1 ADDING 1 PRIVATE MOTOR EXCESS INSURANCE PROTECTION (Connected Sale or Mandatory Offering) Policy Structure This document sets out the terms and conditions of your cover and it is important that you read it carefully. It explains what is covered and what is not covered. There are also exclusions and conditions that you must follow for the policy to work. The cover you hold is set out in the accompanying policy schedule. Selling Broker An intermediary authorised by the Financial Conduct Authority or equivalent body in the country where this policy is sold, who is entitled to act on behalf of the customer and able to advise upon, sell and administer general insurance products in that jurisdiction. Please check your certificate of insurance for details of the selling broker. Marketing Intermediary Adding1 Limited (company number 94484), a trading style of Advantage Underwriting Limited, which is authorised and regulated by the Jersey Financial Services Commission to carry out general insurance mediation business activities in and from within Jersey. Adding1 Limited deals only with the selling brokers in relation to this insurance. Insurer This policy is underwritten by Inter Partner Assistance SA (IPA) which is fully owned by the AXA Assistance Group. Inter Partner Assistance is a Belgian firm authorised by the Belgian National Bank and subject to limited regulation by the Financial Conduct Authority. Details about the extent of our regulation by the Financial Conduct Authority are available from us on request. These motor excess insurance policy terms and conditions and your certificate of insurance must be read together as they form your insurance contract. Monetary limits We can insure you up to the annual aggregate limit as specified on your certificate of insurance. Cooling off period If you find that this cover does not meet your needs, please contact the selling broker within fourteen days of receiving this document and they will arrange for us to cancel this policy. You will receive a refund of your premium provided you have not made any claims. The contact details of your selling broker is stated in your certificate of insurance. Adding 1 PMXS v1 draft 1

2 If you cancel this commercial excess insurance policy outside the fourteen day period you will receive a refund of your premium proportionate to the amount of time left to run on the policy, less an administrative charge of 15 provided you have not made any claims. We may cancel this policy by giving you at least fourteen days written notice at your last known address for the following reasons if you fail to make payment of premiums; if you otherwise cease to comply with the terms and conditions of this policy in any significant respect; and/or if the cost of providing this policy becomes prohibitive We may cancel this policy without giving you prior notice if, by law, we are prevented or otherwise impeded from providing it. If we exercise our rights to cancel the policy under this section, we will refund the premium paid proportionate to the remaining period of insurance, unless you have made any claims. We reserve the right to refuse renewal of any individual policy. We may cancel this policy without giving you prior notice and without refunding your premium if you make or try to make a fraudulent claim under your policy you are abusive or threatening towards our staff you repeatedly or seriously break the terms of this policy Jurisdiction and law This motor excess insurance policy will be governed by the laws of England and Wales. 3 Definitions Any word or expression to which a specific meaning has been attached will bear the same meaning throughout this policy. Annual Aggregate Limit means the total amount of cover you have purchased under your motor excess insurance policy as stated in your certificate of insurance. The policy will continue to respond for the period of insurance or until your chosen level of indemnity on the reimbursement is exhausted; whichever comes first. Once the Annual Aggregate Limit is exhausted you are then liable for all and any future excess payments as defined in your main motor insurance policy for the remainder of this period of insurance. Certificate of Insurance means the document that contains the name of the policy holder and gives details of the cover provided by this motor excess insurance policy and the motor vehicle to which this cover relates. Commercial Travel means commercial use by sales representatives. Driving Instructor means Approved Driving Instructor (ADI) with the Driving Standards Agency. Excess means the amount you must pay towards a claim under the terms of your main motor insurance policy. The excess is the first part of any payment of a claim. Payment of the excess will not include any administration or other fees which you may be charged by your insurer under your main motor insurance policy. Such fees are not recoverable under your excess policy. Motor Vehicle means a private motor vehicle or motorcycle (not being an invalid carriage) which is constructed for the carriage of passengers and their effects and is adapted to carry not more than seven passengers and does not exceed 3.5 tonnes, of which you are the owner and which you are authorised to drive. Motor Vehicle Hire means the motor vehicle owned by a licensed rental company or agency, which you have agreed to hire from them according to the terms of your rental agreement. The hired vehicle must not exceed the limitations as stated under the definition of motor vehicle. Motor Vehicle Hire Insurance Policy means the main motor insurance policy issued by an authorised UK motor insurer to you in respect of a motor vehicle that you have hired. Named Driver(s) means drivers in addition to you who are permitted to drive under the terms of your main motor insurance policy. Adding 1 PMXS v1 draft 3

4 Period of Insurance means the period for which this motor excess insurance policy applies to that we have accepted the premium as stated in your certificate of insurance. Main Motor Insurance Policy means the insurance policy issued by an authorised UK motor insurer to you in respect of your motor vehicle. Motor Insurer means an authorised UK motor insurer. Waived or Reimbursed means where a third party has already made good, which is the first amount of any claim, shown in the schedule under own damage of your main motor insurance policy. We/Us/Our means Inter Partner Assistance (the insurer), AXA Assistance (UK) Ltd both of The Quadrangle, Station Road, Redhill, Surrey, RH1 1PR and any companies appointed by the insurer to process and settle claims you may make under this policy. You/Your/Insured Person means the person whose name appears at the top of your certificate of insurance of this motor excess insurance policy. Who and what vehicles are eligible for cover under this Policy? Who s covered? Any person who is permanently resident in the United Kingdom (England, Wales, Scotland, Northern Ireland, Channel Islands and the Isle of Man). Any person who has a current and valid UK driving license, or holds a full internationally recognised license. What is Covered Subject to the appropriate premium being paid, we will pay you in each relevant period of insurance an amount equal to the excess in relation to each settled claim on your main motor insurance policy up to the annual aggregate limit in respect of claims arising from fire, theft, flood or vandalism or an accident where you were at fault, or where within six months you are unable to recover your excess from a liable third party. This applies to one motor vehicle in your name or a motor vehicle that you have hired. Annual Aggregate Limits available a) 250 in any one period of insurance. b) 500 in any one period of insurance. c) 1000 in any one period of insurance. Adding 1 PMXS v1 draft 4

5 Once you have made claims which total the annual aggregate limit, no further payments will be made under this policy and this excess insurance policy will lapse. You will then be liable for all and any future excess payments as defined in your main motor insurance policy. Please refer to your certificate of insurance to check the annual aggregate limit you have chosen. Cover is provided under the following use types; a. Social Domestic and Pleasure b. Personal business use by the policyholder c. Personal use by named drivers d. Personal business use by policyholder and named drivers e. Business use by the policyholder and named driver (excluding commercial travel) ii. Approved Driving Instructors are included. General conditions 1. The main motor insurance policy that you have must be current and valid Protection Insurance that is provided by an FCA regulated and authorised UK insurer or the Jersey Financial Services Commission. 2. The policyholder as stated on your certificate of insurance must match the lead name of the individual on your motor insurance policy or on the motor vehicle hire insurance policy that has responded and to which this policy will respond to the amount of the excess. 3. In the event that any misrepresentation or concealment is made by you or on your behalf in obtaining this insurance or in support of any claim under this insurance the policy is voided and no refund of premium will be given. 4. Right of recovery - we can take proceedings in your name but at our expense to recover for our benefit the amount of any payment made under this policy. 5. Other insurance - if you were covered by any other insurance for the excess payable following the incident, which resulted in a valid claim under this policy, we will only pay our share of the claim. 6. Reasonable precautions - you must take reasonable steps to safeguard against loss or additional exposure to loss. 7. Keeping to the terms of this policy - We will only give you the cover that is described in this policy if any person claiming cover has met with all the terms of the excess protection insurance policy, as far as they apply. 8. Fraudulent claims - If you make a claim under this policy that is false or fraudulent in any way, the policy is void and any claim will not be paid. Adding 1 PMXS v1 draft 5

In the event we pay a claim under any cover provided by this insurance that may be recoverable from third party, we will be entitled to ask for all reasonable help from you to take action in your name to get back our costs from the third party 10. We will not provide cover, pay any claim or provide any benefit if doing so would expose us to any sanction, prohibition or restriction under United Nations resolutions or the trade or economic sanctions, laws or regulations of the European Union, United Kingdom or United States of America What is not covered (Exclusions) 1. Any claim that your main motor insurance policy or the motor vehicle hire insurance policy does not respond to or where the excess is not exceeded. 2. Any claim on the main motor insurance policy or the motor vehicle hire insurance policy which occurred prior to the start date of this insurance as shown on your certificate of insurance or confirmation of coverage document unless the period of insurance start date is equal to your main motor insurance policy or the motor vehicle hire insurance policy 3. Any claim notified to us more than 31 days following the settlement of your claim by your motor insurer. 4. Any contribution or deduction from the settlement of your claim against your main motor insurance policy or the motor vehicle hire insurance policy other than the stated policy excess, for which you have been made liable. 5. Where a third party has waived or reimbursed you and made good, which is the first amount of any claim, shown as excess in the schedule under own damage of your main motor insurance policy or the motor vehicle hire insurance policy. 6. Any liability you accept by agreement or contract, unless you would have been liable anyway. 7. Any claim that is refused by your motor insurer to whom you are claiming. 8. Any claims where the motor vehicle in your name is used for hire and reward. Motor insurance you must maintain at all times during the period of this policy a main motor insurance policy issued by a UK registered and authorised motor insurer to you in respect of your motor vehicle. 9. Motor claims arising from breakdown, misfuelling, windscreen repair or replacement or any glass repair or replacement to your motor vehicle or a vehicle you have hired. Adding 1 PMXS v1 draft 6

7 10. Any losses caused by war, revolution or any similar event. 11. Any losses caused by: - ionising radiation or radioactive contamination from any nuclear fuel or from any nuclear waste which results from burning nuclear fuel; or - radioactive, toxic, explosive or other dangerous properties of any nuclear machinery or any part of it. - How To Make a Claim Your claim will be us. To make a claim we will ask you to submit supporting documentation listed below. It is important you submit all the documentation requested, as we will be unable to process your claim until received. 1. Scheme code: Evidence the excess amount has been paid to your motor insurer. 3. Evidence that your claim with your motor insurer has been settled stating that you were at fault. 4. Certificate of your main motor insurance policy that you have paid the excess on. 5. The certificate of insurance or documentation detailing your excess cover. Or By phone Please call us on to notify your claim and you will be asked to send us copies of your documents. Our internet solution allows you to enter all the necessary details we require to settle your claim. We recommend you use the web link as you will need to post documents to us if you contact us by phone, which could result in delays of your claim being settled. Please note: Failure to follow these steps may delay and / or jeopardise the payment of your claim Complaints Procedure We do everything possible to make sure that you receive a high standard of service. You agree that Inter Partner Assistance may: a) disclose and use information about you and your insurance cover to the AXA group of companies, to its service providers and agents in order to administer and service your insurance cover, collect payments for fraud prevention and otherwise as required by applicable law. b) monitor and/or record your telephone calls in relation to cover to ensure consistent servicing levels and account operation; c) undertake all of the above within and outside the United Kingdom and the European Union. This includes processing your information in other countries in which data protection laws are not as comprehensive as in the European Union. However, we have taken appropriate steps to ensure the same (or equivalent) level of protection for your information in other countries, as there is in the European Union.
