1 REGULATION ON TEACHING AND RESEARCH POSITIONS IN CONSTANTA MARITIME UNIVERSITY

2 CHAPTER I. GENERAL PROVISIONS Art. 1. In Constanta Maritime University (CMU) teaching positions are subject to contests in accordance with: National Education Act, No. 1 of and 92/ GEO Order of the Minister of Education, Youth and Sport no. 6560/ GD 457 of 26 May 2011 approving the methodology framework for competition for teaching and research positions in higher education OMEN Nr. 3759/2011 on the Regulation of organization and functioning of the National Council for Titles, Diplomas and Certificates (CNATDCU). CMU Charter Decisions of Constanta Maritime University Senate. The contest is public and takes place under this Regulation. Art. 2. Candidates for a teaching position must have a specialization (certified by recognized legal degree and / or scientific results) in accordance with the disciplines the candidates apply for. Art. 3. At the contest for a teaching or research position can participate Romanian or foreign citizens without any discrimination under the law. The Methodology of the competition cannot contain discriminatory provisions based on gender, ethnic or social origin, religion or belief, disabililities, political, social or economic condition. Art. 4. The competition methodology does not refer to seniority and does not contain provisions to disadvantage candidates from outside the institution. Art. 5. Description of the vacant position will be in detail and will express the real needs of the university, and not short, artificially, to limit the number of potential candidates. Art. 6. A teaching position in a department payroll, to one of the fields associated with a higher education fields is characterized by position (sequence); teaching degree (university assistant lecturer / lecturer, associate professor, professor) higher education disciplines included, teaching and research activities associated with the post. Art. 7. All teaching and research posts can be taken, on a finite term or indefinitely. Hiring indefinitely for any teaching or research post is possible only through public contest published in the Official Gazette, organized by CMU, after holding the title of doctor. Art. 8. Teaching positions reserved, vacancies or temporary vacancies are covered prevalently of CMU permanent teachers or school staff member by paying by the hour, according to Law no. 1/2011. Hiring professionals with recognized scientific value in this field, inventions, and innovations, awards, scientific publications in the country or abroad, as invited associates, is proposed by the department board and the faculty board, and approved by CMU Senate.

3 Art. 9. (1) Persons who are spouses, in-laws and relatives to the third degree including one or more candidates may not, directly or through intermediaries: a) participate in the decision on the appointment of the competition commission, b) be members or alternate members of the competition, c) be engaged in professional or administrative assessment decisions in the competition, d) be involved in resolving complaints. (2) It is considered to be involved in the process of competition persons who: a) participate in the decision on the appointment of the competition, b) members or alternate members of the competition, c) are involved in vocational assessment decisions or administrative authority in the contest, d) are involved in resolving complaints. (3) There cannot be involved in the competition procedure persons who: a) spouses and relatives to the third degree with one or more candidates, b) are engaged in the same institution with a candidate who holds a management position and are hierarchically subordinate to the candidate c) are associated with a candidate in companies where each owns shares representing at least 10% of the company d) are or have been paid through research projects that a candidate acted as project director for the last 5 years preceding the contest, e) receive or have received in the last 5 years preceding the competition benefits of any kind from a candidate. Art. 10. In case that after winning a contest by a candidate, one or more of the CMU is to be in a situation of incompatibility under art. Article 295 (4) of the National Education Law no. 1/2011, appointment and granting of university title by CMU can occur only after solving situation / incompatibility. How to solve incompatibility is communicated to MEN within 2 working days from the settlement. Art. 11. (1) a competition for a teaching and research place can be held only if it is declared vacant, designated as such in the payroll, drawn up annually or made vacant during the academic year by one of the following ways: (a) termination of employment, under the law, (b) transfer of a person occupying another position within the CMU, as a result of winning a contest. (2) teaching and research posts cannot be open to competition by changing a post to a senior one. Art. 12. (1) OMEN 6.560/2012 compliance with the provisions on minimum standards for acceptance participating in competitions for the titles of associate proffessor and professor and Researcher of the CS1 and CS2 is the first condition for participation in the competition for these positions. (2) To check compliance with national minimum standards under OMEN 6.560/2012, candidates prepare records in conformity with OMEN, specific to each area and they are checked more than ten days before the contest by the Verification Commission appointed by the Rector's decision. Attributes of the committee refer strictly to meet the minimum standards of employment verification teaching positions of each candidate. The committee shall include teaching staff moral and professional prestige. The Commission is appointed for a period of four years and can be amended or supplemented at each contest organized. (3) CMU cannot create its own methodology or other documents equivalence of a candidate meeting the minimum standards of national standards, criteria and indicators other than those provided by these national minimum standards.

4 (4) If the Commission decides verification found failure of meeting the criteria of minimum mandatory standards the file cannot be sent to the competition commission. The verification can take place in public meetings attended by candidates. (5) The applicant may appeal the Commission's decision within 24 hours of its publication. Within 72 hours Rector will appoint a committee for appels. CHAPTER II. ESTABLISHMENT AND HOLDING A CONTEST FOR VACANCIES Article 13 (1) In accordance with the legislation in force, a competition for teaching and research can be held at least for: a) Assistant Professor, indefinite time b) Lecturer c) associate professor d) professor e) research assistant for indefinite period f) Senior Researcher III, g) Senior Researcher II, h) Senior Researcher I. (2) Constanta Maritime University can organize a competition for a teaching position only if it is declared vacant. (3) A position is considered vacant if so provided in the positions of the department, drawn annually or vacant during the academic year. Art. 14. Departments with a vacancy rate of over 70% cannot hold contests for teaching positions. Art. 15. The proposal to hold a contest for a teaching post is made by the department leadership and is based on occupancy rate of teaching positions and in conjunction with the strategic plan of the institution and financial resources. Art. 16. Faculty Council approves lists of teaching positions proposed for competition by faculty departments. List of suggested post for contest, centralized at faculty level and approved by the dean, is submitted for approval of the Board of Directors of CMU, within 10 calendar days from the start of the academic semester. Art. 17. CMU Managing Board send MEN the request for publication in the Official Gazette of Romania, Part III, the vacancies for indefinite time within 30 calendar days of the start of each semester of the academic year, including the following documents: a) list of proposed stations on the contest and structure, signed and stamped by the Rector b) extract from the department payroll containing Vacancies, signed by the restor, dean and head of the department, c) the rector s declaration on own responsibility, certifying that all contests regard only subjects in the curricula of specializations / programs established legal studies, including the form of education and place of the event, (d) specific rules of competition.

5 Art. 18. Public announcement of the contest is published at least 2 months before the date of the first contest. Registration for the contest begins on the day of publication in the Official Gazette of Romania, Part III and ending 15 days before the first contest. Notices shall be published at least in the following ways: a) in a visible location on the front page of the CMU website, b) on a specialized website run by MEN, c) in the Official Gazette of Romania, Part III the (occupied indefinitely). CMU and MECTS may announce comtests by any means, including publication in the media, national and international scientific publications on websites specialized in the publication of job offers and the like. Art. 19. The contest website of the Constanta Maritime University will publish the following information: a) description of the vacant position, b) the tasks / activities for the vacant position, including teaching load and types of activities included teaching norm, ie the norm research, c) minimum wage job when allocating employment d) competition calendar, e) evidence of the contest theme, including lectures, courses or subjects or such other committee of the contest can choose themes evidence actually supported f ) description of the competition procedure g) the list of documents that applicants must include in their application files, h) to be sent to the address of the contest folder. Advertisement of posts of associate professor and professor will be published in English. Art. 20. The websites of the competition Constanta Maritime University managed respectively by the Ministry of Education, Youth and Sports will be published at the latest within 5 working days of the deadline for entering the contest, each of the candidates and with the protection of personal data within the meaning of the law: a) curriculum vitae, b) checklist of minimum standards are met c) the nominal composition of the competition commission. d) complete list of works CHAPTER III. ESTABLISHING THE COMPETITION COMMISSION FOR TEACHING POSITIONS Art.21. (1) Establishing of the components of the competition is made by publication on the contest announcement post for each vacant position. (2) The contest commission can include alternates. (3) The Council department in whose structure the post is, make proposals for the composition of the committees of the competition, which was approved by the faculty council. The nominal composition of the competition along with the opinion of the faculty, the dean\'s signature is transmitted CMU and subject to Senate approval. Following approval by the University Senate, the competition commission is appointed by decision of the Rector. (4) after the Rector s decision, it is sent to the Ministry of Education, Youth and Sports and the nominal components of the competition are published on the website of the contest, as well as on

6 CMU website. For positions of associate professor, professor and researcher I and II, the committee is made public in the Official Gazette of Romania, Part III. Art.22 (1) The competition committee consists of 5 members, including its president, specialists in the open position or in related fields. (2) In case of unavailability of participation of a member from the Committee, the member shall be replaced by alternates, appointed by the same procedure as committee members. (3) The decisions of the contest committee are taken by secret ballot of the members. A decision of the Commission shall be valid if the vote of at least three members of the committee. (4) The works of the competition are headed by the President. (5) Members of the committee are Constanta Maritime University or institution outside the country or from abroad who have an employment contract with the respective higher education institutions, the publication date of the contest. If higher education institutions abroad, they are necessarily included in the list of those approved by OMEN, prepared according to art.216 par. (2). f) of Law no. 1/2011. (6) a position of associate professor or professor, at least three committee members must be from outside the institution that organizes the contest, in the country or abroad. (7) for a position of professor, except in areas with Romanian stations, at least one member has an employment contract, the date of publication in the official gazette of removal from the contest post with an educational institution foreign education and research, which is included in the list approved by Ministerial Order issued under Art. 216, paragraph 2, item f of National Education Law 1/2011, the proposal CNATDCU and CNCS. (8) Members of the contest must have PhD and teaching have a title superior or at least equal to that of the vacant position or to members abroad to meet university standards proper open position. (9) For the exclusive purpose of participation in the competition commission, the equivalence of foreign didactic titles of the applicants from abroad with local ones is done by the University Senate which approve the composition of the committees. (10) The president of the competition is one of the following: Head of the department, the dean or the dean of the faculty, a member of the department or faculty council delegated for this purpose by vote of the board. In case of Associate Professor and Professor positions, the Chairman is usually a member of the Senate. (11) Data on the establishment of the competition are presented in Appendix 7, members must have significant powers in specific disciplines in the post in question. CHAPTER IV. ENTERING THE COMPETITION FOR TEACHING POSITIONS Art. 23. (1) The conditions for entering the competition for teaching positions approved by the legal department of CMU, are the following: - Minimum attested status of PhD student for assistant professor position awarded to a determined period and holding a doctor diploma recognized in Romania for teaching positions of assistant, lecturer and professor, indefinite employment. - Average of BS years of education plus Master degree (total annual average / total years of study) of at least 8.00 [PhD] and [confirmed doctors], while the average of the BS diploma and master dissertation at least 9,00, at the the first successful contest for a teaching job in CMU. -Meeting the national minimum standards for acceptance to participate in contests for conferring scientific and teaching positions specific to associate professor and professor approved by OMEN Nr /2012.

7 -Considering the specific specializations and study programs and the delay in setting up the doctoral domain for the marine engineering and navigation specializations of CMU, the Competition Committee may allow the participation to contest for vacancies recognized scientific experts in the field, the proof being the inventions, innovations, awards, scientific publications in the country or abroad. They can meet the minimal standards by means of: holding the title of maritime expert, member in IMO committees, IMO auditor, valuable publications, member of international associations in the field of navigation, maritime safety committee member, etc.. -Documents required for attestation of studies. CHAPTER V. FILLING OF TEACHING POSITIONS Art. 24. (1) Certification of these conditions of competition is the responsibility of the contest Committee, composed of experts selected according to specific vacant position and their report will be approved by the Faculty Council and by the CMU Senate. (2) Requirements for the position of assistant professor: 1) PhD-student status (for short time jobs) or holding the diploma of doctor (for the long time jobs) in the field of the position or related fields; 2) Specialization consistent with the structure of position, referring to BS studies, master and doctoral degrees, all confirmed by the Competition Committee, after taking into consideration even continuing education and specialization. 3) Minimum 3 scientific papers in extenso, presented at scientific sessions (including students sesssons), and / or published in journals, in the position domain for short time jobs. 4) Minimum 3 scientific papers published in full in a journal / conference volume indexed in an international database [BDI], of reference for the job domain [ISI journals and Thomson Reuters - Class A-CNCSIS, ISI Conference Proceedings; journals CNCSIS B +-other BDI] at a for short time jobs. 5) Actively participated and achieved practical laboratory equipment, guidance specific educational activities to guide students to participate in scientific communication sessions, carried out teaching in paid by the hour regime and performed very well this work. 5) Passing of three tests, the direct assessment of expertise in disciplines consistent with the open position: (a) written test (b) practical test (laboratory or management guidance seminar), (c) oral test. The result of the competition tests is assessed by each committee member by grades from 10 to 1, the final mark representing their average. The Commission shall, within 5 days from the last test, produce a report on the competition. The report includes compulsory assessment on the public lecture, held in accordance with Art. 36 para 1 for the post published in the Official Gazette. The content of the Commission report is presented in Appendix 8. 6) A person who has not obtained a doctor degree can not hold the position of Assistant Professor at CMU for an aggregate period of more than 5 years. At the end of this period, the employment of the person is no longer valid. For the position of Assistant Professor, long time, a PhD is necessary. 7) As for the recognized experts in the field for their inventions, innovations, awards, scientific publications in the country or abroad, meeting minimal standards for the contest presented in paragraph 4 of this Article shall be replaced by: holding the title of maritime expert, IMO member committee, auditor IMO, sea and river officer certificate, valuable publications, member of international maritime associations in the field of navigation, maritime safety committee member, etc. (3) For lecturer positions the requirements are:

8 1) Holding diploma of doctor in the job s field or in related fields, 2) Specialization consistent with the structure of position, referring to BS studies, master and doctoral degrees, all confirmed by the Competition Committee, after taking into consideration even continuing education and specialization. 3) Obtain a minimum qualification of "good" following specialized lecture (course), with the theme set by the Competition Commission relating to the specific job domain. 4) A minimum of seven scientific papers published in full in a journal / conference volume, of which a minimum of 5 indexed in international databases [BDI], of reference in the field [ISI journals or Thomson Reuters-category A-CNCSIS, ISI Conference Proceedings, magazines B + - CNCSIS, other BDI], of which at least 2 have them as main author and a minimum of 2 are ISI. 5) Actively participated and achieved practical laboratory equipment, guidance specific educational activities to guide students to participate in scientific communication sessions, carried out teaching in paid by the hour regime and performed very well this work. 6) Recommendation of the competition committee for the open position after evaluation of the file in accordance with the aspects listed under Articles The chairman will make a report [Appendix 9] based on the assessment reports of the committee members, which assesses the candidate's teaching and scientific activity, the extra educational work. The report must include the assessment of the public lecture, held in accordance with Article 36. Based on this analysis each member of committee will cast their vote for one of the candidates or none. The Commission proposes for the post the candidate who is nominated by the majority of its members. (4) Associate professor functions require: 1) Holding diploma of doctor in the open position or in related fields, 2) Compliance with national minimum standards for acceptance to participate in contests for conferring scientific and teaching titles specific to Associate Professor approved by OMEN 6560/ ) obtain a minimum qualification of "good" after a specialized lecture (course), with the theme set by the Competition Commission relating to the field of the vacant position for candidates who come from higher education. 4) Participation in the development of scientific research in the country / abroad on contract / grant, or other research works in the open position, as a member of the research team or project manager. 5) Recommendation of the competition committee following the file evaluation with regard to the aspects set out in Articles The Commission will appreciate if scientific work that led to the fulfillment of the minimum standard for registration in the competition has specific relevance for the vacant position. The chairman will report [Appendix 10], based on the assessment reports of the committee members, the evaluation of the candidate's teaching and scientific activity, the extra educational work. The report must include the assessment on the public lecture, held in accordance with Article 36. There will also be considered the letters of recommendation regarding the applicant's professional qualities, developed by experts in this field in the country or abroad, established in accordance with Article 28. Based on this analysis each member of the committee will cast their vote for one of the candidates or none. Commission proposes for the post the candidate who is nominated by the majority of its members. (5) Professor positions require: 1) Holding diploma of doctor in the open position or in related fields, 2) national minimum standards for acceptance in competitions for scientific and educational titles specific to university professor, approved by OMEN 6560/2012, Round the time of application.

9 3) Obtain a minimum qualification of "good" after a specialized lectures (course), with the theme set by the Competition Commission relating to the specific vacant position for candidates who come from higher education. 4) Participation in the development of scientific research in the country / abroad on contract / grant, or other research papers in the open position, as a member of the research team or the director / project manager. 5) developed at least one specialty book, published in a publishing house representative clearly outlining their contributions to the development of knowledge in the field, as first / single / coauthor, in the case of publications with multiple authors will clearly highlight own contribution. 6) Recommendation of the competition committee following file evaluation accordin to the aspects presented in articles The Commission will appreciate if scientific work that led to the fulfillment of the minimum standard for registration in the contest and the ability certificate are of relevance to the specific open position. The chairman will report [Appendix 11], based on the assessment reports of the committee members, which assesses the candidate's teaching and scientific activity, the extra educational work. The report must include the assessment of thepublic lecture, held in accordance with Article 36. There will also be considered the letters of recommendation regarding the applicant's professional qualities, developed by experts in this field abroad, established in accordance with Article 28. Based on this analysis each member of the committee will cast their vote for one of the candidates or none. Commission proposes for the post the candidate who obtained the majority of votes. CHAPTER VI. Competitors register Art. 25. In order to enter the contest for a teaching candidate the applicants prepare a file [Appendix 1] that contains the following documents: a) The application for the contest [Appendix 2], signed by the candidate accompanied by an affidavit concerning the veracity of the information presented b) A proposal for the development of academic career, both in terms of teaching as well as in terms of scientific research, proposal written by the candidate hold a maximum of 10 pages and is one of the main criteria of selecting candidates. c) Curriculum vitae of the candidate, in writing / electronically [Appendix 3] d) list of papers written / electronic [Annex 5] e) checklist of the fulfillment of standards in the contest and / or employment position; checklist is completed and signed by the candidate [Appendix 4] f) Documents relating to the holding of the diploma of doctor: a certified copy of the diploma of doctor and if the original doctor's degree is not recognized in Romania, the statement recognition or equivalence thereof; g) summary in Romanian and English of the thesis or, where appropriate, habilitation thesis on one page maximum; h) Affidavit of the candidate that they are not in any incompatibility with the Law 1/2011, the National Education Act if they are winning the competition or lack of such situations of incompatibility [Annex 6] i) Copies of other certificates attesting to the applicant's studies j) Copy of identity card or, if the candidate does not have an identity card, passport or other identity document issued as an equivalent to identity card or passport; k) If the candidate has changed their name, copies of documents evidencing the change of name - marriage certificate or proof of name change; l) Not more than 10 publications, patents or other work of the candidate, in electronic format, selected by him and considered to be most relevant for their professional achievements; if one or

10 more publications are available in electronic format, the candidate will present in the file, a copy of the book / monograph whose author is, the conference site where work was presented, ISSN, Proceeding etc. or scanned copies in pdf format. m) once submitted by the candidate the file cannot have additions, changes or corrections. Art. 26. Curriculum vitae [Appendix 3] of the candidate should include: a) information about studies and diplomas awarded, b) information about work experience and employment c) information about research and development projects that they led as project and grants obtained, if there are such projects or grants, indicating for each source of funding, amount of funding and main publications and patents resulting d) information about the awards or other recognition of the scientific contributions of the candidate. Art. 27. List of works the applicant will be structured as follows [Appendix 5]: a) list of works, and the list of 10 works considered to be the most relevant by the candidate for professional achievements, which are included in the electronic format file which can be found in other types of work referred to in this article. b) doctoral thesis or theses c) Patents and other intellectual and industrial property titles d) books and book chapters, e) articles / studies in full, published in the main international scientific journals f) publications in full, the principal works published in international scientific conferences; g) other works and scientific contributions or, where appropriate, of artistic creation. It also recommends mentioning, whenever possible, all useful information for assessing the respective publications, such as magazines (including ISSN), rated (last year's impact factor, relative influence score etc. ) or indexed (no impact factor) in ISI Thomson Reuters (Web of Science specifying section) ditto for the conferences indexed in Thomson Reuters ISI Web of Science; journals and proceedings of conferences indexed in international databases (BDI) of reference, indicating these bases, in domain-specific databases (eg Chemical Abstracts, Metal Abstracts, INSPEC, etc.) indicating the work code, category and code Romanian CNCSIS recognized magazines, conference organizer and editor, quoting summary of these works, and so on. These data are stringent for the works selected from (a). Art. 28. (1) Candidates for the posts of Associate Professor should include in the file at least 3 names and contact addresses of personalities in this field in the country or abroad, outside the higher education institution whose post is put up, who have agreed to write letters of recommendation regarding the applicant's professional qualities. (2) Candidates for the position of professor must include in the file at least 3 names and contact addresses of personalities in the field of foreign higher education institutions and research the list approved by the Minister of Education, Research, Youth and Sports issued under Art. 216, paragraph 2, item f of National Education Law 1/2011. For national specific domains, credentials for candidates for the position of professor may come from some personalities in this field in Romania, outside the higher education institution whose post is put up. Art.29

11 The application file is prepared by the candidate according to Annex 1 and submitted to the Maritime University of Constanta, 104 Mircea cel Batran Street, specified on the Contest website, or through postal or courier services that confirm receipt in less than 45 days after publication in the Official Gazette of the contest, part III. Application file is sent to the members of the competition from the closing date for application process of competition no later than 5 working days before the first test of the competition. Art.30 The Secretariat of the department that created the post will receive complete set of works, consisting of one copy (copies) of each paper published and listed in the application form, the same day that registration took place. The set of works must contain the particulars of the candidate and a checklist of the content. Delivery and reception will be recorded in a report signed by the candidate and by a representative of the department designated by the director of the department. Art.31 The Legal Department of Constanta Maritime University will certify the candidate s fulfillment of the legal requirements. The decirsion will be communicated to the candidate within 48 hours of its issuance but not less than 5 working days before the first test of the competition. The files are submitted to the legal department within 7 days from the end of the enrollment period. Art.32 Where the number of candidates for a job, that met the legal conditions of competition, is less than or equal to 5 candidates, they will be invited by the university to take the tests. If the number of candidates for a job is greater than 5 the competition commission may preselect, on application files, at least 5 candidates to take the tests. Art.33 The candidates who meet the legal requirements will be invited by the university to attend the other candidates tests. CHAPTER VII. DUTIES OF THE DEPARTMENT Art.34 (1) For Assistant Professor vacancies, the Head of Department and the disciplines coordinators establish the study programs - including literature - in which candidates are to be examined. (2) Following the publication of jobs in the Official Gazette of Romania, Part III, it is displayed on the notice board of the department, the materials set out in Article 19 and after finishing the contest, those listed in Article 20, in a section dedicated to contests organized by the department, as well as any other material relating to contests. (3) The director of the department and the heads of the competition committees decide upon the committee activities (acceptance of competition files, preparing reports, etc) and will see that all the papers in the files will be checked by all committee members. Department directors shall ensure transmission to all members of the examination of the documents required (nomination in the committee, application file, CMU methodology). On planning the work of the committees it is necessary to take into consideration the legal time limit which is no more than 45 days after the end of the registration period. (4) The tests for all contests are planned and take place only once. It is recommended that three tests for assistant professor positions be programmed in two or three different days. All these actions are programmed so as to communicate the theme at least 5 working days before the test.

12 (5) After completion of the examination work, the director of the department receives all the contest papers from the committee presidents and hands them over to the Faculty Council. Senate members (folders with tender documents and reports / papers Commission). The complete set of publications kept at the department will be given back only after the contest, or validation by the Senate. CHAPTER VIII. RESPONSIBILITIES OF THE COMPETITION COMMITTEE Art. 35 The competition committee evaluates each candidate in terms of the following: a) relevance and impact of the scientific results of the candidate b) the candidate's ability to guide students and young researchers, c) the candidate's teaching skills, d) candidate's ability to transfer knowledge and results to the economic or social environment or to make public their scientific results e) the candidate's ability to work in teams and efficiency in scientific collaborations f) the candidate's ability to conduct research and development g) the applicant's professional experience in other institutions than the institution which organizes the competition, especially the experience in higher education institutions and research from the list approved by OMEN. Art.36 (1) The contest will assess the candidate's professional competence exclusively by one or more competition tests (specific to teaching position) including lectures, courses and the like. For all posts at least one contest is represented by a public lecture, at least 45 minutes, in which the candidate presents the most significant results of previous professional and academic career development plan. This test contains necessarily a session of questions from the committee and the public. Details of the contest, date, time and place of test will be found on university website. (2) For all teaching posts, candidates not coming from higher education will be evaluated by teaching lectures (course) in front of students and representatives of the committee. The activity is assessed by the Commission as: unsatisfactory, satisfactory, good, very good. Competition Commission may require such a course in the case of permanent or associated CMU teachers, if deemed necessary. Art.37 Competition consists in evaluating scientific activity and the teaching qualities of the candidates. The BS studies or similar, masters and doctoral studies, professional standing and professional and scientific activities and achievements are presented and assessed. Art. 38 Upon completion of the committee activities, its president will deliver all documents to the Department Director and a minute will be signed. Art.39 (1) If, for a good reason, a member of the committee cannot perform his duties the committee president Committee Chairman will make a report to Faculty Council. The decision of the Faculty Council shall be submitted to the CMU Senate that will decide republication or filling the vacant position with one of the previously approved substitutes or can nominate a new commission. (2) If the Commission has not fulfilled its legal duties within the legal period, the competition procedure is interrupted and can be resumed at the request of the department. The Faculty

13 Council will consider why the committee has failed to do their duties and submit a written report to the University Senate containing also proposals for sanctions. CHAPTER IX. CONTEST FINAL STAGE Art.40 Contest approval (1) For each job, the competition commission decide the hierarchy of the candidate and nominate the candidates who had best results. (2) The president of the contest committee shall make a contest report based on the assessment reports prepared by each member of the commission. This report is approved by decision of the committee and signed by each member of the committee and its president. Decisions are taken by the contest committee members by secret vote. A Commission decision is valid if voted by at least three members of the committee. (3) The Faculty Council examine the procedures established by this methodology and approve the contest report or not. The hierarchy established by the competition commission cannot be changed by the faculty council. (4) The Senate examine the procedures established by this methodology and approve the contest report or not. The hierarchy established by the competition commission cannot be changed by the senate. Art.41 (1) The decisions of the Faculty Council and the Senate shall be made by show of hands, by majority vote, on condition that at least two-thirds of the total members of the two management structures are present [teachers and students]. Art.42 Where no candidate gets at least 3 votes the title is not awarded or the teaching position is not filled. If the open position was not filled, a new contest will be organized and the same steps will be taken. Art.43 Within 2 working days after completion of contest competition the results will be on the website of the contest. Art.44 The granting of the job and academic title by CMU, is the Rector's decision starting with the semester following the contest. For all teaching positions, the appointment decision and granting academic title by CMU shall be sent by the CMU CNATDCU MECTS within two working days of the decision of appointment. Art.45 The appointment and the title of assistant professor is given to PhD students for a 5 year period. If in themeantime they do not get their PhD, the employment contract is terminated. The candidates who won the contest for the post of assistant professor published in the Official Gazette and have a Ph.D. will get an open-end contract. CHAPTER X. APPEALS Art.46 Appeals may be filed only for non-legal procedures.

14 Art.47 Where an applicant has elements that can prove breach of competition law proceedings, the applicant may appeal the decision within 5 days of the result. The appeal shall be in writing, registered at the rector s office and solved by the Board of Appeals, appointed by the faculty in matters relating to the department or by the Senate, for issues in the work of the faculty council, in maximum 30 days of the notification. Art.48 The faculty council or the senate shall answer the appeals within 30 days from receiving the conclusions of the appeal analysis committee. Art.49 Failure to comply with this methodology by people with responsibilities in the process of organizing and conducting competitions constitute a disciplinary offense and shall be punished in accordance with the National Education Law no. 1/2011 or other provisions. CHAPTER XI. FILLING VACANT TEACHING POSITIONS BY ASSOCIATED TEACHING STAFF Art. 50 Reserved teaching positions, vacancies or temporary vacancies, are mostly covered by permanent teachers of the institution and associated staff members paid by the hour, according to the National Education Law no. 1/2011. Art. 51 The associated staff may fill lecturer, associate professor and professor, during a semester or a whole academic year with possibility of extension, no age limit. Teachers in this category must be experts in the field of their position and to hold a PhD. Art. 52. For each semester of an academic year, in the week preceding the start the selection of associated teaching staff is conducted by a commission nominated by the department for each vacancy. If the teaching activity in both semesters are similar approval in the first half may be extended to the second, without further evaluation. Art. 53. The Commission consists of three members, the director of the department is chairman and two members with a teaching rank at least equal to that of the post in question, including course coordinators. Candidate evaluation is the analisis of the file submitted and an interview. The file contains: -an application for enrollment, -curriculum vitae, -list of publications, -copies of documents. The file is submitted directly by the candidate. The Commission may request additional information if deemed necessary. Art. 54. The committee evaluates the candidate in terms of the relevance of research results and training skills.

15 Art. 55. The files of candidates selected are kept at the department and its Director gives the Faculty Council a written presentation with proposals. After approval, they are submitted to the Senate. Temporary appointment of associated teachers is done by a decision of the Rector. CHAPTER XII. TEMPORARY FILLING OF VACANCIES WITH INVITED ASSOCIATED STAFF Art. 56 The University Senate may approve invitation of academics and other professionals with recognized value in the field, in the country or abroad, as associated professors invited. Art. 57 In case of specialists without university teaching rank recognized in the country, the University Senate may approve, after proper assessment, the holding of the rank appropriate to teaching performance in accordance with national standards. Art. 58 Employing recognized experts in the field who have inventions, innovations, awards, scientific publications in the country or abroad, as professors or associated professors, is approved by the department council and approved by the faculty council based on a file compiled for the department which requires the fillin of post. The final agreement will be given to the University Senate. Art. 59 The application file submitted to the department where the vacancy exists, contains: -The report on the need for temporary employment for a post of guest associate professor or professor; -department recommendation for a specific person, referring to job specifications of the post to be filled and candidate performance in relation to the minimum requirements for a position in CMU -curriculum vitae -list of papers of the recommended person for the job list; -other information in support of the proposal. Art. 60 Employment of specialists as professors or invited associate professors is made by the Rector s decision, for a period determined by the University Senate for each case. This Regulation was approved by the University Senate on 26 July 2012 and entered into force on July 27, The first revision of the Regulation was conducted from 08/11/2012 board meeting and forwarded to the CMU Senate for approval. LIST OF DOCUMENTS IN THE CANDIDATE S FILE AT REGISTRATION For enrollment in the contest for a teaching position, the candidate prepares a file containing the following documents: a) the application form [Appendix 2], signed by the candidate as well as statutory declaration confirming the veracity of the information presented in the file,

16 b) proposal to develop academic career, both in terms of teaching and in terms of scientific research, the proposal shall be drafted by the candidate on maximum 10 pages and is one of the main criteria for candidates. c) curriculum vitae of the candidate, in writing / electronic d) list of candidate s papers written / electronic; e) record of the fulfillment of contest standards and / or post employment; checklist is completed and signed by the candidate [Appendix 4] f) documents related to the degree of doctor: a certified copy of the doctor diploma and if the original doctor's degree is not recognized in Romania, certificate of recognition or equivalence thereof; g) summary in Romanian and English of the thesis or, where appropriate, habilitation thesis on one page maximum; h) statutory declaration of the applicant that there is no incompatibility in the Law 1/2011, the National Education Act if they are winning the competition or lack of such situations of incompatibility [Annex 6]; i) ) if the contest is for the post of professor, a certified copy of habilitation certificate; j) copies of other certificates attesting to the applicant's studies; k) if the contest ia for the post of professor, a notary certified copy of the certificate of habilitation or right to coordinate doctorates obtained before entry into force of Law no. 1/2011; l) copy of their identity card or, if the candidate does not have an identity card, passport or other identity document issued in for the same purpose; m) if the candidates changed their name, copies of documents evidencing the change of name - marriage certificate or proof of name change; n) no more than 10 publications, patents or other work of the candidate, in electronic format, selected by him considered to be the most relevant for their professional achievements, if one or more publications are not available in electronic format, the applicant shall include in the file, a copy of the book / monograph, the conference website, ISSN, Proceeding etc. or scanned copies in pdf format.
