7 AN ORDINANCE OF LEWIS COUNTY PROVIDING FOR A PROPOSAL FOR AN ENHANCED EMERGENCY TELEPHONE SYSTEM, FOR THE HOLDING OF A PUBLIC MEETING ON SUCH PROPOSAL, AND FOR PLACEMENT OF AN ADVERTISEMENT NOTIFYINTG THE PUBLIC OF SUCH MEETING AND OF THE LOCATION AT WHICH A COPY OF SUCH PROPOSAL MAY BE EXAMINED. WHEREAS, SECTION 3-CC,ARTICLE 1, CHAPTER 7 ( CC) OF THE WEST VIRGINIA CODE GRANTS THE AUTHORITY TO COUNTY COMMISSIONS TO ESTABLISH AN ENHANCED TELEPHONE SYSTEM AND IMPOSE A FEEFOT THE CAPITAL,INSTALLATION AND MAINTENANCE COSTS THEREOF, WHEREAS, ARTICLE 6, CHAPTER 24 ( et al) OF THE WEST VIRGINIA CODE REQUIRES THE PREPARATION OF A PROPOSAL, THE HOLDING OF A PUBLIC MEETING AND THE TIMELY PLACEMENT OF AN ADVERTISEMENT CONCERNING SUCH PROPOSAL AND MEETING BEFORE A FINAL PLAN FOR IMPLEMENTATION OF SUCH AN ENHANCED EMERGENCY TELEPHONE SYSTEM MAY BE ADOPTED. NOW THEREFORE BE IT ORDAINED BY THE COUNTY COMMISSION OF LEWIS COUNTY, WEST VIRGINIA, PURSUANT TO AND IN ACCORDANCE WITH SECTION THREE-CC, ARTICLE ONE, CHAPTER SEVEN (7-1-3-CC) AND ARTICLE SIX, CHAPTER T'WENTY-FOUR ( et OF THE WEST VIRGINIA CODE THE FOLLOWING: THAT A COPY OF THE PROPOSAL ATTACHED HERE TO BE MAILED TO THE TELEPHONE COMPANIES PROFVIDING LOCAL EXCHANGE SERVICE WITHIN LEWIS COUNTY AND TO LOCAL EMERGENCY SERVICE PROVIDERS AND THAT THE COUNTY COMMISSION SEEK THE ADVICE OF SUCH COMPANIES AND SUCH PROVIDERS IN DEVELOPING A FINAL PLAN FOR AN ENHANCED EMERGENCY TELEPHONE SYSTEM; THAT A COPY OF THE PROPOSAL ATTACHED HERE TO BE MADE AVAILABLE FOR EXAMINATION BY THE PUBLIC AT THE LEWIS COUNTY COURTHOUSE. THAT A PUBLIC MEETING BE SCHEDULED TO BE HELD AT THE LEWIS COUNTY COMMISSION OFFICE ON NOVEMBER 17,2008 at 11:OO AM, IN ORDER TO RECEIVE COMMENTS FROM OTHER PUBLIC OFFICIALS AND INTERESTED PERSONS;\ THAT AT LEAST THIRTY DAYS BUT NOT MORE THAN SIXTY DAYS BEFORE SUCH MEETING AN ADVERTISEMENT BE PLACED BY THE LEWIS COUNTY COORDINATOR IN THE WESTON DEMOCRAT, A NEWSPAPER OF GENERAL CIRCULATION IN LEWIS COUNTY, NOTIFYING THE PUBLIC OF THE DATE, PLACE AND PURPOSE OF SUCH MEETING AND OF THE LOCATION AT WHICH A COPY OF SUCH PROPOSAL MAY BE EXAMINED. 2

9 PROPOSAL FOR AN ENHANCED EMERGENCY TELEPHONE SYSTEM FOR LEWIS COUNTY, WEST VIRGINIA SECTION 1 - DEFINITIONS: As used in this proposal, unless the context clearly requires a different meaning: county Answering Point means a facility to which enhanced emergency telephone system calls for a county are initially routed for response, and where county personnel respond to specific requests for emergency service by directly dispatching the appropriate emergency service provider, relaying a message to the appropriate provider or transferring the call to the appropriate provider County Commission means the County Commission of Lewis County, West Virginia. c C~~nWs means Lewis County, West Virginia. EmerEency Service Provider means any emergency services organization or public safety unit. Enhanced Emergency Telephone Svstem means a telephone system which automatically connects the person dialing the primary emergency number to the county answering point and in which the telephone network system automatically provides to personnel receiving the call, immediately on answering the call, information on the location and the telephone number from which the call is being made, and upon direction fkom the personnel receiving the call routes such call to emergency service providers that serve the location from which the call is made. Local Exchange Service Line means the same as defined in the contracts attached to this fmal plan as Appendix A and Appendix B. 6CTelephone compaav means a public utility which is engaged in the provision of telephone service. SECTION 2 - TERRITQRY INCLUDED IN SYSTEM (a) All territory in Lewis County, including every municipal corporation in Lewis County, which is served by a telephone company central ofice equipment that will permit an enhanced emergency telephone system to be established, is proposed to be included in the system. 3

11 (b) The municipal corporations included in the system are proposed to include, but not limited to the following: City of Weston, West Virginia Town of Jane Lew, West Virginia (e) The territories which are not served by telephone company central office equipment that Will perrnit an enhanced emergency telephone system to be established are as follows: NONE (d) EFFECTIVE FEBRUARY 02,1999, THE 452 EXCHANGE OF BRAXTON COUNTY WAS SELECTIVE ROUTED TO BRAXTON CONTROL. ALL 452 EXCHANGE CALLS THAT ORIGINATE FROM BRAXTON COUNTY, WILL BE IMMEDIATELY, ONE BUTTON TRANSFERRED TO BRAXTON CONTROL. (e) FIRE AND EMS UNITS WILL BE DISPATCHED ONLY BY REQUEST RELAYED THROUGH BRAXTON CONTROL OR BY DIRECT REQUEST FROM THE OFFICER IN CHARGE THAT IS ON THE SCENE OR ENROUTE. SECTION 3 - MULTI - COUNTY ANSVVERING POINT (a) The Multi - County Answering Point is proposed to be operated constantly and provide a Full Service Capabilities, including but not limited to the hearing impaired (b) There is One (1) proposed Multi - County Answering Point. The location is to be as follows: 201 ORCHARD STREET, WESTQN, WV (e) This Multi - County Answering Point will serve all of Lewis County. (d) THIS ANSWERING POINT WILL ACT AND SERVE AS THE PRIMARY ANSWERING POINT FOR GILMER COUNTY, BY ORDINANCE AND CONTRACT. (e) The Lewis-Gilmer E-91 1 and Emergency Communication Center, otherwise known as Dispatch, will act as the Multi - County Answering Point and respond to calls for Police, Fire, Ambulance, Rescue and Emergency Service Calls as follows: Jackson Mill Vol. Fire Department - Direct Dispatch Jane Lew Vol. Fire Department - Direct Dispatch Midway Vol. Fire Department - Direct Dispatch Pricetown Vol. Fire Department Direct Dispatch Walkersville Vol. Fire Department - Direct Dispatch Weston Vol. Fire Department - Direct Dispatch Lewis County Emergency Ambulance - Direct Dispatch 4

Office of Emergency Management WV Dept of Natural Resources Enforcement) WV Dept of Natural Resources (Forestry) - Direct Dispatch - Direct Dispatch - Direct Dispatch - Direct Dispatch - Qn Call Paging - Direct Dispatch - Direct Dispatch - Call Transfer (f) The county answering point is proposed to be connected to each telephone company s Telephone network as follows: Verizon Wv Inc. by dedicated automatic number identification trunks and combination voice & data circuits. Citizens Telecommunications Company of Wv by dedicated automatic number identification trunks and combination voice & data circuits. SECTION 4 - HANDLING OF MISDIRECTED CALLS (a) Every Emergency Service Provider that provides emergency service within the Territory of the county will, if this proposal is adopted as a final plan for an enhanced emergency telephone system, be required to participate in the enhanced emergency telephone system. (b) In the event of a dispute between The County and one or more Emergency Service Providers, such dispute, upon application to The Public Service Commission of West Virginia by any party to the dispute, may be resolved by order of the Public Service Commission of West Virginia. (c) Misdirected calls will be handled as follows: To Agencies from Dispatch Center: Correction via radio transmission if unit is enroute or correction via telephone if unit has not responded when misdirection of the call is realized. To Agencies without Radio capabilities, from dispatch center: Correction via radio paging circuits if unit is enroute or correction via telephone if unit has not responded when misdirection of the call is realized. Each emergency provider participating in the system will, if this proposal is adopted as a final plan, be required to maintain a telephone number in addition to the one provided in the system, which shall be appropriately listed in the proper phone directories.. 5

15 SECTION 5 - PROJECTION OF COSTS (a) The initial capital and installation costs of the enhanced emergency telephone system are projected to be as follows: ITEM 1 - NO INITIAL COSTS This system has been in operation since June 3,1991. (b) The annual costs for the budget year of : * THIS IS FOR FOURTEEN (14) FULL-TIME AND ONE (1) PART-TIME TELECOMMUNICATORS, 2 ADMINISTRATIVE AND ONE FULL- TME AND ONE PART-TIME ADDRESSING PERSONNEL. 17 SECTION 6 - IMPOSITION OF FEE: ADOPTION OF' BILLING CONTRACT; ESTABLISHIMENT OF SEPARATE E-911 FUND; PAYMENT OF' COSTS NOT RECOVERED THROUGH FEE. (a) The imposition, pursuant to section three-cc article one, chapter seven (7-1-l-cc) of the West Virginia Code, a fee of $1.75 cents per month per local exchange service line is proposed to finance the projected costs of the capital installation and maintenance costs for the enhanced emergency telephone system. Such fee is proposed to become effective approximately on DECEMBER 1,2008. (b) The County Commission of Lewis County proposes the adoption and ratification of the contract attached hereto as Appendix A for the billing of the enhanced emergency system fee by Verizon Wv Inc. and Citizens Telecommunications Company of Wv Telephone Companies. (c) All fees remitted under the contract referred to in subsection (b) are proposed to be deposited in a separate E411 Fund. (d) The costs associated with establishing, equipping, fiunishing, operating or maintaining The Multi - County Answering Point are proposed to be paid for as follows: COUNTY FUNDS, CONTRACT FUNDING AND 91 1 FEES SECTION 7 - TELEPHONE COMPANIES (a) Upon the adoption of this proposal as a final plan, the terms and conditions of the Telecommunications services and facilities provided by the telephone companies will be governed by the applicable tariffs on file with and approved by the Public Service Commission for West Virginia, the rules, regulations and orders of the Public Service Commission of West Virginia and the laws of the State of West Virgin (b)the telephone companies that are proposed to be providing the services and facilities identified in subsection (a) are as follows: Verizon Wv Inc. Citizens Telecommunications Company of Wv SECTION 8 - TARIFFS, RULES, REGULATIONS, AND LAWS The final plan will be supplemented and superseded by the applicable tariffs on file with and approved by the Public Service Commission of West Virginia, the rules, regulations and orders of the Public Service Commission of West Virginia, and the laws of the State of West Virginia. Such tariffs, rules, regulations, orders and laws will be deemed incorporated in the final plan as iffidly set out herein. 7

19 SECTION 9 - FILING OF PLAN WITH THE PUBLIC SERVICE COMlMISSION Upon completion and adoption of the final plan, the Lewis County Commission will send a copy of such plan to the Public Service Commission of West Virginia. SECTION 10 - IMPLEMENTATION DATE Under the terms and conditions as set out herein, the Proposal and Final Plan, the effective date of this ordinance will be Monday, December 0 1,2008.
