Commercial We are experienced in advising about business structures, acquisitions, due diligence and financing. We guide our clients about legislative compliance and office holder fiduciary duties and support them in discharging their workplace health and safety and industrial relations responsibilities. Litigation In all jurisdictions we are skilled in leveraging an early commercial outcome. Our litigation experience encompasses commercial, contracts, employment/industrial relations, motor vehicle property damage, defamation, insurance and superannuation disputes, building and construction, Wills and Estates, personal and corporation insolvency and real property disputes. We are experienced in the successful prosecution of hardship / restricted driver licence applications. This success rate is attributable to the fact we provide our clients with a frank, early assessment of their prospects with such applications. Wills and Estates Most people are motivated by a desire to leave a legacy to their loved ones. It is important that a Will not only accurately reflects that desire, but achieves that outcome. 5 Reichman Lawyers Capability Statement P a g e 5 Recent cases: enforcement of contractual and statutory obligations under the Body Corporate and Community Management Act 1997; enforcement of contractual, property and statutory rights under the Property Agents and Motor Dealers Act 2000; litigation before the Queensland Court of Appeal and the High Court of Australia arising from the Property Agents and Motor Dealers Act 2000; litigation including injunctions resisting attempted enforcement by major banks of mortgages against the family home and security interests over proceeds of sale; prosecuting claims under the Building and Construction Industry Payments Act 2004; resolution of an opposed child care centre development application; recovery of money owing under loan agreements and enforcement of securities; Corporations Act 2001 litigation including winding up applications, recovery of preferential payments and director related transactions; appeal to the District Court of Queensland against the recording of a conviction in the Magistrates Court for dangerous driving; application for a hardship / restricted driver licence by an applicant who had three previous drink driving offences including one while on hardship / restricted driver licence; defence of prosecution arising from a breach of the Electrical Safety Regulations (Qld) 2002 and Electrical Safety Act (Qld) 2002; resolution of a workplace harassment claim which resulted in an employee being found partially liable for the claim, thereby reducing the employer s liability; reinstatement of a company to the Australian Securities and Investments Commission register in circumstances where as a result of the company s initial deregistration its property had vested in the ASIC; defence of prosecution under the Fair Trading Act 1989, resulting in the lowest fine ever being imposed for breaching that Act; negotiation with the Office of Fair trading for the reinstatement of a Crowd Controllers Licence, thereby avoiding the need for a formal QCTA hearing of the application; defence of prosecutions for breach of development conditions and unlawful material environmental harm; defence by a body corporate in response to an adjudication application for the review of contribution levies set at annual general meeting; review of decisions made by WorkCover Queensland to re-assess premiums payable by Employees under the Workers Compensation and Rehabilitation Act 2003.
