4 PRICE PROPOSAL PRICE PROPOSAL MUST BE SENT IN A SEPARATE SEALED ENVELOPE. The FIRM OF: Hereby agree to provide the requested services as defined in Request for Proposal Insurance Product Broker Each Proposer shall submit Proposal that will include, at a minimum, fees to provide services for each listed in this RFP for the base year and three one-year options. Proposer is encouraged to provide any additional options and fees for services they may offer that are not listed in the RFP. Offer Notes: 1. Evaluation will be made on the total price proposal for the base year and three one-year options. 2. Price realism analysis will be performed. 3. The Commission may reject an offer as nonresponsive if it is materially unbalanced as to the price. An offer is unbalanced when it is based on prices significantly less than prices for some work, and prices which are significantly overstated for other work. 4. All allowances, fees, taxes, contractors, sub-contractors fees and prices are included in this total Proposal. 5. The Commission will evaluate offers for award purposes by adding the total price for the base year and three one-year options. Evaluation of options will not obligate The Commission to exercise the option(s). At a minimum, invoices shall contain the identity of the provider of the services, the date of the services, a description of the services, and any applicable taxes. The price specified shall include all taxes and duties of any kind levied by federal, state, municipal, or other governmental authority, which either party is required to pay with respect to the materials or services covered by this Agreement. 6 Introduction The Charleston County Park and Recreation Commission (CCPRC) is seeking proposals from qualified firms specializing in providing Insurance Products. Upon review of the proposals submitted, it is the intent of CCPRC to select a firm to provide the services outlined in this RFP and in accordance with CCPRC s Procurement Policy. CCPRC represents one of the most unique park and recreation agencies in the State of South Carolina. As a Special Purpose Public Service District created in 1968, CCPRC has specific areas of responsibilities that have been defined through its legislative empowering act. CCPRC is responsible for providing park and recreational services, and, as appropriate, works in cooperation with other recreational and governmental agencies to provide these services. One of CCPRC s ongoing goals is the development of a diversified county park system emphasizing the provision of passive activities, public beach and boating access and environmental stewardship. Each park facility also offers a variety of programming opportunities, facilities and events, of which may are directed toward highlighting the natural features and characteristics of each site. These goals and accomplishments have resulted in providing CCPRC with annual park visitation in excess of 2,000,000. To learn more about the CCPRC park system, please visit our website at Scope of Services The Charleston County Park and Recreation Commission (CCPRC) is currently under a contract with the South Carolina Public Employee Benefit Authority s Employee Insurance Program which offers Health, Dental, Dental Supplemental, Vision, Group Life, Long Term Disability, Supplemental Long Term Disability, and a Section 125 Cafeteria Plan. We currently have a separate broker that offers Short Term Disability, Cancer Expense Protection Policy, Whole Life Insurance, Universal Life Insurance, Intensive Care Policy, and Hospital Confinement Policy. CCPRC is seeking proposals from qualified firms specializing in brokering Health, Dental, Vision, and Voluntary Insurance Products. CCPRC is seeking a broker/consultant to perform the full range of services related to the design, implementation, maintenance, communication, and improvement of the group medical, Rx, dental, disability, life, AD&D, and voluntary insurance programs. Specific responsibilities include, but are not limited to: 1. Provide depth and breadth of expertise in all matters relating to CCPRC s health and welfare employee benefit plans. 2. At the time specified as the deadline for submission of proposals, the offeror shall hold a current insurance broker s license issued by, and must be in good standing with, the South Carolina Insurance Department. License shall be provided with the 6 Insurance Product Broker

7 proposal. Offerors that do not possess required licenses at the time proposals are due shall be determined non-responsive. 3. Confirm that you serve as a consultant or broker, independently, and are not affiliated with any insurance company, third party administrative agency or provider network. 4. Review all aspects of the benefits programs and make recommendations for changes based on CCPRC s financial needs, employee needs, industry trends or market conditions. 5. Model the cost impact of any recommended or mandated changes. 6. Assist in the administration of all group insurance plans, responding to questions from and providing information to HR staff, and providing other consulting services during the course of the plan year. 7. Assist CCPRC in complying with laws and regulations related to employee benefits. 8. Review and analysis of claims experience, claim service, and claim administration to ensure maximum benefit to CCPRC. 9. Determine and recommend the most economical funding methods for the benefit programs. 10. Represent CCPRC in all negotiations with providers on all issues including those related to premiums, benefit levels, plan design, and special terms and conditions. 11. Meet with and providing reports to various CCPRC representatives. 12. Assist CCPRC with the implementation and communication of new programs or changes to existing programs, which will include drafting of communications and presentations as well as attending and/or presenting information at Open Enrollment meetings. 13. Research and advise CCPRC of any new developments in the state and federal laws pertaining to employee benefit programs on an ongoing basis. 14. As requested by CCPRC, prepare bid specifications and solicit proposals from insurance markets that specialize in group insurance plans as needed. Assist with evaluation of bids and bidders, including administration, claim payment procedures, customer service, network, reserve establishment policies, financial soundness, and identifying the most cost-beneficial package from the various bidders. 15. Interface with insurance carriers as needed to assist CCPRC in the resolution of problems associated with the benefit programs. 7 Insurance Product Broker

Act as a partner with CCPRC to implement, administer, negotiate, update and communicate the employee benefits programs, and assist with compliance and control costs of the programs immediately and in the future. 17. Positively impact claims costs through the use of creative plan design, financial analysis and protocols that provide the right care, on a timely basis, in the most appropriate setting. 18. Provide forward-thinking approaches to maintain employee satisfaction and impact future claims costs with a focus on identification of risk and proactive intervention to improve the health of CCPRC employees. 19. Provide the lowest reasonable costs consistent with CCPRC objectives. 20. Provide a proven account manager/team that will be focused on CCPRC Company. 21. Provide superior levels of service to the Human Resources Division and staff through the use of state-of-the-art technology. 22. Experience working with clients of similar industries; experience with creative cost containment methods; experience, reputation and ability to reach a wide array of insurance markets and provide innovative services; record of completing work on schedule; strength and stability of the company; technical experience and strength and stability of proposed subcontractors; and assessment by client references. 23. Evidence of the ability to provide service in a prompt, thorough, innovative and professional manner. Proposals must clearly indicate ability to meet timeline for presentation of benefits to employees in September and open enrollment of October 1, 2014 through October 31, 2014, and to provide products beginning January 1, Firms may submit other proposals for providing other products; however, the proposals must address, at a minimum, the following list of products: A. Health Insurance i. Low deductible, open access plan for staff members ii. Medicare Supplemental Plan for retirees B. Dental Insurance C. Vision Insurance D. Long Term Care E. Short Term Disability i. Current plan covers first 12 weeks of leave F. Long Term Disability i. Current plan starts in the 13 th week of leave G. Life Insurance 8 Insurance Product Broker

9 i. Currently offers Group Term, Whole Life, and Universal Life Insurance H. Section 125 Cafeteria Plan i. Pretax premiums, Flexible Spending Account, and Dependent Care Accounts I. Prepaid Legal Services J. Cancer Expense Protection Policy K. Intensive Care Policy L. Voluntary Indemnity Policy (Hospital Confinement Policy). CCPRC currently employs 185 full staff, listed below is a breakdown of the age of those employees: A. 60 years old B years - 44 C years - 42 D years - 58 E. Less than 30 years - 25 CCPRC currently covers retired staff, listed below is a breakdown of the age of those retirees: A. Medicare Eligible 3 B. Non-Medicare Eligible 4 Nature of Services Required All proposals should include a Price Proposal for an insurance product broker annually, travel and other related expense. In addition, there are options three one-year options. Evaluation of options will not obligate The Commission to exercise the option(s). Selection Process Proposals will be received from qualified firms; however, no proposal submitted may be withdrawn for a period of sixty (60) days after the date the proposals are due. The Commission will determine whether the evidence of ability to perform is satisfactory and will make awards only when such evidence is deemed satisfactory. The Commission also reserves the right to waive any irregularities and/or reject any and/or all proposals that do not adequately meet the Owner s intended quality, cannot meet the schedule, or are not within the Owner s budget constraints. The Commission also reserves the right to accept the proposal as a whole or any items listed on the Proposal Form. 10 Proposers, by virtue of submitting a proposal, agree to The Commission s terms and conditions herein and will take precedence over any terms and conditions submitted with the proposal, either appearing separately or included in other literature. Withdrawal of an inadvertent or erroneous proposal before award may be permitted if there is reasonable evidence of a clerical or mathematical error. A mistake of business judgment does not constitute adequate grounds for withdrawal of a proposal. In the case of any ambiguities between the proposals and contract documents, The Charleston County Park and Recreation Commission s Contract and Procurement Policy will prevail. Upon submission, all proposals become the property of The Commission and are subject to public record laws. It is the Proposer s responsibility to notify The Commission of any proprietary information listed in proposals submitted. If a proposal contains proprietary information, the Proposer shall include a cover letter indicating such information. In addition, any information in which the proposer considers proprietary MUST be clearly marked proprietary next to the relevant part of the text in order for it to be treated as such. It is anticipated that the selected Proposer will enter into an Open-Ended Contract with The Commission for a period of one year, with three additional one year options. All prices, terms and conditions shall remain firm for the initial period of the Contract and for any renewal period. The Commission, at its discretion, may renew this Contract annually, up to three additional one year options, subject to satisfactory performance and with determination the renewal will be in the best interest of The Commission. Evaluation of options will not obligate The Commission to exercise the option(s). Qualification and Evaluation of Proposals It is of utmost importance for firms to demonstrate qualifications, competence and capacity to provide the Contractor services for the Financial Advisory Services. While The Commission is concerned about the ultimate costs for this project; the specific and primary attention to the evaluation of the proposals will include the following factors, is listed in the order of importance (factors 4 and 5 are of equal importance): 1) Project approach 2) Capacity 3) Corporate Experience 4) Cost 5) Past Performance 6) Local Preference The Commission will determine the best value based upon these criteria and recommend the selection of a Proposer. The Commission reserves the right to request additional information from one or more firms after the submission of the initial proposals in order to clarify, confirm or properly evaluate any 10 Insurance Product Broker

11 proposals. The Commission also reserves the right to negotiate terms of the contract with the intended firm pursuant to Charleston County Park and Recreation Commission s Procurement Policy. There is no expressed or implied obligation for The Commission to reimburse responding firms for any expenses incurred in preparing the proposal and/or any subsequent interview and/or requests for additional information. The Commission reserves the right to, at reasonable times; inspect the part of the business of a contractor, or any subcontractor, which is related to the performance of any contract awarded, or to be awarded, by The Commission and the books and records of such contractors and subcontractors in accordance with Charleston County Park and Recreation Commission s Procurement Policy. Proposals for services shall include all charges including, but not limited to, taxes and duties of any kind levied by federal, state, municipal or other governmental authority which either party is required to pay with respect to services covered under this agreement and travel and other related expenses. Contractor is required to sign a copy of the contract, a copy of which is attached. Criteria for Selecting Institution based on Qualifications Proposer Representations Each responding firm, by submitting proposals, represents that: 1. The responding firm has read and understands this solicitation (including all Attachments) and that its offer is made in accordance therewith. 2. The responding firm has reviewed the solicitation, become familiar with the local conditions under which the service is to be performed, and correlated personal observations with the requirements of the proposed contract documents. 3. The responding firm is qualified to provide the services required under this solicitation and, if awarded the contract, will do so in a professional, timely manner. Basis of Award The award determination shall be based on technical and price factors, not necessarily the lowest price. Following the deadline for submittal of proposals, a selection committee will review, analyze, and rank all submittals based on their response to the information requested. If desired, the selection committee may short list the number of qualified responding firms. The Commission reserves the discretion to determine the number firms that will be on the short list. The selection committee may conduct discussions with the firm(s) submitting responses regarding the contract and shall select from among them the firm(s) deemed most qualified to provide the required service. At the discretion of The Commission, the discussions with the 11 Insurance Product Broker

12 firm(s) may consist of written questions and responses, and/or personal interviews with members of the firm(s). If personal interviews are required by The Commission, the persons proposed to be responsible for performing the work required herein shall attend the interview. If requested, firms should be prepared to submit financial status information, which shall be held in confidence. The Commission reserves the right to reject any or all submittals and to waive defects, technicalities, and/or irregularities in any submittal. The Commission reserves the right to finalize a contract based on all factors involved in the written qualification submittal without further discussion or interviews. It is not the intent of CCPRC to meet with and/or discuss this Request for Proposal with individuals and/or firms during the RFP process; however, CCPRC may request additional information from one or more firms after the submission of the initial proposals in order to clarify confirm or properly evaluate any proposals. CCPRC also reserves the right to negotiate terms of the contract with the intended firm pursuant to CCPRC s Procurement Policy. Basis of Evaluation for each Factor The firm shall be rated higher during evaluations if their proposal meets or exceeds the following items: (Factors 1 through 6). Factor 1- Project Approach Basis of Evaluation: The responding firm may be rated higher during evaluations if their proposal indicates a solid understanding of The Commission needs and, present innovative or creative approaches in performing financial advisory services. Factor 2- Capacity Basis of Evaluation: The responding firm will be evaluated to determine if their proposal has sufficient capacity to meet and maintain service. Capacity is determined based on ability to meet or exceed the schedule and show a sample of a critical timeline for a successful project as well as sufficient local resources and personnel that will be allocated to perform the financial advisory services. Factor 3- Corporate Experience Basis of Evaluation: The responding firm will be evaluated in order to determine if it has demonstrated the necessary corporate experience to meet The Commission s needs in performing financial advisory services. 12 Insurance Product Broker

13 Factor 4 - Cost Basis of Evaluation: The Commission will evaluate price based on the total price proposal submitted for the base and the three option years. Evaluation of options will not obligate The Commission to exercise the option(s). If you are deriving your fee from the insurance companies and do not expect to charge CCPRC any fees you must disclose this information on the price proposal Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price: Price received in response to the RFP Price realism analysis performed Factor 5- Past Performance Basis of Evaluation: Include at least 3 references that are of similar size and scope from within the past three years of the insurance product broker services, preferably located within the South Carolina area. The Commission is interested in information that reflects a trend of satisfactory and/or an outstanding level of performance, considering: Successful completion of tasks Timely product delivery Quality products and services Cooperativeness and teamwork at all levels In addition to the above, The Commission may review any other sources of evaluation information of past performance. Other sources may include, but are not limited to, inquiries of firm representative(s), and any other known sources not provided by the firm. While The Commission may elect to consider data from other sources, the burden of providing detailed, current, accurate, and complete past performance information rests with responding firm. Based on the trend and satisfactory and/or outstanding ratings, performance may be rated higher. Factor 6 Local Preference Basis of Evaluation: The responding firm whose business is physically located and operating within the limits of Charleston County and who otherwise meets The Commission s vendor requirements in Attachment 7, 3, (b) thru (e). Evaluation Criteria Each response to this Request for Proposal will be subject to the same review and assessment process. Submittals will be evaluated on the basis of the Proposal s technical capability, experience and cost. All firms submitting qualifications must provide at a minimum, their expertise and capabilities as they relate to factors 1 thru 6 with regard to the insurance product broker services. 13 Insurance Product Broker

14 The distinction between corporate experience and past performance is corporate experience pertains to the types of work and volume of work completed by a firm comparable to the types of work covered by this requirement in terms of scope and complexity. Past performance relates to how well a firm has performed. Contractors will be evaluated on Factors 1 thru 6. Factor 1 Project Approach Factor and Solicitation Submittal Requirements include: 1. Describe the approach to the review of a new client s health and welfare plans. 2. Describe your engagement calendar with regard to meetings. Please describe how often you meet with clients, the focus of each type of client meeting, the frequency of each type of meeting, who participates in each type of meeting, and how meetings are conducted (i.e. in person, WebEx, etc.) 3. What is the process for developing CCPRC s long term benefit strategy? How will you forecast our costs 3-5 years in the future? 4. Describe any and all relevant enrollment, employee communication, and billing software. Describe your support services for the before mentioned software. 5. Describe management of Section 125 Cafeteria Plan. 6. Describe firm s approach to provide training for Human Resources staff for products and services. Additionally, provide details on webinars, seminars, publications, and training materials. 7. Describe the process your organization uses for renewals? 8. Describe firm s approach for providing legal and legislative updates affecting staff and/or products and/or services. 9. Healthcare Reform: What resources do you provide to help CCPRC remain compliant with healthcare reform? How will you help our company know what impact health care reform will have on our benefit offerings? Can you help us predict the financial impact that healthcare reform will have on our plan? Factor 2 Capacity Factor and Solicitation Submittal Requirements include: 1. Describe your firms approach to the project including timelines and scheduling. ; 2. Ability to attend meetings with The Commission, County Council, staff, and others, as necessary; 3. Ability to meet a schedule; and Factor 3- Corporate Experience Factors and Solicitation Submittal Requirements: Proposals shall identify the Principal-in-Charge and Project Manager for this project. Proposals shall also provide a statement of the firm s commitment that the identified 14 Insurance Product Broker

15 individuals will be involved throughout the entire project and must address, at a minimum: A. The Corporation The organizational strength and stability of the responding firm is an important component to the selection process. The experience of work by the firm, which was obtained by personnel no longer with the firm, and therefore, not available to work the project, is of no interest to CCPRC and shall not be submitted in the response when providing the firms qualifications. CCPRC evaluators will only consider firm projects that were presided over by project members who still work for the firm in the office submitting a proposal. Failure to properly identify work accurately may disqualify the proposal. Provide a listing of key members of the firm, their experience with similar projects and their role in the projects, a listing of what your firm offers that others may not, relevance and appropriateness of firms expertise and experience. Proposal must address, at a minimum: 1. Firm s background including organizational structure and years in existence. Provide description of previous work. Responsiveness and compliance with the items listed in request for proposal. 2. Firm s memberships in professional organizations 3. Number of firm s clients for each of the past five years. 4. Number of clients they currently have under contract. 5. Provide details for firms approach in handling the account and managing products. Please list and describe the core services that are typically provided to your clients. 6. Provide detailed organizational structure for managing services. 7. Provide details on the percentage of fees derived from brokering services and/or products (outline if offer fee based or commission based). Do you disclose all carrier commissions in writing? How? What is your process? 8. If you use subcontractors to supply any services, who are they, and how will your compensation arrangement with them impact the timing or frequency of services provided to us? 9. Describe what, in your opinion, your firm has that is unique to CCPRC in providing the services outlined in this Request for Proposal. 10. 16 B. Project Team Proposal shall clearly address the following: 1. Names, titles and responsibilities of those who would work on this project. 2. Resume of each project team member that will be assigned to this project. 3. Applicable Professional Registrations 4. Longevity with firm. 5. Membership in professional organizations 6. Detail individual's experience in the capacity of Project Manager that will be assigned to this project - highlighting experience with similar projects. 7. Provide the title of the referenced project, year work was done, name of the client and the name, address and telephone number of a contact person knowledgeable of that individuals role on the project. 8. In addition, what types of Subject Matter Experts do you have and what types of services do they provide? 9. Provide a general overview and brief history of your organization, including customer service philosophy, parent and/or subsidiary companies, and the number of employees. 10. Provide the address of the primary office and/or branch location that will service the account; 11. Describe the firm s direct experience in providing similar services for other governmental agencies, specifically local government agencies located in South Carolina. Include the number of public agency clients, and the types of services ; 12. Describe the firm s policy on changing the primary contact person; 13. Name the individuals who will work with The Commission; and information should include: a. Identify what each person s role and responsibilities will be. b. Biographical information. c. Experience working with governmental agencies. d. Number of years experience in this field. e. Number of years with your firm. f. Provide the name, title, address, phone number, fax number and address of the primary contact person(s) assigned to this account. Factor 4 Cost Factor and Solicitation Submittal Requirements include: The responding firm will be evaluated based on the total price proposal submitted including the base year and three one-year options; however, awards will not necessary be given to the responding firm with the lowest price. 17 companies and do not expect to charge CCPRC any fees you must disclose this information on the price proposal. The Commission will evaluate cost based on the total price proposal submitted for the base year and three one-year options requested by name in the Price Proposal. Evaluation of options will not obligate The Commission to exercise the option(s). Proposal shall include, at a minimum, fees to provide services for each listed in this RFP. Proposer is encouraged to provide any additional options and fees for services they may offer that are not listed in the RFP. Factor 5 Past Performance Factors and Solicitation Submittal Requirements: Responding firm should ensure correct phone numbers and addresses are provided for all client points of contact as well as submit a copy of references as indicated in Contractor Certification/Qualification Questionnaire and Reference Questionnaire, Attachment 2 and 11, which contains the point of contact information for each of the three required client references. The references should: 1. Provide three recent client references (from within the past three years); 2. Provide the client s name, as well as address and telephone number for a point of contact who can provide information regarding the firm s role on the providing supplies and service; 3. Submit any other information the institution believes will enhance its position in the evaluation criteria; 4. Include reputation and previous experience of the responding firm and its products, equipment and services; 5. Provide at least three (3) references that are of similar size and scope of service utilization as CCPRC insurance product broker, preferably local government agencies located in South Carolina; and 6. Address how many public sector clients, both within and outside of South Carolina, have terminated services in the last three years. Transmittal Letter: A signed letter of transmittal briefly states the Offeror s understanding of the work to be done, the commitment to perform the work, a statement why the Team believes it to be best qualified to perform the engagement, and a statement that the submittal is a Team and irrevocable offer for one hundred twenty (120) days. Detailed Submittal: The purpose of the detailed submittal is for the Offeror to demonstrate their qualifications, competence, and capacity to provide financial advisory services to The Commission in conformity with the requirements of this solicitation.
