete all requirements in courses 1 and 2, in addition to any other requirements under state law, prior to performing services on guests. o If you are granted more than 320 hours of transfer credit, you may take an evaluation which, if passed at 80%, will allow you to be eligible to perform guest services. A student who wishes to be guest-service eligible must complete the evaluation prior to his or her first scheduled day in the Regency program. Additionally, transfer students may receive credit for individual practical service requirements completed at another school that, based on a review of the student s transcript, appear to cover substantially similar practical service requirements included in the Regency curriculum. Regency does not grant specific transfer credit for tests or evaluations completed in a prior program. Because tests and technical evaluations in Regency s program are tied to classes, if a class is assigned to a transfer student, then all tests and technical evaluations associated with that class are also required. If you have an active esthetician or nail-technician license, or if you have previously attended an esthetician or nailtechnician/manicuring program, you may receive transfer credits for a maximum of 100 hours in our program. In addition, if you have an active esthetician or nail-technician license, you may not perform services for which you are licensed on guests. 3 Occasionally, enrolled students may wish to request transfer credits after enrollment and/or to be evaluated for guest eligibility after the deadlines stated in the policy. Such requests are for a policy exemption and must go through our appeals process, described in the Grievances and Student Appeals Section of this catalog. If the appeal is granted and transfer credits are approved, an amendment to the Enrollment Agreement will be required. (No appeal is required, however, for approval for transfer credits from a high-school cosmetology program, assuming the request for transfer credits is received by Regency prior to the student s start date.) Please note that Regency will not consider a request to transfer hours from a third-party school for a student who has completed two courses in the Regency program. 4 Regency reserves the right to deny a request to transfer from one Regency campus to another Regency campus based on (i) differences in the curriculum or program between the two campuses; or (ii) the student s progress, including attendance, academic, or program standing, or (iii) the student s disciplinary record. 3

7 We reserve the right to deny transfer credits from third-party schools. Additionally, we will deny all transfer credits if any of your hours, tests, and/or practical services from your prior program were completed more than 4 years prior to the date that we receive your request for transfer credits; provided, however, that we maintain discretion to accept credits outside of these time limitations for transfers from other campuses doing business as Regency Beauty Institute. Transferring to another Regency Institution Regency has over 80 campuses in 20 states. If you move or otherwise wish to transfer to another Regency campus after starting the program, Regency s Student Services Department will work with you in order to determine if your request may be accommodated under Regency policy. There are limits and restrictions on transfers between Regency campuses (for example, students in a Studio Luma program may not transfer to a campus not yet offering a Studio Luma program). For more information about transferring between Regency campuses, please contact a Student Services Specialist. Transferring to a non-regency Institution Regency cannot guarantee that hours earned in our program will be accepted as transfer hours by another institution. Transfer of hours is at the discretion of the accepting institution. If you wish to transfer hours to another institution, it is your responsibility to confirm whether or not that institution will accept hours from Regency. Occupational Demands In keeping with our commitment to equal opportunity, no student will be denied admission based on membership in a protected group. At the same time, it is our mission to teach our students the skills necessary for success in the beauty industry. In order for you to meaningfully participate in the program and receive the full benefit of the education delivered, there are certain physical demands that you must be able to meet. Specifically, to perform the essential requirements of the cosmetology curriculum, you must have the physical ability, with or without a reasonable accommodation, to: Tolerate exposure to and handling of products having or emitting odors, fragrances and chemicals Stand and walk for up to 8 hours consecutively, except during 15 or 30-minute breaks Manually grasp, handle, control, move and manipulate objects or tools standard within the beauty industry Bend or twist the body and engage in repetitive motions, as needed to perform and demonstrate the full range of services standard within the beauty industry Hold the arm and hand in one position and, at other times, hold the hand steady while moving the arm Lift up to 30 lbs. Perform and demonstrate the full range of esthetics-related services standard within the skin care industry (e.g., facial and body skin care with massage, facial and body waxing and makeup application) View detail in objects within arm s length and discern the differences between colors, shades and brightness within and between those objects Perform and demonstrate the full range of hair-related services standard within the cosmetology industry (e.g., shampoo with massage, comb, haircut, hairstyle, hair color and chemical texturing, braid, sculpt, hairdry, etc.) Perform and demonstrate the full range of nail-related services standard within the cosmetology industry (e.g., file, buff, clip, clean and apply polish to nails and/or attach artificial nail products) If you may require an academic adjustment in order to meet these occupational demands, please review the Academic Adjustments Based on Disability Section of this catalog. Student Financing Cosmetology Program Tuition and Costs 4

8 You will be responsible to pay the tuition, and kit fee (optional) 5 as stated on your Enrollment Agreement. Please see the State Appendix for the tuition, kit fee, and other costs applicable in your state. Students must pay the full tuition before starting the program or in accordance with Regency s interest-free monthly payment plan. Additionally, you may be subject to potential additional fees. Payments made after they are due and accounts with a past due balance in any month will be subject to a $25 late fee. Any checks returned for insufficient funds (NSF) will be subject to a $25 NSF fee. Should you lose your Regency name tag, you will be required to replace it and will be charged the current market price. Potential additional fees and costs are summarized below: Item Overtime fee Late payment fee Additional program hours Fee $5 per hour $25 each time that the school does not receive payment from the student by the invoice due date Current hourly rate of tuition at time of purchase Replacement name tag Current market prices Overtime fees are due when incurred and Regency reserves the right to suspend attendance until these fees are paid in full. Regency accepts payment in the form of cash, personal check, cashier s check, debit card and credit card (Visa, MasterCard, or Discover). Payments by credit card must be made through Regency s website or by telephone to Regency s business office. Payments by check must be mailed to addresses provided upon invoicing. If no invoice is provided (for example, a payment to remove a suspension for non-payment), payment by check may be made directly to the campus. All checks must have a Student ID# clearly written on the check. All checks returned for insufficient funds will be subject to a NSF fee of $25. Financial Aid for Students Federal Financial aid is available to those who qualify. The financial aid application process has 4 main steps: Complete a Free Application for Federal Student Aid (FAFSA) online at Turn in any documents requested by our Financial Aid Office. These may include federal tax returns and financial information concerning you and/or your parents. Review and, if you wish, accept results with our Financial Aid Office Complete federal loan paperwork online, as directed Regency s Financial Aid Department will be available to guide you through the process. Please see the State Appendix for information regarding state financial aid that may be available. Cosmetology Program Name of Program Cosmetology Program Educational Objectives Students will be provided a curriculum that includes theory and practical experiences in all phases of cosmetology necessary to meet licensing requirements 5 The kit includes various cosmetology supplies. Students are required to have all items in the kit for program participation, but may obtain a list of kit items from the Campus Manager and purchase those items from an outside vendor of their choosing. For those who choose to purchase a kit from Regency, appropriate state sales tax will be applied. 5

9 Prepare students to pass the required written and practical state exams To teach entry-level skills and efficiency needed to work in a professional salon or related occupation To develop employer-employee relationships, effective communication and client-building skills Instructional Methods The cosmetology program is delivered in a progressive, individualized format. Teachers guide students through classes with support of an ipad-based Filmbook. Students demonstrate their knowledge of cosmetology theory and technical skills through practical and clinical activities, graded technical evaluations, and Filmbook class assessments. 6 Please see the State Appendix for the Program Outline, including Program Length, Program Description and Curriculum Requirements, applicable in your state. Grading Students will complete Filmbook class tests and technical evaluations: Technical evaluations are conducted as part of a guest service and are graded as pass/fail. The required criteria and minimum passing score are set forth in the technical evaluation process. A student is awarded points for each criterion that is performed properly. A student will receive a pass if s/he passes sanitation requirement and the total score on the technical evaluation form meets or exceeds the minimum score. Students are required to complete a total of four (4) Technical Evaluations in the program. Filmbook tests are completed at the end of each class (4 per course) to demonstrate the knowledge gained during that class. Assessments are scored on a 0-100% scale. A score of 80% or above is required to pass an assessment. If a student does not pass an assessment, s\he must retake it (with varying questions), until achieving a passing score. Students will take a total of assessments in the program depending on the state program hours and student progress. You are required to retake each technical evaluation and assessment until you have earned a passing score. You cannot complete a class until you have obtained a passing score on the assessment. You must pass all Technical Evaluations prior to completing the program. The school will maintain your grade records as part of your electronic student record. Grading Scale Satisfactory 79 and Below Unsatisfactory Program Materials While in the campus, you will be provided with a Regency-owned ipad which contains Regency s cosmetology Filmbook. The Filmbook includes live-action film scenarios, an e-textbook, practice exercises, animated shorts, illustrated guides and the assessments. You will also receive a copy of the Laws and Rules book for your state. Additional reference materials are available for checkout through the school library, including, but not limited to, printed copies of the e-textbook procedures, the Milady Standard Cosmetology Textbook and Study Guide (2008 Edition), the Milady Standard Cosmetology Exam Review and Regency Technical DVD Set. Student Support We re all about helping you do your very best. That s why we have a network of resources to support your during your time at Regency. The Campus Manager is available to work through any questions or concerns relating to your 6 The program is taught in English and Regency does not offer remedial classes or classes in English as a second language (ESL). 6

10 experience in the program. Additionally, our Student Services Specialists are available as another resource to discuss questions or concerns. You will receive additional support through the following tools and processes: Student Progress Report. Regency maintains a Student Progress Report for each student and updates these reports at the close of each day. You may view and print your Student Progress Report which includes your rate of attendance, academic average, completed practical service and other academic requirements and other program information from the student computer kiosks in the campus. Campus Manager Consultation. On a few occasions during your program, you will review your progress with the Campus Manager. (This schedule may vary for students restarting or transferring into Regency.) In these meetings, the Campus Manager will provide you with a printed copy of your progress report. Additionally, if the Campus Manager believes that a student may benefit from outside resources (for example, suicide prevention or domestic abuse advisors), he/she may provide that student with a list of third-party resources that the student may choose to contact for assistance. Daily Roll Call and Coaching. Teachers regularly review the Daily Roll Call and Coaching Report for the campus, which notes the clock-in status, rate of attendance and academic and practical service status for all students in their learning settings. The teachers use this report to touch base with individual students who may not have clocked in or may be falling behind in attendance or completion progress, to ensure that they understand their status and discuss steps towards improvement. Teachers also use this tool to celebrate students for improving their performance. Student Services Department. Student Services Specialists are also available by telephone to review your progress and status, as well as your questions concerning schedules, leaves, withdrawals and restarts. Our Specialists will also review any requests you may have to make a schedule change, take a leave of absence, withdraw and/or restart, as needed. In connection with such requests, they will also review the sufficiency of any documentation required to support the request(s), will determine if you meet any applicable eligibility requirements and will inform you of whether the request must be referred to the Student Appeals Committee for a final determination. Student Services Specialists may also provide students with a list of third-party resources if they believe a student may benefit from those resources. Program Completion and Graduation Graduation Requirements In order to graduate and receive a diploma in Cosmetology Arts and Sciences, students must meet the following requirements: Complete the required hours of training; Complete all curriculum requirements; and Satisfy all financial obligations to Regency Please see the State Appendix for additional graduation requirements, if any, applicable in your state. Please note that if you reach the last eight (8) hours of your program and have an unpaid balance with Regency, you will be suspended from participation until your outstanding balance is paid in full. If you have completed all required program hours but have not satisfied one or more of the other requirements for graduation, you will have the status of incomplete graduate. An incomplete graduate will not be provided with a diploma or official transcript, but will have the option to complete all outstanding requirements and qualify to receive a diploma. You will be charged for additional hours required, if any, to complete any outstanding requirements. Additional hours will be charged at the current tuition rate. After Graduation State Licensure 7

11 State licensure requirements vary by state but generally require completion of all program requirements, completion of a state application, successful completion of state written and practical exams, and payment of any applicable state testing and license fees. Please see the State Appendix for the licensure requirements in your state, including hour marks when exams may be taken. Each state administers its own licensing exam(s). You must pre-schedule your licensing exam with the state testing service. Regency will pay all the legally required fees for a graduate of its Studio Luma cosmetology program to (a) take the state licensing exam(s) one time and (b) obtain an initial cosmetology license, for students who start or restart March 2, 2015 or later. To trigger these payment obligations, the graduate must schedule to take the exam(s) within three months of graduating from the program and also advise his/her Career Coach of the testing date(s). By accepting payment for the licensing exams, the graduate also agrees to provide all test results to his/her Career Coach within one (1) week of receiving them. Each student must schedule an exit interview with the Campus Manager after they have successfully passed all state required exams to complete the licensing process. In this interview, we will solicit your feedback on our program through a confidential graduate survey, discuss your licensing exam results and career plans and review the career services available as a graduate. Career Paths Once you graduate and secure a cosmetology license, these achievements open the way to many possible career paths, which may include: Cosmetologist Esthetician Stylist Nail Technician/Manicurist Cruise Ship Stylist Cosmetology or Product Consultant/Trainer Color Technician Cosmetology or Product Sales Representative Chemical Texturizing Specialist Research Cosmetologist Cosmetology Instructor Platform Artist Salon Manager or Owner Video, Magazine or Film Artist Some of these career paths may require additional training, experience, or licensure. Students should also be aware that (1) the law may differ by state as to the training, experience or licensure that will be required for any of the career opportunities in the list and (2) state reciprocity laws may limit the application of program completion in one state to licensure in any other state. Regency has not made and will not make any guarantees of employment or salary upon graduation. Career Services Regency s Career Services Department actively works to establish relationships with potential employers and to provide you access to and information about potential employers through salon fairs and the SalonPartners Program. In addition, Regency provides students with access to employment opportunities through participation in The Regency Schedule Regency s program runs year-round, and we generally start new students every four weeks. The campus is open six days a week and each full-time student is scheduled for five days a week, regularly including Saturdays. This section of this catalog describes the Regency schedule in detail. The part-time program is not available in all locations. To determine if a part-time program is offered in a particular campus, please refer to the campus page on Regency s website at Regency Holidays The campuses will be closed on the following days in 2015: Monday, May 25, 2015: Memorial Day Friday, July 3, 2015: Independence Day Observed Saturday, July 4, 2015: Independence Day Monday, September 7, 2015: Labor Day Thursday, November 26, 2015: Thanksgiving Thursday, December 24, 2015: Christmas Eve Friday, December 25, 2015: Christmas Day Additionally, the campuses with a part-time program will be closed during the evening session on New Year s Eve. Campus Closures Campus closures due to inclement weather or other reasons will be communicated to students by telephone and posted on the Regency website. Student Schedules Please see the State Appendix for student hours in your state, as well as special attendance requirements that may apply in your state. Students are required to adhere to their assigned schedule and may not exchange assigned days or times with other students. Schedule Changes At certain campuses, with Campus Manager approval, students may change from full-time to part-time status, or from part-time to full-time status. However, no student may change from part-time to full-time when on a warning or probation status under the Satisfactory Academic Progress Policy. Students wishing to change from full-time to part-time status, or from part-time to full-time status, must confer with the Student Services Department. Our Student Services Specialists will determine if and when the change can be accommodated based on class size and schedule. Students may change status only twice during their entire training program; provided, however, that Campus Managers may approve additional status changes for students faced with circumstances such as changes in work schedules or day care conflicts. Students must provide written documentation of such circumstances before the schedule change is approved. Approved schedule changes can be implemented only between (1) the date of an evaluation point under the Satisfactory Progress Policy and (2) the midpoint before the next evaluation point. Time and Attendance Policies Mastering Your Time Sustained regular attendance is important to your success at Regency. Regency s time policies and tools are designed 9

13 to teach you the habits and skills that will help you complete your program and, more significantly, prepare you for success after graduation. Additionally, Regency has built touch points into the program to provide you with information about your progress. We recommend that you use these tools and processes to stay on-track for completion. The actions that will allow you to effectively manage your time are straightforward: Clock your time Be on time Take your daily breaks Attend regularly Manage your leaves from school Clocking Time In order to receive credit for all time attended, you must record your own time using a computerized time-clock. Regency uses this system to track student attendance and update student records daily. You should clock in and out as appropriate to record your time in school and to exclude time periods that do not count for attendance purposes, such as your 30-minute meal breaks (discussed below). Please see the State Appendix for information on additional or different clocking policies which may apply in your state. Daily Breaks Full-time students have a 30-minute meal break and two 15-minute breaks each day. The following policies apply to these breaks: Your schedule will not be shifted forward 30 minutes if you skip your break. You should take your break and stay until the end of the day. You must clock out during the 30-minute meal break, and you may leave the campus. You should not clock out for 15-minute breaks and should stay in the campus. If your learning setting goes to their assigned meal break you must clock out and return after 30 minutes Timeliness For full-time students, each school day is divided into two sessions; for part-time students (where applicable), each school day has one session (except Saturdays, which have two). 7 Regency expects that you will be on time for each session. Excessive or chronic tardiness may be addressed by the campus staff in accordance with the Student Behavioral Expectations Policy. Teachers will not repeat class materials to accommodate tardy students. Each student is responsible for any content missed due to tardiness. Your future clients will demand reliability, including promptness, from you. Develop the habit of being on time, every time. It s a good habit to develop. Being late disrupts your educational experience and reduces your overall attendance rate. Overtime Fees You must complete the program by your agreement end date to avoid overtime fees. Please read this Section carefully and plan ahead to prevent additional fees for exceeding Enrollment Agreement end date. Please review your Enrollment Agreement to make sure you know your Agreement End Date. If you do not complete by your Agreement End Date, you will be charged an additional fee of $5 per hour for all contract hours not yet completed. If you do not complete all program practical services within your contract hours, you will be charged for additional hours to complete all services. Additional hours will be charged at the current tuition rate. You will not graduate until all program requirements are met. 7 Sessions are generally defined (i) for full-time students as 8:30am-12:30pm and 12:30pm-5pm and (ii) for part-time students (where applicable), as M-Th 5:15pm-9:15pm, and Saturday 8:30am-5:00pm, except where state law requires otherwise. Please see the State Appendix to determine whether sessions are defined differently in your state. 10

14 14-Day Absence Policy If you miss 14 consecutive calendar days (excluding days on an approved leave of absence), you will be terminated from the program. Note: Suspension days are counted in the 14 consecutive calendar days. You must have clocking activity in order to be considered present for that day. On the 14 th day of absence, you must clock at least three hours to be considered present for that day. For purposes of the 14-day absence policy, attendance is measured in sessions, as described in this Section of the catalog above. Manage your Leaves from School From time to time, you may need a leave from school for family and medical or other reasons. We permit leaves from school for a variety of reasons, as outlined in the Student Leaves section below. Except when you are on an approved leave, there are no excused absences from the program. By planning ahead when a need for a leave is foreseeable (or, when an unexpected need for leave occurs, by promptly submitting your leave request), you can use these leaves to keep your attendance rate high and help you complete the program. Student Leaves Regency recognizes that over the course of the program, it may be necessary for you to take a short break from training for a variety of reasons. Days included in an approved leave of absence are removed from your schedule and, therefore, do not count towards your attendance rate or under the 14-day absent policy. Leave Categories Regency provides three types of leave: Family and Medical Leave Personal Leave Administrative Leave Combined Leave Limits The maximum combined personal and family and medical leave time cannot exceed 98 calendar days (including up to 84 days family and medical leave and two 7-day personal leaves) in any 12 month period, except in rare extenuating circumstances or where state law requires otherwise. Please see the State Appendix for information on whether leave limits are different in your state. Planning and Requesting a Leave If you are considering a leave, you must talk with a Student Services Specialist about the particular circumstances. The specialist will determine if you are eligible for a leave and explain how the leave may impact your progress through the program. He/she will also assist you with the leave request process, including determining any supporting documentation that will be required to approve the leave. You are strongly encouraged to reach out 30 days before the start of the desired leave or, where that is not possible, as soon as the need for the leave is known. In cases where the need is unforeseeable (for example, a sudden illness), you must reach out within 7 days or as soon as circumstances otherwise permit. Please note that in the event that you are terminated under the 14-day absence policy described in the Time and Attendance Policies Section of this catalog, that termination cannot be reversed regardless of the reason for the absence. Family and Medical Leave You may request up to two leaves based upon: Your own medical condition The care of a child, spouse, domestic partner, or parent with a medical condition The birth or adoption of a child or placement of a foster child (provided that the leave must begin within 12 months of the birth, adoption or placement) 11

15 The death of a child, sibling, spouse, domestic partner, parent, or grandparent The two medical leaves, when totaled, cannot exceed 84 calendar days (12 weeks), except in rare extenuating circumstances. The two medical leaves may be taken back to back. To approve a leave request relating to your own or your family member s medical condition, Regency requires that you submit valid and authentic medical certification from a health care provider (HCP) to support the request. The HCP certification must include a start and end date for the leave and reference you by name. The leave may be refused until such HCP certification is provided and, if adequate HCP certification is not provided, the leave may be denied. Regency reserves the right to contact the HCP noted on certification submitted to Regency, in order to confirm that the HCP certification is authentic. To approve a leave request related to the birth or adoption of a child or the death of a family member, Regency will require that you submit appropriate verification (birth certificate, adoption order, obituary, etc.). Personal Leave You may request up to two (2) personal leaves for any reason. A personal leave must be seven (7) consecutive calendar days in length. A request for personal leave must be submitted to the Student Services Department at least one day in advance of the first scheduled day of the leave. Administrative Leave Administrative leave may be taken in the event that an absence from school is required for military duty or jury duty. If you are called for jury duty, at your request the Student Services Department will provide you with a letter notifying the court that you are enrolled with Regency and stating that an absence for jury duty would have a negative impact on your training. If you wish to attend jury duty or if appeals to be released from duty are denied, you must provide the Student Services Department with documentation from the court certifying the day(s) required for jury duty. If you are called to military duty, you must likewise provide the Student Services Department with documentation from the applicable military branch certifying the day(s) required for military duty. In addition, Regency reserves the right to place a student on an administrative leave under circumstances justifying such a leave. For example, students placed on an absence for investigation (described in the Complaints, Investigations, and Disciplinary Action section below) may, if permitted to continue the program, convert the time on the absence for investigation to an administrative leave. Time spent on an administrative leave will not count towards the student s combined leave limits of 98 days applicable to personal and family and medical leaves, except where state law requires otherwise. Please see the State Appendix for information on whether leave limits are different in your state. When Leave is Approved If you are granted a leave from the program, Scheduled hours falling within the approved leave time will not count and, therefore, will not affect your rate of attendance. Your Enrollment Agreement End Date and the end date for your maximum timeframe for program completion will be extended by the same number of days in your leave. You will be informed as to the day you are required to return to the program. During the leave, you will receive no disbursements of Title IV loan funds (i.e., Stafford loans or PLUS loans) or state financial aid, as applicable. Leave Amendment If you wish to change the length of an approved (1) family and medical leave or (2) administrative leave (that is, to reduce or extend the leave), you are required to contact the Student Services Department prior to the date you are required to return to the program. Two business days notice is required, except in extraordinary circumstances. A new 12

16 leave request form with updated dates and a new HCP certification (if applicable) will be required. A personal leave must be 7 days and may not be reduced or extended; however, the 2 personal leaves may be taken back to back. Return from a Leave Failure to return from a leave on the scheduled return date will result in immediate termination from the program. A student returning from an approved leave or other official interruption of training will return to school at the same SAP and RAP statuses he/she maintained immediately prior to the leave. Please see the State Appendix for Regency s SAP and RAP Policies Governing Attendance and Academic Progress Student Withdrawals In the event that you withdraw from the program, your Student Record will note the withdrawal and the reason for withdrawal, if known. A student who decides to officially withdrawal from the program should contact the Student Services Department as soon as possible. Students must remove all personal belongings from the campus building within 14 days from the date of the withdrawal/termination/ or they will be removed by the School and disposed of accordingly. Student Restarts Applying to Restart after Withdrawal or Termination If you withdrew or were terminated from the program and wish to restart, you must contact the Student Services Department. A Student Services Specialist will first determine whether you meet eligibility requirements to restart based on your rate of attendance, academic average, time period elapsed since your termination or withdrawal from the program, 8 and other objective metrics or credentials. If you are eligible, Regency will review your record of prior enrollment, including your disciplinary history and the reason for your termination or withdrawal (as applicable), in order to determine whether your request to restart may be granted without an appeal or must be submitted to the Student Appeals Committee. Regency retains discretion to grant or deny the request for any reason, based on the totality of the circumstances. If you are approved to restart after a withdrawal, a Student Services Specialist will talk with you about the factors that led you to withdraw and the specialist will encourage you to thoughtfully evaluate whether those factors have been sufficiently addressed, to give you every opportunity to successfully complete the program. Restart Requirements A student who restarts at Regency after a withdrawal or a successful appeal from a termination: Retains his or her prior hours, attendance and academic history, including, but not limited to, his or her (1) suspensions and (2) RAP and SAP status for purposes of determining a student s eligibility for financial aid. Must pay any balance owed to Regency prior to restart, unless other payment arrangements have been made. Must verify his or her financial aid status with Regency s Financial Aid Department. This process can take up to 3 weeks and will be initiated by a Student Services Specialist once restart eligibility has been confirmed. Must sign a new Enrollment Agreement. The terms and conditions of the new Enrollment Agreement will be based on the program requirements at the time the new Enrollment Agreement is signed. This means that the new Enrollment Agreement may reflect any applicable tuition increases or other program changes. Please see the State Appendix for information any additional requirements for restart which may apply in your state. 8 Your prior hours with Regency must have been earned within 5 years of your prospective graduation date, except in states where a different requirement applies. Requests for an exemption to this policy must go through our appeals process, described in the Student Appeals section of this catalog. 13

17 If a student restarts within 1 year from his or her last date of attendance at Regency, the student will not lose program hours. Regency reserves the right to adjust a student s hours if his or her restart occurs more than 1 year from the last date of attendance at Regency. A restart requires sufficient time for Regency to process the withdrawal paperwork as required by state and/or federal agencies, as well as the restart paperwork. It is the student s responsibility to ensure all required paperwork and fees are paid prior to restart. Student Behavioral Expectations Honor Code Regency expects its students to uphold high standards of integrity, professionalism and honesty. Students who cheat on assessments, seek unearned clock-hour credit, clock other students time, steal services, retail items or equipment from Regency or steal equipment or other items from other students, may be terminated, prosecuted, or both. Regency expects students and staff who observe honor code violations by other students to report these violations to the Campus Manager. Drug and Alcohol-Free School Policy Regency embraces the spirit of the public law that requires schools to provide a drug-free campus and workplace. As part of our philosophy, we are dedicated to the advancement and well-being of the population we serve. The use and abuse of alcohol and other drugs can lead to physical and psychological health risks. These risks depend upon the type of drug used and the intensity of the use. Long-term use of drugs can lead to organic damage to the body and psychological problems. And even short-term use carries a risk of an overdose that can result in effects as serious as death. Drug and alcohol use also carries other direct and indirect health risks, including a heightened risk of bloodtransmitted disease for users of intravenous drugs, the risk of pregnancy complications and birth defects in women who use drugs or alcohol while pregnant and the impairment of the ability to operate motor vehicles. As such, all students and employees are encouraged to abstain from the use of illegal drugs and irresponsible use of alcohol. Students are prohibited from the unlawful manufacture, distribution, dispensing, possession or use of a controlled substance or alcohol anywhere on Regency property including grounds, parking areas, anywhere within the buildings or while participating in school-related activities. Students are also prohibited from being present on campus under the influence of alcohol or controlled substances. Students who violate this policy will be subject to disciplinary action up to and including termination of enrollment. If there is a reasonable suspicion that a student of Regency is under the influence of alcohol or a controlled substance while on Regency s premises, the student will be required to clock out for the day and asked to leave and may be subject to formal discipline. In all cases, Regency will abide by local, state and federal sanctions regarding unlawful possession of drugs and the consumption of alcohol, including the full enforcement of applicable underage drinking laws. Any student who suspects that he/she or someone else may be at risk is invited to seek services that can be of help. Regency maintains drug and alcohol education information and a list of counseling and support services, including local services, which can be obtained from the Campus Manager. Title IV Implications of Illegal Drug Convictions Any students convicted of possessing or selling illegal drugs while receiving Title IV assistance will be ineligible for federal financial aid based on the chart below. If convicted of both possessing and selling illegal drugs and the periods of ineligibility are different, the longer penalty will apply. In addition, violations of federal, state, or local laws and ordinances concerning drugs and alcohol can lead to felony or misdemeanor convictions and legal sanctions, which include but are not limited to: fines, imprisonment, forfeiture of property and loss of driving privileges. In addition, Regency prohibits students from carrying, possessing, or using firearms and/or weapons while on school premises and while attending school-related events off Regency premises. This policy applies to all students, including those with a valid permit to carry a firearm. Campus Practice and Procedure Student Compliance You are required to come to school in dress code and with the kit items required to perform the work scheduled for your session. You are also required to comply with all campus practices and procedures regarding observance of no smoking areas, use of cell phones and other personal digital devices, storage of personal belongings and the like. Campus staff will inform you of the practices and procedures that apply in your campus. Students in violation of these practices and procedures will be required to clock out and leave the campus and repeated violations may result in disciplinary action under the Complaints, Investigations and Disciplinary Action Section below. Smartphone and Cell Phone Usage Policy General Rule Smartphones, cell phones and other personal electronic devices (collectively, Cell Phones ) may be used within the Regency campus, provided they are not distracting to other students or the learning environment. You should use your best efforts to use cell phones at times, and in areas, that do not interfere with the scheduled learning sessions. While in the campus, Cell Phone ringers and audible alerts must be turned off. Taking photographs or videos of Regency s assessment materials, proprietary documents and technologies are prohibited. Students may not audio-record, videorecord, or photograph a fellow student, Regency staff, or third-party with whom they interact in the course and scope of their enrollment, without the knowledge and prior consent of that person. A. Photos: Regency understands the importance of a strong visual portfolio in the cosmetology industry and students are encouraged to begin building their portfolios while still in school. However, please be mindful that Cell Phones may be used to take photos of student work only if: 1. Performance Floor: (i) a Teacher grants the student permission to take the photo, (ii) the client grants the student permission to take the photo (while the Teacher is present), and (iii) the client/model confirms that he/she is at least 18 years old. 2. Classroom: a Teacher grants the student permission. (Photos of work performed on another student also requires permission from that student.) B. Uploading Photos: Cell phones may be used to upload photos to online portfolios at appropriate times: 1. Uploading should not be a distraction to other students; 2. Uploading should not interfere with a client service; and 3. Uploading should not disrupt the learning environment. Taking and uploading photos of student work is optional and will not impact a student s grades or program progress. Campus Manager will make a final determination of what constitutes unacceptable Cell Phone usage. Regency is not responsible for lost, stolen, or damaged Cell Phones. Any Cell Phone found unattended in the campus must be turned in to Regency staff. 15

19 Regency Photographs & Recordings From time to time, Regency takes photographs, videos and audio-recordings of campus activities including its students, guests and others for promotional or other purposes. If you wish not to be included in such photographs, videos and audio-recordings, please notify your manager or a Student Services Specialist for directions. Dress Code Preparing for your career includes building the work habits you will need to succeed. Accordingly, we require you to come to school dressed in a professional manner. For example, students are not preparing for success if they look like they just woke up! Like your future employers, we require that if you choose to wear makeup or style your hair, that you perform all your grooming at home. The following requirements apply to all students while in the campus, including STAR Program students and students on a leave of absence. Dress Code Details: A Regency-issued smock or solid black smock that is substantially similar in length and style, which is clean and in good condition. A Regency issued Nametag/ID card must be worn at all times. No jeans except for on designated jeans day and only in states that allow jeans. Pants cannot touch the floor. Students should look clean and professional in appearance. The following is not allowed: o Open toed shoes, headscarves, hats and bandanas Your Campus Manager will make a final determination of what constitutes acceptable dress under this policy or is otherwise inappropriate for safety, sanitation or regulatory reasons. Equal Opportunity Policies Policy against Discrimination, Harassment, Bullying and Offensive Behavior Regency strives to provide an environment in which all students can achieve their goals and thrive. Discrimination, harassment, bullying and any significantly offensive behavior create barriers to education and achievement and are contrary to Regency s core values. In certain cases, such conduct may also violate the law. Regency is committed to complying with all applicable laws providing equal educational opportunities to individuals regardless of race, color, religion, national origin, ethnic origin, sex, age, disability, military or veteran status, or other applicable protected classes under federal, state or local law. Discrimination means treating an individual or group less favorably than another because of a membership in a legally protected class. Harassment is verbal or physical conduct that demeans, stereotypes or shows hostility or aversion toward an individual or group because of a membership in a legally protected class and which creates an offensive, intimidating or hostile school environment. Bullying is the continuous or repeated infliction of physical harm or psychological distress on one or more students or employees. For all these reasons, Regency will not tolerate discrimination, harassment, bullying or other significantly offensive conduct directed towards students in connection with their educational programs and activities at Regency, without regard for the intent or basis for the conduct. If you believe you have been subjected to conduct in violation of this policy and wish to make a complaint, please see the Complaints, Investigations and Disciplinary Action Section of this Catalog for direction. Title IX and Sexual Misconduct Policy: Discrimination, Harassment, & Other Misconduct on the Basis of Sex In addition to its general prohibition of discrimination, harassment and offensive behavior, Regency has instituted policies and procedures applicable to sexual misconduct, including sex discrimination, sexual harassment, sexual assault, dating violence, domestic violence and stalking. These policies and procedures are contained in Regency s Title IX and Sexual Misconduct policy, available in full at Regency is committed to complying with all laws that prohibit discrimination on the basis of sex in admission to, employment with, and otherwise in the operation of its educational program and activities. Among the applicable laws, Title IX of the Education Amendments of 1972 prohibits sex discrimination and sexual harassment in schools. In compliance with Title IX, Regency is committed to ensuring that all its students have equal 16

20 opportunity to benefit from our program and activities, and that all its employees enjoy equal employment opportunity, free from sex discrimination and sexual harassment. The protections of Title IX also extend to third parties. Additionally, the Jeanne Clery Disclosure of Campus Security Policy and Crime Statistics Act ( Clery Act ) in part requires educational institutions such as Regency to prohibit the offenses of domestic violence, dating violence, sexual assault and stalking. There is some overlap between the requirements and prohibitions of Title IX and the Clery Act. All references to Regency s Title IX and Sexual Misconduct Policy or Title IX Policy encompass Regency s policy and procedures in compliance with Title IX, the Clery Act, and all applicable laws that prohibit discrimination, harassment and criminal conduct on the basis of sex. Regency has developed its Title IX and Sexual Misconduct Policy and the associated processes to ensure that all complaints of sex discrimination, sexual harassment, and criminal conduct on the basis of sex whether brought by students, employees, or third parties are promptly investigated and, where a violation is found, that Regency takes action to end the conduct, prevent its recurrence, and address its effects. The Title IX and Sexual Misconduct Policy is supplemental to Regency s policies generally prohibiting illegal discrimination and harassment against students and employees, including on the basis of sex and includes certain additional safeguards and requirements pursuant to Title IX and the Clery Act. Regency may be limited in the type of response it can provide with respect to conduct that did not take place within the context of Regency s educational programs and activities. Where Regency s response is limited, Regency will provide assistance, under this policy, in directing complainants to resources and organizations able to assist with investigation, prosecution, shelter and victim services, and the like. More detail concerning Regency s Title IX and Sexual Misconduct Policy and procedures concerning sex discrimination sexual harassment, sexual assault, domestic violence, dating violence and stalking, including complaint procedures, can be found at Additionally, these terms are defined below, along with some examples of types of conduct that may violate this policy. Sex Discrimination Sex discrimination means treating an individual or group less favorably than another based upon the sex or gender of that individual or group. For students, it involves conduct or statements that deny the student(s) an equal opportunity to fully benefit from our program and activities. For employees, it involves conduct or statements that deny the employee(s) an equal opportunity in employment. Sexual harassment is one form of sex discrimination. Sexual Harassment Sexual harassment is one form of sex discrimination. Sexual harassment is unwelcome conduct of a sexual nature. It includes unwelcome sexual advances, requests for sexual favors and other verbal, nonverbal, or physical conduct of a sexual nature when: (1) submission to such conduct is made a term or condition of enrollment or employment; (2) submission to or rejection of such conduct is used as a basis for enrollment or employment-related decisions; or (3) such conduct has the effect of unreasonably interfering with school or work performance or creating an intimidating, hostile, or offensive environment. Sexual harassment also includes sexual assault, as defined below. Sexual harassment is defined by the sexual nature of the conduct or communication, not the gender of the individuals 17

21 involved. Therefore, it may be perpetrated by and against individuals of either gender and between individuals who are of the same gender. The determination of what constitutes sexual harassment will vary with the particular circumstances. Uncivil conduct or common profanity generally do not meet the definition of sexual harassment, except where sexual in nature and so severe or pervasive as to deny or limit the individual s ability to participate in or benefit from our program (in the case of a student) or to enjoy equal employment opportunity (in the case of an employee). A series of incidents may constitute sexual harassment, even if one of the incidents on its own would not rise to the level of harassment. At the same time, a single or isolated action may constitute sexual harassment when that action is sufficiently severe. While hostile-environment sexual harassment may encompass a wide range of conduct, some examples of specifically prohibited conduct include: Acts of verbal, non-verbal or physical aggression, intimidation or hostility based on sex or sexstereotyping Use of offensive or demeaning terms that have a sexual connotation Objectionable physical closeness, behavior, actions or contact Inappropriate or repeated suggestions regarding or invitations to, social engagements or events, whether or not Regency-related Suggestions, express or implied, that the terms or conditions of enrollment or employment may depend on the granting of sexual favors Actions relating to a student s or employee s status with Regency which is in fact impacted by the grant or refusal of sexual favors Jokes or remarks of a sexual nature Showing or sending materials that have a sexual content or are of a sexual nature (such as cartoons, articles, pictures, etc.), either by , interoffice mail, internet or otherwise This list is not exhaustive. Regency reserves the right to determine whether particular conduct violates its Policy against Discrimination, Harassment, Bullying and Offensive Behavior, the Title IX and Sexual Misconduct Policy or other policies. Additionally, sexual harassment may include, but is not limited to, sexual assault, domestic violence, dating violence, and stalking, as defined below. Sexual Assault Sexual assault is a form of sexual harassment. A range of conduct falls into the category of sexual assault, including without limitation sexual violence, sexual battery, sexual coercion, rape, or other sexual contact involving force, threat, or intimidation, or without consent. Consent to sexual activity means words or overt actions indicating that the person is agreeing to a particular act. Consent is informed, knowing, and voluntary. Consent is active and not passive. Silence, in and of itself, cannot be interpreted as consent. Domestic Violence Domestic violence includes crimes of violence committed by: A current or former spouse or intimate partner of the victim A person with who a victim shares a child in common A person who is living with or has lived with the victim as a spouse or partner A person similarly situated to a spouse of the victim under the domestic or family violence laws of the jurisdiction in which this policy applies, or Any other person against an adult or youth victim who is protected under the domestic or family violence laws of the jurisdiction in which this policy applies Dating Violence Dating violence means violence committed by a person who is or has been in a social relationship of a romantic or intimate nature with the victim; and where the existence of such a relationship shall be determined based on the following factors: 18

22 The length of the relationship The type of relationship The frequency of interaction between the persons involved in the relationship Stalking Stalking means engaging in a course of conduct directed at a specific person that would cause a reasonable person to (1) fear for his or her safety or the safety of others; or (2) suffer substantial emotional distress. Academic Adjustments Based on Disability As set forth in the Policy Against Discrimination, Harassment, Bullying and Offensive Behavior, Regency policy prohibits unlawful discrimination against students based on protected characteristics, including disability. Regency is committed to working with qualified students with disabilities to provide equal access to the education that Regency provides and to create an inclusive environment for all. Regency will provide reasonable academic adjustments (including accommodations, auxiliary aids and services) to an otherwise qualified student with a disability. For purposes of this policy, the term student includes an enrolled student as well as any prospective student who requires reasonable academic adjustments in the application process, including in connection with the entrance examination. The purpose of academic adjustments based on disability is to provide an otherwise qualified student with equal access to Regency s classes, services and facilities. Accordingly, a reasonable academic adjustment is a modification of or exemption from a Regency policy, procedure or practice that enables a student to fully participate in Regency s educational program and meet program requirements by overcoming barriers posed by the student s disability. By contrast, a requested academic adjustment will be denied as unreasonable if it would (1) excuse a student from essential program requirements or institutional standards for program completion, (2) conflict with licensing or other legal requirements or (3) otherwise place an undue financial or administrative burden on the institution. Additionally, Regency is not required to provide a student with the academic adjustment(s) he/she most prefers, so long as it provides reasonable academic adjustments, where possible. Complaints, Investigations and Disciplinary Action Complaints to Regency If you believe you have been subjected to conduct in violation of Regency s Equal Opportunity Policies, Student Behavioral Expectations Policies or any other Regency policy or law by anyone in connection with your enrollment with Regency (e.g., an employee, fellow student or guest), you are urged to notify Regency immediately. Regency takes all such complaints seriously. We strongly encourage each complainant to put his or her complaint in writing, providing a detailed description of the alleged events that are the basis for the complaint and list of witnesses to the events. We suggest that a student who wishes to make a complaint present the complaint to a Student Services Specialist, but you may bring complaints to any campus employee with whom you feel comfortable. With respect to complaints under the Title IX and Sexual Misconduct Policy specifically, we strongly encourage students to present their complaint directly to the Title IX Coordinator, at the contact information provided above. 20

24 Investigations by Regency Upon receipt of a complaint or other knowledge of a potential policy violation, Regency will undertake a prompt and thorough investigation. Regency seeks to handle each complaint and investigation with professionalism and discretion. A fair and effective investigation often requires that the details of the complaint and/or the identity of the complainant be shared with those individuals involved in and/or interviewed in the investigation. Such individuals will, however, be instructed that they are expected to maintain the confidentiality of the matter as directed. Students are expected to cooperate fully with any investigation of inappropriate conduct. Except in extraordinary circumstances, Regency seeks to conclude each such investigation within 30 calendar days. Upon conclusion of an investigation Regency will, where appropriate, take corrective action. Further information concerning the investigation of complaints under the Title IX and Sexual Misconduct Policy including without limitation requests for confidentiality in connection with such a complaint as well as the timeframes for the major stages of the investigation is provided at Absence for Investigation In circumstances where the student is the subject of a complaint, Regency reserves the right to place the student on an absence for investigation. During an absence for investigation, the student will not be allowed to return to the campus and may not complete hours until the investigation is complete and any disciplinary action has been taken. Such an absence counts against the student s attendance, but is limited to 12 calendar days. If a student continues in the program at the conclusion of an absence for investigation and any related disciplinary action, the student may petition for an administrative leave for the absence so that it does not count against the student s attendance rate. Further information concerning the investigation of complaints under the Title IX and Sexual Misconduct Policy including without limitation requests for confidentiality in connection with such a complaint as well as the timeframes for the major stages of the investigation is provided at Disciplinary Action by the School Every incident of student misconduct presents unique facts and circumstances, and we review the facts of each incident on its own merits. Regency will consider aggravating (making more serious) and mitigating (making less serious) circumstances when determining appropriate discipline. Factors considered can include the student s history of prior misconduct, the severity of the conduct at issue, the harm or risk posed by the misconduct, the student s acceptance of responsibility for his or her actions, and the impact upon other students in the school. In each instance, Regency retains full discretion to determine what discipline (up to and including termination) is warranted. Further information concerning factors considered in the investigation of complaints of sex discrimination or sexual harassment under Title IX policy is provided at Regency commonly employs 5 levels of disciplinary action, set forth below. Regency does not provide students with progressive discipline. Additionally, these levels of discipline are not exclusive; rather, Regency may implement other types of discipline (e.g., transfer to another Regency school or campus) as appropriate to the situation. Thus, while multiple disciplinary actions issued to an individual student may progress up the levels described below, such step-by-step progression is neither promised nor required. Regency s common disciplinary actions for students are as follows: 1. Verbal Warning. Generally, a verbal warning is appropriate when Regency has no knowledge of prior misconduct by the student and Regency determines that the misconduct is moderate in nature. A memorandum of the verbal warning will be placed in the student s record. 2. Written Warning. Generally, a written warning is appropriate when it is determined that the student has engaged in a prior act of misconduct or the misconduct is serious in nature. 21

25 3. One-Day Suspensions. Generally, a one-day suspension is appropriate when the student has engaged in a prior act of misconduct or the misconduct is serious in nature. 4. Three-Day Suspension. Generally, a three-day suspension is appropriate when the student has engaged in repeated acts of prior misconduct or the misconduct is severe in nature. 5. Termination. Generally, termination of enrollment is appropriate when the student has engaged in repeated acts of prior misconduct and the misconduct is severe in nature. However, certain types of misconduct are so severe that Regency may choose to terminate the student s enrollment upon a first offense. The following nonexclusive list provides examples of conduct that, when committed by a student, are likely to result in disciplinary action: Statements or conduct towards a fellow student, staff member or guest that demeans, harasses or discriminates against that person on the basis of race, color, national origin, ethnicity, religion, disability, gender, sex, sexual orientation or any protected characteristic; Sexualized, abusive, bullying, profane or other offensive statements or conduct towards a fellow student, staff member or guest; Refusal to follow reasonable directions from a staff member or other insubordination; Theft or destruction of property belonging to Regency, students, guests or co-workers; Acts or threats of violence towards a fellow student, staff member or guest or on Regency property; Violation of the drug and alcohol-free school policy; Possession of alcohol, illegal drugs, firearms, explosives, weapons or other unlawful or dangerous materials or items on Regency property; 9 Appearing in the school intoxicated or under the influence of a controlled substance; Cheating on an exam; Copying or photographing assessment materials; Disrupting the learning environment; Refusing a client Violation of the clocking in and out policy, including but not limited to clocking in or out for another student, or asking another student to clock in or out for you; Other acts in violation of Regency policy; and Acts in violation of applicable federal, state, and local law or accreditor standards. This list does not limit the circumstances under which Regency may impose disciplinary action against students. Any conduct that falls below our standards of conduct or breaches Regency policy is subject to disciplinary action. External Grievance and Complaint Policy If a student wishes to file a complaint alleging that Regency has violated NACCAS rules and directives, that complaint may be sent directly to NACCAS, using the contact information provided in above in the Accreditation Section of this catalog. Please note that NACCAS requires that a student try to resolve his/ her complaint through Regency s internal complaint and appeals processes before filing a complaint. Please see the State Appendix for contact information for certain state agencies where you may file a complaint. Anti-Retaliation Policy Regency will not retaliate against you for filing a good-faith complaint or for participating in good faith in an investigation of alleged misconduct. Likewise, Regency will not tolerate retaliation by others against you on these grounds. An employee or student who retaliates will be subject to disciplinary action, up to and including termination from Regency. Any student who feels that he/she has been subject to retaliation in violation of this policy should report the matter immediately. We suggest that a student make the complaint to a student services specialist, but you may bring complaints to any campus employee with whom you feel comfortable. 22

26 Grievances and Student Appeals Grievance Policy Regency will work to resolve any student grievance that has merit. In the event that you disagree with a final decision or disciplinary action issued by Regency or have another grievance, you may seek a review of the matter by submitting an appeal to Regency s Student Appeals Committee. To file a grievance or appeal with the Student Appeals Committee, you must submit a written statement that clearly identifies the decision or matter at issue, the reason that you disagree with the decision or matter in which you are aggrieved, what outcome you seek and any other information that you would like the Student Appeals Committee to consider. Appeals When a student appeals a disciplinary action, the appeal must be filed within 14 calendar days of receipt of the disciplinary action and the appeal may be made on one or more of the following grounds only: (1) an error occurred that, if corrected, may change the outcome of the investigation; or (2) new information has arisen, that was not available or known to the student at the time of the investigation, which if considered may change the outcome of the investigation. Information that was known or available to the student during the investigation will not be considered. 27 Release of Records to Third-Parties Regency maintains student records and administers access to student records in compliance with law, including the Family Educational Rights and Privacy Act (FERPA). Under FERPA, the release of student education records by Regency to third parties, other than a school department or official, is generally prohibited without the student s written permission. Regency, therefore, requires written consent from the student (or parent/guardian if the student is a dependent minor) before releasing any information from a student s education record in response to a third-party request, other than a request by NACCAS, unless otherwise required or permitted by law. 24

This refund policy applies to all terminations and withdrawals for any reason, by either party, including student decision, program cancellation or school closure. B. If an applicant is not accepted by the School, or the Student s Program is cancelled before the Student starts the Program, the Student is entitled to a refund of all monies paid to the School. C. STUDENT S RIGHT TO CANCEL: A Student (or in the case of a Student under legal age, his/ her parent(s) or legal guardian(s)) has the right to cancel this Agreement in writing and receive a refund of all monies paid until the Student s Start Date or the fifth (5 th ) business day after signing this Agreement, whichever is later. The official withdrawal or termination date for a Student on an approved leave of absence is the earlier of the date of expiration of the leave of absence or the date the Student notifies the School that he/she will not return to continue the Program. Pursuant to the Code of Federal Regulations, 34 CFR Section of the Higher Education Act Section 484B, Return of Title IV Funds, the School must calculate the amount of Title IV funds the Student has earned at the time of withdrawal or termination from the School. Title IV funds are funds received from one or more of the following programs: Pell grant, FSEOG, or Federal Direct Loans. This amount is based upon the number of School hours the Student is scheduled to complete in the payment period. After 60% of the payment period has been completed, 100% of Title IV funds may be retained. The School must return any portion of unearned Title IV funds for which the School is responsible within 45 days. The School will advise the Student of any amount of unearned Title IV grant aid that must be returned by the Student, if applicable. K. Refunds to the Title IV programs and others will be disbursed in the following order: 1) Federal Direct Unsubsidized Stafford loan 2) Federal Direct Subsidized Stafford Loan 3) Federal Direct Plus Loan 4) Federal Pell Grant 5) Federal SEOG 6) Other Title IV aid. L. If applicable, the Student will receive the proportional share of any remaining refunds (after Title IV distribution) from non-title IV programs (i.e. state grants, scholarships, other agency grants). In the event of a permanent school closure, the Student will receive, at the School s option, either a teach-out at a comparable school or a pro-rata refund of his/her Tuition. O. Under certain circumstances, the School may choose to enter into modified Tuition payment arrangements with a Student. In order for the School to consider a modification, the Student must submit to the School a written request of the modification sought, the circumstances supporting the request, and any supporting documentation. 33 State Licensure Hour Marks When Exams May Be Taken State Practical Exam: 1,800 (60 credit hours) State Written Exam: 1,800 (60 credit hours) Licensure Requirements A student applying for a cosmetology license in the State of Colorado must meet the following requirements: Be at least sixteen years of age; Successfully complete sixty credit hours of training in a beauty school approved by the private occupational school division; Pass examinations; and Pay to the director all examination and application fees. Felony Conviction It is a violation of the Barbers and Cosmetologists Act to have a felony conviction. The Director has the authority to determine the qualifications of applicants and to grant or deny licenses. When an applicant for licensure has a felony conviction, the Director will consider several factors, including but not limited to the severity of the felony, the circumstances surrounding the felony conviction, the number of felony convictions, whether the applicable sentence(s) has/have been discharged, and evidence of rehabilitation. For that reason, we encourage every student to strive for 100% in their rate of attendance and academic performance. At the same time, A6

34 to provide flexibility for school-life balance, we have set our minimums for attendance and academic performance at 80%. Specifically, Regency requires that all students maintain both of the following: A rate of attendance of 80% or higher and An academic average of 80% or higher, in the program. Federal and state laws require that we strictly enforce these standards and have led us to create a dual set of policies governing attendance and academics. They are the: Regency Academic and Attendance Policy RAP and Satisfactory Academic Progress Policy SAP A copy of these policies is included in the student catalog, which is provided to students prior to enrollment. This policy applies to all Regency students whether or not they actually receive federal financial aid. For those students who do receive federal financial aid, it is critical to understand that failure to comply with SAP may lead to termination of eligibility for financial aid. Regency Academic and Attendance Policy ( RAP ) The first policy under which we enforce the minimum rate of attendance and academic average is the Regency Academic and Attendance Policy, or RAP. The minimum requirements are a rate of attendance of 80% and an academic average of 80%. Rate Attendance Calculation under RAP. The rate of attendance is calculated by dividing the cumulative clocked hours by the cumulative scheduled hours recorded during a student s enrollment, rounded to the nearest hundredth (for example, 521 clocked hours divided by 550 scheduled hours equals 94.73% attendance). 28-Day Policy under RAP. Under RAP, any student whose attendance is below 50% on the 28 th calendar day of enrollment will be terminated, with the option to appeal, as described below. Alerts & Terminations under RAP. While we update each student s rate of attendance and academic average daily, each full-time student s RAP status is updated once a month (and each part-time student s RAP status is updated every other month). This RAP status update occurs on or near the day-of-month anniversary date of the student s start date. (For example, a student who started the program on January 4 th will be measured on or near the 4 th of each month thereafter.) The RAP status is determined as follows: Students who meet the minimum RAP levels for attendance and academics will be assigned a RAP status of Acceptable. Students below the minimum levels in attendance and/or academics will be assigned a RAP status of Alert, as follows: Regency will perform a calculation to determine whether it is mathematically possible if the student attended at a rate of 100% for that student to achieve a rate of attendance and/or academics of 80% by the end of two additional monthly measurement periods. If this is possible, the student will have a status of Alert 1, but will not be terminated at that time. If this is not possible, the student will be terminated from the program, with the option to appeal. Alert 1: After being assigned a RAP status of Alert 1, if the student is still out of compliance with RAP at the next monthly measurement date, Regency will determine whether it is possible that the student will be able to meet the required rate of attendance or academic level by the end of one additional monthly measurement period. If this is possible, the student will be assigned a RAP status of Alert 2. If this is not possible, the student will be terminated, with the option to appeal. Alert 2: If a student with a RAP status of Alert 2 is out of compliance for 3 consecutive monthly measurement periods, the student s enrollment will be terminated, with the option to appeal. Where a student is subject to termination under RAP, Regency retains the discretion to suspend rather than terminate the student s enrollment under its RAP re-entry process. RAP re-entry is generally available to those students who (i) have not been terminated from the program on two or more occasions in the past, (ii) may, based on current attendance, achieve an attendance rate of 80% within two to three additional monthly measurement periods; and (iii) submit a Goal Statement noting the steps that the student will take to meet and maintain acceptable attendance and A7

35 academic levels. Subject to his or her full cooperation with the reentry process, an eligible student will be permitted to continue in the program without interruption under his or her current enrollment agreement. Satisfactory Academic Progress Policy ( SAP ) The second policy under which we enforce the minimum rate of attendance and academic average is the Satisfactory Academic Progress Policy, or SAP. Just as with RAP, the minimum requirements are a rate of attendance of 80% and an academic average of 80%. Attendance and academics are measured on a cumulative basis. SAP is designed in compliance with Title IV (federal) law and its accompanying regulations, which are applicable to schools that participate in Title IV loan and grant programs and require those schools to enforce Minimum Satisfactory Progress. (Under these complex regulations, the minimum rate of attendance is required to complete the program within the maximum timeframe established by Regency, which is 125% of the program s scheduled length.) SAP Evaluation Points A student s status under SAP is maintained and updated under a different cycle than the student s RAP status. Specifically, each student s SAP status will be evaluated as follows: The SAP evaluation points for all students will occur upon the completion of 20 credit hours (600 clock hours) and 40 credit hours (1,200 clock hours) of the program, unless one of the following exceptions apply: Transfer Students (external transfers only): The SAP evaluation point for a transfer student that contracts with Regency for less than a full academic year of program hours will occur upon the completion of half of the student s contracted program hours. Restart Students (Special Restarts only): A Special Restart is one of the following: A student that restarts after being out of the program more than 180 consecutive calendar days; or A student that restarts from a different Regency campus, which results in a material change in the base program requirements, tuition or length; or change in U.S. Department of Education school code The SAP evaluation point for a Special Restart student that contracts for less than a full academic year of program hours will occur upon the completion of half of the student s remaining program hours. The SAP evaluation point for a Special Restart student that contracts for more than a full academic year of program hours will occur upon the completion of 20 credit hours (600 clock hours) and 40 credit hours (1,200 clock hours) after restarting the program. Maximum Timeframe The maximum timeframe for SAP is 125% of the program length or approximately 56 calendar weeks for full-time and 94 calendar weeks for part-time. Transfer hours are counted as both attempted and completed for the purpose of determining the maximum timeframe for SAP. Grading Procedures Technical Evaluations are graded Pass/Fail only. The required criteria and minimum passing score are set forth on the Technical Evaluation Form. A teacher observes the student s performance and awards points for each criterion that is performed properly. A student will receive a pass if the total score on the technical evaluation meets or exceeds the minimum score. Filmbook assessments are completed at the end of each class to demonstrate the knowledge gained during that class. Assessments are scored on a 0-100% scale. A score of 80% or above is required to pass an assessment. If a student does not pass a class, they must retake the assessment (with different questions), until achieving a passing score. Students will take an assessment in each class, for a total of 48 assessments in the program. A8

36 Grading Scale Satisfactory 79 and Below Unsatisfactory This is how SAP works: Rate of Attendance Calculation under SAP. The rate of attendance is calculated in the same manner as under the RAP Policy. The rate of attendance is calculated by dividing the cumulative clocked hours by the cumulative scheduled hours recorded during a student s enrollment, rounded to the nearest hundredth (for example, 521 clocked hours divided by 550 scheduled hours equals 94.73% attendance). For purposes of SAP, all time that a student is scheduled to attend and actually clocks will be considered when determining the rate of attendance, even if the hours are spent repeating units of instruction or portions thereof for any reason. Warnings & Termination under SAP. If a student fails to maintain the Minimum Satisfactory Progress levels for attendance or academics at a SAP evaluation point (defined above), he/she will be assigned a SAP status of Warning. If a student does not meet the Minimum Satisfactory Progress levels at the next required evaluation point, the student s enrollment and eligibility for financial aid will be terminated, with the option to appeal. If a student does meet the Minimum Satisfactory Progress levels at the next required evaluation point, the student s SAP status will be considered Satisfactory. Students who meet the Minimum Satisfactory Progress levels for attendance and academics, as well as students who have a SAP status of Warning or Probation (having been granted an appeal from the Student Appeals Committee) will be considered to be making Minimum Satisfactory Progress and will remain eligible to receive financial aid until the next scheduled evaluation. Course incompletes, repetitions and non-credit remedial courses are not offered at Regency and therefore they have no effects upon the SAP policy. Supporting Student Success under RAP & SAP The RAP and SAP policies establish the processes by which Regency monitors every student s rate of attendance and academic average. Regency will support you in meeting the attendance and academic requirements with several resources and tools by which both Regency and you can closely monitor your attendance and academic performance. As discussed in the Student Support section of the catalog, we provide you with a Student Progress Report, on which your rate of attendance and academic average are updated daily. You may view or print your Student Progress Report from the student kiosk in the campus, and the Campus Manager will review your Student Progress Report with you during touch-points during the program. Also, our Teachers have regular access to our Daily Roll Call and Coaching Report, and use that Report to counsel you if you are falling behind in attendance or academic performance. Warning and Alerts. In addition, during your enrollment, our system will evaluate your rate of attendance and academic average about once a month for full-time students and about once every other month for part-time students to determine whether you are on track in attendance and academics. If you are not meeting the minimums for attendance and/or academics, you will receive an and telephone call from a Student Services Specialist providing notice that your attendance rate and/or academic average has fallen below expectations and noting any change in your RAP or SAP status. Termination under RAP & SAP At times, the change in RAP or SAP status that will result from a student s failure to meet the minimum requirements for rate of attendance and academic performance will be termination of enrollment and/or loss of eligibility for additional federal financial aid. However, under the RAP and SAP policies a termination is not necessarily final. Rather, a student whose enrollment and/or financial aid eligibility is terminated under RAP and/or SAP often has the option of filing an appeal requesting to restart the program. A student can appeal a termination under RAP or SAP, subject to a limit of 2 appeals of a termination under RAP and a limit of 1 appeal of a termination under SAP. A9

37 Appeals Under RAP & SAP An appeal, if granted, will allow the student to restart the program. If the appeal is denied, the student s termination from participation in the program is final. RAP Appeals. If a student s appeal from a termination under RAP is granted, the Student Appeals Committee may impose conditions on the student s restart intended to ensure that he/she will regain a RAP status of Acceptable. The student s progress after restart, including whether he/she is meeting the conditions required by the Student Appeals Committee, will be evaluated once a month for full-time students and once every two months for part-time students on or about the student s monthly anniversary date of the restart date. SAP Appeals. If a student s appeal from a SAP termination is granted, he/she will restart the program with a SAP status of Probation and generally must regain Minimum Satisfactory Progress levels for both attendance and academics before the next required SAP evaluation point. Additionally, just as in case of an appeal under RAP, when the Student Appeals Committee grants a student s appeal from a SAP termination, it may impose conditions on the student s restart intended to ensure that he/she will regain Minimum Satisfactory Progress under SAP (i.e., an academic plan). The student s progress after restart, including whether he/she is meeting the conditions required by the Student Appeals Committee (i.e., the academic plan), will be evaluated once a month for full-time students and once every two months for part-time students, on or about the student s monthly anniversary date of the restart date. RAP & SAP Appeal Procedure. In order to file an appeal following RAP or SAP termination, the student must submit a written appeal to: Student Appeals Committee c/o Regency Beauty Institute 1600 Utica Avenue South, 9 th Floor St. Louis Park, MN Fax: [email protected] Appeals may be submitted to the Committee by fax, or mail. Along with the appeal, the student will be required to provide a detailed Goal Statement explaining (1) the reason for the appeal (for example, the death of a relative, an injury or illness of the student, or other special circumstances), (2) any changes the student has made that will allow him or her to be successful, (3) the steps the student will take to meet and maintain acceptable attendance and academic levels if he/she is permitted to restart program, and (4) any additional information the student believes is relevant to the Committee s determination. Each appeal will be decided by the Student Appeals Committee. The factors considered to determine whether a student may restart may include, but are not limited to, (1) the current rate of attendance and academics, (2) the extent of unfulfilled program requirements, (3) the current capacity at the campus and (4) the student s disciplinary record. The Committee reserves the right to deny an appeal to restart following termination, at its sole discretion. The Student Appeals Committee will issue a written decision including any and all conditions on the decision to the student. All decisions of the Student Appeals Committee are final and are documented in the student s electronic file. Restart and Re-Entry after Termination under RAP or SAP A student who restarts at Regency after a termination under RAP or SAP will retain the attendance and academic history from his or his or her previous enrollment at Regency, including, but not limited to, his or her RAP status and SAP status for purposes of determining eligibility for financial aid. Additionally, as noted above, a student restarting after a successful appeal from a SAP termination will restart the program with a SAP status of Probation and must generally regain Minimum Satisfactory Progress levels before the next required SAP evaluation point. He/she will also be subject to the policies in the Student Restarts Section of this catalog. Re-Establishment of Satisfactory Academic Progress Students may re-establish satisfactory academic progress and Title IV aid, as applicable, by meeting minimum attendance and academic requirements by the end of the probationary period. Student Leaves under SAP If a student is placed on an approved leave of absence, he/she will have his or her maximum timeframe for course completion and Enrollment Agreement End Date extended by the same number of calendar days as the approved leave A10

38 of absence. A student returning from an approved leave or other official interruption of training will return to school at the same SAP statuses he/she maintained immediately prior to the leave. Scheduled hours falling within the approved leave time will not count and, therefore, will not affect a student s rate of attendance.
