4 ELECTRIC HEAT AGREEMENT PLUMBING AGREEMENT Clean, service and safety check once per year. (Fall/Winter) 2. Lubricate all motors which require oiling. 3. Inspect heat exchanger (hot air furnace only). 4. Check thermostat for proper operation. 5. Inspect electrical elements for proper operation 6. Check water for proper PH level (hot water systems). 7. Check all safety controls. 8. Change air filters* 9. Clean and service humidifier** 10. Guaranteed priority service 24 hours a day, 365 days a year. The following services will be scheduled twice yearly. Work will be scheduled Monday thru Friday 8:00 a.m. to 5:00 p.m. unless other arrangements are made. - Treat main sewer with root destroyer. - Treat all small drains with degreaser agents. - Safety check water heater. - Install identification tags on all important shut off valves. - Safety check your gas logs, water heater and gas dryer for carbon monoxide. - Check sump pump for proper operation. - Dye check all toilets to insure proper operation - Visual inspection of accessible plumbing systems - Install of lint trap on laundry tray tub - Shut off or turn on of outdoor hose faucets (must be requested) The following services will be covered at no cost during normal working hours, Monday thru Friday, 8:00 a.m. to 5:00 p.m. - Clogged toilets provided toilet does not have to be removed from the plumbing to clear. - Clogged drains which can be cleared without the use of sewer machines. - Jammed garbage disposals. Plumbing Agreement also includes the following: - Priority 24 hour service, 365 days a year. - No overtime charges for holidays, weekends and after hours service. - $25.00 discount off all our normal price book charges for all plumbing services. Total - $125.00

5 EXCLUSIONS, CONDITIONS & REQUIRED INFORMATION CONDITIONS Each inspection will be performed once annually (except on the Plumbing Agreement where it will be twice annually). Inspections will be performed at a mutually convenient time during regular work hours unless otherwise agreed. Owner agrees to call our office Monday thru Friday, between 9:00 a.m. and 5:00 p.m. to arrange a convenient time for us to perform the work requested on your heating, air conditioning and/or plumbing systems. At the conclusion of the inspection, the service technician will present the Owner with a service report. This report will set forth the work that was performed, the condition of the equipment and what repairs are needed. Murphy s Plumbing & Heating, Inc. will obtain written authorization from the Owner to perform work not covered by Murphy s Plumbing & Heating, Inc. service agreement prior to commencing such work. That written authorization will set forth the work that Murphy s Plumbing & Heating, Inc. will perform and an estimate of the charges that will be incurred in connection with that work. The Conditions, Exclusions and Required Information set forth in this Agreement shall extend to that work to the extent applicable. Murphy s Plumbing & Heating Inc. will invoice Owner for all repairs made on this basis. The obligation of Murphy s Plumbing & Heating, Inc. to furnish replacement parts is subject to the parts availability through normal sources of supply. Obsolete equipment and parts will incur additional charges. The service agreement shall be in effect upon payment for the stated period. Additional charges will be made for servicing equipment not covered by service agreements. Calls to balance heat and/or cooling to specific rooms will be considered chargeable calls. If emergency service is required after 5:00 p.m., weekends, holidays or any other circumstance when our office cannot confirm that Owner has a service agreement in effect with Murphy s Plumbing & Heating, Inc., Owner must produce the invoice from Murphy s Plumbing & Heating, Inc. indicating the agreement was paid for. In the event the invoice cannot be produced, Murphy s Plumbing & Heating, Inc. reserves the right to require payment by cash, check or credit card. If a agreement was purchased and in effect, Murphy s Plumbing & Heating, Inc. will issue a refund promptly. These maintenance agreements do not cover work required because of acts of God, such as work required because of fire, lightning, explosions and floods or work required because of freezing or breaking of pipes, sabotage, shortage of electrical or water supply, electrical surges, electrical work beyond units, cleaning of ducts, painting, moving of equipment or correction of installation or design deficiencies or expenses caused by improper operation, negligence or misuse of the equipment or damage from any cause that is external or does not arise solely and directly out of the operation of this equipment. (Service to address such issues, if requested by Owner, will be billed out at contract rates). Murphy s Plumbing & Heating, Inc. reserves the right to reject any service agreement if upon inspection by our technician, equipment is found in disrepair or unsafe condition and such equipment must be brought up to operating condition at Owner s expense before protection plan(s) go into effect. No service will be rendered under this agreement if customer has a past due account. Murphy s Plumbing & Heating, Inc. reserves the right to cancel any agreement without notice and refund the unused portion of the annual fee paid. Murphy s Plumbing & Heating, Inc. will endeavor to provide prompt and efficient service, hereunder, but it is expressly agreed that Murphy s Plumbing & Heating Inc. shall in no event be liable for damages or losses caused by delay or any loss arising out of the performance of this agreement. Murphy Plumbing & Heating, Inc. assumes no responsibility for any equipment that has been serviced by other individuals or companies and Owner hereby acknowledges responsibility for any loss, damage or injury caused by that service. EXCLUSIONS Unless specifically listed in the Agreement, the following items are excluded: Compressors refrigerants heat exchangers combustion chambers burners humidifiers air cleaners all accessories that are not an integral part of the furnace or air conditioner. Refrigerant leaks on air conditioning systems and heat pumps are not covered. Control and zone valves are not covered. REQUIRED INFORMATION This agreement will be automatically renewed by payment of invoice each year. Murphy s Plumbing & Heating, Inc. will notify the Owner of this renewal, and advise Owner of its option to cancel such renewal. Murphy s Plumbing & Heating will notify Owner of this renewal, by mail, not earlier than 20 days and not later than ten days prior to the date of any such renewal. Owner may choose not to renew. To do so, Owner must provide written notice to the Murphy s Plumbing & Heating, Inc. via first class mail postmarked no later than three business days prior to any renewal. Murphy s Plumbing & Heating, Inc. has liability insurance covering personal injury in excess of $500,000 and insurance covering property damage caused by the contractor doing the work in excess of $500,000. Information concerning Murphy s Plumbing & Heating, Inc. registration can be obtained by calling the Pennsylvania Attorney General Bureau of Consumer Protection

6 AGREEMENT Murphy s Plumbing & Heating, Inc. and the Owner, intending to be legally bound, agree that for the fee set forth below and on the specification page and subject to the Conditions, Exclusions and Required Notices set forth on the final pages, Murphy s Plumbing & Heating, Inc. will perform the services specified in each of those service options accepted by the Owner by initialing next to the services desired: GAS HEAT AGREEMENT - $ OIL HEAT AGREEMENT - $ AIR CONDITIONING AGREEMENT - $ HEAT PUMP AND AIR CONDITIONING AGREEMENT - $ ELECTRIC HEAT AGREEMENT - $ PLUMBING AGREEMENT - $ AGREEMENT TO ARBITRATE ALL DISPUTES ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THIS AGREEMENT, OR THE BREACH THEREOF, SHALL BE SETTLED BY ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION UNDER ITS COMMERCIAL ARBITRATION RULES. THE DECISION OF THE ARBITRATOR SHALL BE FINAL AND BINDING ON BOTH PARTIES TO THIS AGREEMENT AND SHALL NOT BE APPEALABLE. THE FACTS OF THE DISPUTE, RELATED DOCUMENTS AND THE DECISION OF THE ARBITRATOR ARE ALL CONFIDENTIAL. JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN THE COURT OF COMMON PLEAS IN THE COUNTY IN WHICH THE PROPERTY COVERED BY THIS AGREEMENT IS LOCATED. Agreed to: You, the buyer, may cancel this transaction at any time prior to midnight of the third business day after the date of this transaction. See the attached notice of cancellation form for an explanation of this right. This Agreement with its attachments represents the entire and integrated agreement between the Owner and Murphy s Plumbing & Heating, Inc. and supersedes all prior negotiations, representations or agreements, either written or oral. 7 NOTICE OF CANCELLATION (Enter Date of Transaction) You may cancel this transaction, without any penalty or obligation, within three business days from the above date. If you cancel, any payments made by you under the contract will be returned within ten business days following receipt by the seller of your cancellation notice, and any security interest arising out of the transaction will be cancelled. If you cancel, you must make available to the seller at your residence in substantially as good condition as when received, any goods delivered to you under this contract; or you may, if you wish, comply with the instructions of the seller regarding the return shipment of the goods at the seller s expense and risk. If you do make the goods available to the seller and the seller does not pick them up within twenty days of the date of your notice of cancellation, you may retain or dispose of the goods without any further obligation. If you fail to make the goods available to the seller, or if you agree to return the goods to the seller and fail to do so, then you remain liable for performance of all obligations under the contract. To cancel this transaction, mail or deliver a signed and dated copy of this cancellation notice or any other written notice, or send a telegram, to (name of seller), at (address of seller s place of business) not later than midnight of (date).
