58 THE CORPORTION OF THE VILLGE OF NEW DENVER BYLW NO. 655, 200 bylaw to amend Village of New Denver Zoning Bylaw No. 62, 2007, being a bylaw to regulate the location and use of buildings and structures and the use of land within the Village of New Denver ****************************************************************************** WHERES the Council of the Village of New Denver has considered Section 903 of the Local Government ct: ND WHERES it is deemed expedient to amend Village of New Denver Zoning Bylaw No. 62, 2007"; NOW THEREFORE the Council of the Village of New Denver in open meeting assembled enacts as follows:. This bylaw may be cited as Village of New Denver Zoning mendment Bylaw No. 655, Section 3 Definitions is herby amended by inserting between the definitions ccessory Building or Structure and pproving Officer, the following definition; ccessory Residence means a dwelling in a stand-alone building on a residential property that also contains a single detached principal building. The accessory residence may be purpose-built, or may be a conversion of, or an addition to, an existing garage or accessory building. 3. Section 4 General Regulations is hereby amended by adding; Section 4.8 ccessory Residences n accessory residence shall comply with the following regulations:. n accessory residence, when permitted, shall not be occupied as a residence except where the registered owner of the subject property resides in the accessory residence or in the principal residence/building on the property..2 If the registered owner of the subject property ceases to reside in either the principal residence/building or the accessory residence, the accessory residence must not be used for any purpose except storage of goods..3 Only one accessory residence is allowed per residential property, and shall not be allowed in conjunction with a secondary suite in the principal dwelling unit..4 No accessory residence will be allowed without meeting the requirements as defined in the British Columbia Health ct for septic disposal capacity..5 ll accessory residences must meet BC Building Code requirements..6 n accessory residence shall not be sited or located on a separate parcel from the principal building/residence..7 n accessory residence shall not exceed 5.0 m (6.4 ft.) in height..8 n accessory residence shall be permitted in R (Single and Two Family Residential Zones).
59 .9 n accessory residence shall only be permitted in R2 (Low-Density Multi-Family Residential) Zones on parcels that contain one principal dwelling unit..0 Subject to Section 4.7.3, the floor area of an accessory residence shall not exceed 40% of the total main floor area of the principal residence or 600 sq. ft., whichever is greater, provided the maximum parcel coverage for all buildings located on the parcel, does not exceed 45% of the total parcel area, and provided the accessory residence conforms to the maximum square footage as set out in Section Parking and ccess Requirements: (i) (ii) One on-site parking space is required for the accessory residence in addition to those spaces required for the principle residence; ll required parking spaces shall be located on the subject parcel..2 n accessory residence shall meet the minimum setback provisions for the zone in which the subject property is located. If attached to a garage or other structure, the entire building containing the accessory residence shall meet the minimum setback provisions of the zone for the principal building on the site..3 ll accessory residences must be registered with the Village of New Denver. 4. Section 6. Single and Two-Family Residential Permitted Uses is hereby amended by re-numbering sub-section 6.(a) to 6.(k) to read 6.(a) to 6.(i). 5. Section 6. Single and Two-Family Residential Permitted Uses is hereby amended by adding the following permitted use; (j) accessory residence. 6. Section 6.2 Single and Two-Family Residential Regulations is hereby amended by inserting between and a new 6.2.5; ccessory Residence Per Parcel parcel in a R zone is limited to a maximum of one accessory residence per parcel. 7. Section 6.2 Single and Two-Family Residential Regulations is hereby amended by renumbering sub-sections to to read to Section 7. Low Density Multi-Family Residential Permitted Uses is herby amended by adding the following permitted use; (l) accessory residence. 9. Section 7.2 Low Density Multi-Family Residential Regulations is hereby amended by inserting between and a new 7.2.6; ccessory Residence Per Parcel parcel in a R2 zone is limited to a maximum of one accessory residence per parcel, provided there is only one single family principal dwelling unit located on the parcel, and shall not be otherwise permitted..
