1 Terms of Agreement between Medical Experts Online Of 152 Downham Crescent. Prestwich, Manchester M25 0BS. and Dr/Mr Service level agreement The following terms represent part of the terms and conditions which apply to the use of the Medical Experts Online ("MEO") website and service. The full terms and conditions can be found online at Both the terms set out below and those on the website are subject to change in the future as may be necessary. Volume Referrals(lower fee faster payment) 1. Solicitor users of Medical Experts Online send medico-legal instructions and enquiries directly to Medical Experts using the MEOL website. Only experts who agree to be bound by these terms and conditions will receive instructions from solicitors via Medical Expert On Line. 2. Instructions will be sent by solicitors to qualifying experts through the MEOL website and occasionally by Royal Mail post. 3. The expert agrees to accept instructions, along with medical notes and other related materials relevant to the case electronically if needed. 4. Upon receipt of an instruction for an examination or re-examination the expert will arrange an appointment directly with the claimant no later than three days after receipt of the instruction. 5. The examination is to take place within the time period (if any) specified within the solicitor's letter of instruction. 6. Details of the appointment must be sent to the instructing solicitor as well as the client. MEOL does not want to be copied in on appointment details. 7. If the claimant is not contactable and/or if for any reason an appointment has not been arranged, the expert must notify the solicitor directly by , no later than the 4 th working day after receipt of the instruction. 8. The expert must send the report to the solicitor by up loading it to the MEOL website under the relevant case details within two weeks from the date of the appointment (subject to availability of notes and x-rays). 9. All reports should be word processed, in double line spacing and justified on both sides. 10. GP and Orthopaedic Surgeons should use the new MOJ template for their reports INVOICING 1. The expert will be required to upload a copy of his invoice with the solicitor s relevant case reference detailed clearly on it to the MEOL website,. 2. The date on which the experts invoice is received by MEOL will be the date from which the time periods for payment will begin. 3. Experts should make out their invoice to MEOL and not to the relevant solicitor. This is required in order to comply with MEOL's invoicing system. However, the expert

2 confirms that it will be paid direct by the solicitor and will have a claim against that solicitor and not MEOL in respect of any outstanding invoice. 4. The solicitors will receive from MEOL a relevant invoice covering the expert's fees. The solicitors will then pay the expert direct. 5. The expert should charge VAT at the applicable rate if he/she usually charges VAT. Please select one of the fee levels from the following list. The most competitive experts will be ranked higher in search results and they will also be more popular with solicitors. By signing these terms you agree that the amount which will be paid by the solicitors for each report is as follows: Please tick ONE or complete the box Other... If and when the expert is requested to consider medical records, the agreed fee will be: As above plus 20 PREMIUM REFERRALS (higher fee slower payment) Some solicitors have requested extended payment terms and so experts are also invited to agree to the terms below in order to receive more direct instructions through the MEOL website. 1. The expert confirms that it will be paid direct by the solicitor and will have a claim against that solicitor and not MEOL in respect of any outstanding invoice. 9. The solicitors will pay the expert direct. 10. The expert should charge VAT at the applicable rate if he/she usually charges VAT. GP Report Charges GP experts will be able to charge between per each report although we recommend In any event you must agree here to accept a minimum of 195 for the provision of a GP medico-legal report. If and when the expert is requested to consider medical records, the agreed fee will be: As above plus 55 Service Fee to Expert Experts may receive instructions from solicitors using MEOL website either 1. By Post or 2. Through the site Regardless of how the experts receive their instructions the cost to experts for each report delivered by them to Solicitors is 10% of the experts report fee. This fee will be payable quarterly for all reports delivered in a given quarter 30 days after the quarter in which the experts report was uploaded to the site or delivered to the solicitor. Additional payment terms are as follows: 1. The solicitors will pay the expert by cheque or by electronic bank transfer. 2. The solicitors have agreed to pay experts, in any event when the claim settles or within 36 months of the date of invoice which ever is soonest. 3. MEOL shall not be responsible for the conduct of solicitors using the site or any dispute which may arise between experts and solicitors, whether in relation to fees, instructions, the contents of a report or any other matter whatsoever. 4. Solicitors have agreed to pay all experts fees direct to the expert (not to MEOL) and therefore experts must pursue any outstanding debts with the solicitors directly.

4 Other fees Further instructions from the instructing / defendant s solicitors for comment upon other medical reports, opinions, questions of clarification, are outside the terms of this agreement save that the expert must undertake to :- Co-operate as fully as possible on all queries and requests for assistance in the furtherance of the claim. Promptly answer all correspondence received from the solicitor to assist in properly and efficiently pursuing the Claimant's claim. Invoice the instructing solicitor directly by for all work carried outside this agreement. There are no further charges to the experts for them to use the site to communicate with the instructing solicitors within the cases on the site. "Did Not Attend" Fees (DNAs) In the event of a DNA occurring, solicitors using MEO's services have agreed to pay to the expert a DNA fee of 35 (plus VAT), provided that the solicitor goes ahead with the claim and can then reclaim this amount from compensation awarded to the client. In the event the solicitor fails to pursue a claim, the expert must agree to waive any DNA fee. In any event, experts should always ensure clients have confirmed appointments which have been made with them. Please do not hesitate to contact us if you have any questions relating to this Engagement Letter or the services provided by MEO. Finally, in recognition of the value attributable to the introduction of the solicitor to the expert by MEOL, it is agreed that for the period of 2 years from the date of this agreement, the expert will not deal directly with the solicitor in such a way as to circumvent the services provided by Medical Experts Online.
