3 Builder News Page 3 Well Underway! Again the time has flown past and we find ourselves looking at summer in the rearview mirror. Projects are in fast pace mode all over the valley as we hurry to get dried in for the winter months. For those of you who were able to make the golf tournament this year, you will know it was one of the best attended tournaments we ve had in recent years. The 1pm tee time didn t seem to slow us down. A fantastic time was had by all! Thank you to everyone who participated with that event. The HBA, together with our local builders, is attempting to bring back some of the events that seemed to bring us together in years past. That being said, you may be someone who s participated in either a habitat house, a play house, or a PAK house. The reason why I mention these prior events is that we re looking for people who d like to get involved with the McKenzie Anderson house project. To learn more about what this is all about, please contact Jerry at our office. The project will be kicking off in October. We re looking for trades people, material suppliers, building materials, and laborers; no help is too big or too small. I d like to make sure to point out our New 2015 Logo. The intent was to create something that would give that at first glance recognition. Our officer team spent some time looking to find just the right logo that would serve a couple different purposes. First, to have a timeless effect that would and could remain with us for several years, yet still be as effective as the first day it was introduced. Second, the team wanted something that related to our industry while being unique to the northwest. Mission accomplished - Great Job to all! In closing I d like to say thank you to everyone who participated in the Builder Appreciation Dinner and for making it a huge success. What a turn out! 5 Builder News Page 5 Oregon Update News from the State Jon Chandler The following article provided courtesy of Bill Kloos. Bill Kloos has been practicing land use law in Eugene since 1981, when the Needed Housing Statute was first enacted. The Home Builders Association of Lane County is a longstanding client of his office. You can find his firm at LUBA s (Oregon Land Use Board of Appeals) opinion in Group B LLC v. City of Corvallis, LUBA No (August 25, 2015), is a real boost for housing developers and builders. LUBA reversed the city s denial of a 10-unit apartment house on a.8 acre subdivision lot. It was the second denial. The lot had a Planned Development overlay zone on it, and the PD criteria included many subjective standards. LUBA reversed the denial meaning that it told the city it could not deny the project. LUBA used the Needed Housing Statute ORS to to reverse. This statute, around since 1981, and tuned up over the years with the help of the OHBA, is intended to help home builders. It has been applied in recent years by LUBA, but this case shows how it has matured into a fine tool for home builders. The statute applies directly to any city decision relating to needed housing. City standards that conflict with the statute may not be applied to deny a project; they fall off the table. Here is the heart of the statute ORS (4) and (6): (4) Except as provided in subsection (6) of this section, a local government may adopt and apply only clear and objective standards, conditions and procedures regulating the development of needed housing on buildable land described in subsection (3) of this section. The standards, conditions and procedures may not have the effect, either in themselves or cumulatively, of discouraging needed housing through unreasonable cost or delay. (6) In addition to an approval process for needed housing based on clear and objective standards, conditions and procedures as provided in subsection (4) of this section, a local government may adopt and apply an alternative approval process for applications and permits for residential development based on approval criteria regulating, in whole or in part, appearance or aesthetics that are not clear and objective if: (a) The applicant retains the option of proceeding under the approval process that meets the requirements of subsection (4) of this section; Cont. on page 6
6 Builder News Page 6 Continued from page 5 So, the statute ensures developers of needed housing will be reviewed only under clear and objective standards and be subject to only clear and objective conditions. Standards are clear and objective if they do not require subjective, value-laden analyses that are designed to balance or mitigate impacts. Thus, a home builder using the statute will know with confidence that they will get an approval at the time she applies, because the city may not apply any maybe or if we feel like it standards. The statute applies to needed housing, but that phrase is a bit misleading. All housing types are needed housing. The key issue is the land involved. The land must be in the residential Buildable Land Inventory (BLI), which is the part of the local plan and lists land to accommodate 20 years growth. So, if your project is on land that is the BLI, you will have a much easier time getting through the city wickets. Here is a list of questions to ask to be sure that you get the benefit of this statute: 1. Can you please let me see a copy of the city s acknowledged residential Buildable Lands Inventory? If the land is in the BLI, then the housing is needed housing. Because the residential BLI is always a supporting document to the comprehensive plan, it likely includes a map and sometimes a description. Most of the BLI land will be vacant or partially vacant land. Some city plans emphasize redevelopment and densification to meet part of their BLI requirements. 2. Does the statute apply to this application? If your land is on the BLI, then the city may only apply clear and objective standards to any decision regulating the development of needed housing. This is a very broad net. It includes big level stuff (like PUD and subdivision and conditional use reviews) all the way down to the micro level stuff (like site improvement and grading permits). 3. Is this standard clear and objective? Sometimes it is a common sense call to make compatibility; height, scale and bulk fits with the surroundings, and the like flunk the test. Numerical standards generally pass. But a numerical standard, such as keep a 20-foot buffer from endangered plant areas flunks if it is not clear where to start measuring. Judgment calls about traffic safety flunk the test. As LUBA found in Group B, if a standard is so ambiguous that it can be interpreted in two ways, then it is not clear and objective. Most cities do not have a separate review track that applies only clear and objective standards, but you get the benefit of the statute anyway because the statute applies directly to the decision. Subsection (6) of the statute allows a city to apply discretionary standards, limited to appearance and aesthetics issues, that a developer can opt into, provided she retains the right to proceed under clear and objective standards. Remind the city when you file your application that you are invoking the statute. Expect some pushback. Some city staff will lean on you to opt into the discretionary tract, saying that will result in a better project, and that you can count on the staff working with you. Be cautious. Remember that the staff is not the ultimate local decision maker on most applications. As always, contact me if you have questions [email protected]
7 Builder News Green Building Howard Asch Seeing Green Page 7 62% of firms building new single-family homes report that they are doing more than 15% of their projects following green principles. By 2018, that percentage will increase to 84% according to McGraw Hill Construction. By green, they mean their houses follow LEED principles, and are not just energy efficient. They predict that by 2018, 84% of firms will be doing at least 15% of their projects with green principles. This may open up new marketing opportunities especially in our state where people tend to be more environmentally conscious. One reason for this trend is that green buildings are seen as being of higher quality. Many pros build with more durable materials under green principles which means the house is likely to hold its value longer. We have become more aware of the importance of indoor air quality. Green builders reduce the use of materials that give off volatile gasses as well as provide ventilation systems that produce reliable and efficient air changes. Many customers will pay more for a house they believe is not likely to make them sick. Of course energy savings is an important part of green building. The building code sets a fairly high standard of efficiency, but many builders try0ng to attract customers who want the health benefits, higher quality and status of green construction will offer houses with greater efficiencies than the code requires. Builders looking to move in the direction of greener houses can find more information from the Green Building Council. Also, locally Energy Trust of Oregon has programs to help design more efficient homes and provides financial incentives to participate in their efforts. Energy Performance Scores, such as those provided by Energy Trust, are a great way to demonstrate how the efficiency of your product exceeds the efficiency of the run-of-the-mill house. Safety David Davidson Federal OSHA has determined that Oregon OSHA s fall protection standard and use of slide guards is not at least as effective as the federal standard. Currently, Oregon OSHA s fall protection rule in the construction standard has a trigger height at 10 feet, while the federal standard is at 6 feet. Additionally, Oregon has a unique provision that recognizes slide guards as a fall protection system. In response, Oregon OSHA is forming a stakeholder group to discuss the implementation, challenges, and fiscal impact of a revised fall protection standard. Michael Wood; Director of Oregon OSHA, says that Oregon OSHA is planning for an updated Fall Protection rule to be adopted by the end of the year. Oregon OSHA hopes to settle this issue with Federal OSHA and have a phase-in with an outreach training initiative that could be up to 2 years before the updated rule would be fully implemented.
