2 Page 2 of 16 EPSSOpGuidever1.2 7/7/08 PRE-SITE PREPARATION Installation Considerations It is highly recommended that the owner/user of this swim spa carefully read all instructions in the manual prior to having your swim spa installed in your chosen location, whether indoors or outside. IMPROPER INSTALLATION MAY RESULT IN EQUIPMENT DAMAGE AND VOID THE ENDLESS POOL SWIM SPA WARRANTY. GETTING THE SPA TO YOUR SITE All portable spas require inches of clearance through gates, doors, between houses and side fences, around corners and 10 feet overhead clearance. If we attempt to deliver and discover a crane is not available, or the yard is not fully prepared, there will be a charge for a second delivery. The customer will pay for the crane service and/or any additional manpower needed. SPA PAD REQUIREMENTS Your new swim spa MUST BE PLACED ON A UNIFORMLY FIRM AND LEVEL SURFACE. The pad foundation recommended is a concrete pad at least 4 inches thick. As an alternative, a pea-gravel foundation pad could be used, but it must be contained in a secure wood or concrete restraining border so that the loose gravel cannot shift once the swim spa is placed. If a concrete pad is poured, this is the logical time to plumb-in your electrical conduit (refer to the following page). Be sure the concrete has cured for at least one (1) week before setting the swim spa in place. AN UNEVEN OR CRACKED CONCRETE PAD, OR THE USE OF SHIMS OF ANY KIND MAY CAUSE THE SWIM SPA TO BUCKLE, DISTORT AND/OR CRACK, AND THE WARRANTY ON YOUR SPA WILL BE VOIDED. ADDITIONAL REQUIREMENTS All installations require the equipment system to be shielded from the weather. If the equipment system is placed away from the spa, then an enclosure for the equipment will be required. The customer is responsible for providing such an enclosure. Balconies and decks must be constructed to current state and local codes to safely support the maximum load of your water-filled swim spa and the number of people using the swim spa. Check with your construction contractor for these specifications. It is the responsibility of the owner to provide clear access on all sides of the swim spa once it is set in place for ease of repair and maintenance. Otherwise, additional costs to service and repair the swim spa may be incurred. If the spa is to be set in-ground, not skirted, even support of bottom, sides and lip are absolutely necessary to insure proper structural support and to keep the warranties valid. A properly constructed vault is recommended for in-ground installations. In-ground installations also require proper drainage of water and may require a sump pump to remove spa and rain water from a vault. It is not recommended to backfill against the swim spa cabinet. This will damage the swim spa. If your spa is located near water sprinklers, adjust or cap them so water will not hit the wood siding of the spa. During colder months, have a fill hose and water supply thawed and ready for filling your spa upon delivery.

3 Page 3 of 16 EPSSOpGuidever1.2 7/7/08 ELECTRICAL REQUIREMENTS The Endless Pool Swim Spa requires two (2) 220-Volt, 30-Amp GFCI protected circuits. Individual GFCI breakers need to be used in the main or sub panel (copper wire only). Both circuits must use a minimum #10 gauge wire. One circuit requires a neutral (4 wires total) and the other circuit does not require a neutral (3 wires total). Two (2) Disconnect Boxes are required within eyesight but at least 5 feet from the swim spa. Allow plenty of extra wire from the Disconnect Boxes to the Spa Equipment System area so the equipment can be directly hard-wired. IF THE WIRE IS TOO SHORT, EPI WILL NOT BE ABLE TO HOOK-UP YOUR SWIM SPA AS EPI IS NOT A LICENSED ELECTRICAL CONTRACTOR AND WILL NOT RUN ANY EXTRA WIRE SWIM CURRENT Breaker Panel Two (2) 220-Volt, 30-Amp GFCI Breakers Customer supplies all electrical components and necessary labor. Disconnect Boxes must be placed 5 (or more) away, but within eyesight, from the swim spa. EPI does not supply any electrical components except those installed on the swim spa at the time the swim spa was originally manufactured.

4 Page 4 of 16 EPSSOpGuidever1.2 7/7/08 THE SENSIBLE WAY TO ENJOY YOUR SWIM SPA Clearly understand the specifics of safe operation and proper maintenance of your swim spa. Spas are fun, but along with the fun comes serious responsibility. Be sure good times are safe times. Establish rules and enforce them. It is your responsibility to be sure that you, your family and guests use the swim spa sensibly. Children are not waterproof! Drowning is one of the largest causes of accidental death for infants and children under the age of five. There is no substitute for adequate supervision Never leave a child alone, out of eye contact, in or near the swim spa not even for a second. Always completely remove the cover before using your swim spa. Avoid the possibility of someone being trapped under the swim spa cover. Insist there be no running, pushing or rough housing near the swim spa. Never consider young children water-safe despite their swimming skills, previous instructions or experience. Common sense should prevail. Never use the swim spa when you are alone in your house. One (1) individual must assume the responsibility for supervising the swim spa. Never use the swim spa while or after using narcotics or other drugs that may cause sleepiness, drowsiness or raise/lower blood pressure. Never use the swim spa while or after using alcohol. Be sure you check the water temperature before and while you are in the swim spa. Persons with heart disease, diabetes, high or low blood pressure or any serious illness, and pregnant women indeed persons with any doubt should not enter the swim spa without prior consultation with their doctor. It is a good idea to shower with soap and water before using your swim spa to wash off common skin bacteria, lotions and deodorants. Plan ahead to prevent accidents and injuries and make your entertaining or workout truly enjoyable. Use only unbreakable items around your swim spa. At least one (1) responsible person should be trained in artificial respiration and/or cardiopulmonary resuscitation (CPR). Spa Preparation Have a licensed electrician wire the spa equipment through a GFCI (Ground Fault Circuit Interrupter). Where possible, use battery-operated appliances around the swim spa. Electrocution from appliances in contact with the water is a real danger. Carefully read, understand and follow operating and maintenance instructions supplied by EPI. It is a good general rule to visually inspect your swim spa and equipment regularly. If you detect something wrong, contact our Customer Service Department at Never perform work on your swim spa or filter equipment without turning the entire system off. Carefully follow the instructions for maintaining, servicing or repairing your swim spa. If you are at all unsure of how to proceed, call our Customer Service Department at For safety, make sure that the water is properly disinfected.

5 Page 5 of 16 EPSSOpGuidever1.2 7/7/08 USING CHEMICALS The chemicals needed for your swim spa help make it clean, disinfected and more attractive to use. Remember, these chemicals are potentially dangerous and may present some hazards if not properly used. Carefully follow the manufacturer s instructions for the use and storage of these chemicals. In general, here are some tips for chemical use and storage. Before using chemicals, read the labels and directions fully. Follow label use on instructions. Keep all chemicals out of reach of children. Storage Chemicals for test kits should be replaced every year. Keep the original lids on all chemical containers and make sure the lids are closed tightly when not in use. Do not stack different chemicals on top of one another. Store your swim spa chemicals in a clean, cool, dry, well-ventilated area preferably off the floor to prevent contamination from other materials. Keep them away from the chemicals and equipment used for garden and/or lawn maintenance. Keep liquid chemicals away from dry chemicals. Keep apart chemicals that are different forms of oxidizing compounds. Physically separate all different forms of chemicals. Do not store your swim spa chemicals where other flammable items may mix with them. For example, a mixture of these chemicals and fertilizer can cause a fire or an explosion. Usage: Always add chemicals directly to the swim spa water, either in a suitable feeder, distributed across the surface of the water or diluted and poured into the water. Follow label use instructions. When preparing water solutions for feeder applications, pour the chemical slowly into the appropriate amount of water, stirring constantly to provide mixing and dilutions. Always add chemicals to water. NEVER ADD WATER TO CHEMICALS. Carefully clean up any spilled chemicals with large amounts of water to dilute and wash away the chemicals. Disinfectants and ph adjustment chemicals can usually be sent to the sewer with large quantities of water since that are intended for use at low levels. Wash out empty disinfectant containers before disposing to eliminate danger of fire, explosion or poisoning. Test the water in your swim spa with a reliable test kit. Add the necessary chemicals according to the test results and the manufacturer s instructions. In the hot water environments of swim spas, disinfectants may rapidly break up and spread out requiring more frequent water testing. Follow your manufacturer s instructions in this regard. The more people who use the swim spa, the more frequently you should test the water. Do not inhale dust or fumes from any chemicals. If necessary, use proper protective devices for breathing, handling and eye protection. Promptly wash off any residues that came in contact with your skin. Never reuse old chemical containers unless specified by the manufacturer.

6 Page 6 of 16 EPSSOpGuidever1.2 7/7/08 INITIAL START UP 1. Fill swim spa with water from a garden hose or water truck. 2. Turn thermostat(s) OFF at the Equipment System in the cabinet. 3. Once filled with water, turn power ON at Disconnect Box. 4. Be sure ON/OFF switch is ON at Equipment System cabinet. 5. Be sure the Hi-Limit Switch is pushed IN on Equipment System (on 100 volt units, check to be sure GFI breaker is ON.) 6. Check to be sure the Circulating Pump is operating (water flowing from small jets in footwell). One (1) jet is the Ozonator Jet and will not appear to be working. You can also check the clear tube coming out of the small Circulating Pump, (at Equipment System inside of cabinet) and going to the Heater Housing, to see if the water is flowing properly. 7. Run jets for two to three minutes with the heat in the OFF position. 8. Check to be sure there are no air locks: Filter (loosen air valve on top of filter until water runs out) Circulating Pump (Warning: Air locks can cause instantaneous heater failure, known as dry firing, and this is not covered under the warranty) 9. Check for water leaks at Couplers on Pumps and hand tighten if necessary. 10. Turn temperature on the Equipment System to maximum level. Periodically check temperature of water until desired temperature is reached. Reduce thermostat setting until HEAT light turns off. 11. Check Alkalinity and ph with test strips or test kit adjust accordingly. 12. Do timely maintenance as directed and ENJOY YOUR SWIM SPA! 13. Contact our Customer Service Department at to answer any questions that you may have. In many areas of the country, the ph and Alkalinity are very high. To bring your ph and Alkalinity down: 1. Add 1 ounce of ph/alkalinity Down per 100 gallons of swim spa water (1,950 gallons = 19.5 ounces) and run the jets for several minutes to mix and dissolve. 2. In approximately 15 minutes, re-check the spa water and if either the ph or Alkalinity is still high, add 1/2 ounce of ph/alkalinity Down per 100 gallons of swim spa water (1,950 gallons = 19.5 ounces) and run the jets for several minutes to mix and dissolve. 3. Repeat step two (2) until both the ph and Alkalinity are within the ideal ranges of your testing kit. 4. Re-check the swim spa two (2) days later and adjust if needed. 5. Do not add ph Up and ph Down in the same day. This will help avoid ph Bounce. 6. Log the number of ounces used to balance your swim spa water as you balance it the first time so that in the future you can add that amount all at once at time of fill up to achieve balanced water much quicker. Special Note: It is extremely important that you check and re-tighten your pump couplers several times during the initial weeks of ownership of you new swim spa. We have done this during the delivery process, but they will need to be re-tightened after the initial fill and warm up of the water. Additionally, you will need to check them once a month to insure they stay tight. If you have any questions, please call our Customer Service Department at

7 Page 7 of 16 EPSSOpGuidever1.2 7/7/08 SWIM SPA CHEMISTRY Refilling your Swim Spa Fill the swim spa with water from your garden hose or water truck, turn on the water quality system and bleed air at the bleeder valve on the filter. Add 6 ounces of Speed Shock. Add 4 ounces of Stain & Scale. This prevents build up of stains, scale and calcium. Check ph and Alkalinity and bring them in Ideal Range on the Taylor Test Kit. It is best to balance the ph and Alkalinity within 24 hours of filling the spa. The best two (2) choices of sanitizers to use: Bromine Tablets Put six (6) bromine tablets into the Floater and float in the swim spa when not in use. More or less bromine may be necessary depending upon usage of the swim spa. Chlorine Granules Add 2 4 ounces of chlorine granules. TIMELY SWIM SPA MAINTENANCE Once a Week: Test water with a testing kit. Bromine will test low in most Endless Pools Swim Spas due to the Ozonator. Add 4 6 tablets of bromine per week to floater or add chlorine granules. Twice a Week: Balance your ph and Alkalinity levels If your ph and Alkalinity level are high, add ph/alkalinity Down. This will lower the levels at the same time. If your ph level is balanced but your Alkalinity level is low, add Alkalinity Up. This will raise the Alkalinity level and leave the ph level alone. If your ph level and Alkalinity level are low, add ph/alkalinity Up. This will raise the levels at the same time. It is very important to keep the levels up, if the ph is low for a long period of time; the water becomes acidic and will corrode the components on your swim spa. It is important to keep both the ph and Alkalinity levels balanced because they help to hold each other within the desired limits. Proper ph and Alkalinity levels help other chemicals used in your swim spa to be more effective. Every Four to Six Weeks: Rinse off your filter or replace with a new filter. You can run your filter through the dishwasher, but DO NOT USE SOAP OR DRY BY HEAT. It is recommended that you clean your filter once a week during the first month of operation. Clean the Skimmer by unscrewing the basket, pulling it out and removing any foreign debris. Things to Remember: Clean your filter regularly. Clean your skimmer basket regularly. It is recommended to rinse all swimsuits an extra time after washing to avoid transferring soap from the laundry into the swim spa s water. Tighten the pump couplers in the equipment area. They can loosen over time from vibration causing a small drip near the pump. Hand-tighten ONLY. Loose couplers are not covered under warranty. Bleed the excess air from the filter after cleaning the filter or changing the water. The turbo jets can be placed in a position that will cause only one-half of the jets to operate. Turn the jet to the proper position to get the desired performance. Filling the swim spa from inside the Filter Housing can help prevent an air-lock in the Circulating Pump. Keep your ph and Alkalinity levels of the water in the proper range to avoid damage to the swim spa s components. Improper levels may cause damage to the swim spa that is not covered by the warranty. High bromine and chlorine levels may cause damage to the swim spa that is not covered by the warranty.

8 Page 8 of 16 EPSSOpGuidever1.2 7/7/08 WATER CHEMISTRY There is more to taking care of a swim spa than just keeping the water clean. You also have to make sure that water is properly balanced. Water that is not balanced, either too acidic or too basic, can cause a swimmer or bather discomfort, cloudy water and damage to the swim spa surfaces and equipment. To help you get a handle on what water balance means and how you can maintain it, let s look one at a time at the factors that shape your water. Keeping the Water Balanced. Before adding any chemicals to adjust your ph levels, you must consider: Total Alkalinity The most important thing to remember about Total Alkalinity is that it affects your ph levels and therefore must be tested before your do any ph testing and adjustments. Basically, Total Alkalinity is a measure of the water s ability to neutralize acid (called the Water s Buffering Capacity), and keeps your ph level within proper range. This is why you test and adjust your Total Alkalinity before adjusting ph. Your goal? To keep alkalinity readings inside the acceptable range of 80 to 120 ppm. What happens if you don t? Let s take a quick look at he problems that can result. High Total Alkalinity Hard to change ph Scale formation Skin and eye irritation Poor sanitizer efficiency Cloudy water Damage to swim spa Low Total Alkalinity Rapid changes in ph or ph Bounce Corroded metals and equipment Skin and eye irritation Damage to swim spa ph The most fragile and arguably the most important component of water balance is ph, a reading that indicates how acidic or basic your swim spa water is. It is important to monitor ph because it has an impact on you, the swim spa s surfaces, equipment and chemicals. All spa chemicals are designed to work effectively at an ideal or neutral ph. Improper ph levels can cause damage or corrosion to your swim spa. Here are the most common problems associated with both high and low ph levels: High ph Readings Poor sanitizer efficiency Shorter filter life Scale formation Skin and eye irritation Poor sanitizer efficiency Cloudy water Damage to swim spa Low ph Readings Corroded metals and equipment Skin and eye irritation Damage to swim spa Destruction of total alkalinity The ideal ph range for swim spas is 7.2 to 7.8. Any readings below 7.2 means that your water is acidic. To correct this situation, add ph Up or ph/alkalinity Up. NOTE: Do not add soda ash to a swim spa as you would a pool because it is too strong for the small swim spa environment.

9 Page 9 of 16 EPSSOpGuidever1.2 7/7/08 If ph reading is above 7.8, the water is basic or alkaline. Liquid muriatic acid is too powerful for a small volume of water as found in your swim spa. Therefore, do not use muriatic acid in your swim spa. Instead, add dry acid such as ph Down or ph/alkalinity Down. Before adding any chemicals to adjust your ph levels, first consider alkalinity. Water Hardness Water hardness is a concentration of the calcium and magnesium in your swim spa, but is often referred to as simply calcium hardness. The amount of calcium hardness your water has depends on your water source. Well water, for example, has a higher mineral content (harder) than a fresh-water source that has gone through a treatment facility. NOTE: You do want your water to have some level of hardness. If the water is too soft, the water will slowly dissolve any metal in your spa equipment. If there is too much hardness, you will see scale formation on the walls of the swim spa and the water will take on a cloudy appearance. As you probably know, the occasional addition of new water or a complete replacement of water is not enough to keep the water clean and clear of unwanted and often microscopic contaminates. Your goals are water sanitation and water balance. This means you want to keep your levels of sanitizers such as bromine and chlorine and your levels of ph, total alkalinity, water hardness and total dissolved solids to fall within acceptable limits. Keeping your Water Clean Sanitizers, or disinfectants, are hard working chemicals. In order for them to do their job, they have to be present in your swim spa water at all times. There always needs to be a certain minimum amount, called a residual, of sanitizer in you water. When you add your sanitizer, you should be adding enough to kill any existing contaminants in the water and create a residual that can neutralize any dirt, debris or germs that may get into the water before you treat it next. Bromine The acceptable range of bromine for your swim spa if 2.0 to 5.0 ppm. Bromine has a low odor and dispensing it into your swim spa via a floating feeder allows it to dissolve at a slow, constant, desirable rate. Remember to remove the floating feeder when the swim spa is in use. Too high a bromine level can cause corrosion to the swim spa. Chlorine has the power to eliminate bacteria and algae, however like most chemicals, it has a threshold a point to which it had used up all its sanitizing power and can no longer protect your swim spa water. Chlorine levels are heavily influenced by evaporation and a low ph. Once added to the water, the free available chlorine will sanitize and oxidize the water by attacking undesirables. As chlorine uses up its potential, the chlorine becomes ineffective or it combines with contaminants and remains in the swim spa water in the form of chlorine. It is these chloramines in your swim spa water not enough good chlorine that causes a chlorine-like odor and can irritate your skin and eyes. Test the water and add appropriate amounts of sanitizer as soon as possible. Too high a chlorine level can cause corrosion to the swim spa.

If necessary, drain all or part of the water and refill with fresh water. Test ph and total alkalinity levels, make appropriate adjustments and consult our Customer Service Department at Drain and clean the swim spa and swim spa filter. Limit clarifier use. 13 Page 13 of 16 EPSSOpGuidever1.2 7/7/08 OZONATOR Although Bromine and Chlorine are the most commonly used sanitizers, we also use an ozonator. An ozonator produces gaseous oxygen from an Ultra-Violet light encased in a housing inside your swim spa and works well as a sanitizer and oxidizer. Because it is a form of oxygen, ozone does not last long in an aqueous environment. Once it does its job of ridding the spa water of bacteria and other unwanted matter, the ozone then reverts back to oxygen and either dissolves into the water or escapes into the air. This is why the ozonator works 24 hours a day, emitting ozone that sanitizes your water. Because an ozonator cannot create a residual, it must be used in conjunction with small amounts of Bromine or Chlorine, or with a catalytic converter. PUMPS/MOTORS/HEATER The pump is probably the hardest working piece of equipment on your swim spa. Its job is the keep the water moving throughout the entire circulation system. The pump draws the water from the swim spa and then pushes water through the plumbing and then through the filter. It pulls the water through the heating process and the pushes it back into the swim spa. Keeping the water circulating in one of the best ways to help you keep your swim spa clean requiring very little attention from you. The motor s function is to drive the circulation systems. It converts electrical energy into mechanical energy that is used to operate the pump. You should not get involved in any hands-on maintenance of the motor. If the motor fails to operate properly, contact our Customer Service Department at to avoid canceling any warranties. The heater warms the filtered water before re-entering your swim spa. As in the case of the motor, the heater does not need much maintenance. Be sure you maintain properly balanced water. Un-balanced water will dissolve metals from the equipment or cause a calcium build-up that can eventually cause heater failure.

14 Page 14 of 16 EPSSOpGuidever1.2 7/7/08 CABINET, COVER, AND CLEANING OF YOUR SWIM SPA Cabinet Care: The spruce wood cabinet on your swim spa is made of the finest quality outdoor wood available. The wood needs to breathe so do not use a traditional sealer on its exterior. You can use a wood preservative such as boiled linseed oil, or a semi transparent stain, like Cuprinol that is available at Sherwin Williams stores. Cover Care: Your 4 -thick matching cover was custom made for your swim spa with top of the line materials. Aluminum channel bars form the structure of the cover for superior strength. Inside, the high-density polystyrene foam core provides excellent insulation from heat loss. Hard working, 4-mil extruded plastic covers the foam core. The outside is made off Marine grade vinyl, safe from coldcracking to 10 degrees below zero. It is treated with UV stabilized pigments so the color will not fade. Cleaning Your Swim Spa: No one wants to get in water that is not crystal clear. It is hard to enjoy yourself if you have to dodge dead bugs, twigs, leaves or other garbage. Fortunately, cleaning your swim spa is easier than cleaning your house. Removing debris: Use a net made of fine mesh to sweep through the water to capture any debris suspended in the water. Check your swim spa s skimmer basket at least every two (2) weeks for anything trapped from the waters surface. Vacuum your swim spa for dirt and unwanted material that gets in your footwell area. Cleaning the acrylic surface of your swim spa requires some special care. DO NOT use ABRASIVE CLEANERS that will scratch your spa. Draining Your Swim Spa Draining your swim spa is an easy procedure. Place one end of your garden hose in a drain or in your yard, and place the other end against a water jet. Turn on the jets and let it push water through the hose until it produces a stream out of the hose. At this point, put the end of the hose in the bottom of the foot-well of your spa, and it will siphon the water down to that point. Be sure to turn off the jets and power after putting the hose in the foot-well. Winter Draining of Your Swim Spa: If you are draining your outdoor swim spa during freezing temperatures, be careful to not let water in the lines and equipment of the swim spa freeze while the swim spa is draining or refilling. Water that freezes during this time can cause damage to the swim spa that will not be covered under your warranty. It is recommended to drain and refill your swim spa when the temperatures are above freezing. If you choose to winterize a swim spa, you should do so during weather that includes temperatures in excess of 40 degrees Fahrenheit

15 Page 15 of 16 EPSSOpGuidever1.2 7/7/08 FILTER CARE The filter is probably the most abused component of the swim spa. It works very hard to keep your swim spa clean and gets very little in return. To be sure your filter is treated properly and is at it top performance, just follow a few maintenance guidelines. Make sure to replace your old filter with a new filter every 12 months or if: The filter is gray, brown or green. The filter looks beige or off-white, even after cleaning. The swim spa has been transferred to a new owner. The actual filter element becomes flat and loses its fibrous sheen. The filter top or bottom has been cracked or split. The actual element starts to unravel or come apart. Rinse the filter off with a high-pressure garden hose once per week or as needed. Do not use any soap-based cleaners or car wax on your swim spa or the filter. Make sure that the filter is seated properly in the filter compartment or skimmer. This insures 100% filtration of the water passing through the filter. Make sure your maintain proper water chemistry at all times. Filters are good, but they are not miracle workers and cannot actually kill off algae or bacteria. Make sure that the filter is cleaned every two months with a Filter Cleaning Solution. Also fully clean the filter whenever draining and refilling your spa. It is a good idea to have two filters and use them on an alternating basis, switching every other week. This way you can be using one while you are cleaning the other. Try to keep your family members and friends from going into the swim spa if they have any one of the following on their body and ask them to shower first: hair spray, mousse or styling gel, deodorant or antiperspirant, suntan lotion, skin creams, or excess soap on their bathing suit. Removing Your Filter with the power OFF Bleed air from the filter housing, turn knob (1) counter-clockwise. Pull on the gray tab (2) and rotate filter ring (3) counter-clockwise and remove. Pull on filter lid handle (4) and remove filter (5) to clean or replace. Check o-ring (6) for damage. Replacing Your Filter with the power OFF Replace ring (7) and reverse steps above turning filter ring (3) clockwise until hand tight. Turn power ON. When water comes out of bleed knob (1), close, turn clockwise and hand tighten.

WARRANTS TO THE ORIGINAL PURCHASER OF THE ENDLESS POOL SWIM SPA MANUFACTURED BY US TO BE FREE FROM DEFECTS IN MATERIALS AND WORKMANSHIP UNDER NORMAL USE FOR TWO YEARS FROM PURCHASE. Our obligation under the warranty shall be limited to the repair or exchange (at our option) of any part or parts which may thus prove defective under normal use within two years from date of purchase by the original purchaser, and which our examination shall disclose to our satisfaction to be thus defective. This warranty is expressly in lieu of all other warranties expressed or implied including the warranties of merchantability and fitness for use and of all other obligations or liabilities for all damages direct or consequential to person, property or business whether or not occasioned by our negligence, and we neither assume for us any other liability in connection with the sale of this Endless Pool Swim Spa. IN ADDITION, ENDLESS POOLS, INC. OFFERS A TEN-YEAR STRUCTURAL WARRANTY ON THE ACRYLIC SHELL STRUCTURE. If the acrylic shell should deteriorate beyond structural use in this tenyear period, we will repair or replace the component at our option after inspection of the defective shell. The structural warranty is voided when suitable drainage is not provided. THE ACRYLIC SURFACE OF THE SWIM SPA SHELL IS WARRANTED NOT TO SPLIT, BREAK, CRACK, BLISTER OR MILDEW FOR A PERIOD OF FIVE YEARS. This warranty does not include cosmetic damage or minor surface imperfections. THIS WARRANTY SHALL NOT APPLY TO THIS ENDLESS POOL SWIM SPA OR ANY PART THEREOF, WHICH HAS BEEN SUBJECT TO SALT CHLORINE GENERATORS, ACCIDENT, NEGLIGENCE, FREEZING, IMPROPER INSTALLATION OR OPERATION, ALTERATION, ABUSE OR MISUSE. THIS INCLUDES, BUT IS NOT LIMITED TO, FLOW RESTRICTIONS OR OBSTRUCTIONS ON ALL WATER AND HYDRAULIC SYSTEMS AND NOT MAINTAINING PROPER WATER CHEMISTRY (ph level must be maintained between 7.4 and 7.8 and total alkalinity between 80 and 120 ppm. Total dissolved solids (TDS) must be no greater than 3,000 ppm). We make no warranty whatsoever in respect to accessories or parts not supplied by Endless Pools, Inc. directly. The term original purchaser, as used in this warranty, shall be deemed to mean the person for whom the Endless Pool Swim Spa was originally installed. We DO NOT warrant this machine to meet requirements of any safety code of any state, municipality, or other jurisdiction. Purchaser assumes all risk and liability whatsoever resulting from the use thereof. In order to claim this warrant, original purchaser must promptly notify our Customer Service Department in writing of the existence of the claim and then follow our written instructions regarding the procedures for remedying the defect. Endless Pools, Inc. shall not be responsible for cartage, transportation, removal and/or reinstallation labor or any other such costs relating to performance of the warranty. In the event any portion of this warranty shall be deemed unenforceable by a court of law, the remainder of this warranty shall remain in full force and effect as if the voided portion were never included. Prepaid returns of all Endless Pool products are accepted less a 10% restocking fee, up to 30 days from the date of purchase if undamaged and in its original shipping containers.
