The liability of the SELLER and MANUFACTURER, whether express or implied, whether in contract or in tort, arising out of warranties, representations, instructions or defects from any cause shall be limited exclusively to replacing the product, provided the same is proved defective, or refunding the purchase price upon return of the unused product. 6 General Advisory Notes It is the obligation of the building owner to properly maintain the NEW YORK STUCCO Systems and/or components of construction. Such maintenance shall include repair of cracks or mechanical damage to the surface of the NEW YORK STUCCO, periodic recoating of the NEW YORK STUCCO, and maintenance of roofing, flashing (see attached drawings if applicable), sealants around windows, doors and other penetrations through the wall assembly, paint on windows, seals at window cracks and seams, and any other area of water entry or potential water entry through windows or other components of construction, in such a manner that these components remain watertight and leak proof. A maintenance guide for buildings clad with NEW YORK STUCCO is available upon request. NEW YORK STUCCO Systems and/or components are not designed or intended to be able to correct or prevent damage from faulty design or workmanship such as the absence or improper integration of flashing, nor are they designed or intended to correct and/or prevent damage from other defective components of construction that leak into the wall assembly. Flashing should always be integrated with the cladding to direct water to the exterior, not into the wall assembly, particularly at potential leak sources. The design/construction professional must take material compatibility and construction sequencing into account when designing a building exterior. Flashings, windows, roofs, doors and other building penetration and termination locations and adjacent materials should be fully evaluated, properly selected and constructed to prevent water entry into building assemblies. The accumulation of moisture behind NEW YORK STUCCO Systems and/or components can result in building damage. Qualified design and construction professionals should strictly comply with specified procedures for mixing, application and integration to avoid causing or contributing to potential water intrusion problems. Any resulting accumulation of water and moisture in wall assemblies may cause damage to building components including delamination of wall coverings incorporating NEW YORK STUCCO Systems and/or components and deterioration of internal wall components and mold. Defects such as, but not limited to, water intrusion caused by misuse, mishandling, improper storage, improper application, mixing of Formulated Solutions (FS) materials with materials made by others, application of FS's materials to an unapproved substrate, application of FS's materials during inclement weather, improper integration into construction or combination with products of FS or others, improper design or engineering, failure of other components or methods of construction to prevent water intrusion or to follow the applicable building code, or failure to strictly follow FS's specifications and procedures are not warranted under any circumstance. FS shall not be responsible for defects in material, or for damage or injury caused by materials not produced by or sold by FS, even if under FS's name, except as otherwise specifically stated herein. FS shall not be responsible for defects in materials or damage to any materials whatsoever, whether or not produced by FS and whether or not otherwise covered under an approved NEW YORK STUCCO limited warranty, where such defects or damage is caused in whole or in part by applicators of FS's products or any other laborer. Further, FS shall not be responsible for any damage or injury whatsoever caused in whole or in part by acts of God, natural phenomenon or physical abuse such as but not limited to falling objects, projectiles, fire, earthquake, floods, hail, tornadoes, lightning, hurricanes, pests, chemical fumes, vandalism, civil disobedience, war, damage caused by remodeling or renovation, structural movement, insufficient or defective waterproofing between the FS materials and non-fs materials, nor any other damage or injury not solely and directly caused by a manufacturing defect in FS's products as covered under an approved NEW YORK STUCCO limited warranty. Performance of the completed building components into which NEW YORK STUCCO Systems and/or components have been installed should be verified by testing and inspection as appropriate, and executed only by qualified individuals. It is the USER s responsibility and obligation to provide for such inspection and testing.
