5 PLANNING ENVIRONMENT & TRANSPORT FEES AND CHARGES PREAMBLE PAYMENT STRATEGY 1 s and Charges must be paid at the time of making an application or other request for service from Council. The Chief Executive Officer shall charge and collect any additional fee and reimburse any overpayment, subsequently found to be payable. 2 Where a minimum fee is shown or a fee is quoted, the prescribed minimum or quoted fee shall be paid at the time of making the application or other request for service and the Chief Executive Officer shall determine an appropriate total fee. Any balance in excess of the minimum or quoted fee shall be paid before provision of the service. 3 All listed uses, terms and conditions listed in the Schedule are defined in the Gold Coast Planning Scheme Part 4 Division 1 Dictionary of Terms Used in the Planning Scheme Chapters 1-3 and, for consistency purposes, should be used in all applications submitted to Council. 4 The Chief Executive Officer may require or agree to the lodgement of a security bond as a condition precedent or as a condition of approval of any application. DEVELOPMENT APPLICATIONS 5 A Development Application for Two or More of the following Development Types: Material Change of Use, Reconfiguring a Lot, Operational Work If a development application for a site includes two or more of the above development types, Council s application fee is the prescribed fee for the development type attracting the highest fee, together with 50% of the prescribed fee for the other development type/s. 6 A Development Application for Two or More Uses If a development application for a Material Change of Use for a site includes two or more uses, Council s application fee is the prescribed fee for the use attracting the highest fee, together with 50% of the prescribed fee for the other use/s. 7 Applications for extension to lawfully established land use The development application fee for any extension to a lawfully established land use is calculated on 50% of the base fee plus the Gross Floor Area (if applicable) of the extension only. 8 Where the fee schedule does not prescribe a fee for any service, a fee shall be determined by the Chief Executive Officer or, if the Chief Executive Officer determines that a prescribed fee is not equitable in the circumstances, he may increase or decrease the prescribed fee. For further information about fees, contact the Town Planning Advice Centre located at the Nerang Administration Building. 9 Development applications well-made in accordance with Council s policies The standard fee will apply when a development application for a Material change of Use, Reconfiguring a Lot and Operational Work is submitted with a comprehensive planning report and Council s adopted Application Lodgement Checklist completed in full. The Planning Report shall address compliance with all relevant codes that are applicable to the development and application for its applied use. Mandatory components of the Planning Report are: Any relevant Domain Place Code Any Local Area Plan Place Code All relevant Specific Development Codes All relevant Constraint Codes. All areas of non-compliance with an identified code should be clearly identified and accompanied by a proposed alternative solution that is both consistent with the Performance Criteria and the Purpose of the code. 10 Development Applications not well made in accordance with Council's policies If a Development Application for a Material Change of Use, Reconfiguring a Lot, or Operational Work submitted to Council is not well made in accordance with Council's policies, the application fee is the prescribed fee plus 50%. 6 PLANNING ENVIRONMENT & TRANSPORT FEES AND CHARGES PREAMBLE REMISSIONS AND REFUNDS 11 Remissions A non-profit, volunteer, charitable, community, sporting or religious organisation making an application consistent with its core activities may be eligible for a fee remission of up to 50% upon Council s receipt of a written request. An additional 25% fee remission may be granted if the application concerns work on a Council reserve. These reductions in fees are at the discretion of the Chief Executive Officer. 12 Refund of Applications s Applicants may request a fee refund when withdrawing an application. A withdrawn application may receive: Up to 75% refund for a development application at the application stage Up to 50% refund for a development application at the information stage Up to 25% refund for a development application at the notification stage Nil refund for a development application at the decision stage Up to 50% refund for a plumbing assessment only. All applications for a fee refund are to be in writing and a decision for a refund is made at the discretion of the Chief Executive Officer. 13 Refund of Planning & Development Certificates s Applicants may receive a fee refund when withdrawing a request for a Planning & Development Certificate. Refunds are as follows: A 75% refund if the certificate request has been loaded into Council s Corporate search system and allocated to an officer A 50% refund if files/information have been researched and sourced A 25% refund if a site inspection has been conducted for standard and full certificates only Nil refund if the certificate has been fully analysed and populated. All applications for a fee refund are to be in writing and a decision for a refund is made at the discretion of the Chief Executive Officer. Planning Environment Transport Preamble 2
