7 MINUTES WEST VIRGINIA COUNCIL FOR COMMUNITY AND TECHNICAL COLLEGE EDUCATION August 21, 2013 A meeting of the West Virginia Council for Community and Technical College Education was held on August 21, 2013, beginning at 9:00 a.m. at Town Center Marriott in Charleston, West Virginia. Council members present were: Bill Baker, Robert Brown, Keith Burdette, Kathy D Antoni, John Panza, Clarence Pennington and John Walker. Joining by conference call was Jerry Berry. Council members absent were: Bruce Berry and Steve Roberts. Also in attendance were Chancellor James Skidmore, Council staff, community and technical college presidents, faculty, staff, and guests. Call to Order Chair Brown called the meeting to order and noted that a quorum was present. 1. Resolution Honoring Gregory Smith Mr. Pennington moved the adoption of the following resolution: WHEREAS, Mr. Gregory D. Smith served as a member of the West Virginia Council for Community and Technical College Education from September June 2013; and, WHEREAS, Mr. Smith has served as an energetic, experienced and dedicated ambassador for community and technical college education in West Virginia; and, WHEREAS, Mr. Smith s inquisitive nature added to the breadth and depth of issues presented to the Council; and, WHEREAS, Mr. Smith is highly respected by the Chancellor, members of the West Virginia Council for Community and Technical College Education, and Presidents of the Community and Technical College System of West Virginia. THEREFORE, BE IT RESOLVED, That the West Virginia Council for Community and Technical College Education and the Community and Technical College System of West Virginia expresses appreciation to Mr. Gregory Smith for his service to the citizens of West Virginia and extends best wishes for continued success and much happiness in all future endeavors; and, FURTHER BE IT RESOLVED, That this resolution be inscribed upon the Council and that a copy be delivered to Mr. Smith. 8 2. Resolution Honoring Nelson Robinson Mr. Panza moved the adoption of the following resolution: WHEREAS, Nelson B. Robinson has served with distinction on the West Virginia Council for Community and Technical College Education since April 9, 2002; and WHEREAS, Mr. Robinson provided outstanding leadership while serving as the chair of the Council from June 2004 to June 2008; and WHEREAS, Mr. Robinson gave unselfishly of his personal time for the advancement of community and technical college education in West Virginia; and WHEREAS, Mr. Robinson s contributions to the development of a comprehensive community and technical college system in West Virginia are unparalleled and will never be forgotten; and, WHEREAS, Mr. Robinson provided wisdom and political insight to the Chancellor, college presidents and his colleagues on the Council; and WHEREAS, Mr. Robinson always served as an advocate for what was in the students best interest. THEREFORE, BE IT RESOLVED, That the West Virginia Council for Community and Technical College Education expresses its gratitude to Nelson B. Robinson for his leadership, contributions and service to the State of West Virginia, and for being a champion for community and technical college education and every student that entered our doors. The Council extends its best wishes for happiness in all future endeavors and in retirement if that should occur; and FURTHER BE IT RESOLVED, That this resolution be inscribed upon the minutes of this Council and that a copy be delivered to Mr. Robinson. Mr. Walker seconded the motion. Motion carried. 3. Election of Officers The floor was opened for nominations for the position of Chairman. Robert Brown nominated Clarence Pennington to serve as Chairman. No other nominations were made; therefore, the floor was closed to nominations. A vote was taken. With all in favor, Mr. Pennington was elected as Chairman. The floor was opened for nominations for the position of Vice Chairman. Jerry Berry nominated Robert Brown to serve as Vice Chairman. Approval of Minutes Mr. Brown moved the adoption of minutes from the June 14, 2013, meeting of the West Virginia Council for Community and Technical College Education. Mr. Baker seconded the motion. Motion carried. Finance and Facilities 6. Fiscal year 2015 Budgetary Submission Request General Mr. Baker moved the adoption of the following resolution: RESOLVED, That the West Virginia Council for Community and Technical College Education approves the fiscal year 2015 budget submission request as presented in the agenda. Mr. Panza seconded the motion. Motion carried. 7. Institutional Compact Strategies for Academic Year Mr. Berry moved the adoption of the following resolution: RESOLVED, That the West Virginia Council for Community and Technical College Education approves the institutional compact updates for the academic year. Mr. Walker seconded the motion. Motion carried. 8. Tech Scholars Program Awards Mr. Baker moved the adoption of the following resolution: RESOLVED, That the West Virginia Council for Community and Technical College Education approves Tech Scholars program funding for Eastern WV Community and Technical College in the amount of $10,500 and for WV Northern Community College in the amount of $12,500. Mr. Brown seconded the motion. Motion carried. 3 9

Naming of Advanced Technology Center Mr. Brown moved the adoption of the following resolution: RESOLVED, That the West Virginia Council for Community and Technical College Education approves naming the Advanced Technology Center located in the West Virginia Regional Technology Park in South Charleston, South Central Advanced Technology Center. Mr. Berry seconded the motion. Motion carried. 10. Revisions to Series 40, Equal Opportunity and Affirmative Action Mr. Baker moved the adoption of the following resolution: RESOLVED, That the West Virginia Council for Community and Technical College Education approves the proposed revisions to Series 40, Equal Opportunity and Affirmative Action, for submission to the Secretary of State for a thirty-day public comment period. FURTHER RESOLVED, That staff is instructed to final file the rule with the Secretary of State at the conclusion of the comment period if no substantive comments are received. Mr Panza seconded the motion. Motion carried. 11. Appointment to Compensation Planning and Review Committee Mr. Brown moved the adoption of the following resolution: RESOLVED, That the West Virginia Council for Community and Technical College Education approves the appointment of Leah Taylor to the Compensation Planning and Review Committee. Mr. Burdette seconded the motion. Motion carried. 12. Senate Bill 330 Progress Report Mark Toor, Vice Chancellor for Human Resources, provided an overview of progress toward fulfilling the requirements of Senate Bill 330, comprehensive human resources legislation passed during the 2011 regular legislative session. Specifically, he discussed the ongoing work of Fox Lawson and Associates, the vendor performing the compensation and classification analysis as required by the legislation. 4 10

11 13. Board of Governors A.A.S. Degree Program Report Sarah Tucker, Director of Planning and Research, presented a report on the Board of Governors A.A.S. Degree Program. Dr. Tucker reported that, overall, the System has seen a 43 percent increase in Board of Governors Associate in Applied Science enrollment. 14. Campus Accessibility and Services Offered to Students with Disabilities Rich Donovan, Senior Director of Facilities presented the report Services for Students with Disabilities, which identifies available support services and resources at each campus across the state. Mr. Donovan reported that all community and technical colleges have also complied with the Americans with Disabilities Act. 15. Council and Board Member Training Requirements Chancellor Skidmore reviewed training requirements for Council and institutional boards of governors members as enacted by 18B-1D-9 during the 2009 legislative session. 16. Report on Consolidation of Bridgemont Community and Technical College and Kanawha Valley Community and Technical College Chancellor Skidmore updated the Council on the progress of the laborious process of consolidating Bridgemont Community and Technical College and Kanawha Valley Community and Technical College. The name "BridgeValley Community and Technical College" was selected by the Board of Governors of the new consolidated college. Dr. Jo Harris was officially named as the president for the college and will preside over both Bridgemont CTC and Kanawha Valley CTC until such time as they are officially consolidated and approved by the Higher Learning Commission. President Harris updated the Council further regarding on-campus consolidation details. 17. Executive Session It was noted, for the record, that the Council elected to remain in open session for the following item: Presidential Compensation at Southern WV Community and Technical College Mr. Brown moved the adoption of the following resolution: RESOLVED, That the West Virginia Council for Community and Technical College Education approves contract changes for the president of Southern WV Community and Technical College as proposed by the institutional board of governors. 5 11

WVCCA/WVADE Joint Conference Dr. Doreen Larson, President of Pierpont Community and Technical College provided details on the upcoming WVCCA/WVADE Joint Conference scheduled for October 23-25, 2013, at the Bridgeport Conference Center. 19. Appointment of Ad Hoc Committee for Chancellor's Contract Chairman Pennington appointed a committee to work on providing a recommendation for the upcoming renewal of Chancellor Skidmore's contract. Appointed Council members were: Bill Baker, Jerry Berry and Robert Brown. 20. Department of Education Program Dr. Kathy D'Antoni, Council Member and Associate Superintendent of Schools, addressed the Council regarding an initiative being launched by the Department of Education called Simulated Workplace which is designed to transform career and technical college students into work-ready employees. 13 WV Council for Community and Technical College Education Meeting of October 17, 2013 ITEM: INSTITUTIONS: RECOMMENDED RESOLUTION: STAFF MEMBER: Post-audit Review of Occupational Programs Blue Ridge Community and Technical College, Bridgemont Community and Technical College, Kanawha Valley Community and Technical College, and Southern West Virginia Community and Technical College Resolved, That the West Virginia Council for Community and Technical College Education receives post-audit and follow-up reports for occupational programs at Blue Ridge Community and Technical College, Bridgemont Community and Technical College, Kanawha Valley Community and Technical College, and Southern West Virginia Community and Technical College and recommends that the programs be subject to the recommended actions as noted. Mark Stotler BACKGROUND: Series 11 of the Council for Community and Technical College Education rules, Degree Designation, General Education Requirements, New Program Approval, and Discontinuance of Existing Programs, includes the following provisions: New occupational programs at community and technical colleges may be implemented without approval by the Council. Three years after the date of implementation of the occupational program, the Council will conduct a post-audit review of the program. After completion of the post-audit review, should there be a recommendation for discontinuance of the program, the Chancellor shall make such recommendation to the Council for action. Eight post-audits and six follow-up reports were submitted for review. Follow-up reports are being requested for six of the post-audits. The follow-up report may need to address a single item or a variety of items. The items most identified for attention in a follow-up are summarized below; Viability and necessity based on enrollment and graduation numbers, there are 13

14 questions regarding the need for the program or efforts to enhance viability. Assessment There is limited evidence of a comprehensive assessment plan or use of the assessment results for program improvement. Advisory Committee There is limited evidence that the program advisory committee is actively involved in program development and improvement. All follow-up reports were accepted, With regard to the Forensic Psychology and Investigation program at Southern West Virginia Community and Technical College, a recommendation had been deferred. It is recommended that the program be continued with additional follow-up. Concerns remain about viability. A newly established advisory committee has expressed confidence that viability concerns can be addressed. The post-audit and follow-up reports with accompanying recommendations are summarized on the following table. 14

Students are provided with knowledge and skills for employment in the networking portion of the information technology field. Supports both Cisco and Microsoft applications. Instruction provided primarily by eight adjunct faculty. A follow-up report is requested that provides: a) a comprehensive description of the academic background for all adjunct faculty, b) evidence of advisory committee involvement, and c) evidence of using assessment results for program improvement. In fall 2013, 261 students were unsuccessful in getting admitted into one of the programs. A follow-up report should address the fate of the students who are unsuccessful in gaining admission into the selective and yet do not graduate from this program. In addition the report should address efforts to enhance the program given the number of students enrolled. 15

The college has recommended increased marketing and enhanced faculty training for online delivery. A follow-up report should address the success of these efforts and provide evidence that assessment results are being used for program improvement. Core curriculum requires 45 hours which leaves only 15 hours for general education. Classes are offered later in the day to accommodate students. All students must have a current certification in EMT-B. *Includes graduates from previous technical studies program. 16

17 Post Audit Reviews Post Audit Follow-up Reports Institution: Bridgemont Community and Technical College Program Recommendation CAS Phlebotomy Accept AS Medical Assisting Accept As requested, the curricula for these two programs have been revised to reduce the number of hours required for graduation to (CAS-30.5, AS- 60.5). The half credit is for a software application course regarding the use of touch control method on computer keypads. Institution: Kanawha Valley Community and Technical College Program Recommendation AAS Hospitality Management Accept The follow-up was to address inconsistencies with respect to graduate placement. The program has produced seven graduates in a three year period ( ). Five of the graduates are either employed or continuing their education. It should be noted that the institution s board is closely monitoring program viability. If growth is not achieved, the program may become an option under the AAS in Management. Institution: Southern WV Community and Technical College Program Recommendation CAS - Central Sterile Supply Technician Accept As requested, information has been provided on specific assessment measures and their use in program improvement. In addition, input from the Advisory Committee resulted in the college developing a skill set for currently employed technicians so they could sit for a certification exam. CAS/AAS Forensic Psychology and Investigation Continue with a follow-up report by August 15, 2015 The follow-up responded to concerns regarding assessment, necessity, viability, and the establishment of an advisory committee. The Committee has been established and had its initial meeting in spring The Committee believes it can assist in enhancing viability. While necessity was supported through the identification of potential employers, evidence is still lacking. A follow-up report is requested to address the college s efforts to enhance program viability. AAS Mine Management Accept The follow-up report provides greater detail on the program assessment plan. Details on how assessment results are used for program improvement were limited. Additional information on the use of assessment results will be expected when the program goes through the regular program review process. The curriculum has been revised to require 60 hours for graduates. 17

18 WV Council for Community and Technical College Education Meeting of October 17, 2013 ITEM: Program Review for INSTITUTIONS: RECOMMENDED RESOLUTION: Blue Ridge Community and Technical College, Bridgemont Community and Technical College, Kanawha Valley Community and Technical College, Mountwest Community and Technical College, Pierpont Community and Technical College, Southern West Virginia Community and Technical College, West Virginia Northern Community College, and West Virginia University at Parkersburg. Resolved, That the West Virginia Council for Community and Technical College Education accept the program review actions of the institutional governing boards. Further Resolved, the Council requests followup reports by October 2014 for all programs that exceed the number of hours required for graduation as recommended in Series 11. STAFF MEMBER: Mark Stotler BACKGROUND: In accordance with West Virginia Code and Council Policy Series 10, Policy Regarding Program Review, the institutions through their respective governing boards conducted academic program reviews for and submitted summary reports and actions taken. A summary of the reports is presented in the following table as information to the Council. It should be noted that the recommended actions are those of the institutional governing board. The community colleges reviewed a total of 47 programs during the program review cycle and took the following actions: Twenty-one programs were recommended for continuation at the current level of activity Nine programs were recommended for continuation at the current level of activity with corrective action or follow-up Three programs were identified for further development One program was recommended for suspension 18

19 Three programs were recommended for termination o AAS-Dental Hygiene SWVCTC o AAS-Welding Management WVU-P o AAS-Industrial Maintenance WVU-P Institutions continue to be diligent in their efforts to comply with provisions of Series 11, Degree Designation, General Education Requirements, New Program Approval, and Discontinuance of Existing Programs that states: Associate degrees require a maximum of sixty-credit hours unless otherwise required by accrediting agencies for completion of the degree and the certificate degree requires a maximum of thirty-credit hours for completion unless otherwise required by accrediting agencies. Many reports reflected that programs had undergone curricular revisions to reduce the number of hours requested for graduation. Based on the provisions of Series 11, the recommended resolution calls for follow-up reports for five programs that exceed the number of hours required for graduation. Two institutions Eastern West Virginia Community and Technical College and New River Community and Technical College did not have any scheduled reviews for

Board of Governors Continue at the current level of activity The program advisory committee has recommended more areas of concentration including medical office field and EMS. Marketing for the program has been enhanced as suggested in previous review. The Board of Governors has recommended Blue Ridge Community & an expansion of articulation agreements. A.A.S. Paralegal Studies Continue at the current level of activity Technical College The program is served by an active advisory board. A recent plan of improvement, focusing on assessment and online learning, is being implemented in the current academic year. The college has adopted NOCTI s Pathway Assessment Blueprint in Legal Services as an exit exam. C.A.S./A.A.S. Technical Studies Continue at the current level of activity CAS-2; AAS-13 30/60 Articulation agreements maintained with two employers 1) Hollywood Casino for Gaming and Culinary Arts and Security (new) and 2) Quad Graphics for Printing Technology and Mechatronics (new). A program coordinator is assigned to each employer. The Governing Board has recommended the development of new concentrations. Enrollment is showing an upswing. Bridgemont Community & Technical College Kanawha Valley Community & Technical College A.S. Business and Health Management Continue with corrective action Emphasis areas include Health Care Supervision, Administrative Professional and Medical Office Assistant. The Computer Support Specialist emphasis has been recommended for suspension. The Medical Office Assistant is a holding major for Medical Assisting which is a limited enrollment program. A follow-up report has been requested to address the low graduation rate. A.S. Business Technology Continue with corrective action Emphasis areas include Accounting, Entrepreneurship and Supervision. Entrepreneurship has been endorsed as a statewide model while Supervision has an excellent placement rate. The use of assessment results for program improvement is evident. A follow-up report has been requested to address low graduation rates for Accounting and Entrepreneurship. A.A.S. Finance Continue at the current level of activity CAS-9; AAS-20 30/60 The A.A.S. program has 2+2 arrangements with Marshall and West Virginia State universities, as well as a concentration in Banking. Future plans call for an articulation agreement with the University of Charleston and preparing an application for the Accreditation Council for Business Schools and Programs. The C.A.S. in Banking and Finance primarily serves students pursuing an A.A.S. in another business area. A.A.S. Administrative Professional Technology Continue at the current level of activity A number of corrective actions have been implemented following the last full review. Available concentrations include Executive, Legal, and Medical. Employer feedback led to curriculum revisions. C.A.S./A.A.S. Accounting Continue at the current level of activity CAS-30; AAS-77 30/60 In addition to a general concentration, 2+2 arrangements have been developed with Marshall and West Virginia State universities. An additional articulation agreement is being explored with the University of Charleston. Through encouragement from the advisory committee, the program will pursue the development of an internship course. Program enrolment is healthy. The certificate is offered at no additional cost. Mountwest Community & Technical College A.A.S. Banking and Finance Continue at the current level of activity As was the case in the last review, the program continues to have low enrollment and a low graduation rate. A formalized evaluation process has identified numerous causes for this situation. A plan has been developed to address the identified causes. A.A.S. Paralegal Studies Continue at the current level of activity Since the least review the program site at Institute has been discontinued. While enrollment is healthy, there has been a recent decline. A plan has been developed to address potential causes for the decline. The placement record is strong. 21

Relocation into the new building should have alleviated this concern. Finally, the program continues to work on revamping course objectives. Pierpont Community & Technical College Southern West Virginia Community & Technical College A.A.S. Drafting/Design Engineering Technology Continue at the current level of activity The program has responded to concerns raised by an accreditation team in 2012 regarding graduate placement/tracking, structure of the advisory committee and evidence that assessment results are being used for program improvement. As a result of these actions, curricular revisions have been made. A.A.S. Graphics Technology Continue at the current level of activity The program is in full compliance with all standards for accreditation. The program has undergone significant revision since the last review. There are plans for adding skill set certificates in 3D Graphics by A.A.S. Aviation Maintenance Technology Continue at the current level of activity Due to FAA regulations, the program has a high number of contact hours which results in the high number of credit hours required for graduation. The program is certified by the FAA. In order to meet federal compliance, the program has undergone at least 10 curricular revisions. The program is developing strategies to retain students after they have completed Power Plant or Airframe certifications. A.A.S. Early Childhood Continue at the current level of activity The program flows seamlessly into the bachelor s program at West Virginia University. The program enrolled 831 students during the review period. At least 85 percent of the graduates are employed either full-time or part-time in early childhood jobs. A.A.S. Business Accounting Continue with corrective action The program is recommended to undertake efforts to enhance program viability which has experienced a recent decline. Efforts already underway include 1) the development of skill sets, 2) reduction in the number of hours required for graduation, 3) marketing, and 4) increased availability of web classes. A.A.S. West Virginia Northern Community College A.A.S. Power Plant Technology Continue at the current level of activity 5 64 The program is offered jointly with Kanawha Valley Community and Technical College through its online delivery of technical courses. The college will explore adding a lab component to the program following the completion of mechatronics labs on the Wheeling and Weirton campuses. C.A.S./A.A.S. Paralegal Studies Continue at the current level of activity CAS-20; AAS-34 32/60 Based on input from the accreditation agency and the advising committee, curricular revisions have been made. Additional revisions will be completed within the next two years. The program is currently accredited by the Association for Legal Professionals but has an ultimate goal of being accredited by the American Bar Association. The program has strong community support and an excellent placement rate. C.A.S./A.A.S. Medical Assisting Continue at the current level of activity CAS-129; AAS-51 30/60 The certificate option has an administrative emphasis while the associate program has a clinical emphasis. The associate degree program is nationally accredited and its graduates are eligible to sit for the Certified Medical Assisting credential. Assessment results have led to enhancing the practicum experience by providing more clinical time prior to the practicum. C.A.S. Health Care Continue with corrective action Students interested in a specific health care discipline are assigned to this program until accepted into that specific program. While preparing students for various health programs, the graduation rate for this program is low. Phase out of this program will be considered once a new CAS in Patient Care Technician is implemented. The new program will provide greater opportunities for entry level employment as well as preparation for associate programs. WVU at Parkersburg C.A.S./A.A.S. Welding Technology Continue at the current level of activity CAS-53; AAS-40 31/60 23

Paraprofessional Studies Continue at the current level of activity 51 Many students work on the certificate while enrolled in other programs. CAS graduates can pursue an AAS in Early Childhood Development or a BA in Elementary Education. The WV Department of Education serves as an external reviewer for the program. A.A.S. Multicraft Technology Continue at the current level of activity WVU at Parkersburg (cont d) A program strength is having a nationally known certifying body (NCCER) and the NCCER curriculum. Plans for improvement include developing online content for an online/blended degree. An NCCER instructor will be hired to provide the hands-on component. A.S. Associate of Science Continue at the current level of activity The program provides affordable access to the first two years of a baccalaureate degree. Plans for improvement include the development of a CAS in STEM for career ladder progression. A.A.S. Welding Management Discontinued The program was terminated in 2011 after a review of the curriculum and enrollment numbers indicated it was no longer a viable program under its current format. A.A.S. Industrial Maintenance Discontinued The program was terminated in A CAS program was developed and when combined with a CAS in Electricity and Instrumentation creates the AAS in Multicraft Technology. 24

25 WV Council for Community and Technical College Education Meeting of October 17, 2013 ITEM: INSTITUTION: RECOMMENDED RESOLUTION: Acquisition of Real Property and Improvements West Virginia University at Parkersburg Resolved, That the West Virginia Council for Community and Technical College Education approves acquisition of the old Go-Mart Convenience Store and real property at the intersection of West Virginia Route 47 and Campus Drive for the purchase price of $28,000, pending verification that all environmental hazards have been remediated by the property owner, Go-Mart, Inc., at the owner s expense prior to West Virginia University at Parkersburg taking ownership of the property. Further Resolved, That the West Virginia Council for Community and Technical College authorizes the Chancellor to grant final approval to the acquisition once the verification has been received that all environmental hazards have been remediated by the property owner. Further Resolved, That the West Virginia Council for Community and Technical College Education approves a modification to West Virginia University at Parkersburg s Capital Development Plan to include this property acquisition. STAFF MEMBER: Richard Donovan BACKGROUND: West Virginia University at Parkersburg (WVUP) has an opportunity to purchase the old Go-Mart Convenience Store and real property at the intersection of West Virginia Route 47 and Campus Drive at an attractive price. The property is located at the main campus entrance off Route 47 and contains approximately one-half acre, a 1,600 square foot convenience store with parking and an attached two-story commercial building of approximately 4,800 square feet. One office is currently rented in the two-story building. 25

26 The appraised value of the property and improvements is $480,000. The owner has offered to sell for $28,000. A Phase 2 Environmental Assessment has been completed. The owner has remediated the environmental hazards at its expense and is awaiting a final report and clearance letter from the Environmental Protection Agency. Also, the canopy over the gas pumps has been removed. WVUP is considering using the property as a bookstore, college/foundation alumni space, for workforce development, or general classroom use. The purchase will be paid from general college reserve funds. Since this property is outside the property acquisition boundaries in the approved WVUP Capital Development Plan, the property acquisition must be approved by the Council and the Capital Development Plan amended to include the acquisition. A survey plat follows on the next page. In addition, It is recommended that the Council grant the Chancellor the authority to grant final approval of the property acquisition pending receipt of the Phase 2 Environmental Assessment Report and verification that all environmental hazards have been remediated at the property owner s expense. 26

Mark Toor BACKGROUND: Series 40, Equal Opportunity and Affirmative Action, is the procedural rule that establishes policy relating to equal opportunity and affirmative action. At the August 9, 2013 Council meeting, the updated procedural rule was approved for filing with the Secretary of State for a thirty-day public comment period. Summarized below are the comments received and staff response. No additional changes have been made to the procedural rule and it is recommended that the rule be approved for final filing with the Secretary of State. Comment: A comment was received proposing to add a definition to the term harassment to the rule or to remove that term from the rule altogether. Response: Series 40 is merely the Council s general statement of policy relating to equal employment opportunities and affirmative action. As such, there are no definitions contained within the rule for the terms discrimination, harassment or any other term of art contained within the rule. The de facto application of the general terms of Series 40 is accomplished through the individual institutional non-discrimination and anti-harassment policies, each of which should include appropriate definitions for the well-established terms of art such as discrimination and harassment. No change was made to address this comment. Comment: A comment was received suggesting a change in the Series 40 due date for the submission of institutional Affirmative Action Plans to the Council, presently set at July 1 of each year. The basis of the comment was a desire to use a different plan year that would provide additional preparation time before the submission due date. Response: Since nothing in Series 40 dictates when an institution s plan year must begin, there is no need to alter the due date for the submission of each institution s 31
