4 Home Rule Colorado Even with State preemption of firearms regulation (Co. Rev. Stat ), the Colorado Supreme Court affirmed a trial court ruling which found that state laws expressly preempting firearms regulation unconstitutionally infringed on Denver s home rule authority with respect to ordinances addressing the open carrying of firearms, but not concealed weapon permitting. State v. City and County of Denver, 139 P.3d 635 (Colo. 2006), (3-3 split decision). But see: City of Cleveland v. State, 128 Ohio St. 3d 135 (Ohio 2010) (rejecting a home rule challenge to Ohio s preemption statute). Denver International (DIA) posted sign: It is a FELONY OFFENSE for any person without legal authority to bring a loaded firearm or explosive or incendiary device into the airport or aboard a commercial aircraft. Violators may be sentenced to five years imprisonment a fine of $ or both. Those with a valid permit/license can carry into the airport but not into the sterile areas of the airport. Your valid permit/license is your legal authority. DIA Rules/Regulations states a Permit/License holder can t carry into secure areas of the airport.

6 18 USC 926A Interstate transportation of firearms Notwithstanding any other provision of any law or any rule or regulation of a State or any political subdivision thereof, any person who is not otherwise prohibited by this chapter from transporting, shipping, or receiving a firearm shall be entitled to transport a firearm for any lawful purpose from any place where he may lawfully possess and carry such firearm to any other place where he may lawfully possess and carry such firearm if, during such transportation the firearm is unloaded, and neither the firearm nor any ammunition being transported is readily accessible or is directly accessible from the passenger compartment of such transporting vehicle: Provided, That in the case of a vehicle without a compartment separate from the driver s compartment the firearm or ammunition shall be contained in a locked container other than the glove compartment or console.

11 United States Gun Laws by State State Colorado Permitted Prohibited Relevant Law Co. Rev. Stat ; Co. Const. Art. XX Sec. 6 Notes State preemption of firearms regulation But Denver Home Rule authority allows firearms regulation at airport. In 2006, in a 3-3 split decision, the Colorado Supreme Court affirmed a trial court ruling which found that state laws expressly preempting firearms regulation unconstitutionally infringed on Denver s home rule authority with respect to ordinances addressing the open carrying of firearms and banning assault weapons and Saturday night specials. State v. City and County of Denver, 139 P.3d 635 (Colo. 2006). The court also held, however, that Denver s ordinances addressing juvenile possession of firearms, carrying concealed firearms with a permit in a public park, and concealed weapon permitting were invalid because they conflicted with state law. As a result, local jurisdictions in Colorado may enact ordinances that utilize some, but not all, policy options to reduce gun violence. But see: City of Cleveland v. State, 128 Ohio St. 3d 135 (Ohio 2010) (rejecting a home rule challenge to Ohio s preemption statute).
