3 1. Introduction The purpose of this Framework Agreement is to aggregate the executive recruitment requirements of all the UK HE and FE Institutions and to provide institutions with an easy to use, EU compliant Framework Agreement to meet their executive recruitment needs. The Framework Agreement is the first collaborative Framework Agreement for the provision of Executive Search Services in the sector and will provide terms and conditions for trading. The performance of each Contractor will be monitored in line with the key performance indicators (KPIs) within the tender document. This Framework Agreement has been tendered by APUC and can be accessed by all Universities, Colleges and affiliated bodies within Scotland. The agreement is also available for use by other UK Higher and Further Education regional purchasing consortia as well as all Higher and Further Education institutions in the UK should they wish to join the agreement at a later date. This would be with the prior agreement of APUC. 2. Benefits of using the Framework Agreement The Framework Agreement offers: Contractors will be held to sector agreed terms and conditions Contractors have demonstrated Most Economically Advantageous Tender (MEAT) Contractors offer a part service option which would allow Institutions to use make additional savings by undertaking some of the process internally Direct Call-Off option on Lot 2, which is ranked to avoid the need for mini-competitions Discounts are available for multiple roles Institutions will pay fixed prices per salary bands All contractors offer a 12 month placement guarantee Travel expenses are contractually controlled in line with the Institutions own policy Some Contractors include personality profiling and psychometric testing within their offer 3. The Structure The Framework Agreement was divided into 2 lots as detailed below: Lot 1 Senior Academic Roles Lot 2 Professional Service Directors 4. The Contractors Contactors were awarded a place on the Framework Agreement after a rigorous tender process which involved a user intelligence group (UIG) of Human Resource and Purchasing professionals from both HE and FE Institutions across the UK, and representatives of APUC Ltd. Submissions were scored to determine the MEAT. Tenderers for Lot 1 were challenged to provide a proven track record in appointments within the sector before they could enter the competition. Submissions were scored on the following aspects: 3
4 Price 35% Including a comparison of fixed fees per designated salary band offered for a full service, part service and additional discounts for multiple roles. Quality 65% Including an assessment of service delivery, Contract and liaisons with APUC & Institutions, Quality Assurance, Continuous improvement and innovation, staffing, business continuity and exit and corporate social responsibility aspects. 6 5. Operation of the Framework Agreement The selection of the Contactor will be made in two ways depending on the type of requirement. Lot 1 Senior Academic Roles If the Institution has a requirement for Senior Academic roles the appointment of the Contractor is by mini-competition. The Institution must invite all 5 contractors in Table 1 to take part in the minicompetition. The job titles applicable for Lot 1 are as follows, and without limitation: Principal/Vice Chancellor Deputy Principal/Deputy Vice Chancellor Senior Vice Chancellor Heads of College Heads of School University Secretary Deans Other Senior Academic Roles Lot 2 Professional Services Directors If the requirement fits into Lot 2, the first ranked supplier should be contacted to ascertain if they can meet an Institution s requirements. If they can, then a call-off contract (typically in the form of a Purchase Order) should be placed with that supplier. APUC Ltd is seeking to appoint up to five (5) Contractors to service this lot. The job titles applicable for Lot 2 are as follows, and without limitation: Finance Director Marketing & Communications Director Estates Director IT Director Human Resource Director Commercial Operations/Procurement Director Communications, Media and Public Relations Director Development and Alumni Relations Director Student Services Director (Registry/Careers service) Deputy Director Other professional service Directors If the first ranked supplier cannot meet the requirement, then the second ranked supplier should be contacted. Only if the first and second ranked suppliers cannot meet a requirement should the third ranked supplier be approached and so on until the fifth supplier. Where the supplier ranked first is unable to meet the specialism required, the demand in whole or part may be moved to the supplier ranked 2nd and so on. 6
7 Where the supplier ranked first has a Conflict of Interest at Call Off defined in Schedule 2, Section as the demand in whole or part may be moved to the supplier ranked second and so on to a maximum of 5 suppliers are listed below. The Contractor must declare a conflict of interest must when appointed to work on a similar assignment simultaneously with another Institution within the UK. The Institution may select an alternative contractor for the assignment if a conflict of interest it declared. Under the terms of the framework, an Institution may also conduct further competition by means of conducting a mini competition between the 5 framework suppliers. A mini competition should only be undertaken if there is a viable reason to believe that a viable return will be made on the time devoted to the competition, for example, an institution is purchasing multiple appointments. Only one or both of these parts (inability to meet the specialism or through a declared conflict of interest) may not be met for the Institutions to move down the ranking of suppliers. 6. Mini-Competition Please see the APUC guidelines (below) on running a mini-competition under a Framework Agreement in order to place a Call Off contract. If an Institution wants to conduct a mini-competition, the opportunity to compete must be offered to all applicable suppliers. The mini-competition must not be issued to suppliers that are not on the Agreement. Microsoft Word - Minicomp guidance leaflet- Final revised pdf The criteria for evaluating mini-competitions will be as follows: Price Quality of service Capacity Response times Interviews/Presentation (at the discretion of the Institution) Ability to understand the needs of the Institution and understand the culture of the organisation The weightings can be refined to suit individual institution requirements but the overall concept of purchasing based on a mix of quality and price ratios should be retained. 7. The Financial Terms Pricing has been determined for this agreement as a fixed fee per the following salary bands: 50,000 99, , , This pricing is available for both full service and part service options. Discounts are available for multiple roles across the salary bands. 7
8 Pricing may be reduced at mini-competition but is capped at the levels offered at the Framework Agreement stage. Payment terms are 30 days from receipt of a valid invoice. Payment for full service options will be made in three stages matching the stages of executive recruitment as follows: Research and production of potential candidates names (long list) Pre-screening and interviewing including psychometric testing (short list) Managing rejects and interviewees through completion 8. Terms and Conditions Please refer to the APUC Standard Terms and Conditions and the Specification detailed on GeM. These are the overarching terms and conditions that govern the framework agreement and any call off contract created through the use of this agreement. Please note that they can only be revised in writing by APUC Ltd and the Framework contractors. 8
