2 Article 1: Purpose of the agreement This agreement governs the relations between the Host Organisation (company, public body, association...) represented by: and the University of New Caledonia, hereinafter referred to as UNC Article 2: Purpose of course: The practical course is designed to provide the student with an opportunity to put into practice the theoretical and methodological tools acquired during his/her course of studies, to develop his/her skills and affirm career objectives. The course is designed as part in the student's training program and personal and professional project. It forms part of his/her academic syllabus and is required to obtain a final diploma. The course program is defined by UNC and the host company in accordance with the overall training program undertaken by the student. This work experience program shall be consonant with the student's field of specialisation and skills. Designated activities Article 3: Terms and conditions of course An additional agreement may be drawn up should the course be extended at the request of both the organisation concerned and the student. Under no circumstances may the course be extended beyond 31 January of the year following the year of the student's registration for the training course giving rise to the work placement. Practical details The student's weekly maximum period of attendance in the company shall be... hours. The placement will be full time/part time (specify...) (Delete as applicable) If the Organisation requires the student's presence at night, on Sundays or on public holidays, such specific circumstances should be detailed below. Article 4: Student's status - Induction and mentoring During the student's training period with the Organisation, he/she remains a full-time UNC student and will be monitored regularly by UNC. The Organisation shall designate a Host Organisation mentor who will be responsible for technical follow-up and ensuring optimal conditions for the training period. The student may return to UNC during the term of the training period to attend various courses explicitly required by the syllabus or to attend meetings or examinations; the relevant dates being communicated to the Organisation by UNC. 2

3 Terms and conditions of mentoring Article 5: Compensation - Benefits in kind Reimbursement of expenses The student may receive a compensation payment. Conditions for payment of compensation amount, if applicable List of benefits in kind, if applicable Article 6: Social security cover outside New Caledonia 6.1 Student's health insurance 1) Health insurance based on New Caledonian student healthcare scheme: Students can claim for healthcare expenses incurred abroad to be reimbursed by the CAFAT on their return subject to submission of supporting documents, i.e. original medical expenses claim forms, paid invoices, a declaration by the relevant institution or a declaration by UNC or a copy of the practical course agreement. Expenses shall be reimbursed based on standard CAFAT rates and there may be a significant difference between actual costs and reimbursement rates. o Students are therefore strongly advised to take out supplementary medical insurance, valid for the country and period of the practical course, with an insurer of their choice (mutual or private insurance company, etc.) Such medical insurance may be required by the host country when completing immigration formalities; o Exception: if the Organisation provides students with health cover under local healthcare provisions (see 2 above), students may opt to be covered by this local scheme. Before making a decision, students should check on the guaranties offered. 2) Health cover provided by the Organisation: By ticking the appropriate box, the Organisation indicates below whether it will provide the student trainee with health cover under healthcare provisions in force in the host country: YES (such health cover is added to continuing benefits under the CAFAT student health care scheme as applicable overseas) NO (the student is only covered by continuing benefits under the CAFAT student health care scheme as applicable overseas) 6.2 Student's occupational hazard insurance 1) To ensure student trainee coverage under New Caledonian regulations relating to occupational injuries, journey injuries and occupational diseases, this practical course shall: 3

4 not give rise to any remuneration liable to entitle student trainees to claim occupational hazard insurance in the host country; take place solely within the Organisation which is a party to this agreement; take place solely in the specified foreign country, unless the student is employed by a firm and is completing the course mentioned hereinabove at the instigation of his/her employer. the student takes out optional occupational hazard insurance with the CAFAT; in this case a certificate of occupational hazard insurance for the period of the course must be attached to this agreement. When conditions have not been met, the Organisation hereby undertakes to pay contributions ensuring the trainee has healthcare insurance and to make any necessary declarations in the event of occupational injury, journey injury or occupational disease. 2) UNC is responsible for declaring all instances of occupational injury, journey injury and occupational disease and the Organisation must give UNC written notice thereof within a period of 48 hours. 3) Coverage concerns injuries occurring: within the perimeter of the course location and within practical course hours; during the student's usual return journey between his/her place of residence abroad and the course location; during the student's journey (at the beginning and end of the course) to or from his/her place of residence in New Caledonia and his/her place of residence abroad; within the context of a task assigned by the Organisation and which must be specified in a letter of assignment. 4) In the event that one only of the conditions set out in 6.2 1) above has not been met, the Organisation hereby undertakes to ensure that the student trainee is covered against occupational accidents and injuries, journey injuries and occupational diseases and that all necessary declarations are made. 5) In all cases, If the student meets with an occupational accident during the course, the Organisation must immediately advise UNC of such accident; If the student undertakes tasks outside Host Organisation premises or outside the course country, the Organisation shall take all measures necessary to provide him/her with the appropriate insurance cover. Article 7: Civil liability and insurances The Host Organisation and the student hereby declare that they carry civil liability insurance. If the Organisation should provide a vehicle for use by the student, the Organisation shall ensure in advance that the vehicle insurance policy covers its use by a student. Should the student use, for the purposes of the course, his/her own vehicle or a vehicle loaned by a third party, he/she shall expressly inform the insurer of the said vehicle that it is to be put to such use and, if applicable, pay any related premium. Article 8: Discipline During the period of his/her course, the student shall be governed by the Organisation's discipline and personnel regulations policy, with specific reference to working hours and health and safety rules as implemented by the Organisation. UNC has sole responsibility for decisions relating to disciplinary measures. Should such an issue arise, the Organisation shall inform UNC of any breach or failure and shall provide any constituent elements concerned. 4

5 In the event of a serious breach of discipline, the Organisation reserves the right to terminate the student's course whilst ensuring compliance with the provisions of article 10 of this agreement. Article 9: End of course Report Assessment At the end of the course, the Organisation shall present the student trainee with a course certificate and complete an assessment form (appendix 2) to be returned to UNC. The student shall provide UNC with a course report in accordance with the terms and conditions set out in the teaching guide. The student may make an oral presentation outlining work undertaken during the course No expenses of any kind may be claimed from UNC by the Host Organisation mentor or any other member of the Organisation who may need to travel to UNC in connection with course arrangements, progress or validation Article 10: Absence and interruption of the course Temporary interruption The student may take time off during the course, subject to agreement by the Host Organisation and to compliance with the duration set for the course. Should the course be temporarily interrupted for any other reason (sickness, maternity, unjustified absence...), the Organisation shall send written notice to the UNC staff member in authority. Definitive interruption In the event of any one of the three parties (the Organisation, UNC, the student) definitively interrupting the course, the party concerned shall immediately inform the other two parties in writing. The reasons given shall be reviewed in close consultation. The final decision to break off the course shall only be taken after such process of concerted review. Article 11: Obligation to observe secrecy and confidentiality The obligation to observe secrecy is an absolute requirement. Student trainees shall therefore undertake not to make use, under any circumstances, of information obtained or acquired by them, including their course report, for publication purposes or to disclose such information to any third party without the prior agreement of the Organisation. Such undertaking shall remain valid not only during the course but after the course has ended. The student hereby undertakes not to retain, remove or copy any document or software whatsoever belonging to the Organisation, unless with the latter's agreement. Note: As regards the confidentiality of information contained in the student's report, the Organisation may request that circulation of such report be limited, and even that certain extremely confidential elements be withdrawn. Any persons necessarily being made aware of such information shall be bound by the terms of professional secrecy to neither use nor disclose information contained in the report. 5

6 Article 12: Intellectual property In the event of the trainee's work giving rise to a creative work protected under intellectual property rights or industrial property rights (including software), if the Organisation wishes to use such work and the trainee agrees thereto, a contract shall be concluded between the trainee (author) and the Organisation. The following points shall be specified: the extent of the rights transferred, possible exclusivity, intended purpose, media used and period of transfer, together with, if applicable, the amount of remuneration payable to the student under the terms of such transfer. This clause shall also apply to practical courses in public institutions. Article 13: Recruitment In the event of the student concluding with the Organisation an employment contract which comes into force before the date on which the course ends, the said "student" would no longer be the responsibility of UNC.
