DES Participants are covered by insurance obtained by DSS while undertaking Unpaid Work Experience Placement Activities and several work experience activities purchased from a jobactive provider. The DES provider must obtain insurance for other Participants engaged in other activities. 3
4 Flow Chart Incident Reporting for all Work Experience Activities providers have a responsibility to report any incidents that result in injury or death, or that have the capacity to bring the service into disrepute, to DSS and the insurance broker (if the incident needs to be reported for insurance purposes) within 24 hours of the event occurring for Unpaid Work Experience Placement Activities, or for other Work Experience Activities that have been purchased from a jobactive provider. 4

All capitalised terms have the same meaning as in the Deed. 2. In this document, must means that compliance is mandatory and should means that compliance represents best practice. 3. 6 What a DES provider must do to comply: Who is Responsible: 1. The DES provider Ensure there is appropriate supervision of Work Experience Activities in place and undertake appropriate action with regard to any incident or accident that occurs during a Work Experience Activity Deed Clause References: Clause 52 Clause 92.6 & 92.8 What is Required: It is the DES provider s responsibility to ensure that Personnel and Supervisors act with due care and diligence if there is ever an incident on an Unpaid Work Experience Placement Activity or purchased Work Experience Activity that results in either Participants or members of the public being injured or killed. If a Participant or member of the public sustains an injury during an Unpaid Work Experience Placement Activity or purchased Work Experience Activity, the DES provider should ensure, first and foremost that they and/or their personnel encourage the injured person to seek appropriate medical attention or call emergency services depending on the nature of the incident. Where an incident results in the death of a Participant the Supervisor must call emergency services and try and protect other Participants from unnecessary trauma where possible. References: Code of Practice Service Guarantee 2. The DES provider Report any incidents or accidents that result in injury or death within 24 hours irrespective of whether a thirdparty makes a claim. The DES provider Report any incidents that have the capacity to bring the Services into disrepute within 24 hours irrespective of The DES provider must report to DSS any incidents that occur during Unpaid Work Experience Placement activities and purchased Work Experience Activities, including those that result in accident, injury or death of: any Participant (including where the incident occurs while the Participant is travelling to and from an activity) any Personnel involved in the delivery or supervision of the activity, and members of the general public and should report any incidents that result in accident, injury or death to the Department and the Department s insurance broker within 24 hours. This includes submission of an incident report. Detailed information on the Department s insurance coverage, and how to report an incident is contained in the Insurance Manual. In addition, DES providers must also report any incident that may negatively impact upon the Services or bring the activities into disrepute. The incident report should identify if the incident was caused by an instance of misconduct by a Participant. Misconduct is defined as 6
7 Who is Responsible: whether a third party makes a claim Deed Clause References: Clause References: Code of Practice Service Guarantee What is Required: being something that would normally result in a paid employee being terminated from paid employment. This could include, but is not limited to: theft malicious damage to, or destruction of, property physical aggression or violence threatening or intimidating behaviour verbal abuse sexual harassment, or intoxication. Any misconduct by Participants may require the DES provider to lodge a Participation Report (see the Participant Compliance Guidelines for more information). After reporting the incident to the Department s Account Manager and the Department s insurance broker, the DES provider needs to submit a report of the incident on the form provided in the Department s insurance manual (also refer to the Work Experience Activities for Guidelines), giving full details of the incident as soon as possible, irrespective of whether a claim is being made at the time of the incident or not. A copy of this report also needs to be sent to the Department s Account Manager. Remember to be as specific as possible with all paper work and correspondence. Reports, s or letters that are drafted could also be forwarded to the DES provider s insurer for assessment and evaluation purposes, and they may be admitted as evidence in court later. The DES provider should remember to record any details of incidents or accidents in the Participant Event screen in the Department s IT Systems. The DES provider is also able to report any instances of misconduct or threatening behaviour on the Participant Incident Report Screen, whether or not the incident is associated with a police report. 4. The DES provider Ensure that there are appropriate processes in place for Participants to lodge complaints or report incidents It is important that Participants have access to reporting mechanisms in the event they wish to report an incident, lodge a complaint or provide positive/constructive feedback confidentially. The DES provider needs to ensure that there is an internal, impartial and easily accessible complaints mechanism that can be used by Participants regardless of the nature of the complaint.
