4 State of Ohio Environmental Protection Agency November 26, 2008 Notice of Proposed Rule-making and Public Hearing Notice is hereby given that the Ohio Environmental Protection Agency, Division of Drinking and Ground Waters (DDAGW) is proposing revisions to the license to operate rules of the Ohio Administrative Code (OAC), which sets forth the requirements for public water system licenses. The draft amendments are, in part, a result of the five year rule review requirements of Section of the Revised Code. The division is proposing to rescind rule of the OAC and replace it with new draft rules through These draft rules will establish conditions and procedures for conditioning, suspending, revoking or denying a license to operate. License applicants will be required to supply information with regard to the legal owner, lessee, financial contact and operator of record. The draft rules also establish requirements to notify the public of the water system's license status by displaying the license on site and for notification of their license status to be included in the consumer confidence report. As part of the rule-making process, the Agency is required by Section of the Ohio Revised Code to consult with organizations that represent political subdivisions, environmental interests, business interests, and others affected by the rules. The Agency is offering you and your organization the opportunity to comment on these rules before the division adopts them. A public hearing pursuant to of the Ohio Revised Code will be conducted on December 29, 2008, beginning at 10:30 a.m. in Conference Room A at the Ohio EPA, Lazarus Government Center, 50 West Town Street, Columbus, Ohio. All interested persons are entitled to attend or be represented and give their written or oral comments on this proposed rule-making. A presiding officer will be present until all interested persons have been heard. 6 Ashtabula County Date of Public Notice: November 25, 2008 NOTICE OF RECEIPT OF 401 APPLICATION AND PUBLIC HEARING Public notice is hereby given that the Ohio Environmental Protection Agency (Ohio EPA) Division of Surface Water (DSW) has received an application for, and has begun to consider whether to issue or deny, a Clean Water Act Section 401 water quality certification and a Level Two Isolated Wetland Permit for a project to construct five (5) elementary school buildings in a campus setting, including parking lots, access drive, sports fields, and storm water facilities. The application was submitted by the Ashtabula Area City School District. The project is located on the south side of Wade Avenue, west of Ohio Avenue and north of Griswold Road in Saybrook Township. The Buffalo District Corps of Engineers Public Notice Number for this project is The Ohio EPA ID Number for this project is SWIMS & As required by the Antidegradation Rule, rule of the Ohio Administrative Code (OAC), three alternatives have been submitted for the project. The applicant's proposed preferred alternative, if approved, would impact 1.41 acres of jurisdictional wetlands, 1.48 acres of isolated wetlands and 1,001 linear feet of jurisdictional ditches. The applicant's proposed minimal degradation alternative, if approved, would impact 0.44 acres of jurisdictional wetlands, 0.23 acres of isolated wetlands and 1,468 linear feet of jurisdictional ditches. The applicant's proposed non-degradation alternative, if approved, would have no direct impacts on waters of the state. Discharges from the activity, if approved, would result in degradation to, or lowering of, the water quality of Red Brook Creek and Strong Brook. Ohio EPA will review the application, and decide whether to grant or deny the application, in accordance with OAC Chapters and In accordance with OAC rule , an antidegradation review of the application will be conducted before deciding whether to allow a lowering of water quality. 10 Lawrence County OHIO EPA RECEIVES NEW HAZARDOUS WASTE CLOSURE PLAN On November 14, 2008, Ohio EPA received a new hazardous waste closure plan from The Dow Chemical and Americas Styrenics Companies for its two (2) hazardous waste boilers at their Hanging Rock facility located at 925 County Road 1A, Ironton, Ohio The EPA Identification Number for this facility is OHD Why is this Closure Plan being submitted? At the request of Ohio EPA, Dow Chemical and Americas Styrenics submitted this closure plan. The two hazardous waste boilers and associated piping/containment system are the subject of this plan. The boilers will be kept in service and will continue to burn non-hazardous comparable fuel following completion of the closure steps.
