13 DOJ s Warning to IBM The expiration of the Decree, after all, does no more than release IBM from a 41-year-old consent decree that has outlived its usefulness. IBM is most assuredly not receiving any exemption from the antitrust laws. If, after the Decree terminates, IBM engages in any anticompetitive activity that would violate the antitrust laws, it would immediately be liable to suit. For example, should IBM engage in anticompetitive tying -- be it to parts or operating systems -- the United States could bring an action for injunctive relief both to stop the illegal conduct and to get other, broader prophylactic relief. Also, IBM would be liable to a host of potential private treble damage actions. - DOJ Consent Decree
14 Everyone is Impacted Just about everyone has used a mainframe computer IBM 1 CONSUMERS indirectly use mainframes everyday for ATM transactions, airline reservations, and other daily transactions. BUSINESSES have trillions of dollars of application and data assets tied up in mainframes today. GOVERNMENTS are some of the biggest users of mainframes for tax, healthcare, and other citizen applications. Mainframes are at the very core of most of the businesses within the nine segments of this country's critical infrastructure. 21 IBM, Linux Playbook and the Cloud In 2000, the Linux operating system was a hot technology, but it had not spread much beyond scientists, researchers and computer programmers. Then I.B.M. declared that it would back Linux with investment, research and marketing, and the technology moved swiftly into the corporate mainstream. The same thing happened with the personal computer in the early 1980s, when I.B.M. endorsed d that upstart technology and entered the market. 23 Principles of an Open Cloud - IBM s Open Cloud Manifesto As cloud computing matures, there are several key principles that must be followed to ensure the cloud is open and delivers the choice, flexibility and agility organizations demand: 1. Cloud providers must work together to ensure that the challenges to cloud adoption (security, integration, portability, interoperability, governance/management, metering/monitoring) are addressed through open collaboration and the appropriate use of standards. 2. Cloud providers must not use their market position to lock customers into their particular platforms and limit their choice of providers. 3. Cloud providers must use and adopt existing standards wherever appropriate. The IT industry has invested heavily in existing standards d and standards d organizations; there is no need to duplicate or reinvent them. 4. When new standards (or adjustments to existing standards) are needed, we must be judicious and pragmatic to avoid creating too many standards. We must ensure that standards promote innovation and do not inhibit it. 5. Any community effort around the open cloud should be driven by customer needs, not merely the technical needs of cloud providers, and should be tested or verified against real customer requirements. 6. Cloud computing standards organizations, advocacy groups, and communities should work together and stay coordinated, making sure that efforts do not conflict or overlap.
