1 ORDINANCE NUMBER 3058 AN ORDINANCE AMENDING CHAPTER OF THE MISSOULA MUNICIPAL CODE PERTAINING TO THE CITY'S ADOPTION OF THE UNIFORM PLUMBING CODE ADOPTED BY THE STATE OF MONTANA TO MAINTAIN THE 1991 EDITION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MISSOULA THAT CHAPTER UNIFORM PLUMBING CODE, OF THE MISSOULA MUNICIPAL CODE IS AMENDED AS FOLLOWS: Section Adoption by reference. The city of Missoula hereby adopts and incorporates by reference the Uniform Plumbing Code, 1991 Edition, along with the State of Montana, with the following amendments, which are listed according to their section number: A. Section 30.4(a) - Permit Fees. The fee for each permit shall be as follows: Permit Issuance 1. For issuing each permit * $ For each water heater and/or vent 6.00 *Except for replacement of water heaters. Unit Fee Schedule (in addition to Item 1 above) 1. For each plumbing fixture on one trap or set of fixtures on trap (including water, drainage piping and backflow protection thereof) For each building sewer and each trailer park sewer Rainwater systems - per drain (inside building) For each industrial water waste pre-treatment interceptor, including its trap and vent, excepting kitchen type grease interceptors functioning as fixture traps For each installation, alteration, or repair of water piping and/or water treatment equipment For each repair or alteration of drainage or vent piping, each fixture For each lawn sprinkler system on any one meter including backflow prevention devices therefor For atmospheric-type vacuum breakers 1 to over 5, each For each backflow protection device other than atmospheric type vacuum breakers: 2-inch diameter and smaller 6.00 over 2 inch diameter Other Inspections and Fees 1. Requested plumbing inspection fee (where an inspection is requested for a project which does not have a permit), $45.00, provided such service is not in excess of 1 hour duration, and then $25.00 for each 30 minutes or fractional
2 travel, research and clerical time in preparation of a report Reinspection (provided the $30.00 does not exceed the original permit fee, in which case the original fee will be charged) B. Section 30.4(b) - Plan Review Fees. Delete in its entirety. C. Section 30.4(f). Add new section to read: "No plumbing permit shall be issued for a building or structure, under the jurisdiction of the city, until the building permit has been issued for said building or structure." D. Section 114. Amend by adding the following definitions: "Maintenance Personnel-Are personnel doing maintenance work on the business premises who are on the regular payroll rather than personnel under contract." "Maintenance Work-Includes the stopping of leaks in drains, soil, waste or vent pipe, clearing of stoppages, and repairing of leaks in pipes, valves, or fixtures, when such repairs do not involve or require the replacement or rearrangement of valves, pipes or fixtures." E. Section 203(a) - Use of Copper Tubing. Delete "DWV" and substitute "L". F. Section 203(d) - Exception. Amend to read: "Type M copper tubing may be used for water piping when piping is above ground in, or on, a building." G. Section Board of Appeals. Create a new Section to read: "A board shall be appointed and this board shall act as a Board of Appeals, this board will be the Board of Appeals as created by the Uniform Building Code Section 105; in making a determination of any appeal arising from actions of the building official. Appeals shall be made in writing and the appellant may appeal in person before the Board or be represented by an attorney and may introduce evidence to support his claims. The appellant shall cause to be made, at his own expense, any tests or research required by the Board to substantiate his claims." H. Section 406(a) - Cleanouts. Amend section to read: "(a) Each horizontal drainage pipe shall be provided with a cleanout at its upper terminal and each run of piping, which is more than one hundred (100) feet in total developed length, shall be provided with a cleanout for each fifty (50) feet, or fraction thereof, in length of such piping. Lines six (6) inches and larger in diameter shall be provided with a cleanout for each one hundred (100) feet, or fraction thereof, in length of such piping." I. Section Grade of Horizontal Drainage Piping. Amend the section, starting at line 7 to read: "(2) percent, any such pipe or piping two (2) inches or larger in diameter may have a slope of not less than one-eight (1/8) of an inch per foot or one (1) percent." J. Section 409(a) - Drainage of Fixtures Located Below the Next Upstream Manhole or Below the Main Sewer Level. In line 3, amend by changing, "shall" to "may". K. Section 506(a) and (c) - Vent Termination. In line 2, amend by changing, "six (6) inches" to "twelve (12) inches".
3 "a minimum of two (2) inches in diameter" to "a minimum of three (3) inches in diameter". In line 5, amend by changing, "not less than ten (10) inches" to "not less than twelve (12) inches". M. Section Vertical Wet Venting. Delete the word "Vertical" from the section title and from line 1 in subsections (a) and (b). N. Section 1003(g). Add the following: "Boiler feed lines, in single family dwellings on their own private well, may be protected with a dual check valve with intermediate atmospheric vent when a nontoxic transfer fluid is utilized in the boiler." O. Section 1003(k). Add the following: "Heat exchangers, in single family dwellings on their own private well, which utilize a nontoxic transfer fluid, may be of single wall construction." P. Section 1003(b) - Cross-Connection Control - General Requirements. Delete subsection (b) in its entirety. Q. Section 1004(a) - Materials. Amend to read as follows: "(a) Water pipe and fittings shall be of brass, copper, cast iron, galvanized malleable iron, galvanized wrought iron, galvanized steel, or other approved materials. Asbestos-cement, PB, CPVC, PE, PEX, PEX-AL-PEX, or PVC water pipe manufactured to recognized standards may be used for cold water distribution systems outside a building; provided however, that this same material may extend to a point immediately inside the building when a sleeve for all pipe passing through or under concrete construction and valve are provided at the point of entrance. PB, CPVC, PEX or PEX-AL-PEX water pipe and tubing may be used for hot and cold water distribution systems within a building. All materials used in the water supply system, except valves and similar devices shall be of a like material, except where otherwise approved by the Administrative Authority." R. Section 1008(f) - Installation, Inspection and Testing. Amend by adding a new subsection (f), which reads: "(f) Disinfection - (1) When required by the Administrative Authority having jurisdiction, potable-water systems or any part thereof installed or repaired shall be disinfected in accordance with one of the following methods: --By filling the system or any part thereof with a solution containing 50 parts per million of available chlorine and allowing it to stand for a minimum period of 6 hours --By filling the system or any part thereof with a solution containing 100 parts per million of available chlorine and allowing it to stand for a minimum period of 2 hours --In the case of a potable-water storage tank where it is not possible to disinfect by one of the above methods, the entire interior of the tank shall be swabbed with a solution containing 200 parts per million of available chlorine and allowing to stand 2 hours --In the case of potable-water filters or similar equipment, the mixture shall be determined by the administrative authority having jurisdiction." S. Section 1008(f) - Unions. Amend by renumbering subsection from (f) to (g). T. Section 1009(h) - Size of Meter and Building Supply Pipe Using Table Amend the second
4 "No building supply pipe shall be less than three-quarter (3/4) inch in inside diameter." U. Section Grade, Support, and Protection of Building Sewers. - Exception: Amend to read: "Exception: When approved by the Administrative Authority and where it is impractical, due to the depth of the street sewer or to the structural features or to the arrangement of any building or structure, to obtain a slope of one-fourth (1/4) of an inch per foot (20.9 mm per m), any such pipe or piping three (3) inches (76.2mm) or larger may have a slope of not less than one-eight (1/8) of an inch per foot (10.5mm). V. Chapter 12, Fuel Gas Piping. This Chapter is deleted and replaced with Appendix B, Chapter 13, 1994 Edition of the Uniform Mechanical Code (as published by ICBO), Fuel Gas Piping. W. Appendix E - Mobile Home Parks. Delete in its entirety. X. Appendix C - Minimum Plumbing Facilities. Delete, replace with ARM and new Footnotes O and P (Copy attached). Y. Appendix I - Private Sewage Disposal Systems. Delete in its entirety. Section Applicability. The purpose of this code, the plumbing code, is to provide minimum requirements and standards for plumbing installations for the protection of life, health, safety and welfare of the general public and the owners and occupants of buildings. Section Safe Drinking Water Act. In accordance with sections 1417(a) and (b) of the Safe Drinking Water Act amendments of 1986 (Public Law ), effective immediately, the use of solders and fluxes containing more than 0.2 percent lead and pipes and fittings containing more than 8 percent lead is prohibited in the installation and repair of residential or nonresidential plumbing connected to a public water supply system." Section Copy on file. The Uniform Plumbing Code, 1991 Edition, is a nationally recognized model code setting forth minimum standards and requirements for plumbing installations. A copy of the Uniform Plumbing Code shall be filed with the city clerk for inspection by the public. A copy of the Uniform Plumbing Code, 1991 Edition, may also be obtained from the International Association of Plumbing and Mechanical Officials, South Walnut Drive, Walnut, California ; the Department of Commerce, Building Codes Bureau, P.O. Box , Helena, Montana ; or the City of Missoula Building Inspection Division, as available. Section 5. Severability. If any section, subsection, sentence, clause, phrase or word of this ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The Council hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause, phrase, and words thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or words have been declared invalid or unconstitutional, and if for any reason this ordinance should be declared invalid or unconstitutional, then
