1 August 18, 2014 Phi Gamma Delta c/o Vinson San Angelo, Graduate Trustee Member Dear Mr. San Angelo: A Student Code of Conduct complaint was submitted to the Dean of Students Office by the University of Arizona Police Department (UAPD) in reference to information discovered during the course of its investigation of a University of Arizona (UA) student death on April 4, This complaint alleges Phi Gamma Delta's involvement in multiple violations of the Arizona Board of Regents (ABOR) Student Code of Conduct. Reportedly Phi Gamma Delta hosted unregistered events where alcohol was provided and served to minors on multiple occasions including: one (1) incident in December 2013; six (6) incidents in January 2014; seven (7) incidents in February 2014; four (4) incidents in March 2014; and two (2) incidents in April These allegations occurred within the timeframe that Phi Gamma Delta was on Suspension of Events with Alcohol through February 2014 and the Probation period which ended May Phi Gamma Delta is also alleged to have engaged in hazing of new members, including but not limited to: New members cleaning before and after parties at the house. New Members cleaning the house after members made intentional messes. New members having food thrown at them and not being allowed to eat at the house. Members being told in an to give new members "a good old fashion pumping." Members kicking a new member in the stomach. New members performing personal acts of servitude for members. New members driving members around in their cars. Leaving a new member stranded in South Tucson and driving off with his car. Putting new members in "bows and toes." Forcing physical training (PT) or calisthenics on new members. Multiple work nights for new members at the FIJI fraternity house where "They (new members) will be learning what bows and toes really means." and "to start really showing them (new members) becoming a Fiji isn't easy by any means."

2 The UAPD report includes allegations of marijuana use in the Phi Gamma Delta fraternity house, and information alleging the chapter president instructed members to deny alcohol presence to police and hide activities from the UA administration and the National Phi Gamma Delta Organization. The Student Code of Conduct investigation by The University of Arizona set out to determine if Phi Gamma Delta violated the following prohibited conduct items set forth in the Student Code of Conduct: Code of Conduct/2. Endangering / Threat / Cause Harm - Endangering, threatening, or causing physical harm to any member of the university community or to oneself, causing reasonable apprehension of such harm or engaging in conduct or communications that a reasonable person would interpret as a serious expression of intent to harm. Code of Conduct/3. Sanction Violation - Violating the terms of any disciplinary sanction imposed for an earlier violation of the Student Code of Conduct or other Board or university rules. Code of Conduct/4. Other Published Rules - Violation of, or attempt to violate, other rules that may be adopted by Board or by the university. Code of Conduct/7. Failure to Comply - Failure to comply with the directions of university officials or agents, including law enforcement or security officers, acting in the good faith performance of their duties. This section is not intended to prohibit the lawful assertion of an individual's fifth amendment right against self-incrimination. Code of Conduct/15. Alcohol - Violation of Board or university rules or applicable laws governing alcohol, including consumption, distribution, unauthorized sale, or possession of alcoholic beverages. Code of Conduct/16. Drug - Unauthorized use, sale, possession, or distribution of any controlled substance or illegal drug or possession of drug paraphernalia that would violate the law. Code of Conduct/19. Hazing - Engaging in, supporting, promoting, or sponsoring hazing or violating Board or University rules governing hazing. Code of Conduct/20. Unwanted Contact - Engaging repeated or significant behavior toward another individual, whether in person, in writing, or through electronic means, after having been asked to stop, or doing so to such a degree that a reasonable person, subject to such contact, would regard the contact as unwanted. Code of Conduct/22. Interference with UA Activities - Interfering with any university disciplinary process, including but not limited to tampering with physical evidence or inducing a witness to provide false information or to withhold information. Code of Conduct/26. Violation of State or Federal Law - Commission of any offense prohibited by state or federal law or local ordinance. Per the Student Disciplinary Procedures (ABOR 5-403), the spring 2014 President and the Graduate Trusteeship of Phi Gamma Delta were provided the opportunity to respond to the aforementioned Student Code of Conduct charges.

3 On August 5, 2014, recent Phi Gamma Delta President responded: The organizational culture of FIJI supported the activities present in this case. Every year FIJI got better and the organization had changed since his freshman year. The Dean of Students needs to recognize some of the s were written to be humorous. FIJI does not accept harm of its new members. FIJI added value to the UA and half of the members would not be at UA if not for FIJI. What they did may not be appropriate, but it was their culture. He apologized for the lies and tricks. On July 14, 2014, the Dean of Students Office was made aware that the International Fraternity of Phi Gama Delta authorized the creation of a Graduate Trusteeship comprised of graduate members of FIJI residing in Tucson. The Graduate Trusteeship took an immediate action of removing current UA student officers from their leadership positions. For this reason, the Dean of Students Office also offered the Graduate Trusteeship an opportunity to respond to the alleged violations of the Student Code of Conduct. Vinson San Angelo, as a Graduate Trusteeship member, you gave the following response telephonically on August 4, 2014: The Graduate Trusteeship moved to action of closing the chapter and house in the spirit of a good faith effort moving forward. The Graduate Trusteeship had no intention of defending the actions of the members in spring The Graduate Trusteeship was swift and severe in their actions to demonstrate to the student members and institution that they understood and did not defend the actions alleged in the police records. You stated you were not aware of the behaviors alleged prior to the release of the UAPD report. The Graduate Trusteeship understood the UA wants the current generation of FIJI men to have moved on before considering FIJI being back on campus but you felt 3 years would be all the time needed to start anew. You asked the Dean of Students Office to take into consideration the remedial actions taken by the international and local leadership in response to the charges. You believe these actions are a mitigating factor that should be considered in determining the period of separation from campus. Based on the information gathered in the investigation, I find that Phi Gamma Delta violated the Student Code of Conduct prohibited item numbers 2, 3, 4, 7, 15, 16, 19, 20, 22 and 26. These findings and the serious and dangerous nature of the allegations support the sanction of Loss of Recognition from The University of Arizona effective immediately through April Loss of Recognition means the withdrawal of the fraternity as a recognized student organization at the University of Arizona. An unrecognized student organization cannot participate in any University sponsored event and loses the use of University facilities and resources. Should the National Phi Gamma Delta Organization present a viable plan to recolonize Phi Gamma Delta at the University of Arizona, the Dean of Students Office would consider reinstating this chapter in April If all current FIJI members have graduated or are no longer present at the UA at the closure of Spring 2017, Phi Gamma Delta may request The Dean of Students Office review mitigating factors on the part of the national and

4 local organization to determine if colonization might be an option at that time. The decision to allow such early colonization will be within the sole discretion of the Dean of Student's Office and will not be subject to appeal. The Student Disciplinary Procedures provide for a formal appeal of the finding and/or sanctions to a University Hearing Board. To secure an appeal, go to or submit a written statement of appeal to the Dean of Students Office, no later than 20 days following the delivery of this decision.
