1 GENERAL CONDITIONS OF USE FOR THE VIRTUAL OFFICE OF FCC Aqualia WARNING FOR USERS OF THE VIRTUAL OFFICE OF AQUALIA. PLEASE READ THIS DOCUMENT CAREFULLY. ACCESS TO AND USE OF THE VIRTUAL OFFICE IMPLIES, ON ITS PART AND WITHOUT ANY RESERVATION, EXPRESS ACCEPTANCE OF ALL THE TERMS IN THESE CONDITIONS, THESE FORMING AN INTEGRAL PAT OF THE LEGAL WARNING OF THE PORTAL AND HAVING THE SAME VALIDITY AND EFFICIENCY AS ANY CONTRACT IN WRITING AND SIGNED. THAT PROVIDED IN THE LEGAL WARNING WILL BE APPLICABLE WITH REGARD TO ANYTHING NOT EXPRESSLY FORESEEN IN THESE CONDITIONS. YOU MUST CAREFULLY READ THESE CONDITIONS EACH TIME TO ACCESS AND MAKE USE OF THE VIRTUAL OFFICE. COMPLIANCE WITH THESE CONDITIONS WILL BE DEMANDED FROM ANY PHYSICAL PERSON WHO ACCESSES THE VIRTUAL OFFICE AND PERFORMS ANY PROCEDURE THROUGH THIS. DO NOT ACCESS OR USE THE VIRTUAL OFFICE IF YOU DO NOT AGREE WITH THE TERMS IN THESE GENERAL CONDITIONS. 1. AIM These conditions have the aim of regulating access, use, request and management of procedures via the Virtual Office for accessible from the website (hereinafter, the Portal), owned by Aqualia FCC Aqualia (hereinafter, the Company) or from any other Internet address leading to the Virtual Office. The address to contact is the following: Departamento de Seguridad de la Información C/ Federico Salmon, Madrid These conditions have been presented sufficiently in advance, in accordance with the legislation in force. Likewise, the Company makes these conditions available to users in such a way they can be stored and reproduced, in this way complying with the legal duties regarding the provision of previous information. 2. SPECIFIC CONDITIONS OF THE VIRTUAL OFFICE 2.1 Acquisition of User Status The Virtual Office User status is acquired by simply accessing the Portal, browsing this and/or performing any procedure in it. Both people maintaining a contractual link with the Company and those not doing so will be considered to be Users. The User will provide the information requested for each of the procedures in order to access these procedures in the Public Access area. In order to access and perform procedures in the Private Access area, the User will be a client of the Company, previously registering and providing the data requested. In addition, the User will use the identifier and, where applicable, the password requested in order to access and perform procedures.

2 In any case, the User will be the only person responsible for the use made of the identifier and the password by physical persons to whom he may have informed these. All the procedures carried out, after previous identification and authorisation via the User identifier and password, will be considered to have been performed in a valid manner by this person and will be binding for him, giving rise to all the rights and obligations deriving from these general conditions of use Procedures and Requirements to make a Request Users may carry out the following procedures via the Virtual Office: A) PUBLIC ACCESS AREA A.1) Request for a New Connection A request for a new connection is made using this option. Data regarding the connection and mail are requested from the User. A.2) Request for New Supply A request for new supply is made using this option. Data is requested from the User with regard to the supply, mail, representative, where applicable, and data on the bank account and the holder of this, together with the language in which the documentation is to be sent and the type of client according to the type of supply. The Company informs on the documents the User must present for this request to be handled including, among others, the return the contract the Company sent to the User signed by him. The User receives, via , the confirmation that the request has been received, together with the credentials to access the Virtual Office. The request goes on to pending status. Once all the documentation requested from the User has been received, the request will go on to being definitely included. A.3) Request for Change of Holder Via this option, a request is made to change the holder of a contract. The contract number, together with the supply address, is requested for validation. The Company informs that the documents and information the User must send for the request to be handled will include, among other information, that on the supply, mail, direct debit and the holder of the account. Via , the User receives confirmation the request has been received, together with the credentials. The request goes on to pending status. Once all the documentation requested from the User has been received, the old contract is cancelled and the new one is included. A.4) Questions and Suggestions Through this option, the user will be able to send any questions and/or suggestions. When the user is not registered, he will be asked for his name, address, telephone number and address. In the event that the user is registered, he must select the contract on which he wants to perform the query.

A.5) Remind Password In this option, the User can request the corresponding credentials to access the Virtual Office are sent to his address. B) PRIVATE ACCESS AREA B.1) Contracts Via this option, the User may: o See contracts. The following data may be modified in this option: Supply and type of client. In this case, the Company receives a request for data modification, which it will evaluate to later be approved or not. Via , the User receives confirmation the request has been received and that the request has ended. Language, name and surnames for mail and the representative, where applicable, together with the details for direct debit. In this case, the Company receives a request for data modification, which is performed automatically. Via , the User receives confirmation the request has been received and that it has been correctly managed. o Meter readings. In this option, the User can enter data relating to meter readings. It is requested the reading, date and telephone number for contacting are entered. The Company proceeds to register the reading in the database. B.2) Online Payment Using this option, the User may perform online payment of bills pending. Once these have been paid, the User may print out a receipt. B.3) Requests By means of this option, the User may: o Change the meter. This option allows the User to request a change of the meter the contract refers to. Via , the User receives confirmation the request has been received, together with the decision on whether it has been approved or not. o Subrogation. In this option, the User is informed about what subrogation entails, together with the information he must send to the Company for the corresponding procedures to be carried out. o Cancellation. In this option, the User is informed about the documentation he must send to the Company for the corresponding procedures to be carried out. B.4) Claims In this option, the User may send different types of claim to the Company. A contact address to which to send the documentation specifically regarding the claim is requested from the User, by default using the mail address the User was included with.

4 Via , the User receives confirmation the request has been received, together with the decision on whether it has been approved or not. B.5) Change of Password/ for Web Communications In this option, the User may: o Change the password for access to the Virtual Office. In this case, the old password and that the new password is entered twice is requested. The User receives the new credentials via . o Change the address through which the User receives communications from the Company. B.6) Electronic Invoice (e-invoice). From this option the shipment of the electronic invoice can be requested in the contracts selected by the user. Once requested, the user can download the electronic invoices of the selected contracts B.7) Registration of a New User In this option, the User may proceed to register in the Virtual Office, so as to carry out procedures via the Private Access menu. The User will provide his tax identification, an address and the contract number. Later, the Company will inform the User on all the contracts he has signed and, if he agrees with the data, the registration is carried out. Via , the User receives the credentials for access to the Virtual Office. THE COMPANY RESERVES THE RIGHT TO SUSPEND THE EXECUTION OF PROCEDURES THROUGH THE VIRTUAL OFFICE IN THE CASE THAT THE USER HAS UNPAID BILLS OR IF ANY BILL PENDING IS RETURNED. LIKEWISE, THE COMPANY RESERVES THE RIGHT TO SUSPEND THE MANAGEMENT OF ANY PROCEDURE IN THE CASE OF IT BEING NECESSARY TO CONFIRM ANY OF ITS POINTS. 3. OBLIGATIONS Notwithstanding any other obligations deriving from these conditions for the Company and/or the User, both parts agree to follow and comply with those below. The Company agrees to the following: To perform and comply with the relation held with the User in accordance with the professional standards to be demanded in the field of activity it is in. To make whatever information is necessary in relation to the procedures to be carried out via the Virtual Office available to Users. To send to the User a check stating the request made has been received by the Company, whenever a procedure is carried out To make these conditions of use for the Virtual Office available to Users, in such a way they can be stored, filed and/or printed by the User. To warn and inform Users on any change that made be made to these conditions of use.

5 The User will be exclusively responsible for: Safeguarding his identifier and password to perform procedures via the Virtual Office. The procedures carried out by him or the people he has provided the identifier and password to and, consequently, assuming the consequences of all procedures carried out via the Virtual Office. Any action or procedure carried out in a different manner to that designated by the Company in its indications or instructions on the execution of procedures via the Virtual Office. The truthfulness, preciseness and updating of the data entered when filling in each of the forms presented by the Company in its Portal. Direct or indirect damage caused by any third party if the User loses, reveals, mislays or, in any way, allows a third party to know the data and information necessary to access the Virtual Office and to perform procedures using this. Any action contravening that provided in these conditions, the generally accepted law, moral, customs and public order. Non-compliance with the obligations deriving for any of the Parts will give rise to the right to claim, where applicable, for the corresponding indemnity for damage caused or brought about. 4. TREATMENT OF PERSONAL DATA AND CONFIDENTIALITY The treatment of personal data and of any other information requested for managing procedures via the Virtual Office, will be carried out in compliance with that stated in Organic Law 15/1999, of 13 th December, for the Protection of Data of a Personal Nature (LOPD) and the regulations on development, being treated in order to manage the requests and/or claims sent, together with the relationship arising between the Company and the User with the execution and management of procedures via the Virtual Office. The address will be specifically used as a means for communication with the User, to attend his requests and/or claims and, where applicable, to send him information on activities, products and commitments of the Company that may be of interest. With regard to the data provided to handle requests and/or claims, which are finally not approved or not attended by the Company, the User will be informed that these data are kept in order to keep a historical database of requests received and handled via the Virtual Office. By providing data of a personal nature, the User guarantees these are true, precise, complete and updated, being the only part responsible for any direct or indirect damage that may be caused as a result of non-compliance with this obligation. In the case that the data provided by a User belongs to a third party other than that providing the data, the User will inform the third party on the aspects contained in this clause and obtain his authorisation to provide his data to the Company. Likewise, in order to guarantee the duty regarding the quality and updating of the data, the User will notify the Company with regard to any modification that may occur in the data provided. The identifier and the password used to access the Virtual Office are provided exclusively to the User with the sole purpose of enabling access to this platform and to manage the execution of procedures. Any other use different from that authorised is expressly forbidden. The User has the obligation to guarantee the confidentiality of the identifier and password, being the only person responsible for the use made of these by physical persons he may have informed them about. It is expressly forbidden to inform or reveal the identifier and password to third parties not linked to the User and, in particular, to third parties who may carry out any other type of activity concurrent with those carried out by the Company or that may be in competition with it. It is expressly forbidden to extract, reveal, copy, distribute, spread or communicate to third parties any information coming from the Virtual Office.

6 The User has the rights to access, rectify, cancel or oppose (A.R.C.O), which he may exercise sending a communication by post and a photocopy of his NID, with the Data Protection reference, to Departamento de Seguridad de la Información, Federico Salmon, 13; Madrid, indicating the right he wishes to exercise.
