2 Obtain a Commercial Feed License List the company or business name, address (city, mailing address, state, zip code). Submit the license application prior to distribution. Pay fifty dollar ($50.00) annual fee.

3 Labeling All pet foods and treats must be properly labeled. The label must meet certain criteria outlined in the Commercial Pet Food Rules (355 IAC 6-2). 6 Must accompany the treat or food throughout distribution.

4 What has to be on a Label? The product name. The species for which it is intended. Guaranteed Analysis. Ingredient statement. Feeding directions. Party responsible for the treat or food. Quantity statement.

5 Product Name Each treat or food must be identified with a name that conforms to the label and labeling. An example would be Bob s s Dog Biscuit. If more than one product is produced, each product must be clearly named. Example would be - Bob s s Dog Biscuit - Bob s s Recipe II Biscuit

6 Intended Species The intended species has to be identified on the label. Usually cat or dog or both. May be in the product name but does not have to be. Bob s s Dog Biscuit. Bob s s Biscuit (for dogs).

7 Guaranteed Analysis Crude Protein (Minimum percentage) Crude Fat (Minimum percentage) Crude Fiber (Maximum percentage) Moisture (Maximum percentage) Other voluntary guarantees may be claimed and listed as specified in the rules. If the label claims other parameters (Fortified with Vitamin A) then a guarantee must be made for that claim.

8 Ingredient Statement The common or usual name of all ingredients used must be specified on the label. If an ingredient used contains multi-ingredients, ingredients, then those single ingredients must be listed instead of the name of the product. For example: If whole wheat crackers were used, the ingredients would be: whole wheat flour, soybean oil, salt, as they appear on the cracker label.

9 Ingredient Statement All ingredients must be approved by the Food and Drug Administration or the Office of Indiana State Chemist. Just because it is safe for humans, doesn t t mean it is safe for animals. Chocolate may be deadly to dogs Onions can be toxic to cats

10 Ingredient Statement If you have a concern or don t t know if an ingredient may be used, please contact us prior to making the pet treat. Our office is open Monday through Friday, 8 AM to Noon and 1 PM to 5 PM (765)

11 Feeding Instructions Directions must be on the label. If the product is a food, then the directions to feed must be stated and the feed conform to the AAFCO dog or cat nutrient profiles. If it is a treat or snack, it must still state directions. Remember most foods contain all the nutrition an animal will need. Therefore, this is on top of their normal diet.

12 Party Responsible The company or name under which you are doing business must be on the label. It must also contain, the city, state, and zip where you are located. A physical or mailing address is not required, but may appear. The name must match exactly your business name on your Indiana Commercial Feed License.

13 Quantity Statement The quantity statement will usually be in pounds, however, it may be in grams, ounces, or other unit of mass or weight. You may also make a quantity statement that lists the number of units or quantity (contains 5 treats)

14 Distributing the Treats If treats are distributed to the customer is in packages greater than ten (10) pounds in weight, or in bulk, then the company must file a quarterly tonnage report with our office. There is a minimum fee of five dollars ($5.00) per quarter or $0.40 a ton, whichever is greater. Quarterly tonnage reports are mailed at the end of each quarter to appropriate licensees.

15 Distributing the Treats If the treats or food are distributed to the customer is packages of ten pounds or less, then each brand and product name must be listed with our office. There is an annual fee of fifty dollars ($50.00) per brand and product name. No tonnage reports or tonnage fees are due on these products.

16 Common Questions & Answers I make three type of biscuits to sell at the local farmer s s market. Do I need to get labels printed for them and pay $200.00? It all depends on how you are selling them. IF you are pre-packaging packaging the treats in small bags, then the answer is yes. IF you are selling them in bulk, then a complete label must be present but you would be under our tonnage system.

17 Common Questions & Answers I take my treats to the farmer s s market in two pound bags to sell, what do I have to do? You must label each container. The fifty dollar annual fee must be paid to our office.

You must label the container in which the treats are stored and make sure it is visible to the customer. File a quarterly tonnage report ($5.00 per quarter)

19 Common Questions & Answers I have one recipe, one formula for dog treats that I sell in one pound bags. I have bone shapes, cat shape, mailman shape and others. Do I owe $50.00 for each shape? No. Since the nutritional value and label is the same, this is still one product, regardless of how many shapes it comes in.

20 Common Questions & Answers I make one recipe, formula, of dog treat. I put yogurt icing on top of some of them. Does this make it a different product? Yes. You have changed the nutritional value of the treat by adding another ingredient. Therefore it is a new product and would have to be labeled accordingly.

21 Common Questions & Answers I have three recipes, formulas, and I want to combine them into a variety pack. How do I label them? You must provide a label with a guaranteed analysis and ingredient section for each formula. If the nutritional value is the same for each formula, then only one guaranteed section is required.

22 Common Questions & Answers I add beef bullion to my treats. Can I tell my customers that it is beef flavored? Yes. If an ingredient imparts a flavor or distinction to the treat, that may be stated. However, if it is an artificial flavor, then that must be stated whenever the flavor is mentioned. It must also be truthful and not misleading.

23 Common Questions & Answers Do you test our treats? Yes, our office collects over three thousand animal feeds a year and analyzes them for nutrient content and potential hazards. The Indiana Commercial Feed Law empowers our inspectors to collect samples offered for retail distribution during normal business hours.

24 Common Questions & Answers I want to make a dog treat but I have no idea how to figure the protein, fat, fiber or moisture. Will you do that? No, there are commercial laboratories that will perform that task for a fee. You can search the internet for those. Some guarantees may be calculated if you know the ingredient values.

25 Common Questions & Answers I bake treats at home, do you inspect my kitchen? Not under normal circumstances. The only time we would perform such an inspection is if we received a complaint from a customer related to the treat. We investigate consumer complaints if an animal has become ill or died and a veterinarian suspects the food.

26 Common Questions & Answers I want to call my treats all natural, may I? You may if it is true. Most foods will not be all natural because they contain minerals, vitamins, and preservatives. So the statement must be qualified.
