2 Page 2 of 9 POOL/SPA INSPECTION AGREEMENT CLIENT: Darlene Carter THIS IS A LEGALLY BINDING CONTRACT, PLEASE READ IT CAREFULLY ADDRESS: 8465 Lakeview Terrace REPORT # SCOPE OF THE INSPECTION: The pool/spa inspection to be performed for Client identified in this contract is a non-invasive visual inspection, performed for a fee set forth below, designed to identify material defects in the pool/spa components as they exist at the time of the inspection. The term material defect is defined as the presence of patent defects or material deferred maintenance of the pool/spa systems, components, or equipment. This definition specifically excludes deficiencies that are normally remedied during routine maintenance and, which generally do not represent a material defect of the pool or spa system. The pool/spa inspection will be performed in accordance with the Standards of Practice of the California Real Estate Inspection Association ("CREIA") in effect at the time of the inspection. Copies of the CREIA Standards of Practice are available upon request. This pool/spa inspection is not intended to be technically exhaustive. Inspector shall prepare a written inspection report for the sole use and benefit of Client identified in this contract. The pool/spa inspection report shall describe and identify the inspected systems, and components of the pool/spa, and shall identify material defects in those systems and components observed during the inspection. Client agrees to read the entire inspection report when it is received and shall promptly contact the Inspector with any questions or concerns client may have regarding the pool/spa inspection or the inspection report. LIMITATIONS,EXCEPTIONS AND EXCLUSIONS: Excluded from this pool/spa inspection is any system, structure, or component of the pool/spa which is inaccessible, concealed from view, or cannot be inspected due to circumstances beyond the control of the Inspector, or which Client has agreed is not to be inspected. The following are excluded from the scope of this pool/spa inspection unless specifically agreed otherwise between Inspector and Client: 1. Determining compliance with installation guidelines, manufacturers' specifications, building codes, all ordinances, regulations, covenants, zoning or other restrictions, including local interpretations thereof. 2. Obtaining or reviewing information from any third-parties including, but not limited to: government agencies (such as permits), component or system manufactures (including product defects, recalls or similar notices), contractors, managers, sellers, occupants, neighbors, consultants, homeowner or similar associations, attorneys, real estate agents or brokers. 3. Geotechnical, engineering, structural, architectural, geological, hydrological, land surveying or soils-related examinations. 4. Certain factors relating to any systems, structures, or components of the pool/spa, including, but not limited to adequacy, efficiency,durability or remaining useful life, costs to repair, replace, or operate, fair market value, or advisability of purchase. 5. Environmental hazards or conditions, including, but not limited to, toxic, reactive, combustible, chemicals, corrosive contaminants, wildfire, geologic or flood. 6. Dismantling of any system, structure or component, or perform any intrusive or destructive examination, testing or analysis. 7. Systems or components of the pool and or spa that are not permanently installed. 8. Systems, structures, or components not specifically identified in the written inspection report and in the CREAI Standards. 9. Operating systems or components that have been disconnected, shut down or in the opinion of the Inspector could result in damage to the pool/spa's components or systems. 10. Inspecting any below grade components or underground systems or portion thereof or pressure testing of any piping. 11. Come into contact with pool/spa water to examine the system, structure, or components. 12. Examine accessories, such as, but not limited to: fountains, water falls, diving or jump boards, ladders, slides, steps or any other recreational components including pool equipment enclosures. (pool houses/sheds) 13. Operating or evaluating, security systems, alarms, remote controls, radio controls, computer controls,low voltage electrical systems, antennas, electronic controls, key-operated switches, timers, photo-electric, motion sensing, or other such similar non-primary electric devices, components or systems. 14. Operating or evaluating, pool/spa covers, back-flushing systems, automatic water re-fills, anti vortex drains, valves, air switches, jets, pool cleaners, aerators, skimmers, chemical injection systems, water chemistry or other conditioning devices, and related components. 15. Evaluate thermostat(s) or their calibration, heating elements and solar systems. 16. Evaluating child access barrier adequacy of pool enclosures. Inspector is a pool/spa inspection generalist and is not acting as an expert in any trade. The pool/spa inspection report may contain recommendations for further evaluation by an individual other than Inspector herein who is qualified as an expert or specialist in that specific trade of profession. If Inspector recommends consulting other specialized experts, Client agrees to do so at their own expense. It is the Clients's duty and obligation to exercise reasonable care to protect themselves regarding the condition of the pool/spa, including those facts which are known to or within the diligent attention and observation of Client. LIQUIDATED DAMAGES: It is understood and agreed by and between the parties hereto that it would be impracticable and extremely difficult to fix the actual damages, if any, which may result from a failure to perform such services as called for under this agreement, and in case of any failure to perform such services, negligence, or act or omission causing damage, and a resulting loss, Clients damages herein

3 Page 3 of 9 shall be liquidated and fixed in the amount of one thousand five hundred dollars ($1500) as liquidated damages and not as a penalty, and this remedy shall be exclusive. CONFIDENTIAL REPORT: The inspection report to be prepared for Client is solely and exclusively for Client's own information and may not be relied upon by any other person. Client agrees to maintain the confidentiality of the inspection report and agrees not to disclose any part of it to any other person. Client may distribute copies of the pool/spa inspection report to the real estate agents directly involved in this transaction, but Client and Inspector do not in any way intend to benefit the real estate agents directly or indirectly through this Agreement or the inspection report. CLIENT AGREES TO INDEMNIFY, DEFEND AND HOLD HARMLESS FROM ANY THIRD PARTY CLAIMS ARISING OUT OF CLIENT'S UNAUTHORIZED DISTRIBUTION OF THE INSPECTION REPORT. SEVERABILITY: Should any provision of this contract be held by a court of competent jurisdiction to be either invalid or unenforceable, the remaining provisions of this contract shall remain in full force and effect, unimpaired by the courts' holding. GENERAL PROVISIONS: This pool/spa inspection contract, the pool/spa inspection, and the inspection report do not constitute a pool/spa code or other regulation compliance, warranty, guarantee, or insurance policy of any kind whatsoever. The pool/spa inspection and inspection report are not a substitute disclosure for real estate transactions which that may be required by law. No legal action or proceeding of any kind, including those sounding in tort or contract, can be commenced against Inspector/Inspection Company, or its officers, agents or employees more than one year from the date the CLIENT discovers, or through the exercise of reasonable diligence should have discovered, the cause of action. In no event shall the time for commencement of a legal action or proceeding exceed two years from the date of the subject inspection. THIS TIME PERIOD IS SHORTER THAN OTHERWISE PROVIDE BY LAW. In the event Client discovers a material defect or other deficiency that was not identified and reported by Inspector, Client shall so notify Inspector in writing and allow Inspector and/or Inspector's designated representative to re-inspect and document the condition(s) of the material defect or deficiency prior to making any repair, alteration or replacement to said material defect or deficiency. The written report to be prepared by Inspector shall be considered the final and exclusive findings of the Inspector regarding the inspection of the pool/spa. Client shall not rely on any oral statements made by the Inspector prior to issuance of the written report. This Agreement shall be binding upon and inure to the benefit of the parties hereto and their heirs, successors and assigns. This agreement constitutes the entire integrated agreement between the parties hereto pertaining to the subject matter hereof, and may be modified only by a written agreement signed by all of the parties hereto. No oral agreements, understandings, or representations shall change, modify, or amend any part of this agreement. Each party signing this Agreement warrants and represents that he/she has the full capacity and authority to execute this Agreement on behalf of the named party. If this Agreement is executed on behalf of Client by any third party, the person executing this Agreement expressly represents to Inspector that he/she has the full and complete authority to execute this Agreement on Client's behalf and to fully and completely bind Client to all of the terms, conditions, limitations, exceptions and exclusions of this Agreement. Client acknowledges that they have read and understood all the terms, conditions, and limitations of this contract and voluntarily agrees to be bound thereby and agrees to pay the fee of $200. 4 Page 4 of 9 POOL/SPA & EQUIPMENT The inspection of the pool and/or spa includes a visual examination of the pool and/or spa; conditions limiting or otherwise inhibiting inspection; enclosures and related gates; hardscaping and drainage related to the inspected pool or spa; condition of visible portions of systems, components or structures; normally necessary and present equipment such as, lights, pumps, heaters, filters, and related electrical and mechanical connections. All reported conditions referenced in the body of this report should be addressed by specialists in the appropriate trades PRIOR TO THE END OF YOUR INSPECTION PERIOD. This should include cost estimates to remedy conditions. Below ground pools or spas may have inherent defects which are not visible during the inspection. We cannot accurately see below the water level. The only way to thoroughly examine the pool/spa body is to drain the pool/spa. If a more thorough inspection of the pool is desired, we suggest you contact a qualified pool/spa contractor, who may use procedures and equipment not utilized by our visual inspection. DO NOT drain the pool yourself. Consult a pool contractor first. We DO NOT guarantee or warranty any components or systems of the pool or spa after the date of the inspection. The inspector IS NOT REQUIRED to: examine any above-ground, movable, freestanding or otherwise non-permanently installed pool or spa, or self contained equipment; come into contact with pool or spa water to examine the systems, structures or components; determine the adequacy of spa jet water force or bubble effect; determine structural integrity or leakage of any kind, including underground plumbing; evaluate thermostats or their calibration, heating elements, chemical dispensers, water chemistry or conditioning devices, low voltage or computer controls, timers, sweeps or cleaners, pool or spa covers and related components; operate or evaluate filter backwash systems; examine accessories, such as, but not limited to aerators or air blowers, diving or jump boards, ladders, skimmers, slides or steps; determine the adequacy of filters, pumps and heaters. 5 Page 5 of 9 DEFINITIONS: 1.7 HEALTH AND/OR SAFETY CONCERN: [HSC] Caution advised. The findings noted are health and/or safety concerns. They could be, or could become hazardous under certain circumstances. They should be reviewed and corrected by qualified trades persons in the appropriate field. 1.8 MAINTENANCE, REPAIR, REPLACEMENT AND/OR REVIEW: [MRR] The findings noted are in need of maintenance, repair, replacement and/or review by qualified trades persons in the appropriate field. Corrections, as needed, are advised. 1.9 UPGRADE RECOMMENDED: [UR] Upgrades are systems and/or components that may not have been available or have been improved since the pool/spa was constructed. These may be, but not limited to safety related items, such as GFCI receptacles, drains, safety barriers and door alarms NOTE: The term [NOTE] may used to identify a particular component or condition. While corrective action may not be warranted, I felt you should be aware of its existence USE OF COLORS, UNDERLINING, BOLDING, ETC: Please read the entire report. I only use special characters and colors to highlight particular conditions and for your convenience. The ENTIRE report should be considered important and read thoroughly PHOTOGRAPHS: Photographs, when used, are simply a tool to convey my findings. They are not intended to enhance those findings or diminish any findings not photographed AHJ: Authority Having Jurisdiction - Usually, the local building department GFCI: Ground Fault Circuit Interrupter - These devices protect people from electric shock. These receptacle outlets are sometimes identified by the little "test and reset" buttons on the face of the outlet. DECKING AND DRAINAGE: 1.15 OBSERVATIONS: The concrete decking and site drainage was observed. Conditions are noted below CONDITIONS: [MRR] Cracking in the concrete decking observed at several areas. It is beyond the scope of the inspection to determine the exact cause of the cracking. Alleviating moist soil conditions and ensuring water flows away from concrete surfaces may alleviate future movement/cracking. You may wish to obtain a second opinion from a competent concrete contractor.

6 Page 6 of 9 POOL SURFACE: 1.17 OBSERVATIONS: Visible portions of the pool body, including tile were inspected CONDITIONS: [MRR] The pool plaster surface is worn. Discolored areas may be indicative of the plaster surface wearing out. Determining the remaining life expectancy of the pool plaster is beyond the scope of the inspection. Pool plaster sufaces generally last for 20 years, if the proper chemical balance is maintained. You may wish to have a pool plastering contractor review the pool plaster and provide cost estimates for corrections before the end of your inspection period. Recommend budgeting for corrections, if no corrections are made now. Recommend visiting a pool supply store and purchasing a chemical test kit and keeping the pool water chemistry balanced on a regular basis. Water chemistry should be checked before and after use of the pool and at least on a weekly basis if the pool is not in use. Chemicals should be stored and used according to label instructions. Do not add chemicals directly to the area around the skimmer. Undiluted chemicals will damage equipment. If this is the first time you have owned a pool/spa, it is highly recommend that you enlist the services of a reputable pool maintenance company, to clean the pool and adjust the chemical balance of the water on a regular basis, until you feel comforatable doing it yourself. All pools/spas require year-round maintenance. PUMPING EQUIPMENT: 1.19 PUMP/MOTOR OBSERVATIONS: The filter pump was inspected and manually operated from the control panel and was found to circulate water in the pool. Conditions are noted below CONDITIONS: [MRR] The pump motor is not permanently secured to the ground. Recommend securing to alleviate undue stress on the plumbing pipes. Water leaking from the outlet fitting atop the pump. POOL FILTER: 1.21 PRIMARY FILTERING OBSERVATIONS: The pool filter was observed to be a cartridge filter FILTER PRESSURE GAUGE: The pressure gauge at the top of the filter read 8 psi when the pump was on. This indicates the filter is not clogged. Monitor the pressure gauge on the filter on a regular basis. Refer to manufacturers operating instructions for filter cleaning instructions. Most manufacturers recommend cleaning/backwashing the filter after an 8-10 psi. increase above the system's clean-filter pressure.

7 Page 7 of 9 Recommend having the pool filter cleaned or replaced upon taking possession of the pool. Often, it is difficult to tell how clean the filter is, without looking at it. Often, the pressure gauge on top of the filter is not accurate. DRAIN(S): 1.23 OBSERVATIONS: An anti-vortex type main drain was observed at the deep end of the pool CONDITIONS: [UR] The current drain configuration in the spa is not per current building standards. Drains in spas should be a minimum of 3 feet apart or located on 2 different design planes; ie-one on the floor and one on the wall. Recommend corrections by a qualified pool contractor to prevent hair or body entrapment. This may have been acceptable when the pool was originally installed. [UR] The current drain configuration in the spa is not per current building standards. Single drains in spas are no longer acceptable. Drains in spas should be a minimum of 3 feet apart or located on 2 different design planes; ie-one on the floor and one on the wall. Recommend corrections by a qualified pool contractor to prevent hair or body entrapment. This may have been acceptable when the pool was originally installed. CLEANING SYSTEM: 1.25 OBSERVATIONS: A pool sweep was observed and operated. No adverse conditions were observed. Please keep in mind, even the best pool sweeping system may require untangling of hoses and adjustments. SKIMMER & BASKET: 1.26 OBSERVATIONS: A pool skimmer and basket were observed. Conditions are noted below CONDITIONS: [MRR] The weir door is missing at the skimmer. This door prevents debris from floating back into the pool and creates surface tension on the water for cleaning. Without it, the ability for the skimmer to pick-up floating debris can be reduced by 50%. Recommend one be installed.

8 Page 8 of 9 RAILINGS AND ACCESSORIES: 1.28 OBSERVATIONS: A diving board was observed. It is beyond the scope of the inspection to inspect this accessory. Please use with caution. For optimum safety, you may wish to have it removed. POOL LIGHT: 1.29 OBSERVATIONS: A pool light was observed. It functioned properly when operated from the manual control switch. VISIBLE PLUMBING LINES, VALVES AND WATER FEATURES: 1.30 OBSERVATIONS: Visible portions of the plumbing pipes and valves were inspected and no adverse conditions were observed. A waterfall was observed and operated. It was found to be functional. HEATERS: 1.31 OBSERVATIONS: A natural gas heater was observed. Conditions are noted below CONDITIONS: [MRR] The pool heater failed to respond through the use of normal user controls. Leaves and debris inside burner compartment, burners are rusted, previously melted plastic adhered to cover. The heater is 28 years old and is past its normal life expectancy. Recommend a competent pool contractor provide cost estimates for replacement before the end of your inspection period. ELECTRICAL: 1.33 CONDITIONS: [HSC] The terminal protector or "dead front" cover is damaged at the timer control panel. This poses a shock hazard. Recommend a replacement cover be installed.

9 Page 9 of 9 BARRIERS, FENCES AND GATES: 1.34 OBSERVATIONS: A self-closing and self latching gate was operated at the left side of the building. It functioned properly CONDITION: [UR] The metal barrier surrounding the pool does not meet current safety standards. Gates must be self-closing and self-latching and 60" high measured from outside the enclosed area. Gates must open outwards. The latch or locking device must be at least 48" above grade and at least 6" from the top of the gate. This device must be protected from outside the enclosed area for a distance of 20" in all directions, except openings not greater than ¼" in diameter. Recommend contacting the AHJ for their current guidelines for pool barrier safety. Corrections recommended. POOL SERVICE: 1.36 RECOMMENDATIONS: It is recommended that all pool owners learn how to operate and maintain their pools safely. Water chemistry is very important. There are pool companies which can service the pool on a regular basis and maintain the water chemistry. Learn to perform CPR. Classes are available from the American Red Cross. It is advised that a qualified pool contractor be consulted before draining the pool. High ground water levels may cause the pool to lift if drained improperly. Many pool pump manufacturers are regularly building more energy efficient pumps. If applicable, recommend consulting with a qualified pool contractor to determine if the replacement of the pump(s) could have an energy savings for the home.
