8 Machinery Directive (98/37/EC) Machinery Directive (98/37/EC) Supply of Machinery (Safety) Regulations 1992 EU Treaty Article 95 (was 100a) - market harmonisation Introduced under European Communities Act 1972 as the Supply of Machinery (Safety) Regulations 1992 Applies to the supplier of the machinery/safety component in the EU. The responsible person can be the manufacturer, importer or end user A New Approach Directive Essential Health & Safety Requirements (EHSRs) (Annex 1/Schedule 3) Harmonised Standards
9 Machinery Directive (98/37/EC) Machinery Directive (98/37/EC) Supply of Machinery (Safety) Regulations 1992 The manufacturer or his representative, resident in the EC is responsible for the following: To carry out a hazard assessment to analyze all of the risks related to the machinery and if required apply measures to reduce these, To ensure that the machinery conforms to the relevant essential health and safety requirements, To draw up an EC declaration of conformity/incorporation and affix a CE mark, To draw up a technical construction file.

12 Machinery Directive (98/37/EC) Machinery Directive (98/37/EC) Supply of Machinery (Safety) Regulations 1992 The manufacturer or his representative, resident in the EC is responsible for the following: After conformity assessment procedure, issue: an EC declaration of conformity for complete machines and safety components a declaration of incorporation for part machines (e.g. those to be incorporated into other machinery) Then affix a CE mark to a complete machine - only if it conforms to all relevant Directives

18 Use of Work Equipment Directive (89/655/EC) Use of Work Equipment Directive (89/655/EC) Provision and Use of Work EU Treaty Article 137 (was 118a) - health and safety Introduced under HSWA (Section 15) as the Provision and Use of Work (PUWER) Work equipment - any machinery, appliance, apparatus, tool or installation for use at work Applies to the ongoing use of the machine, even if it was supplied to comply with the Machinery Directive..
19 Use of Work Equipment Directive (89/655/EC) Use of Work Equipment Directive (89/655/EC) Provision and Use of Work (continued) Use any activity involving the work equipment, including starting, stopping, programming, setting, transporting, repairing, modifying, maintaining, servicing and cleaning Directive stipulates minimum requirements Not a new Approach Directive, therefore: No EHSRs or Harmonised Standards But does have a supplementary ACoP (HSWA s.16)
20 Provision and Use of Work Use of Work Equipment Directive (89/655/EC) Provision and Use of Work In general terms, the Regulations require that equipment provided for use at work is: suitable for the intended use; safe for use, maintained in a safe condition and,in certain circumstances, inspected to ensure this remains the case; used only by people who have received adequate information, instruction and training; and accompanied by suitable safety measures, e.g. protective devices, markings, warnings.

23 Provision and Use of Work Use of Work Equipment Directive (89/655/EC) Provision and Use of Work Controls and control systems regs14-18 Ensure that equipment has suitably located and easily identifiable controls e.g. start, accelerate, stop and emergency stop Ensure control systems are SFAIRP safe, and chosen with due allowance for failures, faults and constraints Isolation from sources of energy reg 19
24 Provision and Use of Work Use of Work Equipment Directive (89/655/EC) Provision and Use of Work Stability and Lighting regs 20 and 21 Maintenance Reg 22 Ensure that maintenance can be carried with the equipment shut down; or, Maintenance can be carried out without exposing the person to risks; or, Appropriate measures can be taken for the protection of maintenance personnel.

Regs transitional provisions, repeals of Acts and revocation of instruments Machines that comply with the EHSRs of the Machinery Directive will generally comply with PUWER Regs and at the time of supply
26 Provision and Use of Work Use of Work Equipment Directive (89/655/EC) Provision and Use of Work Employers must therefore Ensure equipment conforms to relevant essential requirements, is fit for purpose and fit for the conditions in which it is used Ensure that risks created by the use of the equipment are eliminated where possible, or otherwise adequately controlled Ensure that equipment can be safely maintained in a safe condition for use
