1 Excess Waiver Insurance Introduction Thank you for choosing to purchase a Motor Excess Protection Insurance policy from Zenith Insurance Plc. This policy document is evidence of a legally binding contract of insurance between you (the Insured) and us (Zenith Insurance Plc). The contract is based on the information you provided at the time of completion of your hire car booking. You must read this policy document and the booking voucher/booking receipt together. The booking voucher/booking receipt tells you the period during which the policy is in force (the period of your vehicle rental agreement) and what limits of indemnity apply to your insurance. Please check both documents carefully to make certain they give you the cover you want. We have agreed to insure you for the amount of excess payable under the primary motor insurance policy arranged by the rental company in conjunction with your vehicle hire. Cover is provided within the geographical limits of this policy during the period of insurance for which you have paid, or agreed to pay the premium. The cover we provide is subject to the terms, conditions and exceptions contained in this policy document or in any endorsement applying to this policy document. Nobody other than you (the Insured) and us (Zenith Insurance Plc) has any rights that they can enforce under this contract. This insurance is only available to residents of United Kingdom of Great Britain & Northern Ireland, the Isle of Man and the Channel Islands; or Any country which is a member of the European Economic Area (EEA); or Andorra, Croatia, Monaco, San Marino and Switzerland. Unless specifically agreed otherwise, this insurance shall be subject to English Law. The terms and conditions of this policy and all other information concerning this insurance are communicated to you in the English language and we undertake to communicate in this language for the duration of the policy. 2 The words or phrases shown below have the same meaning whenever they appear in this policy document or in the booking voucher/booking receipt or any endorsements applying to this policy. So that you can easily identify these words and phrases they are shown in bold print throughout this policy document. Booking voucher/booking receipt Printed confirmation that a booking has been made and the insurance premium collected by easycar.com. This document will show your booking voucher number. Booking voucher number The booking reference number which is exclusive to you and your vehicle rental and is shown on your booking voucher/booking receipt. easycar.com (a trading name of Low Cost Vehicle Rental (UK) Limited) Our appointed representatives who are responsible for the introduction of insurance business to us, the administration of this policy and the collection of premiums on our behalf. Endorsement(s) A change in terms of this insurance, which replaces or alters the standard insurance wording. Excess An amount you have to pay towards the cost of a claim under the primary motor insurance policy arranged by the rental company in conjunction with your vehicle rental agreement. Geographical limits This insurance applies on a worldwide basis provided that the primary motor insurance policy that has been arranged by the rental company in conjunction with your vehicle rental agreement has been extended to apply in the country in which the insured vehicle is being used and/or driven. The countries in which this policy applies will be shown on your booking voucher/booking receipt. For the avoidance of doubt this policy does not apply in Afghanistan, Belarus, Cuba, Congo, Iran, Iraq, Ivory Coast, Liberia, North Korea, Myanmar, Sudan, and Zimbabwe nor in any other country which is subject to a notice not to travel by any UK Government Department Insured vehicle The private motor car rented to you on a daily or weekly basis under a vehicle rental agreement. For cover to commence under this insurance the vehicle must be collected from the rental company at a location within the geographical limits of this insurance by the insured person. Period of insurance The period that the insured vehicle is on hire as shown on the vehicle rental agreement. Primary motor insurance policy A valid Comprehensive policy in respect of the insured vehicle arranged by the rental company with the primary motor insurer. Primary motor insurer An insurance company or Lloyd s Syndicate authorised by the relevant regulatory authority to transact motor insurance business in the country in which the insured vehicle is hired and in any other country shown on your booking voucher/booking receipt. Rental company A vehicle rental company or agency licenced by the regulatory authority in the country in which the insured vehicle is hired to the insured person(s) Specified driver(s) The driver(s) who are named as permitted to drive the insured vehicle on the vehicle rental agreement. Roadside assistance company

3 The company appointed by the rental company to provide roadside assistance in the country in which the insured vehicle is being used/driven. Vehicle rental agreement The contract of hire between you (the insured person) and the rental company. We/Us/Our Zenith Insurance Plc and/or its co-insurers whose names and addresses are available upon request. You/Your/the Insured person(s) The insured policyholder named in the policy schedule who must be eligible to drive. The insured policyholder must be the individual named as the main driver and lead contracting person on the vehicle rental agreement. The specified driver(s) are also included within this definition when they are using the insured vehicle on the order of or with the permission of the insured policyholder.

4 Part A Cover Provided General limitations Cover applies to only one rental vehicle at any one time. Cover commences from the time you take legal control of the rental vehicle and ceases when you return the rental vehicle to the rental company either at the location of the original hire or elsewhere. Cover only operates if purchased prior to the collection of the rental vehicle from the rental company. Cover is only valid in the countries specified on the booking voucher/booking receipt. Section 1 Excess Protection What is Covered We will provide cover to reimburse the amount of excess which you are required to pay under the primary motor insurance policy arranged by your rental company for any single incident or series of incidents under a single vehicle rental agreement in respect of physical loss or damage to the insured vehicle including: physical damage to the windows and windscreen of the insured vehicle; and physical damage to the roof, tyres and undercarriage of the insured vehicle; and loss or damage resulting from fire, theft or vandalism. We will also provide cover to reimburse any costs for which you are responsible in relation to: The protection and removal of the insured vehicle to the nearest competent repairer or nearest place of safety following an incident involving physical loss or damage to the insured vehicle; and The loss of use of the insured vehicle. Payment can only be made if a claim is successfully made by you under the primary motor insurance policy arranged by the rental company. The most we will pay The most we will pay under this section of the policy will be the amount of excess applying under the primary motor insurance policy arranged by the rental company; or the maximum amounts of 3500 for any single claim or 5000 for a series of claims arising during any single vehicle rental agreement, whichever is the lower.

5 Section 2 - Replacement Keys What is covered If one or more of the keys or lock transmitters or entry cards for a keyless entry system for the insured vehicle is lost or stolen we will pay for the costs incurred in replacing: the door locks and/or boot or tailgate lock; and the ignition/steering lock; and the lock transmitter and/or central locking system. The most we will pay The most we will pay under this section of the policy will be 300 for any one claim. What is not covered Any claim resulting from the keys, lock transmitters or entry cards being left in or on the insured vehicle. We will not pay for the cost of replacing alarms or other security devices used in connection with the insured vehicle under this insurance. We will not pay claims under this section of the policy unless the appointment of the locksmith has been approved by both the roadside assistance company and rental company and the locksmith s receipts and invoices are approved by the roadside assistance company before they are submitted to us for payment and/or reimbursement. Section 3 Being Locked Out of the Insured Vehicle What is Covered We will provide cover to reimburse the costs incurred in gaining access to the insured vehicle if you are unintentionally locked out of the vehicle during the period of the single vehicle rental agreement covered by this policy. Both the roadside assistance company and rental company must approve the appointment of the locksmith to be used to gain access to the insured vehicle. The most we will pay The most we will pay under this section of the policy will be 100 for any one claim. What is not Covered We will not pay claims under this section of the policy unless the appointment of the locksmith has been approved by both the roadside assistance company and rental company and the locksmith s receipts and invoices are approved by the roadside assistance company before they are submitted to us for payment and/or reimbursement.

6 Part B General Exceptions THESE GENERAL EXCEPTIONS APPLY TO THE WHOLE OF THE INSURANCE This policy does not cover 1. Any claim for an excess which has already been waived by the primary motor insurer or reimbursed to you by the primary motor insurer or a third party. 2. Any claim for loss or damage arising while the insured vehicle is being: (a) used for a purpose which is not permitted or is excluded by the terms of the vehicle rental agreement or corresponding Certificate of Motor Insurance issued by the primary motor insurer; or (b) used on the Nurburgring Nordschleife or any race track, racing circuit or prepared course unless you have told us about this and we have agreed to provide cover; or (c) used beyond the limits of the public highway; or (d) (e) used to transport illegal goods or contraband; or driven by you or any specified driver, should it be proved to our satisfaction that the driver was under the influence of alcohol or drugs at the time of such loss or damage occurring. A conviction under the relevant law (including a conviction for failing to supply a specimen of breath, blood or urine) shall be deemed to be conclusive evidence that the driver at the time of the loss or damage was under the influence of alcohol or drugs. 3. Any claim for loss or damage that occurs outside of the geographical limits of this policy. 4. Any claim for depreciation or loss of value following repairs. 5. Any claim arising from confiscation, requisition or destruction by or under the order of any Government or Public or Local Authority. 6. Any claim resulting from loss or damage caused deliberately by you or any of the specified drivers. 7. Any claim for loss or damage that occurs prior to the commencement date of this policy or after the expiry date of this policy. The commencement and expiry dates of this policy must coincide with the dates of hire shown on the vehicle rental agreement otherwise cover will be invalid. 8. Any claim whilst the insured vehicle is being driven by or is in the charge of: a) any person who is aged less than 21 years of age or more than 84 years of age; or b) any person who is not named as a specified driver on the vehicle rental agreement; or c) any person who does not hold a valid driving licence in the country of hire or other country in which this insurance applies or alternatively does not hold a full international driving licence. 9. Any claim arising from the rental of a vehicle which is: a) more than 20 years old; or b) valued at more than 65,000; or c) considered to be unconventional or unusual (e.g. is antique or exotic ) 10. Any claim arising from the rental of a vehicle which is not a private motor car or which is a vehicle that has more than 15 seats. There is no cover under this insurance for loan or courtesy vehicles, off-road vehicles or motor homes. 11. Any legal liability of whatsoever nature directly or indirectly caused by or contributed to or arising from: a) ionising radiations or contamination by radioactivity from any irradiated nuclear fuel or from any nuclear waste from the combustion of nuclear fuel, or b) the radioactive toxic explosive or other hazardous properties of any explosive nuclear assembly or nuclear component. 12. Any consequence of war invasion or act of foreign enemy, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection or military or usurped power. 13. Loss or damage caused by an inappropriate type or grade of fuel being used. 14. Loss or damage caused by wear and tear, gradual deterioration, domestic animals, pets, insects or vermin. 15. Loss of or damage to the insured vehicle resulting from mechanical breakdown. 16. Loss of or damage to the contents of the insured vehicle or any property being transported by you or otherwise in your care, custody or control. 17. Any liability loss or damage if either you or a specified driver is in breach of the terms and conditions of the vehicle rental agreement at the time such liability loss or damage occurs.

7 Part C Policy Conditions THESE GENERAL CONDITIONS APPLY TO THE WHOLE OF THE INSURANCE 1. Payment of Premium, Keeping to the Policy Terms & Avoiding Misrepresentation We will only provide the cover described in this insurance policy if:- you have paid or agreed to pay the premium for the current period of insurance, and you or any person claiming protection has kept to all of the terms and conditions of this policy (including those applied by endorsement) as far as they can apply, and you have taken all reasonable care in answering all questions and in not making any misrepresentations in relation to this insurance at the time you applied for cover through the rental company. Under the Consumer Insurance (Disclosure and Representations) Act 2012 your failure to take reasonable care to avoid misrepresentation in relation to the information provided could result in your policy being cancelled or your claim being rejected or not fully paid. If you or anyone acting on your behalf knowingly commit a fraudulent act or submit a fraudulent document or make a fraudulent statement or exaggerate any claim made under the policy, we will not pay the claim and cover under this and all other insurances currently in force with us with which you are connected will cease immediately. You will not be entitled to any refund of premium under any policy. 2. Looking After the Insured Vehicle You or any specified drivers are required to maintain the insured vehicle in a roadworthy condition. You or any specified driver in charge of the insured vehicle are required to take all reasonable care to safeguard it and its contents from loss or damage, for example the car should not be left unlocked. We shall at all times be allowed free access to examine the insured vehicle. 2. Accidents or Losses If your claim is due to theft, attempted theft, malicious damage or vandalism, you must also notify the police and obtain a crime report number. If we ask to examine driving licences and documentation before agreeing to settle a claim under this policy you must supply this documentation before we can proceed with the settlement. We shall be entitled to take over and conduct the defence or settlement of any claim or prosecute any claim in the name of any person covered by this insurance. 4. Claims Procedures No admission of liability, payment or promise of payment shall be made or given by you or any person on your behalf. No proceedings may be commenced against, or settlement accepted from, any other party without our written consent. We shall have discretion in the conduct of any proceedings or in the settlement of any claim. You must give us whatever co-operation, information and assistance we require in dealing with any claim under this policy. If there is any other insurance in force which covers the same loss, damage or liability as this insurance, we will only pay our proportionate share of the claim. 5. Cancellation Cancellation by Us We can cancel this policy by giving you 7 days notice in writing to your last address notified to us. We will refund the premium relating to the remaining period of insurance on a pro rata basis.

8 Non-payment of premium We may at our discretion reduce any claims payment by the amount of outstanding or overdue premiums that you owe us. Cancellation by You Owing to the nature of this short period policy and associated administration costs, there is no refund of any monies paid in the event of the policy being cancelled. 6. Right of Recovery If under the laws of any country in which this insurance applies, we have to make payments which but for those laws would not be covered by this policy, you must repay the amounts to us. Part D How to Make a Claim If you wish to make a claim under this policy, you should contact the Claims Department at our service providers in the UK. If your claim is due to theft, attempted theft, malicious damage or vandalism, you must also notify the police and obtain a crime report number. For cover to be valid under this insurance any claim must be reported within 31 days of the incident likely to give rise to a claim under the policy. Once the claim has been reported to us via our service providers we will need you to submit the following documentation in support of your claim: 1. a copy of your vehicle rental agreement; and 2. a copy of your policy schedule and/or booking receipt/booking voucher showing your booking voucher number; and 3. a copy of your driving licence (front/back and counterpart) or the driving licence of the specified driver in charge of the insured vehicle at the time of the incident giving rise to a claim under the policy; and 4. copies of the receipts, invoices and other documents confirming the amounts paid by you in relation to the incident for which you are claiming. This documentation must include a copy of your credit card statement(s) or other proof of payment of the amounts claimed. Dependant on the circumstances of the incident leading to the claim we may also require the following additional documentation: a) a copy of any accident damage report issued by the rental company; and b) a copy of any police report issued in relation to the loss or damage leading to a claim under the policy. Your failure to follow the above procedures and/or submit the appropriate documentation may invalidate your right to claim under the policy All claims correspondence should be addressed to the Claims Department at our UK service providers: Zenith Insurance Management UK Limited, Chester House, Harlands Road, Haywards Heath, West Sussex, RH16 1LR Part E - Complaints Procedure We want your experience with us to be second to none but if this is not the case, we want to know about it. Important Information for Policyholders Data Protection and Sharing Information with other organisations Data Protection We are governed by the Data Protection legislation applicable in both the United Kingdom and Gibraltar. Any information provided by you in connection with this policy will be processed by us in compliance with the provisions of the UK Data Protection Act 1998 and the Gibraltar Data Protection Act 2004 for the purpose of providing insurance and handling claims

10 if any. Under this legislation we are required to tell you the following information. It explains how we may use your details and tells you about the systems we have in place that allow us to detect and prevent fraudulent applications and claims. The savings that we make help us to keep premiums and products competitive. Insurance Administration Information you supply may be used for the purposes of insurance administration by us and our agents and by re-insurers. In assessing any claims made, we may undertake checks against publicly available information such as electoral roll, county court judgement, bankruptcy or repossessions. Information may also be shared with other insurers either directly or via those acting for the insurer such as loss adjusters or investigators. Information on Products and Services We may use the details you have provided to send you information about our other products and services or to carry out research. We may contact you by letter, telephone or . Please be reassured that we won t make your personal details available to any companies outside the Markerstudy Group to use for their own marketing purposes. Fraud Prevention, Detection and Claims History In order to prevent and detect fraud we may at any time share information about you with other organisations and public bodies including the Police. We may check and/or file your details with fraud prevention agencies and databases, and if you give us false or inaccurate information and we suspect fraud, we will record this. We and other organisations may also search these agencies and databases to: - Help make decisions about the provision and administration of insurance, credit and related services for you and members of your household; - Trace debtors or beneficiaries, recover debt, prevent fraud and to manage your accounts or insurance policies; - Check your identity to prevent money laundering, unless you furnish us with other satisfactory proof of identity; In addition we may undertake credit searches and conduct additional fraud searches (this may include requests for copy driving licences, utility bills and other documentation to establish the identity of any person applying for insurance). Claims History Insurers pass information to the Claims and Underwriting Exchange Register, run by Insurance Database Services Ltd (IDS Ltd) and the Motor Insurance Anti-Fraud and Theft Register, run by the Association of British Insurers (ABI). The aim is to help us to check information provided and also to prevent fraudulent claims. Under the conditions of your policy you must tell us about any Insurance related incidents (such as fire, water damage, theft or an accident) whether or not they give rise to a claim. When you tell us about an incident we will pass information relating to it to these databases. We may search these databases when you apply for insurance, in the event of any incident or claim, or at time of renewal to validate your claims history or that of any other person or property likely to be involved in the policy or claim. Other Insurers We may pass information about you and this policy to other insurance companies with which we either reinsure our business or who are dealing with a claim made under this policy. In addition, information may be passed to other insurance related organisations in common with industry practice. These companies may be located in countries outside the UK but within the European Economic Area ( EEA ). We may also share data with other group companies who may be located outside of the EEA.
