1 E911 INFORMATION MARSHALL COUNTY COMMISSION

2 By the County Commission of Marshall County an Ordinance enacted under Chapters 7 and 24 of the WEST VIRGINIA CODE. An Ordinance of Marshall County providing for the establishment of a county wide, Enhanced Emergency Telephone System and the imposition of a fee upon local exchange service consumers to finance installation, recurring maintenance, and dispatcher costs. WHEREAS, the Marshall County Commission seeks to promote the public health, safety and general welfare of all individualswithin the county by ensuring all requests for emergency assistance can be channeled through one central answering point to the appropriate emergency service response agency, regardless of whether the caller is located in an incorporated or unincorporated area of the county; and WHEREAS, the Marshall County Commission has installed and maintains an Enhanced Emergency Telephone System that automaticallyconnects a person dialing within the non-wheeling portion of the county to the central answering point and provides prompt information on the location and telephone number from which the call is being made so that the source of a callfor help can be locked in even ifa caller is disconnected or unable to communicate with emergency officials; NOW THEREFORE be it ORDAINED by the County Commission of Marshall County, West Virginia, that the plan herein modified be adopted providing for the ongoing operation and maintenance of an Enhanced Telephone System that will serve both incorporated and unincorporatedareas of the county in accordance with section three-cc, article one, chapter seven r7-f-3~~) and article six, chapter twenty-four r24-6-1et al) of the WEST VIRGINIA CODE; That a copy of the proposal attached hereto be made available for examination by the public at the County Clerk's Office of the Marshall County Courthouse, Seventh Street, Moundsville, West Virginia; That a public meeting be scheduled to be held at the Marshall County Commissioners Room, Marshall County Courthouse, Seventh Street, Moundsville, West Virginia at 1O:OO A.M. July 22"d,2008 in order to receive comments from other public officials and interested persons; That at least thirty (30) but not more than sixty (60) days before such meeting an advertisement be placed by Larry D.Newell, Marshall County E9-1-1 Director in the Wheeling lntelligencer and the Moundsville Daily Echo newspapers of general circulation in Marshall County, notifyingthe public of the date, place and purpose of such meeting and of the location at which a copy of such prodosal may be examined... 1of9

3 COMPREHENSIVEPLAN FOR ENHANCED EMERGENCY TELEPHONE SYSTEM ARTICLE I-GENERAL PROVISION SECTION 1 - DEFINITIONS As used in this ordinance unless the context clearly indicates otherwise, the following words and phrases shall have the meanings hereinafter set forth: a) "PUBLIC SAFETY ANSWERING POINT (PSAP)" means a facility to which Enhanced Emergency Telephone System calls for the county are initially routed for response, and where trained personnel dispatching the appropriate provider or by using "one-button"transfer to transfer the call to the appropriate emergency service provider. The Public Safety Answering Point for Marshall County Enhanced System shall be in the Marshall County Courthouse. b) "EMERGENCYSERVICES ORGANIZATION" means the organization established under Article 5, Chapter 15 of the West Virginia Code. c) "EMERGENCY SERVICE PROVIDER" means any emergency services organization of the county or its municipalities, or any public safety unit. d) "ENHANCED EMERGENCY TELEPHONE SYSTEM" means a telephone system which automatically connects the person dialing to the appropriate Public Safety Answering Point and in which the telephone network system automatically provides to personnel receiving the calls, immediately upon answering the call, information on the location and the telephone number from which the call is being made, and upon direction from the personnel receiving the call routes such call to emergency service providers that serve the location from which the call is made. e) "PUBLIC AGENCY" means MarshallCounty and all incorporated municipalities of the county which provide or have authority to provide firef@ting, police, ambulance, medical, rescue, and/or other emergency services within the county. Those municipalities shall include, but shall not be limited to the following: 1) City of Benwood 2) City of Cameron 3) City of Glen Dale 4) City of McMechen 5) City of Moundsville 2 of 9

4 9 PUBLIC SAFETY UNIT means the functional divisions of Marshall County and each county municipality which provide firefighting, police, medical, rescue andlor other emergency services. g) PUBLIC UTILITY any entity providing local exchange type communicationsservice or functional equivalent, either by means of physical or wireless connection, to the public at any location within Marshall County. h) REGULATING AGENCY means the West Virginia Public Service Commission which, by law, regulates services provided by a public utility. SECTION 2 -TERRITORY INCLUDED IN SYSTEM A) All Territory in the county, except as noted in C, below, shall be included in the Marshall County Enhanced Emergency Telephone System. B) All emergency service providers, includingthe West Virginia Department of Public Safety (State Police} serving any non-wheeling portion of Marshall County, including all local political subdivisions that provide emergency services within the County will participate in the Enhanced EmergencyTelephone System, as will any future emergency service providers approved by the County Commission. C) The portion of Marshall County which iswithin the corporate limits of the city of Wheeling, West Virginia, will be provided emergency service by the City of Wheeling and all calls from that area will be routed to the Wheeling/Ohio County Public Safety Answering Point. SECTION 3 - PUBLIC SAFETYANSWERING POINT A) The Public Safety Answering Point for the Enhanced Emergency Telephone System will be at the following location: 1) The Marshall County Sheriffs Office located at 601 Sixth Street, Moundsville, West Virginia. All Emergency Calls originating in the Cities of Benwood, Cameron, Glen Dale, McMechen, and Moundsville and all unincorporated areas of Marshall County will be automatically routed to this PSAP. The PSAP will be in full service twenty-four (24) hours a day for receiving and dispatching emergency calls constantly. All Emergency Calls originating in the Marshall County portion of the City of Wheeling will be automatically routed to the Wheeling/Ohio County PSAP. 6) The Marshall County PSAP will be connected to the Verizon West Virginia s network facilities via dedicated Automatic Number Identification(ANI) 30f9

5 trunks and combination voice and data circuits and will serve as the only primary Public Safety Answering Point for the Marshall County Enhanced Emergency Telephone System. C) The above-designated Public Safety Answering Point will respond to calls for police, fire, ambulance, rescue and emergency service calls as follows: Benwood Clty Police Department - Call Transfer Benwood Emergency Squad - Call Transfer Benwood Volunteer Fire Department - Call Transfer Bethlehem VFD/Ambulance Squad - Call Relay Big Wheeling Creek VFD - Direct Dispatch Boggs Run Volunteer Fire Department - Direct Dispatch Cameron Emergency Squad - Direct Dispatch Cameron Volunteer Fire Department- Direct Dispatch Cameron Police Department- See MOU between City of Cameron, Marshall County Commission and Marshall County Communications 911 Dallas Emergency Squad - Direct Dispatch Dallas Volunteer Fire Department - Direct Dispatch Fish Creek Volunteer Fire Department - Direct Dispatch Fork Ridge Volunteer Fire Department - Direct Dispatch Fork Ridge Emergency Squad - Direct Dispatch Glen Dale City Police Department - Call Transfer Glen Dale Emergency Squad - Call Transfer Glen Dale Volunteer Fire Department - Call Transfer Grandview Emergency Squad - Call Relay Grandview Volunteer Fire Department - Call Relay LimestoneVolunteer Fire Department - Direct Dispatch Limestone Regional Emergency Squad - Direct Dispatch Marshall County Animal Shelter - Call Relay MarshallCounty 0. Department of Natural Resources (Law) - Direct Dispatch W.Va. State Fire Marshall (Arson Division) - Call Relay W. Va. Department of Public Safety (Moundsville)-Direct Dispatch with the blind toss system with the Marshall County Sheriffs Office. W.Va. Department of Public Safety (Moundsville) - Call Transfer, at the discretion of the dispatcher when a caller asks for a transfer to the W. Va. Department of Public Safety in order to report his or her emergency. NOTE: See MOU between Marshall County Sheriff, W Department of Public Safety (Moundsville) and the Marshall County Communications 911. All Call Transfers, as designated above, shall be "one-button" transfers and, further, when PSAP personnel transfer a call to an emergency service provider they shall remain on the line until it is determined that the transfer was properly made to the correct emergency service provider and that adequate information has been given to the emergency service provider to enable prompt and adequate response to the caller's need for emergency service. D) The above-designated Public Safety Answering Pointwill, as appropriate, also respond to calls for police, fire, ambulance, rescue and emergency service calls in Marshall County with responding agencies from adjoining Counties and States as follows: Bethlehem Emergency Squad - Call Relay BethlehemVolunteer Fire Department - Call Relay Grandview Emergency Squad - Call Relay Grandview Volunteer Fire Department - Call Relay HundredVolunteer Fire Department - Call Relay Hundred Emergency Squad - Call Relay New Martinsville Emergency Squad - Call Relay New MartinsvilleVolunteer Fire Department - Call Relay New Martinsville Rescue Squad - Call Relay Silver Hill Volunteer Fire Department- Call Relay Stone Church Emergency Squad - Call Relay Stone Church Volunteer Fire Department - Call Relay Triadelphia Volunteer Fire Department- Call Relay Triadelphia Rescue Squad - Call Relay Valley Grove Rescue Squad - Call Relay Valley Grove Volunteer Fire Department - Call Relay Valley Grove Emergency Squad - Call Relay West Finley, Pa Rescue Squad - Call Relay West Finley, Pa Volunteer Fire Department - Call Relay SECTION 4 - EMERGENCY SERVICE PROVIDERS 5 of 9

7 A) Every Emergency Service provider that provides emergency services in the territory of Marshall County (including emergency service providers providing services to the Marshall County portion of Wheeling) are included in the Enhanced Emergency Telephone System. B) The Emergency providers referred to in subsection A), above, shall be the following: Benwood City Police Department Benwood Emergency Squad Benwood Volunteer Fire Department Bethlehem VFD/Ambulance Squad Big Wheeling Creek VFD Boggs Run Volunteer Fire Department Cameron Emergency Squad Cameron Volunteer Fire Department Cameron Police Department Dallas Emergency Squad Dallas Volunteer Fire Department Fish Creek Volunteer Fire Department Fork RidgeVolunteer Fire Department Glen Dale City Police Department Glen Dale Emergency Squad Glen Dale Volunteer Fire Department Grandview Emergency Squad Grandview Volunteer Fire Department Limestone Volunteer Fire Department Limestone Regional Emergency Squad Marshall County Animal Shelter Marshall County 0. Department of Public Safety (Moundsville) SECTION 5 - MISDIRECTED CALLS; PUBLICLYACCESSIBLE TELEPHONE NUMBERS; RESOLUTION OF DISPUTES A) If at any time a call is incorrectly dispatched to an emergency service provider, the provider receiving the call shall either radio the correct local jurisdiction to respond to the call or advise the PSAP personnel to correctly dispatch the appropriate provider. Under no circumstances will the caller be asked to make another call. 6) Each Emergency Service Provider participating in the enhanced EmergencyTelephone System shall maintain a publicly accessible 7-digit telephone number, which shall be appropriately listed in appropriate telephone directories, in addition to any telephone numbers provided in the system. C) In the event of a dispute between the County and one or more emergency service providers, such dispute, upon application to the Public Service Commission of West Virginia by any party to the dispute, may be resolved by order of the Public Service Commission of West Virginia. SECTION 6 - SPECIAL SERVICES A) All coin operated telephones in Marshall County shall be equipped by the public utility or other appropriate entity providing public telephone service to permit a caller to dial and initiate calls to the Emergency Telephone Answering Point without having to insert a coin. SECTION 7 - PROJECTION OF COSTS Based on one (1) Public Safety Answqting Point (PSAP) at the Marshall County Courthouse. 9 C) The initial costs associatedwith establishing, equipping and furnishing the Public Safety Answering Point are projected to be as follows: No additional cost have been identified. The PSAP existed prior to implementing an Enhanced Emergency Telephone System. D) There are no recurring costs, such as rent, since the Answering Point will be located at the Marshall County Sheriffs Ofice, 601 Sixth Street, Moundsville, West Virginia. SECTION 8 - IMPOSITIONOF FEE; ADOPTION OF BILLING CONTRACT; ESTABLISHMENTOF SEPARATE E9-1-1FUND; PAYMENT OF COST NOT RECOVERED THROUGH FEE. A) The imposition, pursuant to section three-cc, article one, chapter 7 ( cc} of the West Virginia Code, of a fee of One (1) Dollar and Twenty (20) cents per month per local exchange service line (except for Tel-Assistance Lines) and line equivalent, is proposed to finance the projected costs of the capital installation and maintenance costs of the Enhanced Emergency Telephone System Such fee is proposed to be reduced when the capitol and installations costs have been recovered to offset recurring maintenance and dispatcher costs only. Such fee is not proposed to be used to offset the costs associated with the establishing, equipping, furnishing, operating or maintaining of the county answering point. Such fee is proposed to become effective beginning May Such fee will not be levied on any telephone line which terminates in any portion of the county which is not a part of the Enhanced System. Portions of MarshallCounty which are within the corporate limits of the City of Wheeling shall pay the Enhanced fee levied by Ohio County. Monies collected by the telephone company[ies] in this manner shall, minus the appropriate collection fee, be sent to the Ohio County Commission. SECTION 9 - TARIFFS, RULES, REGULATIONSAND LAWS The final plan will be supplemented and superseded by the applicable tariffs on file with and approved by the Public Service Commission of West Virginia, the rules, regulations and orders of the Public Service Commission of West Virginia, and the laws of the State of West Virginia. Such tariffs, rules, regulations, orders and laws will be deemed incorporated in the final plan as if fully set out therein. SECTION 10 - FILING OF PLAN WITH THE PUBLIC SERVICE COMMISSION

10 Upon completion and adoption of the final plan,the County Commission will send a copy of such plan to the Public Service Commission of West Virginia.
