1 ECC Board of Trustees Executive Summary Date: November 19, 2015 Subcommittee: Curriculum and Student Success Agenda Item: Letter of Agreement for Education Services between ECC and SBG Technology Solutions, Inc., on behalf of the Department of Homeland Security, Transportation Security Administration [TSA] Renewal This item is: For Board's Approval Backup Documentation: Attached to this document Background Information: This agreement is a continuation of previous agreements (relationship began in October 2012) to offer offsite courses for TSA employees. Initially, ECC offered offsite courses at the Buffalo Airport. This has gradually transitioned into six Distance Learning courses being offered to TSA employees at six hub airports and 33 spoke airports located throughout the Northeast States of New York, Massachusetts, Vermont, New Hampshire and Maine. The goal is to continue to provide high quality/content online distance training to TSA employees at these Airports and to expand ECC course offerings to these airports and to airports in other parts of the country. These courses also lead into other ECC programs; such as: Homeland Security and Criminal Justice for those that may want to continue. These programs can be positively affected as a result of good delivery. Reasons for Recommendation: Agreement will enhance ECC s Homeland Security program and its reputation and standing as being the only SUNY institution to currently provide a TSA Homeland Security certificate in an online format. Since this program is now offered entirely in an online format, ECC is positioned to become the premier provider of this enhanced education for TSA employees and other students. Fiscal Implications: ECC expects to enroll up to 175 students (25 in each online class) in the Spring 2016 semester and possibly even more in the Fall 2016 semester assuming a favorable outcome and further expansion. The fee per distance learning course delivery is $8,040 for a minimum of 10 students with each additional student from 11 to 25 requiring $804 per student (tuition of $651, distance learning fee of $75, technology fee of $33, registration fee of $30, and activity fee of $15). SBG will also reimburse ECC for the purchase of textbooks which ECC must furnish to the students with a maximum reimbursement of $130 per text. ECC has been purchasing ebook licenses which are much less than this $130 maximum. Consequences of Negative Action: Loss of potential revenue and an opportunity to expand ECC s online Homeland Security certificate program. 2 LETTER OF AGREEMENT FOR EDUCATION SERVICES Between Erie Community College and on behalf of The Department of Homeland Security, Transportation Security Administration This Letter of Agreement ( Agreement") has been prepared to outline the scope of the training services that Erie Community College (hereinafter referred to as "College") will perform for SBG on behalf of the Department of Homeland Security, Transportation Security Administration ("Client"). This Agreement defines the responsibilities of the College and Client regarding the delivery of the TSA Associates Program from 01/19/2016 to 06/30/2016. Services to Be Rendered The College will participate in an education program for the Transportation Security Administration Officers working at the following airports: Hub Airport Albany International Airport (ALB) Boston Logan International Airport (BOS) Burlington International Airport (BTV) John F. Kennedy International Airport (JFK) LaGuardia Airport (LGA) Manchester-Boston Regional Airport ( Spoke Airports BUF, SWF, PBG, SLK, IAG, JHW, ROC, ELM, SYR, BGM, RME, ART, ITH, MSS, and OGS ACK, BED, CEF, HYA, MVY, ORH, PVC, AUG, PQI, BGR, BHB, PWM, and RKD RUT HPN and ISP LEB and PSM This education program will be delivered at or near the airport location as mutually agreed upon by College and Client. Participants will receive three (3) credit hours for successful completion for each of the three core courses in the program. Program delivery requirements are identified in the Program Delivery Agreement (PDA; Appendix A) executed by SBG and the College. All amendments and modifications to the PDA must be in writing, have a specified effective date, and be accepted by SBG and the College. Payment Terms Fees and payment terms are outlined in the executed Agreement between SBG and the College, found below. The College will invoice the Client for program delivery costs as outlined below. Payment for services will be paid directly from the Department of Homeland Security, Transportation Security Administration. 2
4 A draft invoice will be submitted to SBG for verification at within one week of the course drop date. Upon verification of final invoice, SBG will submit the final invoice on the College s behalf to the Client. The fee per distance learning course delivery is $8, for a minimum of 10 students with each additional student from requiring $ per student (tuition of $651.00, distance learning fee of $75, technology fee of $33.00, registration fee of $30.00, and activity fee of $15.00). The invoice will also include the textbook charges. The textbook charges for each registered student, in receipt of a textbook, will not exceed $130 per registered student per course without prior written permission from SBG. The Client will pay invoices within 30 days of receipt of approved final invoice. General Conditions The College will seek required approval from SBG on behalf of the Client. Utilization of seals representing the Department of Homeland Security and/or Transportation Security Administration for any purposes, including, but not limited to, marketing, promotional, and logistical, requires approval by the Department of Homeland Security Office of Public Affairs. The College shall comply with all applicable federal, state, and local Laws. No waiver, alteration, or modification of any provisions of this Agreement shall be binding unless evidenced by written agreement signed by duly authorized representatives of the two parties. Any notice required or permitted under this Agreement will be delivered on official company or organization letterhead via or mail to the opposing party s liaison listed on page one of the Agreement. 6 Appendix A TSA OFFICER EDUCATION PROGRAM DELIVERY AGREEMENT SBG-TSA This Program Delivery Agreement is by and between SBG Technology Solutions located at 1000 North Payne Street, Suite 300, Alexandria, VA and Erie Community College located at 4041 Southwestern Blvd, Orchard Park, NY Description of Service: The Client is providing its Transportation Security Officer (TSO) workforce at airports throughout the nation the opportunity to work toward a TSA Homeland Security Certificate and/or Associates Degree in Homeland Security, or a related field. SBG has been contracted by the Client to provide program management support for the education program. Each session will be delivered at the airport one or two times a week, usually at a time adjacent to Officer shift change schedules (for example 9:00am or 5:00pm). Participants will receive three (3) credit hours for successful completion of the course. This is an ongoing program with three (3) core courses being offered by accredited higher education institutions. The Officers receive a Certificate of Achievement from TSA upon successful completion of the three (3) core courses. The three (3) core courses are: Introduction to Homeland Security Intelligence Analysis & Security Management Transportation and Border Security Delivery College Program Requirements: Participant interest determines class demand. Given sufficient participation, the allocations listed in the Letter of Agreement will be offered. All attendance reports must be submitted on the official SBG spreadsheet within 48 hours of the class (see Appendix B). 1. Perform the services called for by this Agreement in accordance with the highest educational standards. 2. Award three (3) college credits for successful completion of each course. Successful completion of a course is defined as receiving marks of C or better. Credits must fall within a degree program. 3. Include all TSA learning objectives in the course syllabus. Organize concepts to be taught in a logical and understandable sequence covering all learning objectives as outlined in the course syllabus and lesson guides. Include experiential writing assignments where appropriate. 4. Follow classroom routines including but not limited to the following: a) Start and end class on time b) Provide a classroom environment conducive to learning 4
7 c) Provide course outlines and syllabi to participants at beginning of course with a grading statement d) Administer rules consistently and fairly e) Establish and maintain classroom control f) Return tests, labs and homework in a timely manner 5. Handle administrative routines in a timely manner: a) Select and purchase, no later than three weeks prior to the course start, textbook from recommended list. Your college will be reimbursed for the textbooks. b) Submit instructor resume to SBG on behalf of TSA no later than two (2) weeks prior to course start c) Submit course syllabus to SBG on behalf of TSA no later than two (2) weeks prior to course start d) Complete participant course registration at airport prior to or at first class e) Maintain attendance records on provided form and submit attendance within 48 hours of the class meeting to SBG on behalf of TSA f) Release final grades in alpha format to SBG on behalf of TSA no later than one (1) week after the last class g) Submit completed end-of-course questionnaires to SBG on behalf of TSA no later than (1) one week after the last class h) Distribute your college's academic ethics policy to the participants i) Inform SBG when an instructor has been removed from a course during a contracted delivery 6. Work cooperatively with airport partner Educational Coordinator and staff and participate in conference calls and client meetings as requested i.e. participate in initial college/airport partnership planning meeting; participate in recruiting information sessions at airport; participate in applicant essay review process; and work with airport TSA staff on publicity and marketing opportunities; work with airport TSA staff on Certificate of Achievement Ceremony after the first cohort completes all three (3) courses. 7. Provide a list of student addresses for each student enrolled through this program to SBG. 8. Work with local TSA Education Coordinator to gain publicity approval prior to any publication regarding the services provided under this agreement (including but not limited to notices, information, pamphlets, press releases, research, and reports). 9. Maintain confidentiality and do not disclose proprietary or confidential TSA information to any third person. 10. Perform any other duties as assigned within the scope of delivery of these three academic courses for the TSA Associates Program. 5
