We are truly honored by your presence and appreciative of your support. Our annual conference is our family reunion, where we come together to reconnect with old friends and look forward to making new ones. This year is no different. The Orlando Committee has worked indefatigably to insure your stay here will be educational, enlightening, and enjoyable. We are excited by the amazing faculty that has been assembled and the diversity of events that have been planned. We are honored and humbled by the number of our Founders and Presidents who will be joining us this week. We are confident this year s conference will be among the best. This year s theme, The NBPA at 30: Examining our Past; Enhancing our Present; Ensuring our Future, promises to engender passionate dialogue concerning a variety of topics. We hope you will participate fully in this dialogue and leave Orlando with a revived spirit of commitment to community. I hope that you will enjoy all the experiences The Sunshine State offers. When it comes to all fun in the sun, Florida is a place not to be missed, as there is always something going on from colorful parades to food to festivals. There are more than 1350 miles of coastline, year round subtropical climate, abundant theme parks, huge shopping malls, fabulous beaches, and wall-to-wall entertainment. I have been deeply honored and privileged to be able to serve as a part of the leadership team of this organization that has had such a rich history. This Year s theme is The NBPA at 30: Examining Our Past; Enhancing Our Present; Ensuring Our Future. Our numbers in the various prosecutors offices represent years of progress, won by the blood, sweat and tears of many who came before us, including the Founders of this wonderful organization. Their sacrifice and solidarity created all that we have today in our organization. It is to keep what we have gained and continue our steady record of increasing our numbers in our local state and Federal prosecutors offices and bettering our communities. Renewing old friendships, making new ones and building a wealth of good memories to cherish for years to come, makes being a member of NBPA a truly fulfilling and satisfying experience for all participants at all levels. 18 SEMINAR DESCRIPTIONS Victim/Witness Interviews- Alcohol Tobacco Firearms Special Agent Michael Dixon Interviewing victims and witnesses, assessing their credibility, presentation, and impression, and taking their statements is an extremely important function and a vital part of the criminal investigation procedure for both the criminal investigator and prosecutor. It can lead directly to the identification, subsequent apprehension and conviction of the guilty offender. Obtaining valid and complete information is one of the most critical skills that any professional working in the criminal justice field can possess. We will define the term victim/witness and how to identify both. We will discuss the differences between a suspect/ defendant interview and a victim/witness interview. The seminar will also cover how to locate your victim and witnesses, how to prepare for the initial contact, what questions should be asked during the initial interview, the importance of follow-up interviews, making a lasting impression on your victim/witness and the importance of communication between the criminal investigator and prosecutor when preparing and conducting the victim/witness interview. This seminar will cover the fundamentals of effective interviewing, including critical communication skills, interpretation skills, and how to effectively relay information. Use of the Polygraph in Investigation- Federal Bureau of Investigations Special Agent Ricardo Enriquez In my presentation I will define polygraph, the role of the polygraph examiner and discuss the various ways the FBI uses the polygraph examinations. The following will be addressed: A proper interview is often the most important and difficult part of an investigation. Effective interviewing skills are required for a successful polygraph examination. How an FBI Polygraph Examiner uses effective interviewing techniques during a polygraph to assist and further the investigation. The importance of preparing for the interview, being an effective listener, and establishing good rapport with the interviewee. Case studies that illustrate these concepts. Computer Forensics: Deleting Does Not Mean What You Think- Detective Charlie Longson, Osceola County Sheriff s Office The session will begin with a very brief overview of what computer forensics is. I will also touch on digital media and file systems. Once this short foundation is laid, I will present facts from three cases that involved recovering evidence which the defendant thought was deleted or destroyed. As I present the facts in each case, I will show the artifacts which were recovered, as well as how they applied to each case. These artifacts will cover META DATA, EXIF DATA, File Slack, carved images, link files, SHA-1 values as well as other areas of interest. This will allow the attendees to not only hear what can be recovered, but see it in real world situations so that it is more relevant. 18

Florida has become a legal battleground as a result of legislation allowing citizens to use deadly force in a broad array of situations. The duty to retreat is eliminated when certain standards have been met. As opposed to the traditional self - defense claim, this law gives a judge the discretion to grant immunity to defendants, ending the trial process; a jury never receives the opportunity to hear the facts and render a verdict. This Stand Your Ground law has been the source of much controversy, and has been interpreted quite widely throughout the state. This presentation will discuss the nuances of this law, and cover the high profile cases that have resulted, including State of Florida vs. George Zimmerman. Role of the Crime Scene Unit- Alina Burroughs This seminar will focus on the role of the crime scene unit and what services can be provided to assist the case. We will also discuss the importance of communication between the crime scene investigator and the prosecution, using a high profile case as an example. We will then briefly cover the types of forensic analyses available, the CSI Effect and also a brief introduction into what information can be gained from interpreting wounds. International Legal Assistance: When the Evidence You Need or the Defendant You Want is in Another Country- Shanna Batten-Aguirre This seminar will explain the processes involved in requesting and obtaining international investigatory or prosecution assistance, including extraditions. Topics to be covered will include (1) understanding bi-lateral and multi-lateral treaty law; (2) determining the types of international legal assistance available to U.S. prosecutors; (3) drafting legal assistance requests; (4) compiling and executing international extradition packages; and (4) working with foreign law enforcement and prosecutorial agencies. Managing a Prosecutor s Office Patricia Smoot This presentation will focus on various considerations senior management can utilize while structuring or restructuring their offices. Topics such as office organization, personal management style and professional development of staff will be discussed. How to Retain Prosecutors of Color- Greg Rhodes This seasoned retired prosecutor worked in two separate US Attorney s offices, as the first black attorney in one office and the only black attorney in the other. He says he stayed out of his own personal stubbornness and made mental notes on why there were not other people of color remaining. Some of these notes and problems concern ethical and moral questions and others are more common sense approaches. He will deliver a common sense approach to retention and recruitment of people of color to our offices. 19

20 SEMINAR DESCRIPTIONS How Prosecutors can use Forensic Psychologists and How to Successfully Cross-Examine Forensic Psychologists: Dr. Michael Brannon, Forensic Psychologist Examining or cross-examining expert witnesses, such as forensic psychologists, presents a range of challenges to lawyers because they must skirt around such sacred issues as doctor-patient relationships, ethical dilemmas, life-threatening information disclosure and the right of the court to know intimate details of a defendant's or litigant's most personal secrets. This advanced workshop for prosecutors will cover a wide range of issues regarding the effective cross-examination of mental health experts. The presenter will provide his perspective as a forensic psychologist who has testified approximately 1500 times in state and federal court regarding the most effective and least effective cross-examination techniques. Other related issues will be discussed such as Malingering, Daubert vs. Frye, the importance of attending to cultural issues in assessment, and the latest volume of the Diagnostic and Statistical Manual (DSM-5). The presenter will attempt to use humor in his examples during the presentation, although he will not accept responsibility for any deficits in Humor Quotient (H.Q.) on the part of the audience (not a diagnosis as of yet in the DSM-5). Cross-Examination of Expert Witnesses- Greg Rhodes Every trial lawyer knows it a case can be won or lost on the cross of your opponent's expert. Most attorneys have the skills for a basic cross-examination, but this seminar provides an additional framework for effective cross-examination of expert witnesses at trial. This presentation will explore and present various ways to prepare and dismantle expert testimony and show that there are various research tools and avenues to bring discrepancies in expert testimony to a jury s attention. It will provide techniques that will hopefully open doors to get at the basis of the expert testimony that most experts try to avoid. A Few Good Prosecutors: The Art and Science of Cross-Examining a Defendant- Attorney April Christine and Ayodele Af Olosunde The art and science of cross-examining a defendant: This workshop will discuss how to prepare, organize, and execute an effective cross-examination of a defendant in a criminal case. 20

21 SEMINAR DESCRIPTIONS Sex Offense and Vulnerable Victims Commissioner Patricia Smoot This presentation will focus on the investigation and prosecution of sex offense cases and will explain why these cases require special attention and special treatment of victims. The discussion will also include techniques on how to deal with child victims, mentally challenged and other vulnerable victims. Public Integrity- Charles Guria This presentation covers the investigation and prosecution of public corruption. It covers basic investigative methods, both proactive and reactive. It discusses topics such as political corruption, judicial corruption, police brutality and perjury by public servants. Additionally, the lecture covers issues that are unique to public corruption cases, such as integrity testing. Finally, the lecture covers trial issues in public corruption cases. Fraud- United States Attorney Kenyen Brown This session will focus on recent criminal fraud trends and will focus on fraud against the government in relation to the federal whistle blower statute, identity theft/tax fraud, identity theft combined with racketeering, BP oil spill fraud claims, and electronic cookie stuffing fraud. Title III Wiretaps-Brooklyn Sawyers In 2001, the Patriot Act was passed to provide new tools to combat terrorism. Chief among these tools is the intelligence gathering method known as wiretapping. The role of wiretapping in the Patriot Act, particularly the constitutionality of this method, includes what criteria must be met to preserve constitutionally protected civil liberties. Wiretapping has had a significant effect as a facet of the Patriot Act on both the personal security and privacy of the American people. This seminar is a primer on Title III wiretaps. 21

22 SEMINAR DESCRIPTIONS The JAG Corps - Fundamentals of Military Justice and Joint Strategies with State and Federal Prosecutors- Panelists: CDR Dominic Jones (US Navy), Lt Col Paulette Burton (US Army), CAPT Douglas Duffin (US Marine Corps) Synopsis of Training: I. UCMJ: a. In the first part of the session we will give a brief overview of the Uniform Code of Military Justice (UCMJ) and the procedures in military courts. We will highlight some of the primary differences between military law and civilian law, such as the forum of prosecution, and jury selection. II. Jurisdiction: a. Military bases are made up of various types of jurisdiction: exclusive, concurrent, and proprietary. We will discuss these different types of jurisdiction. Why is this important? You may have a case where your law enforcement agency needs to gain access to a military base to investigate, conduct a search and seizure, or arrest a suspect. The type of jurisdiction for that base will affect your ease of access to the base. b. What happens when a service member commits a crime in your city and both the DA and the military have jurisdiction over the defendant? Who should prosecute? This decision should not be made in haste; rather the DA and the JAG Commanding Officer should discuss strategy to determine the best forum for the case. We will discuss why this is important and various factors that may cause problems for the prosecution of such a case. III. Service member Defendant/Witness: a. After discussions between the DA and JAG Commanding Officer, it has been decided that the case should be prosecuted by the DA. Now what? How do you locate the defendant? How do you get in touch with his chain of command to get information about the defendant and possible witnesses in the command? What if the member is deployed, how do you get him back to the US to prosecute him? What if the defense attorney claims the member will be kicked out of the military if he accepts certain provisions in a plea agreement, how can you verify this information is true? The JAG Corps attorneys can help you with these issues. b. JAG Corps attorneys can also be of assistance if your witness in a case is a service member. How do you locate the member? How do you get in touch with his/her chain of command to arrange their personal appearance at trial? IV. JAG and DA s working together a. Ultimately the JAG Corps wants to build a partnership with the District Attorneys across the country to share resources and make our prosecutions more effective. We would like to discuss certain problems attorneys have encountered with service members in the past and how working together will help us resolve these problems in the future. 22

23 SEMINAR DESCRIPTIONS Transitioning from Local/State practice to Federal practice- Kelly Harris, Keith Cave, Winifred Acosta Nesmith Hear what current and former Federal prosecutors have to say about their route from local and state prosecutor s offices to the coveted United States Attorney s Offices and beyond. The panel discussion will target city, county and state prosecutors who desire a move to federal criminal practice. Each attorney began their careers as local prosecutors, and later moved to work in the United States Attorney s Office or in Federal agency practice. The panel will discuss such issues as preparing yourself professionally for the move, in terms of the type of experience, professional contacts, and other ways to prepare for moving into federal practice. They will discuss preparing financially for the move, the security clearance process, and other factors that will be examined by federal agencies in the hiring process. This is intended to be an informal question and answer session with attendees. Securing an Adjunct or a Full-Time Teaching Position- Associate Dean Darryll K. Jones and Associate Professor Phyllis Smith, FAMU College of Law This panel will discuss and explore the ways and means of securing a position as an adjunct or full time professor. A FAMU Associate Dean and a Professor of Law will discuss what you should do now if your long term goal is to share your knowledge, experience, training and expertise with up and coming future attorneys. The panel will discuss the importance of transforming your work product into a scholarly article, building relationships with faculty and administrators at the law school of your choice, and then performing well in the classroom once you secure your position as an adjunct. The panel will also discuss the need to avoid getting pigeon-holed as a career adjunct if your goal is to become a full time professor, as well as ways to become the go-to adjunct if your goal is to remain in practice with one foot in the academic word. Questions are welcome. Opening Statements- Shareema Gadson Shaw What will I say? How can I get their attention. Is an opening statement a roadmap? If you have these thought when you think about your opening statement then this is the workshop for you. 24 SEMINAR DESCRIPTIONS Domestic Violence Homicide Prevention: A Collaborative Approach Linda Major This workshop will feature a promising homicide reduction initiative in Indianapolis, Indiana that involves a network of over 10 law enforcement and community agencies. Indianapolis Baker One Initiative was designed and implemented by police and prosecutors as a comprehensive community approach to address domestic violence in Indianapolis, IN. This workshop presenter was a founding member of this initiative and will discuss: collaborating toward ending both domestic-related homicide and escalating assault; recognizing lethality; tools for combating escalating violence and domestic-related homicide; the strategic plan; who should be included at the table; implementation lessons; sharing growing pains; measuring success; and communicating success proactively to media and your constituents. The presenter will also illustrate the collaborative success of the initiative by tracking the progress of a Baker One offender and victim through the criminal justice system process. This Term at the Supreme Court: A review of this Term s decisions and how they affect our practice as prosecutors- Lisette M. Reid, Assistant United States Attorney, Appellate Division, Southern District of Florida We will discuss compelling search and seizure questions like: how close can that drugsniffing dog get to the front porch; do I need to offer Fido s field-performance records to establish probable cause; can we draw blood without a warrant; and can we routinely swabs arrestees for their DNA. We will also discuss ceilings and floors - mandatory minimums and statutory maximums -, how to take the Fifth, aggravated felonies, crimes of violence and more. Murder for Hire - Charles Guria, Chief of the Kings County District Attorneys Office's Civil Rights and Police Integrity Unit The first portion of the lecture covers investigations and prosecution of past completed murders for hire and the methods used to uncover them. The second portion of the lecture examines pro-active conspiracy to commit murder plots and the role the prosecutor plays in investigation and prosecuting those cases. The presentation includes examples of murder for hire cases, helpful investigative tools, sample indictments, and an examination of common legal issues and defenses at trial. 24

25 SEMINAR DESCRIPTIONS Prosecuting the Stalking Case: A Collaborative Effort Linda Major Law enforcement, prosecutors, advocates and survivors play an essential role both individually and collaboratively toward the goals of offender accountability and victim safety where stalking cases are concerned. This workshop will address the particulars involved in working together to encourage the successful investigation, filing and prosecution of a stalking case. Participants will receive statutory examples defining stalking and insight as to challenges associated with some of those definitions. Participants will also receive instruction and practical advice on proving the elements of a stalking case. This workshop will walk the participant through the various stages of a stalking case from investigation through trial, covering topics such as: the decision to charge and what to charge, safety planning, bond review, the importance of context and 404(b) evidence, managing depositions, defense tactics, limiting motions and more. Cyber-Stalking- A. Jason Saliba With the increased use by defendants of 21st century technology, prosecutors and law enforcement personnel are facing more complex challenges with investigation, trial preparation, motions practice, admissibility concerns and trial presentation of this complex evidence. The faculty member will overview a variety of forms of 21st century evidentiary challenges presented with the defendant who engages technology to further his criminal actions. Some topics which may be discussed include: various computer programs such as adware or spyware why and how stalkers use this; how spyware can get on your computer; charges available for defendants who utilize spyware in this manner installing an eavesdropping device or using the computer to commit a crime. Other questions which should be addressed include: Are charges of cyber stalking available? What should you be looking at on their computer to discover this evidence? How can you do it? Can you complete any functions remotely? What are the hardware devices keystroke logging which allow defendants access to passwords? What tips offer protections? What about GPS? How can you ping? How does this assist investigators/victims? Ex-Offender Re-Entry- United States Attorney Kenyen Brown Out of a necessity to find resources that would be helpful to ex-offenders more generally, I designed a program that has the potential of impacting a multitude of state and federal ex-offenders. Historically, Federal District Court and the Federal Probation Office in the Southern District of Alabama have not been supportive of any re-entry effort that would include a court administered re-entry program or any substantial participation by either entity. In this seminar I will detail the re-entry strategy and activities in which I have engaged. 25

26 SEMINAR DESCRIPTIONS Prosecutors as Leaders, Catalysts and Citizens: Making the Case Beyond the Courtroom-Executive Assistant U.S. Attorney Marcus Christian Restorative Justice- Kathleen Bankhead Restorative Justice: Traditional Justice for Modern Prosecutors will explore the Philosophy of Restorative Justice (RJ), including its ancient origins and modern resurrection. The discussion will focus on RJ as an alternative and complimentary philosophy for addressing conflict and crime through the peacemaking circle practice. Ethics and Professionalism- Phyllis Smith and Nicola Boothe-Perry, Associate Professors, FAMU College of Law The Rules of Professional Responsibility mandate the minimum standards of ethical behavior required of all attorneys. They however do not define the criteria for ethical behavior nor do they provide any guidance regarding what professionalism means for the legal community. Former Chief Justice Harold Clarke of the Georgia Supreme Court provided a basic distinction between ethics and professionalism. He stated that "... ethics is a minimum standard which is required of all lawyers while professionalism is a higher standard expected of all lawyers." The CLE will involve audience participation. The CLE, entitled Are You Smarter than a Law Student? is modeled after Are You Smarter than a Fifth Grader. Volunteer audience members will be asked to participate as contestants where they will attempt to answer a series of questions focused on ethics. Contestants will be able to use lifelines in the form of audience assistance or assistance from a law student. This CLE will also explore the differences between ethical behavior and professional behavior ( professionalism ), with a particular focus on frequent unethical and unprofessional behavior noted with criminal prosecutors and defense counsel. During the last few minutes of the CLE the presenters will discuss typical ethical and professionalism pitfalls, and reiterate the importance of identifying and preventing violations. Running a Positive Campaign- Los Angeles District Attorney Jackie Lacey A behind the scenes look as a Prosecutor becomes an elected official. 26

28 WHAT IS THE NBPA? The National Black Prosecutors Association (NBPA) is the only professional membership organization dedicated to the advancement of blacks as prosecutors. Founded in 1983, the Association s membership is comprised of over 800 prosecutors nationwide, and in Canada. It includes both chief and line prosecutors from local, state, and federal offices. In addition to prosecutors, the association s membership includes law students, former prosecutors, and law enforcement personnel. NBPA is emerging as the international association of black law enforcement professionals with a reputation for providing education and leadership in the legal profession through its intensive training sessions and multi-disciplined networking. MISSION AND GOAL OF THE NBPA The mission of the National Black Prosecutors Association is reflected in the organization s commitment of the recruitment of Black attorneys within the prosecutorial arm of the legal profession. It is also to ensure not only retention of Blacks in prosecution, but also to correct the dramatic inequality that exists with Black representation in the executive ranks of prosecutor s offices. A further goal is to recruit, train, and mentor younger aspiring lawyers for leadership roles in the years ahead. NBPA s mission is realized through the following important goals: To serve as a catalyst for interdisciplinary communication, innovative training, professional development and camaraderie among blacks choosing careers in law enforcement. To provide intensive training, both academic and practical, accommodating the wide variety of specializations within the membership. To seek out and support young people interested in public service by providing realistic exposure to the prosecutor s role as a vital members of the community. To create a pool of legal scholars to provide and conduct symposiums on topics that are contemporary, germane, and on the cutting edge of the legal profession. To create forums, both national and regional, which involve subjects that impact directly the needs and concerns of the black community. To develop an international information network relevant to the needs of black law enforcement personnel. To promote, strengthen and support the roles of blacks in all aspects of law enforcement. 28

29 A LOOK BACK AT NBPA HISTORY By the Honorable Norman S. Early Jr. (November 2001) IIn late 1981 or early 1982, Norman S. Early Jr., then the Chief Deputy in the Denver District Attorney's Office, was contacted by the East Coast Chapter of the NAACP requesting his participation on a panel. Norm responded that he knew he was being solicited for only two reasons - they needed a prosecutor as some fodder and because he was "Black." He suggested they contact a Black prosecutor from the East Coast. The NAACP opined that was their preference, and requested the name of one. Norm had to embarrassingly acknowledge that he knew not one single name or position of a Black prosecutor outside his home state of Colorado. And although he had attended many NDAA events, Norm had not encountered many prosecutors of color. Two non African-American prosecutors were instrumental in the formation of the NBPA. One was the Chicago States Attorney (now Mayor) Richard Daley. The other was Norm's Denver District Attorney predecessor and mentor Dale Tooley. Norm strolled into DA Tooley's office and told Tooley of his consternation in not being able to network with fellow African-American prosecutors around the United States. DA Tooley suggested that Norm call the largest offices in the states and counties with the largest Black populations, and request that the receptionist transfer him to a Black lawyer. If he met with any resistance, he was to tell them he was the Chief Deputy in the Denver DA's Office and was compiling a reference list to be used in instances where Black prosecutors were requested to make presentations. If necessary, Norm's ace in the hole was the NAACP conversation. When Norm inquired if he was expected to do this on public time, using a government telephone, the response was that establishing this network was every bit as important as the cases Norm tried and the programs Norm ran. So, Norm got on his government phone, in his government office, on government time, with DA Tooley's blessing, and began the arduous task of calling one office after another. There was greater resistance in some offices than others, but within a few short months a list of over 175 Black prosecutors was compiled, with Chicago, IL, and Florida dominating the list. In fact, Chicago proved to be a most important city for our organization. Years earlier, Norm met Glenn Carr through the now defunct Regional Heber Smith Community Lawyer Fellowship Program, run under the auspices of Howard University Law School, where Glenn was the program director. Glenn was now the Deputy States Attorney in the office of Richard Daley. The day Norm and Glenn reconnected was the day things started taking shape for the formation of a national organization serving Black prosecutors. Sterling Johnson, the then NYC Special Narcotics Prosecutor (now a Federal judge) joined with Norm and Glenn in organizing a meeting of as many Black prosecutors as they could identify and, amongst other things, to discuss the possibility of forming an organization. With that in mind, in August of 1982 a letter was sent to everyone on the list of 175. Of course the intention of forming an organization was intentionally not mentioned in the letter because of some of the reservation and fears that had been expressed by non African-Americans when the initial phone calls were made. Over 100 Black prosecutors gathered in Chicago in 1983, with States Attorney Richard Daley serving as host. It was both eerie and refreshing to see so many people of color who performed the same responsibilities and had the same kinds of concerns regarding recruitment, retention, and respect. Those assembled readily agreed to form an organization. A committee comprised of the late Judge Loretta Hall Morgan, Glenn Carr, Art Hill, Sterling Johnson, and Norm Early commenced their work on formalizing the will of the group. These individuals, who met repeatedly in Chicago to deal with name, incorporation, bylaws, and other communications, are considered to be the Founders of our organization. Those Black prosecutors around the nation who responded to the communications and invitation for membership are the Founding Members of the newly formed National Black Prosecutors Association. In 1984 the NBPA, with Norm as President and Glenn as Vice-President, held the organization's first official meeting (the second actual meeting) in Orlando, Florida. That meeting almost proved to be the death knell of the NBPA before we had even gotten off the ground. With a total of only thirty participants, the organization was unable to meet hotel guarantees without some serious begging and passing of the hat. The most meaningful part of the program was then State's Attorney and soon-to-be mayor of Baltimore, Kurt Schmoke, delivering his well known thoughts on the legalization of drugs. For its next meeting, NBPA returned to the already proven and friendly confines of Chicago. We became financially healthy and - you know what's coming - THE REST IS HISTORY! 29
