1 The Corporation of the TOWN OF MILTON Report to: Chair & Members of the Administration & Planning Standing Committee From: E. lovio, M.C.I.P., R.P.P., Director of Planning & Development Date: June 18,2007 Report No. PD Subject: Public Meeting and Initial Report - Proposed Temporary Use Amendment to the Zoning By-law , as amended to permit the establishment of a French Catholic elementary school at 263 Britannia Road East, Town of Milton for a 3 year period. RECOMMENDATION: THAT Planning and Development Department Report PD , BE RECEIVED FOR INFORMATION; AND THAT staff be authorized to bring forward a Technical Report with recommendations upon completion of the review process. EXECUTIVE SUMMARY The subject lands comprise the old Percy Merry school property at 263 Britannia Road East. The French Catholic School Board have purchased this property and wish to establish a French Catholic school here for a temporary 3 year period until they can build a new school within Milton. Conclusion and Recommendations: The application is complete pursuant to the requirements of the Planning Act and is being processed accordingly. Staff recommends that, upon completion of the consultation and review process, a Technical Report, including recommendations, be prepared and brought forward for consideration by Council. Surrounding Subject Lands Vacant Land Uses: Zoned Agriculture (Al) with a small area of Greenlands A on its eastern edge. to the south to the west and north to the east Farmlands and a garden centrelnursery Zoned Agricult~~~re (Al) with a belt of Greenlands A running through the lands. Parklands Zoned as Open Space (0s) Open space Zoned as Greenlands Proposal A Temporary Use Amendment to the Zoning By-law , to pern-lit a school use on the subject lands. see Appendix A - Draft By-law

3 The Corporation of the TOWN OF MILTON AP Report IVo.PD Page No. 3 Planning Policy Provincial Policy Statement (PPS) 2005 The application for Zorring By-law amendment is consistent with the following PPS policies: Development should "optimise the use of land, resources and public investment in infrastructure and public service facilities. " Seek to ensure that the necessary "public service facilities are or will be available to meet current and projected needs. " In rural areas development should be "appropriate to the infrastructure which is planned or available...." In rural areas development should be "compatible with the rural landscape and can be sustained by rural service levels. " "The use of existing.....public service facilities should be optimised, wherever feasible, before consideration is given to developing new infrastructure and public service facilities. " Greenbelt Plan (2005) Existing uses that were lawful when the Greenbelt Plan came into effect are permitted. Places to Grow (2006) Err~phasises the need to optimise the use of the existing land supply. Region of Halton Official Plan Envisions a community where educational opportunities are accessible to all sections of society. The lands fall within an Agricultural Rural Area designation in the Regional Official Plan

Town of Milton Official Plan One of the goals is to "...provide a full range of community and cultural facilities including schools which is essential to the achievement of a strong and healthy community. " Objective is to ensure that new community facilities "are planned, located and designed such that they can be adapted readily to alternative and expanding public uses as the community's needs change. " The Town will work with the Boards of Education to ensure that school sites are planned to meet the needs of residents. Encourage the location of schools by parks to allow the sharing of facilities. The land is designated Agricultural Area with an area of Greenlands A on its eastern edge. Existing legally established uses are permitted in the Agricultural Area. Terr~porary use bylaws can be permitted where the proposed use conforms to the Regional Plan, fulfils reasonable planning standards, is compatible with adjacent uses, is appropriate for the size of property in question and has adequate services, such as waste, water and roads. Zoning By-law Agricultural (Al) Zone with an area of Greenlands A (GA) on the eastern edge. Schools are not permitted in these Zones. Site Plan Not required. The building with associated school yard and parking lot currently exists and no new building is

Discussion Circulation of Public Notice: May Circulation of Public Agencies: May Comments Due: June 5,2007 Technical Report: Upon completion of Planning review and evaluation of comments received. Issues Traffic generation & car parking Noise and disturbance to neighbours Impact on farmland and open space character and appearance of surrounding area. Relationship to the Strategic Plan The proposal is consistent with the goal of ensuring educational opportunities are made accessible to all sections of society. There is an existing school on this property, with its associated parking and school yard although the premises have been vacant since the Percy Merry Public School closed approximately 4 years ago. Financial Impact Should the development proceed, no change in the assessed value of the subject lands for property tax purposes is anticipated.

11 Appendix 1 to Report PD THE CORPORATION OF THE TOWN OF MILTON BY-LAW NO Being a by-law of the Town of Milton to amend the Town of Nlilton Comprehensive Zoning By-law 61-85, as amended, and Comprehensive Zoning By-law pursuant to Section 34 of the Planning Act, as amended, in respect of the lands described as Part 6, Concession 7, Trafalgar Township, Town of Milton, 263 Britannia Road East, Milton, (Conseil scolaire de district catholique Centre-Sud, Schedule A, File 2-08/07) WHEREAS Section 39 of the Planning Act, as amended, authorizes Municipal Councils to pass by-laws to permit temporary land uses for specific periods of time; AND WHEREAS the Council of the Corporation of the Town of Nlilton deems it appropriate to amend Comprehensive Zoning By-law 61-85, as amended, and Comprehensive Zoning By-law to allow the proposed use for an additional period of three (3) years; AND WHEREAS the Town of Milton Official Plan provides for the passing of temporary use by-laws; NOW 'THEREFOREthe Municipal Council of the Corporation of the Town of Milton hereby enacts as follows: I.O THAT the Special Provisions Section 23 (3)(k)(i) of Corr~prehensive Zoning Bylaw 61-85, as amended, and Section of Comprehensive Zonirlg By-law are hereby further amended by addition of the following use: School 2.0 THAT, this By-law shall expire three (3) years from the date of its adoption unless the Council of the Corporation of the Town of Milton has granted an extension by amendment to this by-law prior to its expiry. 3.0 This by-law shall come into force on the day of its passing.
