Krantz and Members of Council Linda Leeds, Director, Corporate Services & Treasurer Date: October 05, 2010 Report No. CORS Subject: 2011 Interim by-law for the Monthly Pre-Authorized Tax Payment Program (PTP) RECOMMENDATION: That Council enact by-law no to provide for the collection of year 2011 interim taxes under the Monthly PTP program. REPORT Background The Town offers three separate payment programs. Monthly plan The withdrawals are spread out over a twelve-month period commencing in November (preceding the taxation year) and ending in October of the taxation year, on the last business day of each month. Due date plan The withdrawals occur on each of the four regularly scheduled instalments (February, April, June, and September) Arrears Plan - The withdrawals occur on the first business day of each month for a prearranged payment amount, agreed to by tax staff and the ratepayer. The Municipal Act provides Municipalities with the authority to levy taxes in order to meet their financial obligations Discussion Staff estimate that enrolment levels for the 2011 taxation year will increase to approximately 4,700 for the monthly plan and 1,150 for the due date plan. This combined enrolment total of 5,850 for 2011, accounts for approximately 22% of all

2 Report No.CORS Page No. 2 billable accounts in Milton. Staff anticipate that an additional few hundred accounts will be signed up in time for the final 2011 billing period. Town staff is preparing to initiate the electronic process for the year 2011 monthly PTP participants. As notification to the ratepayer of the withdrawal amounts and their respective due dates are a requirement of the Municipal Act, by-law no , outlining the proposed due dates for the monthly plan is attached for Council s consideration. The interim monthly PTP amounts are calculated by using the 2010 returned assessment value (plus/minus any in-year assessment changes), multiplied by the 2010 final tax rate, divided by 12 months. Interim sample based on 300,000 residential assessment: 300,000 x % / 12 = $ (for each of the first 7 monthly withdrawals November thru May) The final 5 withdrawals will be calculated using the 2011 returned assessment values multiplied by the 2011 final tax rates, less the interim levy. The calculation of the interim Due Date PTP amounts do not take place in November 2010 as these amounts will be determined in January 2011 using the 2011 returned assessment values along with the calculated notional tax rates. Relationship to the Strategic Plan By-law , supports the goal of a responsible, cost effective and accountable local government by ensuring that the service of an alternative tax payment option is delivered in the most cost effective manner and responding to the needs of the community. Financial Impact A year 2011 interim PTP by-law is required so that the Town can meet its financial obligations, and to provide the necessary funding for the other levying bodies.

4 THE CORPORATION OF THE BY-LAW NO Being a by-law to provide for the Levy and the Collection of Interim Taxes subject to an agreement under the Town of Milton Monthly Pre-Authorized Tax Payment program for the year 2011 Interim. WHEREAS it is expedient to provide for the levy and collection of interim taxes for the year 2011 by instalments and to impose penalties on all current levies and interest on all arrears of taxes pursuant to Section 317 of the Municipal Act S.O as amended; AND WHEREAS section 317 of the Municipal Act provides for an interim levy, on the assessment for real property according to the most recently revised assessment roll, of a sum not exceeding 50 percent of the total amount raised for all purposes in the previous year by the levying of tax rates. NOW THEREFORE the Council of The Corporation of the Town of Milton ENACTS as follows: 1. (a) That for the year 2011 interim, there shall be levied and collected a sum calculated using tax rates against the most current available assessment subject to an agreement under the Monthly Town of Milton Pre-Authorized Tax Payment program. (b) (c) (d) The Treasurer is hereby authorized to adjust the interim levy of any property at the request of the property owner if the taxes imposed by this by-law significantly exceed 50% of the taxes paid by the property in 2010, adjusted to annualize any assessment changes incurred during No adjustment made shall reduce the 2011 interim levy to below 50% of the 2010 adjusted tax amount. No adjustment will be made after the Final 2011 taxes for the property have been calculated. That there may be added to the Collector s Roll all or any arrears of charges, fees, costs or other expenses as may be permitted by Provincial legislation and such arrears of charges, fees, costs or other expenses shall be deemed to be taxes, collected as taxes, or collected in the same manner as municipal taxes, or dealt with in such fashion as may be specifically authorized by the applicable statute. That such levies made shall be due and payable as follows: 1

5 Program I 2011 INTERIM- monthly plan November 30, 2010 December 31, 2010 January 31, 2011 February 28, 2011 March 31, 2011 April 29, 2011 May 31, That any instalment or any part of any instalment of rates, taxes and assessments not paid on or before the day prescribed by the respective section of this By-law which sets out payment of such instalments, shall be subject to penalty/interest which shall be added to and collected with rates, taxes and assessments and which shall be a percentage charge of One and One Quarter (1 ¼%) per centum for each calendar month thereafter in which default continues in the year in which the taxes were levied. 3. That the Treasurer is hereby authorized to accept part payment from time to time on account of any taxes due and to give a receipt for such a part payment, provided that acceptance of any such part payment does not affect the collection of any percentage charge imposed in respect of non-payment of any taxes or any class of taxes or of any instalment thereof. 4. That the Treasurer is hereby authorized to mail every tax notice or cause the same to be mailed to the address of the property or directed alternative address of the person taxed.
