2 A) Credit rating 1. How does a credit rating take place? Latest at the time of bidding the participant must demonstrate credit rating criteria in a suitable form to EWE. This can be documentation of a recognized external credit rating agency or current balance sheet / annual accounts and if applicable proof of an existing Profit and Loss Transfer Agreement. B) Contract management 2. Is a simultaneous injection and withdrawal possible? EWE GASSPEICHER enables the Storage Customer to use all of the four delivery points in Jemgum. If the storage customer has booked more than one delivery point, it is possible to inject simultaneous at different delivery points to withdraw simultaneous at different delivery points to inject and withdraw simultaneous at different delivery points (cf. What impact will the BEATE rules for storages which are connected to more than one market area have on the storage service? Due to the fact that the Jemgum storage is connected to several market areas (GASPOOL, NCG and TTF) the storage system operator (SSO) has to fulfil the BEATE rules according storages which are connected to more than one market area in order to realize the transmission fee discount to the amount of 50 percent (which is also a part of the BEATE regulation) for their storage customers. The BEATE rules for storages which are connected to more than one market area will have no impact on the storage service if the storage customer uses only one Delivery Point (or two Delivery Points within the same market-area) within the whole Service Period. In such case, the aforementioned 50 percent discount on the transmission fee shall be applicable. Since the BEATE rules became applicable not before 1 January 2016, they will have no impact on any storage service from 1 May 2015 to 31 December This also applies if the storage contract includes more than one Delivery Point. The storage capacity can be used at all contractually agreed Delivery Points without any additional rules beside the conditions of the storage contract in the above mentioned period. If the storage contract includes more than one Delivery Point in more than one market area (e.g. GASPOOL and NCG) the BEATE rules for storages which are connected to more than Seite 2 von 5

3 one market area shall apply as of 1 January 2016 to this storage contract only in case of a cross market area storage utilization. With regard to the BEATE rules the SSO and the storage customer will agree on a side letter which includes the terms of cross-market-area-storage-utilization covering the relevant BEATE rules. 4. What do the BEATE rules for storages which are connected to more than one market area include (basic contents of the side letter)? The SSO is obliged to set up and operate separate gas- accounts ( within-store-accounts ) for each storage customer per market area / TSO. In addition the SSO has to differ between discounted and non-discounted gas-accounts. The non-discounted gas-accounts will be used for gas-amounts which were injected with a non-discounted transmission fee. Amounts of gas which were put on or removed from discounted gas-accounts of the storage customer will be determined on an hourly basis by the SSO. The SSO has to transfer the movement data of each storage customer to the connected TSO(s); especially movements between the within-store-accounts. In case of gas-amounts were put on or removed from discounted gas-accounts a supplementary invoicing of transmission fees (transfer fee) will take place via the SSO. This does not apply for amounts movements between gas-accounts within the same market area. The supplementary invoicing will be fulfilled in consideration of the BEATE rules by the SSO. Procedure: The transfer fee will be calculated on a daily basis and arises from the difference between the highest and the lowest yearly transmission fees (divided though the amount of days of the year) of the according transmission system operators multiplied with a factor of 1,4 applied to the maximal transferred capacity (between the discounted accounts) of the day. 4 Transfer fee = (((max. yearly transmission fee TSO A - min. yearly transmission fee TSO A) / days of the year) * 1,4 * max. transferred capacity of the day) + (((max. yearly transmission fee TSO B - min. yearly transmission fee TSO B) / days of the year) * 1,4 * max. transferred capacity of the day) The storage customer has to pay the transmission fees directly to the TSO A and B (as a Shipper). In addition, the storage customer has to pay the transfer fees to the SSO for the cross-market-area-storage-utilization. The SSO is obliged to transfer the transfer fee to the according transmission system operators (TSO A and B). 5. Why does the storage customer has to initially allocate his working gas amount to transmission accounts as of 1 January 2016? According to the BEATE rules every storage customer will have storage gas-accounts for each transmission system operator (TSO) as of 1 January 2016 to separate the working gas volumes which were injected via one of the connected TSO into the storage from other potential injected gas volumes (via other TSO) of the same customer. As of 1 January 2016 the then existing working gas level has to be allocated to the above mentioned gas-accounts by the storage customer. The working gas can thereby be split and allocated to more than one gas-account. The SSO will request the allocation from each storage customer by the end of For the initial allocation no transfer fee is charged. D) Extension Option 6. Is it possible to extend the storage contract for the period beyond? EWE GASSPEICHER offers no extension option for the storage product BOSY - Balance of Storage Year 2015/2016. What happens when more than one storage package is allocated to a customer? In the case that more than one package is allocated to the Storage Customer, the storage packages are bundled in terms of capacity and invoicing. Thus, the respective working gas Seite 4 von 5

5 capacity and the withdrawal- and injection capacities of the allocated packages are added together. For the bundled storage service, a joint standard delivery point shall be determined. Each additional contracted extended delivery point also applies to the bundled storage service. If the storage customer does not wish his storage capacities to be bundled, each bid allocated will be treated as a single/separate storage contract (relating to nomination management; storage level, invoicing, delivery point, etc.).
