3 GENERAL PROVISIONS Introduction The revised Ports and Waterways Safety Act is valid from 1 January 2010, with transitional provisions for 2010 and The new regulation allows for free pricing on the port s sales of goods and services, with the exception of call fees. Objective Fees, charges and other payments will provide the necessary income for the Port Authority to cover administrative and operational costs, maintenance, new installations, expansion of facilities, etc. The Port Regulation Prices in this regulation are based on the Ports and Waterways Safety Act from April 17, 2009, no. 19. The regulation applies to the fiscal year. Discount Schemes In special cases and for business related purposes only, the Port Director can grant discount schemes. Calculation basis for goods charges Goods charges are calculated based on weight in metric tons (unit weight). Volume goods are converted to unit weight no less than 1m3 = 0.5 tons. Unit price can be used per container or cargo carrier. Calculation basis for passenger fees Passenger fees are calculated per passenger. Collection of fees and charges The Administration may require that the port operator collect charges and fees for the use of public docks, areas and facilities in the port. Rental agreements for public quays and other port facilities The Administration may enter into fixed leases for all or parts of public quays or port facilities. The leasing amount shall cover the costs attributable to the lease object and its use. Debt cancellation and reduction In special cases, the Administration may decide to cancel or reduce accrued fees and charges. 3
4 CALL FEES GENERAL The call fee is pursuant to 25 of the Act of 17 April 2009 no. 19, related to ports and waterways safety. The call fee covers the entire sea area within the municipal borders of Bamble, Porsgrunn and Skien, with the exception of the areas above Skien locks. All prices exclude value added tax (VAT). CALCULATION BASIS The Port Authority of Grenland uses the vessel's gross tonnage (GT) for calculating docking fees based on the International Convention of Tonnage Measurement of Ships of If GT is not specified in the certificate, it will be determined at the Administration's discretion. CALL FEE a. The call fee is payable per call in the fee area. When there are repeated calls within the same day, the fee is payable only once per day. b. The Administration may decide that there should only be paid a fee for a certain number of calls in a calendar month for vessels with frequent calls. A monthly fee may also be determined. c. Vessels, which are mainly operating in the port without leaving the fee area, will pay a fee for their use of the ports and water ways. The fee can be calculated on a monthly or annual basis. d. Exempt from call fees are: i. Vessels that pass a fee area without calling at the port. A vessel calling at the port because of damage or due to an emergency when the stay does not exceed 2 days and the vessel does not load or unload or take on board ship's necessities or passengers. Rescue and icebreaking vessels in the process of rescue or icebreaking operations. Vessels covered by general provisions for exemptions in the Act. ii. iii. iv. e. The Administration sets a minimum fee amount of NOK 500 for all types of vessels in scope. f. The Administration will establish a minimum size for the collection of call fees, for vessels that are not subject to measure. 4
5 TARIFF FOR CALL FEES Fee per GT For vessels up to 3,000 GT NOK 0.65 up to 8,000 GT NOK 0.75 above 8,000 GT NOK 0.85 For gas carriers/lpg: For vessels up to 8,000 GT NOK 0.65 up to 20,000 GT NOK 0.85 above 20,000 GT.. NOK 0.75 a. Scheduled container and line vessels are granted a reduction of 75% of the rates. Separate agreements can be made for ferry/ropax and RoRo ships on regular routes. For Cruise lines price by agreement. b. The Port Authority of Grenland may give a discount in extraordinary circumstances. The Administration will determine whether or not a vessel is under the rebate scheme. QUAY FEES a. The quay fee is payable per docking day commenced. b. The docking time is calculated from when the vessel is moored and until its time of departure. 6 hours or less is considered half day. The minimum quay fee payable is one day. When vessels are ordered by the port inspector to move from quay to make room for another vessel and then re-berth, it will be considered as uninterrupted time at quay. If the absence from the quay exceeds 3 hours, an equivalent deduction in the estimated total length of stay will be made. If a vessel re-berths within the public quay, the docking time will be calculated as if the vessel had been moored without interruption. c. The Administration may decide that the quay fee should be paid for a certain number of port calls during a calendar month. A monthly fee can also be determined. d. A vessel that is double-berthed will pay the quay fee as if the ship was moored at the quay. e. If a vessel has been granted, by application, permission to remain in port without loading/unloading cargo or passengers, the Administration may reduce the fee, provided that the vessel is not in the way of other traffic. 5
6 f. Yachts moored at the public quays must obtain permission from the Administration. Yachts without permission will be removed at the owner s cost. g. Vessels that mainly operate within the sea area may be assigned a place by the Administration and shall pay in accordance to the regulations. Upon request, a vessel that has been assigned a place may have to move to another quay. h. The Administration sets a minimum fee of NOK 150 for all types of vessels paying a quay fee. i. Special conditions apply for yachts that use the marinas and facilities. j. Special conditions apply for fishing vessels. k. Discounted docking fees are granted for vessels that are registered in the Environmental Ship Index (ESI). With a total score of 20 points or more, the rates are discounted by 30% of the rates in the port tariff. The ESI registration must be specified in the ship s pre-notification of calls and the discount is only applicable to calls within the ESI-certificate's validity period. l. Separate tariffs apply to guest harbors. TARIFF FOR QUAY FEES The Port Authority of Grenland uses the vessel's GT for calculating quay fees. If the GT is not specified in the certificate, it is determined at the Administration's discretion. GT Fee per GT For vessels up to 2,000 NOK 0.70 For vessels up to 4,000 NOK 0.67 For vessels up to 10,000 NOK 0.62 For vessels up to 20,000 NOK 0.50 For vessels above ,000 NOK 0.40 a. For vessels on a shorter route with several calls per day, the fee is calculated only once per day. b. Scheduled container ships and ship liners may be given a discount upon agreement. c. Separate agreements may be entered into for scheduled ferries and RoPax vessels. d. For Cruise lines fee by agreement. 6
7 FAIRWAYS AND PORTS Vessels that are operating mainly within the municipal sea areas, such as tugboats, barges, floating cranes and cruise ships, will be charged for the use of fairways and ports. The fee is due in advance annually, as follows: Vessels up to 200 GT Vessels from 200 to 1,000 GT Vessels above 1,000 GT Mooring tariff NOK 7.50 per GT NOK 9.50 per GT by agreement NOK 650 per meter per year THE FISHERMEN S TERMINAL For the use of the fishermen s terminal in Langesund, the annual price is NOK 600 per meter of the boat s length. The fee is paid in arrears and can be settled monthly, quarterly, or half yearly depending on the lease agreement. Renovation costs are payable in arrears per annum, based on consumption. 7 GOODS CHARGES a. Goods charges are payable on all goods that are transported by ship to or from the port and across the public quays. b. An inbound goods charge is payable on goods arriving at the port in transit or for forwarding to domestic destinations. An outbound goods fee is charged for goods in transit to other countries. c. A charge is also placed on goods that are transferred from one vessel to another, without passing the quay, if one of the vessels is docked at the quay. In such cases, the charge amounts to one third of the charge for goods that are carried over the quay. d. The goods charge covers the storage of goods at the quay area for up to 48 hours after unloading or commenced loading of the ship. e. Payment of goods charges on incoming goods is the responsibility of the receiver. Goods charges on outgoing goods are the responsibility of the sender. However, the Port Authority of Grenland can make an agreement with the local representative for the goods owner about another form of collection of the goods charge, or the fee can be calculated into the freight. f. For project cargo, the charges will be determined by agreement for each loading/offloading operation.
8 Exempt from goods charges are: Passenger luggage Provisions, water, oil, and necessities loaded for the vessel's own requirements Containers, pallets and similar items that are not commodity goods TARIFF FOR GOODS CHARGES All charges are in NOK per m-tons, unless otherwise indicated. Volume goods are regarded as unit weight where 1 m3 = 0.5 tons. For goods stored at the Port Authority s quays, areas or warehouses for more than 48 hours before loading or after unloading, a fee incurs according to the following rate: On an open area In a warehouse:. NOK 0.50 per m2 per day NOK 2.00 pr. m2 per day The fee is calculated based on the largest area occupied. The exception is a leased area. 2. Goods placed in the port area should be removed as quickly as possible unless permission is granted by the Port Administration. 3. This (point 2) also applies to transfer goods for further transport by sea or land. NOK 0.50 is paid per day for empty containers stacked vertically as well as for larger packaging units. 4. Storage over a longer period of time in warehouses and on land is available by agreement. 8
9 5. In some instances, the Port Director upon written request, may reduce or dismiss accrued fees when there are conditions present to justify this. Such application must be submitted no later than 14 days after the invoice is received. 6. Goods placed on quay areas or in warehouses without permission, or that remain longer than permitted, may be removed by the Port Authority without prior notification, and stored at the beneficiary or the shipper's expense. If such goods are not collected within 3 months, the Port Authority can sell these at public auction following announcement. 7. Upon prior notification, the Port Authority can dispose of goods before the 3 month expiry period if the goods do not provide security for the costs incurred or they are perishable and thus can cause damage. 8. If the Port Authority finds that the repair of packaging or repackaging of goods is required, this can be done against a reimbursement of expenses. 9. Grenland Port Authority cannot be held responsible for goods placed on the quay, land or warehouses. QUAY AREAS AND WAREHOUSES Grenland Port Authority may, space permitting, let quay areas and warehouses for the longterm storage of goods. For letting to other businesses, port related business will be given priority. Fees and other conditions are determined on a case-by-case basis and according to contract. Fees for special conditions that are not directly associated with port operations are agreed on a case-by-case basis. TARIFF FOR RAILWAY AND GENERAL CARGO 1. All transports need permission from the Port Authority. 2. Permission for transport related activities is given to the port s agents, clerks or representative for the owner of the goods. This may require a fee for reloaded goods and a trailer fee for the mode of transport. The Port Authority has the option to withdraw a given consent for the use of the port area if traffic conditions should warrant this. 3. A monthly statement with transport type, number and weight is submitted along with the settlement to the Grenland Port Authority. 9
10 Cargo fee by agreement Truck fee by agreement Freight charges are not payable to Grenland Port Authority on goods that are already charged a goods fee. A separate agreement with agent or owner can be made for prolonged operations and lease terms. Paid freight fees allows for the goods to be stored up to 2 working days in the relevant port area. For excess time, the goods are charged in accordance with applicable tariffs. EQUIPMENT AND CREW a. Cranes are rented preferably for unloading and loading of vessels and barges. b. Crane/forklift is ordered by contacting Skien Port Terminal. c. Orders for crane/forklift for 7am must be received by 2pm the previous day. On working days on the eve of public holidays, orders must be received by 12noon. d. If the crane/forklift is not used as agreed, a new pre-order is required. e. Outside regular working hours, the customer must pay a fee for pre-ordered crew and equipment. f. Subletting and/or transfer of crane/forklift to another company is not allowed. g. Working hours with the crane/forklift are by current agreement. h. The customer must pay overtime according to tariff, including overtime ordered but not used. i. Time for the necessary movement and preparation of materials is included in the rental period for the crane/forklift. j. The cranes must not be used for heavier lifts than notified. The customer shall on request show the bill of lading, invoices or other proof of the weight of the goods to be lifted. A joint lift between the crane and the vessel's own crane is not allowed. k. Cranes must be used only for vertical lifts. They cannot be used for moving cargo within the ship or on quay, or for towing barges. l. Port of Grenland will be responsible for operating the cranes only. The customer will be responsible for providing straps, shackles, etc. 10
11 m. The customer is responsible for freight handling and is obligated to provide a competent signal person for the crane operator. n. Grenland Port Authority cannot be held responsible for any damages to goods and other articles on board the ship or on land that incur during crane operations or forklifting, when requested by the customer or his staff, or for any damages incurred as a result of technical failure on the equipment. WAITING TIME The standard hourly rate for the crew is used for any waiting time per hour commenced during business hours. Outside regular working hours, overtime pay is calculated as per current agreement. CRANES 1. Preparation of the crane before and after use is regarded as usable time, and billed accordingly. 2. The maximum lift per crane is 100 tons. 3. The minimum charge for the use of the crane in general is 2 hours. 4. The minimum charge for one special lift is 3 hours. 5. The crane time is calculated to the nearest full hour. 6. The fixed rate for loading and unloading using Port of Grenland grabs is NOK per ton. 7. For attendance outside of regular working hours, an additional 2 hours is charged for the crane operator. 8. After business hours and until 21pm an additional 50% is added to the crane operator s working hours as per current tariff. An additional 100% is added to the crane operator s working hours between 21pm and 7am, including Saturday and Sunday, as per current tariff. An additional 133% is added to the crane operator s working hours between 12pm and 12am on Wednesday before Maundy Thursday, Pentecost, Christmas Eve and New Year's Eve as well as during weekends and public holidays, as per current tariff. 11

For lower frequency, the price for lifts up to 50 tons applies. Overtime pay applies to all crane operations outside regular working hours, as per current tariff. During business hours a rate of NOK 450 for each commenced hour will be charged for ship delays and waiting time during loading/unloading of a ship. Overtime pay applies when work is done outside regular working hours, as per current tariff. For more information, see section 8 above. Lifts Fork lift up to 4 tons... NOK 950 per hour All prices apply to regular working hours (between 8am and 3.30pm) Monday to Friday and include driver/operator. Minimum rental time during working hours is 0.5 hour. Minimum rental overtime is 2 hours. A separate agreement must be entered into for renting equipment outside of the Crane Quay and Skien Harbor Terminal areas. Machines and equipment cannot be rented without the operator. Simple lift.. NOK 260 per unit 12

For renting the Port of Grenland s floating equipment, the price is NOK 2,000 per hour including skipper. 2. Extra crew is available at an additional cost. 3. Separate agreements may be made for assignments in connection with acute pollution or other special missions. WAITING ROOM A waiting room is available for rent at NOK 600 per day. WASTE FEE Vessels arriving at Port of Grenland's docks can dispose of ship waste in containers located on the quays. This does not include dunnage, broken pallets or other large items. Disposal of these materials must be ordered separately and will be charged to the vessel. All vessels calling at the quay, provided they have not reported an exemption, must pay the following waste fees: NOK 0.25 per GT; minimum NOK 100; maximum NOK 500. For waste delivered unsorted an additional fee of 25% applies. Vessels with the last port outside of the EU/EEA entail an additional 50% fee. PASSENGER FEE When the port has exceptional costs for passenger amenities, the Committee of Representatives may determine a fee to cover these. The fee is charged to the shipping company and is calculated for both embarking and disembarking passengers. The fee per passenger is NOK

BUS, WINNEBAGO, CAR, TRUCK AND SEMI TRAILER To cover irregular costs of loading/unloading vehicles, the Committee of Representatives may determine a fee to cover such costs. The fee is charged to the shipping company. Car (with or without trailer).. NOK 50 per unit Winnebago.NOK 70 per unit Truck (with or without trailer)...nok 70 per unit The fee is calculated for motorized and non motorized items, both embarking and disembarking units. RAILWAY GOODS To cover the cost of the use of the rail facilities at Brevik Terminal, the Committee of Representatives may determine a fee. The fee is calculated as a unit price per unloaded/loaded unit on the railway carriage. The fee is charged to the operating rail company. 15 WATER DELIVERY Fresh water is available at The Port of Grenland's quays. Orders can be made by the ship or through the ship's agent. Price for water delivery NOK 25 per ton water minimum NOK 500 If the port s crew is used outside regular working hours, overtime is accrued according to tariff. MOORING Mooring crew is booked through the ship s agent. Only mooring personnel approved by Grenland Port Authority may be used. MANAGEMENT Processing fee The following fees will be charged for the processing of applications for actions under the Act on Ports and Waterways Safety 27.1: Class Action 1: NOK 1,500 Class Action 2: NOK 5,500 Class Action 3: NOK 8,500 If the processing of applications for actions requires extraordinary inspection and/or meetings, the port can claim compensation for the time spent in connection with this. 15
