1 TULSA COUNTY CRIMINAL JUSTICE AUTHORITY REQUEST FOR PROPOSALS FOR THE MANAGEMENT OF THE DAVID L. MOSS CRIMINAL JUSTICE CENTER The Tulsa County Criminal Justice Authority, a public trust (the Authority ) is soliciting proposals for the management of The David L. Moss Criminal Justice Center. TEN (10) COPIES OF THE SEALED PROPOSAL MUST BE SUBMITTED NO LATER THAN 4:00 P.M. (CENTRAL STANDARD TIME), February 17,2005, TO: Tulsa County Purchasing Department Attn: Linda R. Webber, Purchasing Director 500 South Denver Tulsa, Oklahoma Affidavit For Filing With Competitive Bid form must have all blank spaces filled in, be signed, notarized and returned with proposal or proposal will not be accepted. Out of State proposers should change State of Oklahoma at the top of the form to indicate state where bidder is located. Proposals will be opened at 10:00 a.m. February 18, 2005 (Central Standard Time) in Room 315, Board of County Commissioners conference room, in the Tulsa County Administration Building with at least one Authority Member in attendance. This will be a posted public meeting and anyone wishing to may attend. Proposals will be evaluated pursuant to evaluation criteria developed by the Authority. All proposers must attend a mandatory pre-proposal conference. Proposals will not be accepted from firms not attending this conference. The pre-proposal conference will be held on the 25 TH day of January, 2005 at 10:00 am in room 119 of the Tulsa County Administration Building, 500 So. Denver Ave, Tulsa, Oklahoma. At that time, a description of the jail operation, a tour of the facility, as well as a question and answer session will be provided. Access to the facility prior to or after the pre-proposers conference will be provided by contacting Linda R. Webber ( , address: lwebber@tulsacounty.org) for scheduling. All questions must be directed in writing to Linda R. Webber. Copies of all questions and responses will be provided to all proposers. 1
2 THE TULSA COUNTY CRIMINAL JUSTICE AUTHORITY IS REQUESTING PROPOSALS FOR THE MANAGEMENT OF THE DAVID L. MOSS CRIMINAL JUSTICE CENTER INTENT: The Tulsa County Criminal Justice Authority (hereafter Authority ) is seeking proposals for the management of Tulsa s direct supervision jail. It is anticipated that the term of the Contract will be for an initial three (3) year term with two (2) additional one year renewal options. However, optional terms may be proposed and will be evaluated by the Authority. GENERAL: The Tulsa County Criminal Justice Authority oversees the management of the facility and the sales tax that funds the operation of the facility. The Authority is composed of the three Tulsa County Commissioners, the Mayor of Tulsa and the Mayors of three outlying towns within Tulsa County. The David L. Moss Criminal Justice Center ( facility ) is a 500,000 sq. ft. podular designed jail with a maximum capacity of 1714 beds. The facility was built and opened in The facility houses pre-trial and sentenced adult males and females under minimum through maximum security. The facility also houses pre-trial juveniles, ages 13 17, charged with serious offenses. The current daily population averages In 2004 there were 30,330 bookings and releases. It must be understood that the facility houses accused persons prior to trial and, in some cases, for short sentence confinement up to one year, thus causing the large number of bookings and releases. The facility was designed to operate as a direct supervision jail. There are a total of 22 housing pods which make up the 1714 total beds. 14 pods are 94 bed general population pods that are currently being utilized as follows: 2 are general population female pods. 10 are general population male pods. 2 are currently vacant. 2 pods are 48 bed closed custody pods currently used for males. 1 pod is a 48 bed closed custody pod currently used for male juveniles. 1 pod is a 28 bed pod located in the medical unit. It is currently used for medical cases and one separate wing of this houses juvenile females. 1 pod is a 16 bed closed custody pod currently used for females. 2
3 3 pods are 70 bed minimum security dormitory style pods. 1 is currently used for minimum security females. 2 are currently vacant. SCOPE: THE SUCCESSFUL PROPOSER WILL BE CONTRACTUALLY REQUIRED TO COMPLY WITH EACH OF THE FOLLOWING REQUIREMENTS: IN YOUR PROPOSAL, DEFINE HOW YOU INTEND TO STAFF AND MEET EACH OF THESE REQUIREMENTS. 1. Provide and manage security and supervision in a direct supervision environment following the recognized principles of direct supervision. Direct Supervision, meaning the overall philosophy of operation which constantly and consistently reinforces good behavior in a podular housing unit design in which the detention officer is stationed in the pod with the inmates for the duration of his/her shift and the basic principles of direct supervision are utilized as are identified by the National Institute of Corrections and the American Correctional Association. 2. Meet minimum Oklahoma State Jail Standards and any other applicable State or Federal laws regarding confinement of inmates. 3. The facility is currently accredited by both N.C.C.H.C. (National Commission on Correctional Health Care) and A.C.A. (American Correctional Association). It will be a requirement of this contract that the operator obtain both accreditations as soon as possible, but no later than eighteen (18) months from service commencement date. 4. Adhere to all current contracts, standards and agreements between the Board of County Commissioners, the Tulsa County Criminal Justice Authority and any other law enforcement agency or governmental entity (i.e. Oklahoma State Department of Corrections, U.S. Marshal, Social Security Administration, City of Tulsa, etc.). 5. Provide and manage facility maintenance and grounds maintenance in accordance with the original recommendations of the Architect. 6. Provide and manage inmate laundry service. 7. Provide replacement inmate clothing and bedding. 8. Provide facility utilities including pest control and trash services. Two years utility history will be provided. 9. Provide facility upkeep and renovation. 3
4 10. Provide all operating supplies (M&O supplies, example janitorial, paper products,etc.). 11. Meet all pre-booking requirements and staffing. 12. Meet all booking requirements and staffing. 13. Provide classification of inmates. The Decision Tree Classification System is currently being utilized. 14. Manage and staff release function. 15. Provide all inmate health services, both in-patient and out-patient. Out-patient also includes providing security and transportation. 16. Provide food service in compliance with ACA regulations. 17. Provide ACA mandated recreation and required staffing. 18. Provide inmate transportation to court and medical appointments. 19. Staff the Court Holding Facility which is located in the Police Courts Building. 20. Provide either access to an attorney or a law library to meet Federal Access to Courts compliance. 21. Provide religious services that meet ACA requirements. 22. Provide access to telephones and voice recordings to authorized agencies. The inmate phone system belongs to the Authority. Revenues go to the Authority. The system is maintained through the Tulsa County MIS Department. The jail operator is trained and provides the recordings to authorized agencies. 23. Provide for inmate and employee drug testing. 24. Maintain inmate records and insure proper data entry. The jail management computer system and related data belongs to the Authority. Software, hardware, maintenance and other related functions are provided by the Tulsa County MIS department. Initial training is provided for using the system. Subsequent employees are trained by the operator. 25. Provide staff for inmate visitation 4
5 26. Provide and maintain an inmate trust accounting system. 27. Provide ACA required academic and vocational training. 28. Provide all inmate hygiene supplies. 29. Provide video court staffing. There are currently two video court rooms within the facility. 30. Provide an inmate property control system. 31. Develop and maintain an inmate disciplinary procedure in compliance with ACA standards. 32. Maintain the Black Creek master control system including keeping the system under a maintenance contract at all times. 33. Staff and manage the Court Holding facility. 34. As part of your proposal, provide a detailed staffing plan including all post assignments with FTE s identified for every position. The management agreement with the current operator will be provided to all proposers upon request. It is anticipated that all the provisions of the current agreement, including but not limited to booking standards, release standards and penalties for negligent releases, will also be mandated for the successful proposer. Upon request, the Authority will provide proposers with a listing of all Authorityowned FF&E and inventory available for facility operations. Proposer will be required to provide the last audited financials showing net worth. The following insurance requirements are currently required of the operator: Please state a cost associated with meeting these requirements as a separate line item on the pricing schedule. 1. Workers Compensation insurance or self funded coverage approved by the Oklahoma Worker s Compensation Board to statutory limits as required by state law. 2. Employers Liability Insurance of not less that One Million Dollars ($1,000,000) bodily injury and One Million Dollars ($1,000,000) bodily injury by disease for each employee, with a Five Million Dollar ($5,000,000) aggregate. 5

Comprehensive Commercial General Liability Insurance, in an amount not less than Five Million Dollars ($5,000,000) for each occurrence with an aggregate of at least Thirty Million Dollars ($30,000,000), including contractual liability endorsement with specific reference to the Contract for civil rights violations, which include claims brought by any persons based in whole or in part on any alleged violation of the United States of the Oklahoma Constitutions, United States or Oklahoma Statutes or regulations, including but not limited to suits brought pursuant to 42 U.S.C. SS1983. The policy shall include coverage for medical and professional liability for employed nurses, doctors, counselors, psychologists and/or social workers, and shall include coverage to protect the Authority against actions by third parties, including, but not limited to, inmates and employees of the Operator, resulting from the Operator s performance of services hereunder. Professionals working under contract with the Operator shall carry insurance in an amount customary for the profession in Tulsa, Oklahoma. 4. Automobile Insurance for automobiles and other vehicular liability in an amount not less that One Million Dollars ($1,000,000) for each occurrence and Five Million Dollars ($5,000,000) in the aggregate. 5. Business Interruption Insurance in the amount of Seven Million Dollars ($7,000,000), the policy for which shall provide for payments thereunder within thirty (30) days of loss and for payment to the Operator, which shall pay, first, for all its costs incurred in carrying out the terms of this Contract and, second, to the Authority for any expenses incurred by it due to the interruption of the operation of the Facility. 6. Fidelity Insurance with limits in the amount of Five Hundred Thousand Dollars ($500,000) per occurrence. The scope of coverage afforded by such insurance shall include, but not be limited to, indemnification to the Authority, the County and all other indemnified parties for losses arising out of the Operator s agent acts or commissions of dishonesty, infidelity and/or lack of integrity. Agents shall be defined as including all employees, agents, officers and directors of the Operator who are involved in, or employed in connection with the performance of the Operator s obligations under this engagement. 7. The Authority shall maintain and pay for fire and property insurance coverage on the Facility and the FF&E. The Authority shall, at its discretion, require a performance bond in the amount of 180 days operating cost to be provided at the time of contract execution. Please state the cost of meeting this requirement as a separate line item on the pricing schedule. 6
7 QUESTIONS: PLEASE ADDRESS THE FOLLOWING IN DETAIL 1. Provide references with contact person and telephone number for local jail facilities that you manage that are similar in size and management style to this facility. Note facilites that are ACA accredited. 2. What is your turnover rate for detention staff? Management? 3. What do you foresee to be your pay scale for Detention staff at our facility? Detail your recruitment standards and qualifications for Detention staff. 4. Describe in detail how you would facilitate a transition if you are selected to manage this facility? 5. Describe your staff training program. 6. Detail how you would indemnify the Authority and Tulsa County from all claims and legal actions against the management of the facility. EVALUATION CRITERIA: The Authority will appoint an evaluation team to review all submitted proposals based on the following evaluation criteria: Experience Factor and Operational Qualifications Ability to Meet Financial Requirements Proposed Cost The evaluation team will make the initial review and possibly establish a short list. Oral interviews may be conducted at the discretion of the Authority. The Authority is expected to make a decision no later than March 18, PRICING SCHEDULE The Authority is requesting that the Proposer provide an all inclusive annual fixed cost for operating the facility with the following pods being utilized to house up to 1175 inmates: 12 pods that are 94 bed general population pods. 3 pods that are 48 bed closed custody pods. 1 pod that is the 28 bed medical pod. 7
8 1 special 16 bed closed custody female pod. 1 pod that is a 70 bed minimum security dormitory style pod. Please list and state approximate costs for all functions that you anticipate will be subcontracted by your company to other providers. Please separate by operational category and give itemized pricing.
