2 In consideration of You having paid the premium or agreed to pay the premium on the date of inception of this contract We agree to provide the insurance described in this Policy and Schedule subject to all of the terms, conditions and exclusions detailed in this Policy booklet and on Your Schedule. The Schedule forms part of Your Policy and should be read together with the Policy document as they both form part of Our agreement with You. The information and answers that You gave Us when You took out the Policy provide the basis on which We have agreed to issue the Policy to You and You have confirmed the accuracy and completeness of that information. A copy of the information You gave Us is recorded on Your Statement of Fact sent to You with this Policy booklet. You should check this document carefully upon receipt and advise Us immediately if any of the information contained in it is incorrect. Unless specifically agreed to the contrary this contract shall be subject to English Law. Definitions: Wherever the following words and phrases appear in this Policy they will always have these meanings: Administrator MCE Insurance, Crown Way, Rushden, Northamptonshire NN10 6BS. Excess The amount of any claim but excluding any increased amounts defined in endorsements MCE5 and MCE16 of Your Motor Insurance Policy, that You must pay following loss or damage under Your Motor Insurance Policy. Insured Vehicle The car, motor cycle, taxi or van shown in the Schedule. Motor Insurer The insurer of your car, motor cycle, taxi or van. Motor Insurance Policy The motor insurance arranged by MCE Insurance. Not At Fault You were not responsible for the accident causing the claim under Your Motor Insurance Policy. Period of Insurance The length of time covered by this contract of insurance, as shown on the current Policy Schedule. Policy The contract of insurance agreed between Us and You and defined in this Policy booklet and Your Schedule. Pre Accident Value (PAV) The value of the Insured Vehicle immediately prior to the Total Loss or Stolen Unrecovered. Recommended Repairer 4th Dimension Innovation Limited, Unit 5 Alpha Way Thorpe Business Park Egham Surrey TW20 8RZ United Kingdom. Renewal Date The date at which your Policy is renewed for a further period as detailed in the Schedule. 2

3 Schedule The document forming part of this Policy that details the Start Date and Renewal Date of Your Policy, the Insured Vehicle details and Your details. The Schedule details the person and Insured Vehicle that the Policy booklet apply to and gives the dates when Your Policy is valid. Start Date The date Your Policy first commences as shown in the Schedule. Stolen Unrecovered The Insured Vehicle is not recovered by the police or any other party following a theft. Third Party The other party involved in the accident giving rise to a claim under the Motor Insurance Policy. Total Loss The Insured Vehicle is considered to be a write off (the cost of repairs is greater than the market value of the Insured Vehicle) by the Motor Insurer. We/ Our/ Us Alpha Insurance A/S, Harbour House, Sundkrogsgade 21, DK-2100 Copenhagen, Denmark. You/ Your/ Yourself The person(s) shown in the Schedule as the policyholder. About this Insurance Policy: You should read the terms and conditions detailed in this Policy including how to make a claim. Please read them carefully so that You know what cover is provided and what You should do if you need to make a claim. If this insurance does not meet Your requirements please contact the Administrator and advise them that You no longer require cover. You should do so within 14 days of cover starting. Please also return this Policy and Schedule. Providing You have not made a claim we will refund You the total premium You have paid. This Policy and the Schedule are important documents. Please keep them in a safe place where You can find them should You need to refer to them in the future. Should You need to discuss any aspect of the cover then please contact Your insurance intermediary. When providing this insurance We have relied on the information and statements which You have provided in the Proposal Form or Statement of Fact when applying for this insurance. Section 1 - Policy Cover What is Covered? Cover under this Policy is effective only in connection with a valid claim made under Your Motor Insurance Policy subject to all of the terms, conditions and exclusions detailed in this Policy booklet and in Your Schedule. When Your Motor Insurer has accepted a claim under Your Motor Insurance Policy that is subject to Your payment of an Excess, this Policy covers the payment of that Excess amount on Your behalf up to the full value of the correct Excess applied under Your Motor Insurance Policy subject to the following conditions: This Policy only becomes effective when the cost of repairs to Your Insured Vehicle or the Pre Accident Value (PAV) of Your Insured Vehicle where Your Insured Vehicle is declared a Total Loss or is Stolen Unrecovered exceeds Your Excess under Your Motor Insurance Policy We will only pay ONE valid claim under this Policy in any Period of Insurance. Cover applies to all Excesses payable under Your Motor Insurance Policy except any Excess for Windscreen Glass Claims or any additional amount of the Excess You have to pay resulting from the application of endorsements 3

4 MCE5 Garaged Vehicle Clause, increased excess and MCE16 Non approved repairer excess of Your Motor Insurance Policy. Where You were Not At Fault for the incident that You are claiming for under Your Motor Insurance Policy the payment of any Excess amount under this Policy will be deferred for a period of 6 months while You seek recovery of your losses including the Excess amount from the responsible Third Party or their insurance company. Payment will only be made under this Policy after 6 months after You have provided evidence to Us that You have attempted to recover the Excess amount from the Third Party or their insurers but have been unsuccessful. In the event of You submitting a valid claim that is accepted under this Policy, We will at Our option either: Pay the amount of the applicable Excess directly to Our Recommended Repairer; Or Pay the amount of the applicable Excess directly to You where Your Insured Vehicle has been repaired by a repairer who is not Our Recommended Repairer after Your chosen repairer has confirmed to Us that the repair Excess has been paid to them by You, or where Your Insured Vehicle is a Total Loss or is Stolen Unrecovered. Section 2 - Exclusions What is not covered? 2.1 Any claim occurring within the first 48 hours of the Start Date of this Policy. 2.2 Any claim notified to the Administrator after 30 days of the incident occurring. 2.3 Any excess in respect of windscreen or glass damage claims. 2.4 Any claim when no cover is provided by Your motor insurers. 2.5 Any commercial vehicle in excess of 3.5 tonnes. 2.6 Any excess recovered from a Third Party within 6 months of the claim being made. 2.7 More than one claim being paid during the same period of insurance. 2.8 Any claim lower than the value of the motor Excess applicable to Your claim under Your Motor Insurance Policy. 2.9 Any additional amount of the Excess You have to pay resulting from the application of endorsements MCE5 Garaged Vehicle Clause, increased excess and MCE16 Non approved repairer excess of Your Motor Insurance Policy. Section 3 - Policy Conditions 3.1 Geographical Limits - Unless otherwise agreed, the Geographical Limits will match those defined under Your Motor Insurance Policy. 3.2 Right of Recovery We, the Administrators or the Recommended Repairers can take over and conduct in Your name the defence or settlement of any claim or take proceedings for Our own benefit to recover any payment We have made under this Policy. We shall have full discretion in the conduct of any proceedings or the settlement of any claim. You shall give Us all the information and assistance necessary for Us to achieve as settlement. 3.3 If You were covered by any other insurance for the Excess payable following an incident which resulted in a valid claim under this Policy We will pay Our fair share of the claim whether or not the other insurer pays anything. 3.4 Reasonable Precautions - You must take reasonable steps to keep Your vehicle in a safe condition and protected from damage. 3.5 Cancellation - We can cancel this Policy by giving You at least 7 days notice by letter to Your last known address. If We exercise this option You will be entitled to the return of a proportionate part of the premium paid in respect of the unexpired term of the Policy provided there have been: No claims made under the Policy for which We have made payment. No claims made under the Policy which are still under consideration. No incidents likely to give rise to a claim but are yet to be reported to Us. 4

5 You can cancel this Policy by giving Us notice in writing and returning the Schedule. No return of premium will be payable. 3.6 Fraudulent Claims - If You make a claim under this Policy and it is fraudulent or exaggerated in any way, the Policy is void and any claim will not be paid. Section 4 - How to Claim? You must give Us notice of a claim by telephoning the Administrator on You should do so as soon as reasonably possible and within 30 days after the claim event. We will send You the claim form. You will need to complete this and return it to Us as soon as reasonably possible, giving Us all the information We ask for to enable Us to process Your claim. However if You use Our Recommended Repairs they may complete the claim form on Your behalf. Claim payment will be made when We receive satisfactory evidence of Your entitlement to claim. Alpha Insurance A/S, who underwrite this insurance are covered by the Financial Services Compensation Scheme (FSCS). You may be entitled to compensation from the scheme if they cannot meet their obligations. Further information is available from the Financial Conduct Authority or the FSCS. The FSCS can be visited on the web at or by contacting the FSCS on Section 5 - Complaints Procedure We aim to provide a first-class service. If You have any cause to complain, or You feel that We have not kept Our promise, please follow the procedures below; For complaints relating to the selling of this insurance please contact the sales agent from which this insurance was purchased. When You do this quote Your Policy number, which is on Your Schedule. For complaints relating to the administration or claims handling of this insurance, please write to the Recommended Repairer, 4th Dimension Innovation Limited, Unit 5 Alpha Way Thorpe Business Park Egham Surrey TW20 8RZ United Kingdom When You do this quote Your Policy number, which is on Your Schedule. If You still remain dissatisfied after following the above procedures in full, You can ask the Financial Ombudsman Service to review Your case. Their address is: Financial Ombudsman Service, South Quay Plaza, 183 Marsh Wall, London E14 9SR. The Financial Ombudsman Service cannot consider Your complaint if it is: Less than eight weeks after receipt of the complaint by the sales agent, Recommended Repairer or Us, or; More than six months after the date on which the sales agent, Administrator or Us provided Our final response advising that You may refer Your complaint to the Financial Ombudsman Service, or; More than six years after the event complained of or more than three years from the date on which You became aware that You had cause for complaint unless You have already referred the complaint to the sales agent, Administrator or Us.
