1 Division of Rehabilitation and Liquidation DEPARTMENT OF FINANCIAL SERVICES April 22, Purpose FLORIDA DEPARTMENT OF FINANCIAL SERVICES DIVISION OF REHABILITATION AND LIQUIDATION Request for Proposal PC The Florida Department of Financial Services, Division of Rehabilitation and Liquidation ( Division or Receiver ), desires to contract with a vendor to consult with the Division regarding the compliance and reporting requirements of health insurance entities in receivership under pre-receivership contracts entered into with federal government agencies that administer health programs (e.g. the Centers for Medicare and Medicaid Services ( CMS ) of the U.S. Department of Health & Human Services ( HHS )). This Request for Proposal invites interested parties ( vendors ) to submit response packages to the Division for services as specified below. There may be one or more vendors selected to enter into a contract to perform the work requested. This is not a state procurement. This Contract will be paid solely out of the funds of companies in receivership, and no public monies will be obligated or spent on this Contract. 2. Overview of The Division of Rehabilitation and Liquidation The Division performs the Florida Department of Financial Services duties as courtappointed Receiver of insurance entities ordered into receivership. In this capacity, the Division as Receiver administers the affairs of an entity placed into receivership by court order. Receiverships exist for the purpose of rehabilitation, liquidation, or conservation. In a rehabilitation receivership, the Receiver controls and protects the property and assets of the insurer, conducts business of the insurer, and formulates and executes a plan to remove the causes and conditions necessitating the rehabilitation. In a liquidation receivership, the Receiver cancels the entity s insurance policies and liquidates the assets to pay the outstanding claims. In a conservation receivership, the Receiver Page 1 of 5
2 conserves the assets of a foreign or alien insurer subject to further direction of the court. In any case, a receivership ends when statutory criteria have been met and the court discharges the Receiver from its duties. 3. Summary of Services to be Provided Provide the Receiver with consulting services concerning the compliance and reporting requirements of health insurance entities in receivership under pre-receivership contracts entered into with federal government agencies, such as CMS, that administer health programs. The selected vendor ( Provider ) may provide services for multiple receivership entities simultaneously, upon request by the Receiver. Each request by the Receiver shall be in the form of a Letter of Authorization ( LOA ) stating the specific service requirements and shall be submitted in writing to the Provider. The work performed must comply with applicable industry standard best practices, including, but not limited to, statutory and administrative rules and regulations. The Provider agrees to the following general scope of services: o Collect and catalog health entity data/information provided by Receiver; o Prepare a timeline and cost budget for the tasks identified in the Scope of Work; o Handle tasks identified in the LOA; and o Provide monthly status updates to Receiver for as long as such services and valuations are required by Receiver. Additional service requirements that may be identified in a LOA may include, but are not limited to: o Review and analyze the data/information obtained from the Receiver; o Advise of federal agency reporting requirements to include deadlines and timeframes; o Make recommendations and provide support regarding the use of external vendors to obtain and prepare relevant data for submission(s) to federal agencies; o Identify, collect and analyze relevant data for the valuation of contract reconciliations; o Upon receipt of final contract reconciliation from the applicable federal agency, prepare a written report and recommended response regarding the valuation of the reconciliation amounts and actionable items in order to improve the expected financial position of the health entity in receivership; and Page 2 of 5
3 o Provide a timeline and cost estimate for the completion of additional services, if required. 4. The Division reserves the right to exclude from consideration any response submitted with material deviations from the prescribed format, as determined by the Division Content of Response Submit a cover letter. The cover letter should be used to communicate the vendor s submission of information in response to the RFP and should reference procurement number PC ; A summary of the company s history since incorporation, current services and products offered, and number of employees; Details regarding your company s qualification/experience relevant to the services contemplated by this RFP; Resumes of principal officers; Names and resumes of the key employees that would perform the work requested, including each person s job title and experience working on this type of project; Fee structure or rate schedule for the services that are offered by your company; Preferred contact name, physical address, address, and phone number; Proof of insurance; and Indicate whether you have performed services and the type and date of services performed for any of the following companies: o Physicians United Plan, Inc. o Florida Healthcare Plus, Inc. o Universal Health Care Insurance Company, Inc. 4 o Universal Health Care, Inc Response Format - Submit your response in PDF format by as specified below. Your response must be less than 9 megabytes in order to be received by our system. Should your response require a larger file size, please send in separate smaller submissions Response Deadline & Delivery - Submit your response no later than 5:00 pm Eastern Time Zone on Monday May 9, 2016, via to: Valerie.Reglat@myfloridacfo.com. Please use PC in the subject line of your RFP Timeline 6.1. Step 1 RFP Published The Division will publish the RFP to vendors on April 22, Step 2 Opportunity to Request Information from the Division Vendors may submit questions and requests for clarification via to the named point of contact (see above) no later than 5:00 pm Eastern Time Zone on Wednesday, May 4, Step 3 Provide Answers to Vendor Questions The Division will respond to vendor questions in writing by 5:00 pm Eastern Time Zone on Friday, May 6, The Division response will be delivered via Step 4 Deadline for RFP Response Responses to the RFP must be received at the Division no later than 5:00 pm Eastern Time Zone on Monday, May 9, 2016, via to: Valerie.Reglat@myfloridacfo.com Step 5 Evaluate Responses The Division will evaluate the RFP responses and may construct a short list of vendors of interest Step 6 Vendor Interviews Schedule and Conduct Vendor Interviews Step 7 Evaluate Interviews The Division will evaluate the vendor interviews and may narrow the short list of vendors of interest Step 8 Evaluate References and Ask Follow-Up Questions of Vendors Page 4 of 5
5 The Division will evaluate vendor references for vendors of interest. The Division may ask follow-up questions of the vendors of interest by phone Step 9 Division Recommendation The Division will evaluate the information obtained and determine whether a single vendor appears to best meet the Division s needs. Note that this may or may not result in a decision to contract with a vendor. 7. RFP Terms and Conditions 7.1. Reservations The Division reserves the right to reissue a modified version of this RFP, or to amend, at any time, any part of this RFP and to change any of the scheduled dates, including the submission due dates The Division at its sole discretion reserves the right to reject any and all responses to this RFP, and to ask any or all respondents for such additional information as it may deem necessary, and to waive any or all irregularities in proposals The issuance of this RFP does not imply any commitment to enter into a contract for services from, any vendor The Division reserves the right to recommend a vendor based on criteria other than lowest price Costs Incurred in Responding This RFP does not commit the Division or any other public agency to pay any costs incurred in the preparation or submission of a response, nor to make necessary studies or designs for the preparation thereof, nor to procure or contract for any products or services Information Confidentiality The Division reserves the right to retain copies of all proposals submitted in response to this Request for Proposal. The Division will adhere to Chapter 119 of the Florida Statutes regarding public records Publicity and News Releases Neither respondents nor respondents representatives shall make any announcements or news releases pertaining to this RFP, this project, the recommendation of a particular vendor s service(s), or the award of any contract without the prior written approval of the Division Conflict of Interest The respondent shall disclose any interest with or adverse to the Division that could create a conflict of interest or the appearance of such.
