2 From the Dean Call for Nominations Dear Friends, A letter from the Dean seems superfluous for an issue of the Advocate featuring the Dean. But I will not pass up the occasion to formally greet you as I embark on this new professional adventure. What an exciting time to lead the School of Law! The University s own strategic plan is still quite fresh, and prominently displays its expectation for a mission-driven educational experience with measurable learning outcomes. In its wake arrived the critiques set forth in The Carnegie Foundation s Educating Lawyers and Roy Stuckey s Best Practices in Legal Education, which question whether the standard law school curriculum adequately prepares our students to perform effectively as lawyers. In this Advocate, you will quickly learn that the practice of law is in my DNA. I suspect that my experience in the field weighed heavily in the decision to appoint me as Dean. I welcome the opportunity to leverage my ties within the profession to reinforce the linkage between what we teach at Hamline and what clients expect from our graduates as practicing attorneys. In his five years as Dean, Jon Garon has built a strong foundation. Our improved standing in the U.S. News & World Report rankings is due in large part to Jon s efforts to promote a broader recognition of the teaching and scholarship of our faculty. I congratulate and thank him for his outstanding service to the law school. Although I am still very much in a listen and learn mode, several challenges and opportunities are self-evident. The law school must articulate its own pathway to distinction and revise its strategic plan consistent with the priorities set by the University and the demands of the marketplace. We must respond to the call for curriculum reform. We must continue to enhance our centers of excellence in dispute resolution and health law, and launch our business law institute. We must substantially expand our fund development. Your support as alumni will be crucial to these efforts. I look forward to communicating with you beyond these pages, and to engaging you directly in the exciting work ahead. Meanwhile, as my daughter would say, It s all good. 4 News Alumnus Leo Brisbois 87 Elected to Lead Minnesota State Bar Association Hamline alumnus Leo Brisbois 87 has assumed the office of president-elect for the Minnesota State Bar Association. He will become president of the MSBA in July 2009 and is the first Hamline University School of Law alumnus to achieve this prestigious distinction. He also is the first MSBA president elect of known American Indian heritage. It is definitely an honor and a privilege to serve the profession in such a role, Brisbois recently commented. In addition to his leadership work with MSBA, Brisbois is an attorney with the firm of Stich, Angell, Kreidler & Dodge, P.A. in Minneapolis. With more than 16,000 members, the MSBA is the state s largest and most influential voluntary organization of attorneys. The MSBA provides Leo Brisbois 87 professional support and development opportunities to its members, public service opportunities for lawyers, assists and supports the development of improvements in the legal system and increased access to justice for all citizens. The organization also works with the State Supreme Court on setting high ethical and practice standards for Minnesota lawyers, and works closely with the State Courts to lobby the Minnesota Legislature for adequate funding for the court system, as well as appropriate salaries for court personnel and judges. Professor Bill Martin Named 2008 Professor of the Year Hamline has always been a student-centered law school. To me this means at least being accessible to students. Moreover, it means being academically rigorous and maintaining the high expectations that experience has shown our students can meet. Only by guiding students to reach their full potential will we have served them well, and prepared them to serve society and justice well. ~ Hamline University School of Law Professor Bill Martin #2 Professor Bill Martin received the coveted Professor Bill Martin Professor of the Year award at Hamline University s Student Bar Association s Barrister s Ball this past spring. It is the fourth time he has received the honor. Bill is a real asset to the law school and the university, noted Professor Larry Bakken. He was an advocate for the university s early effort at creating diversity policies. He also brought great credibility to Hamline when he joined the faculty. But, most importantly, he s always been a good teacher. He works hard and he has great respect for students. Professor Martin joined the faculty in 1976 after five years at Dorsey & Whitney, where he specialized in labor law and civil litigation. He is a frequent lecturer in continuing legal education programs in workers compensation and employment law, and currently serves as the commissioner s representative on the Minnesota Rehabilitation Review Panel. He is listed as a neutral arbitrator with the Minnesota Bureau of Mediation Services, is a referee for Hennepin County Conciliation Court, and an arbitrator in labor disputes. He has been on the executive committee of the Labor Law Section of the Association of American Law Schools.
5 Two Distinguished Alumni Honored for Community Service and Outstanding Merit The Alumni Association Board s Communications Committee selected Susan Koberstein 95 and Professor Len Biernat 75 as the Distinguished Alumni Award winners for The Distinguished Alumni Awards were presented by Alumni Association Board (Past) President Don McNeil 89 at the On the Fives Alumni Reunion in October. Susan A. Koberstein 95 Community Service Susan A. Koberstein is an associate attorney at Wilson Law Group, where she practices in the areas of immigration and general civil litigation. Susan handles a wide variety of immigration matters, with a particular focus on detention and removal cases. Susan has significant experience representing clients before the immigration courts, the Board of Immigration Appeals (BIA), the U.S. consulates abroad, and the field, service, and asylum offices of the U.S. Citizenship & Immigration Service. Prior to joining Wilson Law Group, Susan practiced with the law firm of Centro Legal, Inc. from , and with the Minnesota Legal Services Coalition from Susan supervised the Immigration Practice Unit at Centro Legal, where she also practiced in the areas of employment, consumer, housing, and government benefits law. She frequently trains other attorneys on issues of immigration law, particularly on the immigration consequences of criminal activity. Her volunteer commitments have included work with the Minnesota Detention Project, the Volunteer Income Tax Assistance Program (VITA), the Minnehaha United Walk-In Legal Clinic and the United Way. Since beginning private practice in 2008, Susan continues to engage in pro bono legal work, including volunteering for Linea Legal Latina and working with victims of domestic violence through the non-profit Civil Society. Susan is a 1995 graduate of Hamline University School of Law and is an adjunct clinical professor at Hamline, where she has taught the Immigration Clinic since Susan is licensed to practice law in the State of Minnesota and is a member of the American Immigration Lawyers Association (AILA), where she serves as the local chapter s non-profit liaison. Professor Len Biernat 75 Outstanding Merit Professor Biernat who teaches in the areas of family law, professional responsibility, remedies, property, children and the law and education law has contributed to the law school since his days as a law student in the early 1970s. As a former member of the Minnesota House of Representatives, Professor Biernat links the legal curriculum he teaches with actual law making. He is committed to giving students exposure to the impact the law and law-making has on individual lives. He has served as a member of the Supreme Court Task Force on Visitation and Support and as a member of a Task Force on Parental Cooperation. Professor Biernat also served as a member of the Minneapolis Board of Education from Professor Biernat has authored several major bills that have become Minnesota laws. He has served on the ad hoc committee of ABA Model Rules of Professional Conduct and has chaired continuing legal education programs in family law, school law, legal education, and lawyer competency. Professor Biernat is coauthor of Legal Ethics for Management and Their Counsel, published by Lexis Law Publishing, and he wrote a chapter on the federal role in education in Federal Administrative Practice published by West Law Publishing. 3
6 News Three Faculty Members Earn Promotions Hamline University School of Law recently promoted three faculty members Z. Jill Barclift, Mary Jo Hunter and Sharon K. Sandeen all of whom bring superior academic and professional credentials to their positions. Assistant Professor Barclift has been named Associate Professor of Law; Associate Professor Sandeen has been named Professor of Law; and Associate Clinical Professor Hunter has been named a full-time Clinical Professor of Law. for more than 12 years, focusing her practice on trademark and trade secret law and intellectual property litigation. Since joining Hamline, Professor Sandeen has taught a wide variety of intellectual property law courses, including the Intellectual Property Law survey course, Trademark Law, Copyright Law, Computer & Internet Law, Transnational Intellectual Property Law, and Information Privacy Law. A prolific writer, Professor Sandeen recently has focused her scholarship on U.S. and international trade secret law. A native of Northern California, Professor Sandeen earned her JD at the University of the Pacific, McGeorge School of Law, and her LL.M. at the University of California, Berkeley School of Law. 4 Professor Sharon K. Sandeen (left) and Associate Professor Z. Jill Barclift Associate Professor Z. Jill Barclift Professor Barclift focuses in the areas of corporate/ business law, governance, and corporate/legal ethics. She brings more than 15 years of corporate law experience to Hamline, having worked earlier as an attorney for a large financial services firm. In 1996 she relocated to Minnesota to head the legal department of a large retailer, and, more recently, she served as executive vice president and general counsel for a Minneapolis financial services firm. Professor Barclift is a member of the Board of Trustees of the Jeremiah Program, which assists low-income mothers who are striving to become self-sufficient. She received her JD from Columbia University School of Law. Professor Sharon K. Sandeen Professor Sandeen, who has substantial academic and professional experience in intellectual property law, joined the Hamline University School of Law faculty in 2002 as an Associate Professor of Law. Prior to joining the Hamline law faculty, Professor Sandeen practiced law in Sacramento, California Clinical Professor Mary Jo Hunter Professor Hunter has focused her professional and academic efforts in the areas of child advocacy and Native American law, and has been a clinical teacher for 19 years. She was elected the first Chief Justice of the Supreme Court Clinical Professor Mary Jo Hunter of the Ho-Chunk Nation and previously worked for the Neighborhood Justice Center and Southern Minnesota Regional Legal Services in St. Paul. She directed the Native American Law Project clinical program at the University of North Dakota School of Law, where she also taught Indian Law. Professor Hunter is a frequent speaker on culture and cultural diversity issues, and the Indian Child Welfare Act. She received her JD from the UCLA School of Law.
7 New Accredited Health Care Corporate Compliance Certificate Program The Hamline Health Law Institute s new program is one of only four such certified programs in the nation Hamline University School of Law now is accredited by the Compliance Certification Board (CCB) to offer a Health Care Corporate Compliance Certificate education program through its Health Law Institute. Hamline s certificate program is the only one of its kind in the Upper Midwest and one of only four such programs in the nation to be accredited by CCB. The health care compliance profession is growing rapidly. Membership in the Health Care Compliance Association (HCCA), which seeks to champion ethical practice and compliance standards, has grown approximately 10 percent per year in its first 12 years and now includes 5,500 members. In 2008, 21 percent of HCCA member organizations required, and 58 percent preferred, the Certified in Healthcare Compliance (CHC) credential for their assistant compliance officers. CHC certification also was preferred or required in similar percentages for compliance auditors, coders, trainers, generalists and attorneys. As the compliance industry continues to grow, employers are increasingly hiring certified compliance professionals because the certification shows that these professionals have the required commitment and training, said Roy Snell, CEO, Health Care Compliance Association (HCCA) and Society of Corporate Compliance and Ethics (SCCE) Symposium Report Available Hamline s 13-credit program is designed to be completed within one year, with courses offered in the evening, making the program accessible for both working professionals and graduate students. The Health Law Institute designed the certificate program to focus on areas included in the CCB exam. Upon completion of Hamline s certificate program, students will be prepared to pass the exam and become certified health care compliance professionals. As the trend toward requiring business compliance officers accelerates, Hamline s Health Law Institute is in a leadership position to meet this important educational need, said Hamline Health Law Director Lucinda Jesson. Miller at or [email protected]. Why is the American health care system susceptible to conflict at all levels and what are the key components of a system to resolve those conflicts? The Hamline University School of Law Dispute Resolution and Health Law Institutes sponsored a symposium in November 2007 to forge conversation around this question. The symposium brought together health care providers, payors, regulators, recognized patient representatives, attorneys, and experienced conflict resolution professionals for an Intentional Conversation about Conflict Resolution in Health Care. The conversations have culminated in a publication, Guiding Principles for Creation of Dispute Resolution Systems in Health Care, which seeks to promote patient-centered resolution systems. 8 News Two Respected Faculty Members Now Emeritus Professors of Law Professor John Weeks and Professor Michael Scherschligt have retired after more than three decades of service to the Law School. Hamline University has recognized the tremendous commitment provided by both of these two highly regarded professors by naming each an Emeritus Professor of Law. Professor Scherschligt and Professor Weeks, both of whom helped shape the Law School from its earliest days, were lauded during special receptions and dinners this past spring. Professor John Weeks After 35 years of teaching and inspiring Hamline law students, Professor John Weeks has retired. Professor Weeks has been an anchor for the Hamline law curriculum teaching Contract Law and International Law, including courses such as International Business Transactions and International Human Rights. Former Dean Jon Garon called retiring Professor John Weeks a man of few words and great wisdom, recalling how he observed one of Professor Weeks classes when he first came to Hamline. That was the first time in my professional career that I saw the Socratic method really work, Garon noted. For his part, Professor Weeks said he has derived tremendous satisfaction from watching his students achieve great success... It has been quite a journey. I ve been associated with Hamline for more than half my life and it s been wonderful. Professor Bill Martin also provided a warm and moving tribute to Professor Weeks. He said You give your best every day and always are completely honest with students... You drive students to improve themselves and have an infallible sense of whom to push, whom to tease and whom to help along the path of inquiry. Most of all, you always let students know that you respect them. 9 Among Professor Scherschligt s accomplishments was the creation of Hamline s nationally noted Legal Research and Writing program (see related story on page 25). He personally hired Professor Cathy Deal to replace him when he was ready to move on to other challenges at the school. He also helped establish The Journal of Law and Religion. Professor Michael Scherschligt Professor Michael Scherschligt joined Hamline University School of Law in After 32 years of hard work and dedication, he has retired. Before he departed to enjoy more time with his wife, Suzanne, and their five children and seven grandchildren, Hamline alumni, faculty and staff lauded Professor Scherschligt at a special retirement dinner. It was an audacious idea to put together the disciplines of law and religion, noted Professor Failinger. Michael did a lot of the difficult, often boring, work to get the Journal started. He helped give an amazing legacy, not just to Hamline but to the world. He selflessly put aside what he could have done for himself to help others who are now in his debt. The evening was punctuated by laughter, tears, poetry, prayer and a beautiful hymn sung by his children and grandchildren. Visibly moved by the tributes and warm wishes, Professor Scherschligt, who also holds a divinity degree, said, The community that has been fostered here is rare. The number one feeling I have at this moment is thanksgiving and gratitude. This is the day the Lord has made. Let s rejoice in it and be glad. Michael Scherschligt s children and grandchildren surprised him by singing one of his favorite hymns. Professor Peter Thompson waxed poetic about retiring Professor Mike Scherschligt Mike I think that I shall never see a law professor quite like... Mike. He charms his students with his wit which makes it easier to sit... through his class. He likes to sing... and sometimes preach, but his true calling is to teach. Torts, insurance and health law, he teaches all without a flaw. A better friend we have not had. When he retires we will be sad. But Mike will tell us not to fear, after all he left us in the third tier. He spent his time showing us the way, but now he s off with his grandkids to play. He will leave behind good friends and success. Will we miss him? Of course... Yes! 7
10 Focus A trial lawyer for nearly thirty years, Donald Lewis is the co-founder of Minneapolis law firm Halleland Lewis Nilan & Johnson, where he centered his practice on employment litigation and white collar criminal defense. Prior to entering private practice in 1988, Dean Lewis served for six years as an assistant U.S. attorney for the District of Minnesota, working as a federal criminal prosecutor focusing on economic and tax crimes. He also was a trial attorney in the Civil Rights Division for the U.S. Department of Justice. Dean Lewis has served on boards of directors of several nonprofit organizations, and is immediate past chair of AMICUS. He is a fellow of the American College of Trial Lawyers, the American Law Institute, and the American Bar Foundation. Dean Lewis is a co-founder of the Minnesota Association of Black Lawyers and has served on the Board of Governors of the National Bar Association. He has served as an adjunct instructor at Hamline University School of Law since Dean Lewis holds a bachelor s degree in journalism from Northwestern University and a JD from Harvard Law School. Don Lewis Speaks Donald Lewis, the 10th Dean of Hamline University School of Law, spoke with the Advocate about his background, his professional experience and his vision for the law school. An extended version of this interview, along with a recording available for play on MP3 players, is available online at conversations. Q You re a Minnesota native. Would you share something about your earlier years in Minnesota... perhaps a pivotal experience that shaped you? A I grew up in St. Paul, in the Rondo area, and watched I-94 be built in front of my home. In seventh grade I received a scholarship to attend St. Paul Academy. I was one of probably only three or four black students at the school at the time. I think when you talk about a defining moment, that was one because most SPA students were people of means and very privileged. It was a defining moment because I realized that I didn t enjoy the same privileges as everyone else because of my economic circumstances, and I already knew I was different because of my race. Those realizations forced me to focus on doing whatever I could to take advantage of that education and establish myself as someone who deserved recognition and respect. Before it was done, I led my class academically for five of the six years that I went to SPA. So that was a very defining experience growing up. Q Did growing up during the 60s and 70s influence your decision to work in the Civil Rights Division of the Justice Department? A Well, I think my civil rights background I owe to my father. He was very active in the local civil rights movement; he led the state and regional NAACP. He also was one of the early directors of the St. Paul Department of Human Rights. Also, my mother grew up in Arkansas so we traveled often to the South. I do remember that experience vividly, having to take long drives without stopping at hotels. I began to understand that my dad did everything he could to avoid having to expose his children to racist experiences. But I also began to understand what was going on in terms of the racial segregation in the South and it did leave an indelible mark on my experience and it is something I will always carry with me. So I became interested in government service, public service when I was in college and law school. Eventually that interest led to working with the Justice Department when I graduated from law school. 8
11 Spread header Q You have commented that your entire life has been spent navigating through different worlds. What do you mean? A That s a reference not only to the diverse social circles that I ve dealt with but also to the variety of my legal experiences. I have been employed in both the private and public sectors. I spent my first 10 years working for the Department of Justice both in Washington and here in the Twin Cities, when I worked in the U.S. Attorney s office. I ve done both civil and criminal law. I ve practiced in both state and federal courts. I ve represented individuals. I ve represented corporations. I ve represented government clients. My professional and social life has given me the opportunity to reveal myself in different settings with different people. Q Could you talk about your non-profit work, particularly your involvement with AMICUS? A I ve done a fair amount of work in the community and have served on several non-profit boards. I think the AMICUS experience has been the longest and most rewarding. AMICUS basically is a prison outreach program that focuses on pairing volunteers with offenders who happen to be serving sentences in Minnesota correctional facilities. Its program has been expanded to focus on re-entry... what do we do when those inmates are approaching the time when they are going to be released and what do we do to prepare them for that and to train them? I just recently left the AMICUS board after 12 years of service and three years as its board chair. However, I still visit an inmate every month, a gentleman named Carl Wesley, who is serving a sentence for a murder conviction. Carl also happens to be a graduate of the Harvard Graduate School of Education, which is one of the reasons I was paired with him because we shared the experience of being at Cambridge. I used to joke with him years ago that he was probably one of the few Harvard graduates to be serving time in prison. But I think in the post-enron era there are a few more, so he s probably not alone in that. Q You were a trial lawyer for many years. Of all the cases you ve tried, can you think of one that was particularly satisfying to you? A I m most proud of the work we did for the University of Minnesota, where we were handling the investigation of the academic fraud allegations for the men s basketball program. That was a highly visible engagement and it was a challenging one to the extent that I was exposed to a new area of law, which was NCAA compliance. It also was a challenging client with high expectations. I was reporting to Mark Rotenberg, who is general counsel to the University, and Mark Yudof, president of the University at the time. Both of them are accomplished lawyers in their own right. So their challenge was Tell me something I don t already know. It also was a public controversy so there was a great deal of visibility. I look back today with a tremendous amount of pride. That also was in the early existence of the Halleland Lewis law firm, so it did a lot to establish the reputation of what was still a very young law firm at the time. Q You are active in the U.S. Presidential campaign of Senator Barack Obama. Is there a risk that we might lose you to the White House if Senator Obama becomes the next President of the United States? A I ve been asked that several times and I m flattered, but I m not a close FOB... Friend of Barack. I am doing some work on his Minnesota finance committee. I m a supporter of Barack Obama in terms of raising money for him, but I applied for the dean s position with the intent of serving out my term, so I don t think there s a risk of losing me. Q I understand that you re a fan of the movie Jerry Maguire. Why? A It is a favorite movie because its key message, in my judgment, is that you can have professional success and you can still have family and love and community. One doesn t have to come at the price of another. And I tend to gravitate toward that message when I describe how you can achieve success professionally. 9
12 Focus Q Why are you interested in serving as dean at Hamline? A First, it s an exciting time to be leading an American law school. We ve all been reading about the recent focus on some of the central tenets of legal education and a growing demand to bring legal education closer to the actual practice of law. The Carnegie Foundation presented a study late last year regarding the disconnect between legal education and the profession. My alma mater, Harvard Law School, has totally revamped its first year curriculum. think that translates very well. I ve served a number of institutions of higher learning as clients, so I come with some experience in that area. I also hope that my connections with lawyers, with corporations, with the bench and bar will help expand the reach of the law school in the broader, external community. Q What was your first reaction when learning that Hamline had moved into the third tier of the U.S. News & World Report rankings? Were you surprised? 10 So I think it will be exciting to be dean of a law school at this time. I ve always been close to Hamline. I ve taught here as an adjunct and I served on the Law School s board of advisors under Dean Krause a number of years ago. I m also a native of St. Paul and grew up not too far away from the Law School. Q We ve talked a lot about your experience. How do you think your experience will transfer to your new role as dean? A A lot of the skills and experiences that we ve discussed earlier will serve me well here. We ve talked about the breadth of my legal experience, which will serve me well as an educator. I think the fact that I ve been involved in building a law firm that has as its core values innovation and an entrepreneurial client service culture translates well in an environment that is student-centered and focused on expanding its outreach into the profession. Keep in mind that Hamline is a relatively young law school. So I think coming from a law firm that s barely twelve years old to serving a law school that is in its mid-thirties... I A I was very pleased but I was not surprised because this isn t the first time Hamline has risen to the third tier. The law school has been doing some exciting things including its centers of excellence in health law, dispute resolution and its evolving work with the University s business school so Hamline has been getting the attention of the legal community. And peer recognition is a significant piece of the U.S. News rankings so I wasn t surprised. Q Can we expect to move into the second tier under your leadership? A Well, that s certainly an aspirational goal. I don t want to promise doing that during three or five years of being a dean, any more than anyone should make promises about universal health care. But what I would like to do is make sure we re in a position where we don t constantly have to look back to make sure we are at the border line between the third and fourth tiers. I think our goal is to continue to make progress that keeps us comfortably in the third tier but continuing forward momentum to the potential of getting into that
13 Spread header Top 100. It s challenging and aspirational, but I don t think it s impossible. So, my goal is to continue the forward momentum. Q How do you propose continuing the law school s forward momentum? A I think we need to do some strategic planning. I don t forecast a lengthy, time-consuming exercise but I think it s important that we develop a vision and a brand that we can clearly articulate to the external business and legal communities. I think that Hamline The College is a national organization of my peers. Becoming a Fellow is a statement that my peers have judged me as an excellent trial lawyer. Our law firm has a number of core values, one of which is excellence. So I want to foster the value of excellence in the legal education students are receiving at Hamline. But also we are instilling in students the value of excellence, in terms of the service they are expected to provide to their clients when they leave the law school. So if there s anything that I m going to bring over from my experiences with the College, it s that value of excellence. University s graduate business school has done a very good job of that, and I want to make sure that the law school is doing the same. Obviously, our fund development is a critical need. We ve brought on board a major gifts officer and we will expand alumni participation in fundraising so that is going to be an important focus. We will continue to hire exceptional faculty. And I want to make sure we re doing what we need in terms of curriculum reform; that s a focus around the country at law schools, making sure training is being provided to students that matches what s being demanded in the profession. So those are some things I think we need to work on. Q You re a member of the prestigious American College of Trial Lawyers. How do you think that might shape your influence on the curriculum? A When I think about the American College of Trial Lawyers, I think about the value of excellence. Q You mentioned cultivating a culture of philanthropy at Hamline. Would you share your thoughts about that? A Let me mention a couple of things. We talked a little bit earlier about the fact that I ve been doing some fundraising for the Obama campaign. If there s one lesson that comes from that experience, it s the power of the small contribution. In Senator Obama s campaign I think the statistics are something along the order of 90 percent of his contributions coming from small contributors. I think there s also some startling number that 40 percent of his contributions are $25 or less. Obviously, I hope people give more than $25 to the Law School. However, there is such a large untapped resource in terms of the alumni that haven t given at all. We need to focus on reaching those former students, introducing them to the culture of giving, and getting them into the habit of making a gift to the law school really no matter how small so they simply get into the habit of giving. Olgetree, a distinguished scholar on issues of criminal justice, race and the law, and legal education, will offer his insights on the impact of the 2008 presidential election on the struggle for equal rights in America and abroad. The Charles Hamilton Houston Institute for Race and Justice ( is named in honor of the visionary lawyer who spearheaded the litigation in Brown v. Board of Education. Recent Accomplishments at Hamline University School of Law The Law School moved into the third tier in the national rankings in the latest U.S. News & World Report assessment of the nation s best graduate schools and specialty programs in Hamline s Dispute Resolution Institute has been ranked fourth in the nation. This is the eighth consecutive year that the law school s dispute resolution program ranked among the top five alternative dispute programs in the nation. Academic enrollment quality and diversity within the class has remained strong. The July 08 first-time bar passage rate climbed above 93 percent. Improved placement rates reflect that more than 94 percent of students seeking employment secured positions within nine months of graduation. More than half of Hamline s law student body actively participate in volunteer pro bono work while in law school, and many more provide legal services through clinical placements and externships/practica to those in need of legal services. In 2006 the Hamline Health Law Institute was launched, providing programs, training, scholarly research and important coursework in a critical area of our nation s political and economic future. The Law School partnered with Hamline University Graduate School of Liberal Studies to create the JD/MFA in creative writing and the Hamline University Graduate School of Business to launch the JD/MBA joint degree. 14
17 Spread header Associate Dean Carol Swanson Lauded for Hard Work and Dedication Office of Associate Dean of Academic Affairs Now Led by Professor Marie Failinger Associate Dean of Academic Affairs Carol Swanson has decided once again that it is time to turn the reins over to someone else. She did not depart from the role to return to her full-time teaching position on the Hamline faculty without recognition for her hard work, ability to keep the dean s office and the law school running smoothly, and, of course, her trademark humor and warmth. Noted outgoing Dean Jon Garon at the spring senior recognition banquet, Carol is undoubtedly the person most responsible for me still standing here. When anything needs to be done, Carol takes it upon her shoulders to make it happen. Associate Dean Marie Failinger Jon Garon is one of several Law School deans that Professor Swanson has worked with as Associate Dean of Academic Affairs. Her dedication has led many at Hamline to note, Carol has done more than her share. Carol Swanson has worked with several Hamline Law School deans as the Associate Dean of Academic Affairs. She most recently stepped down to return to her full-time faculty position on July 1. Incoming Associate Dean for Academic Affairs Marie Failinger concurred, Carol has really worked her heart out for Hamline Law School. We owe her a great debt of gratitude for extending her service as Associate Dean through some important transitions in the law school s history. The Associate Dean for Academic Affairs works with the faculty and the Registrar on curriculum, course scheduling, student academic issues, adjunct faculty matters, the academic support program and other projects of the dean s office. I hope I can be of some service to the Law School as we look ahead to a greater emphasis on lawyering skills, professionalism and service in our program, added Associate Dean Failinger. Don Lewis Speaks (continued from page 11) The second focus is the need to develop major gifts, which is why getting the major gifts officer on board has been a priority. I m going to rely on the advice of those professionals in terms of developing that strategy. My role as dean as the ambassador and number one advocate of the law school will be accompany the major gifts officer on visits to potential donors. All that being said, a significant and important prerequisite is the strategic planning because we ve got to have a message that allows us to articulate a very clear and concise vision and brand to potential donors that they can support. Q As a co-founder of the Minnesota Association for Black Lawyers, do you see Hamline playing any particular role in addressing diversity issues within the legal community? A I want Hamline to be very aggressive in addressing what I describe as pipeline issues, that is, what we need to do to expand the participation of people of color in the legal profession. I believe we should be addressing the need at the high school level or maybe even earlier than the junior school level. Q Is there anything else that you d like to share with Advocate readers? A They can count on hearing from me in terms of promoting the programs and the good work that we re doing and the need for their support. We need their participation at events that I look forward to holding and, more important, their financial support. We need to build an endowment; we need to expand our resources for our day-to-day work; we need to support our faculty in the efforts they are making towards teaching and scholarship. I m going to try to be very visible and in their face, so to speak. 15

19 Hamline s Legal Research and Writing Program Gains Momentum As any lawyer knows, legal research and writing skills are essential to success. And as any Hamline Law School alumnus knows, Hamline is committed to building the legal research and writing skills of students. Hamline s Legal Research and Writing (LRW) department made a significant leap forward in that regard when the LRW directorship was made a tenure track position last winter. After a national search, Mary Trevor was named the new LRW Director in January. She brings a fierce commitment to strengthening the already strong department. We hope to have an expanded writing curriculum in place in the near future, as well as a website that provides highly interactive resources for students, she recently noted. effective teaching approach with adult learners. Unlike many law school legal writing programs, Hamline does not rely on adjunct faculty. In addition to Trevor, full-time faculty members include Mary Dunnewold, Beth Honetschlager, Ken Swift, Brenda Tofte and Kimberly Holst. Kelly Mickelson, a part-time faculty member, recently joined the department to teach in the weekend program. The large faculty means the program can offer nine weekday sections and two weekend sections. Our emphasis on tutorials and individual contact with students are the cornerstones of our program, says Trevor. Hoida is Deputy General Counsel for Opera Software. Ledbetter is a legal consultant working part-time while he completes his thesis as part of the LL.M. program at the University of Oslo. His duties include reviewing and revising non-disclosure and service agreements, researching legal issues in the field of technology and business, and working with the General Counsel and business officers to ensure that Opera is protected in all business deals and partnerships that the company pursues. My education at Hamline, especially the ADR courses, is a benefit to me in my capacity at Opera, says Ledbetter. Understanding the big picture and vision that a company sets is key in dealing with global business partners. Our main goal is to grow In addition to teaching, Hamline s LRW faculty takes time to hone other skills. All of the weekday program faculty recently attended the Legal Writing Institute Biennial Conference in Indianapolis (some of whom are shown at left), which brings together faculty from around the country to network and learn about current trends in legal research and writing education. LRW department members also are involved in a variety of activities including podcasting, editing, scholarly research, publishing textbooks, teaching topics other than LRW, and coaching young attorneys in the local community. During the past year alone, we enjoyed wonderful bar passage statistics among our graduates, the advent of two new joint degree programs in the JD/MFA and JD/MBA, a tier improvement in U.S. News rankings and, of course, the opportunity to welcome Dean Donald M. Lewis to our Hamline community. We embrace Dean Lewis goal to continue the forward momentum and build on the success we saw during Dean Jon Garon s tenure. You, our alumni, always play a key role in our success and our forward momentum. Your participation as community has been inspiring. I want to thank all of our wonderful alumni who have been so involved in and supportive of our events and outreach efforts this past year. Carrott 80 has been appointed to the 7th District bench by Governor Pawlenty. She will be replacing Honorable John E. Pearson, who has retired. Miggie Cramblit 80 has been named Vice President, General Counsel, and Corporate Secretary of NorthWestern Energy. Thomas Bennett Wilson, III 80 passed away May 19, 2008, just short of his of 62nd birthday. He had a successful civil trial practice and was instrumental in expanding the rights of the elderly, mentally ill and children. In 1986 the Mental Health Association and the State U.S. Veteran Hospital Advocates honored him with the Dwight V. Dixon Award. In 1987 the MN Mental Health Association recognized him with the Outstanding Legal Services to Adolescents award. He was named to Who s Who in American Law in 1991, and MN Law and Politics recognized him as a Super Lawyer in employment, Social Security and elder law in Evelyn Anderson 81 passed away at the age of 89 on January 17, 2008, at the Fairview Seminary Home. She practiced with Peder Hong, and then had a private practice in Red Wing. In 1986 she received the Pro Bono Public Attorney Award. Michael G. Dougherty 81 was re-elected as President of Severson, Sheldon, Dougherty & Molenda, P.A. He also has been elected to the firm s Board of Directors. Paul McKeen 81 has been appointed by United Airlines (UA) as Senior Vice President in Labor Relations. Michael Prairie, Jr. 96 has been the General Counsel of the U.S. operations of Nitto Denko Corporation, a Japanese multi-national company. Nitto Denko has five companies in the United States, with headquarters in California, Wisconsin and Florida. Claudia Saavedra Hoyos 96 passed away on December 13, 2008, at the age of 38, surrounded by her husband Juan and her closest family members and friends. She had been admitted to in-patient hospice care at North Memorial on December 5. Claudia is survived by many family members, including her brother Jorge Saavedra, a 1997 graduate of Hamline University School of Law. Claudia was born in Santiago, Chile, and came to the United States at the age of six.
