6 WASTE PREVENTION PROGRAMMES New obligation? DIRECTIVE 2006/12 (Article 7) In order to attain the objectives referred to in Article 3 the competent authority shall be required to draw up as soon as possible one or more waste management plans. (Article 3) Member States shall take appropriate measures to encourage first, the prevention or reduction of waste production and its harmfulness. 6

10 WASTE PREVENTION PROGRAMMES Evaluation and revision (Article 30) 1. Member States shall ensure that the waste prevention programmes are evaluated at least every six year and revised as appropriate. 2. The European Environment Agency is invited to include in its annual report a review of progress in the completion and implementation of waste prevention programmes. 10

11 WASTE PREVENTION PROGRAMMES Public participation (Article 31) Member States shall ensure that relevant stakeholders and authorities and the general public have the opportunity to participate in the elaboration of the waste prevention programmes, and have access to them once elaborated, They shall place the programmes on a publicly available website. 11

12 WASTE PREVENTION PROGRAMMES Cooperation (Article 32) Member States shall cooperate as appropriate with the other Member States concerned and the Commission to draw up the waste prevention programmes 12

13 WASTE PREVENTION PROGRAMMES Notification (Article 33) Information to be submitted to the Commission 1. Member States shall inform the Commission of the waste prevention programmes, once adopted, and of any substantial revisions. 2. The format for notifying the information shall be adopted in accordance with the procedure referred to in Article 39 (3). 13

14 DEFINITION OF PREVENTION (Article 3) (12) Prevention" means measures taken before a substance, material or product has become waste, that reduce: a) the quantity of waste, including through the re-use of products or the extension of life span of products; b) the adverse impacts of the generated waste on the environment and human health; or c) the content of harmful substances in materials and products. 14

15 DEFINITION OF REUSE (Article 3) (13) Re-use" means any operation by which products or components that are not waste are used again for the same purpose for which they were conceived. (16) Preparing for re-use" means checking, cleaning or repairing recovery operations, by which products or components of products that have become waste are prepared so that they will be re-used without any other pre-processing. 15

16 TO APPLY THE HIERARCHY (Article 4) 1. The following waste hierarchy shall apply as a priority order in waste prevention and management legislation and policy: (a) prevention; (b) preparing for re-use; (c) recycling; (d) other recovery, e.g. energy recovery; and (e) disposal. 2. When applying the waste hierarchy referred to in paragraph 1, Member States shall take measures to encourage the options that deliver the best overall environmental outcome. This may require specific waste streams departing from the hierarchy where this is justified by life-cycle thinking on the overall impacts of the generation and management of such waste. 16

17 WASTE PREVENTION Supporting tools (Article 9) The Commission shall submit in support of the prevention activities and the implementation of the waste prevention programmes: a) by the end of an interim report on the evolution of waste generation and the scope of waste prevention; - the formulation of a product eco-design policy with a view to promoting technologies focusing on durable, re-usable and recyclable products; - an action plan to change the current consumption patterns b) by the end of 2014 waste prevention and decoupling objectives for
