Team Based Critical Analysis: A New Look at Evidence Based Argument. This manuscript documents the efforts to increase student learning in the sophomore level business law course. We use a modified form of Team Based Learning (TBL) along with the traditional law school IRAC method to create a teaching technique we call Team Based Critical Analysis (TBCA). TBCA allows the business law professor to integrate team based learning methodologies with the traditional critical thinking technique of IRAC to increase engagement in the classroom and retention of learning. Ficht, Linda S., Disclaimers of Mass Deflection: Tempering Commando Legal Advice to Enhance Customer Relationship Building. This manuscript analyzes disclaimers commonly used in business that are written in iron clad terms adverse to the interests of the customer and overly protective of business interests. This paper discusses the use of disclaimers from a social responsibility perspective and suggests to business owners that they take responsibility for their disclaimers. Business owners need to inform the attorney drafting the disclaimer that oppressive disclaimers can have a negative impact on customer relationship building and instead direct the attorney to draft a protective disclaimer that is not oppressive. This type of disclaimer is more likely to allow the business to build a strong relationship with the customer and protect itself from potential litigation. Levashina, Julia, Ficht, Linda S. Can I Fake It? Courts View on Faking in Interviews. This manuscript reviews recent research on past-behavioral and situational interview questions and applies the case law regarding fraud to the research to hypothesize whether certain impression management tactics would be viewed as legal or illegal by a court of law. Levashina, Julia, Ficht, Linda S. Human Resource Background Checks: Fact or Fiction? This manuscript is a survey of approximately 168 Human Resource managers and evaluates their background check policies, their adherence to such policies and trends seen in the survey. Findings and research implications for HR practitioners will be discussed.

4 Ficht, Linda S., Chulkov, Dmitriy. We have completed an IRB approved study on Team Based Critical Analysis in the L201 classroom during the spring 2012 and fall 2013 semesters. We are now analyzing the data collected for a pending research paper discussing how Team Based Critical Analysis affects learning and whether there is a positive correlation between Team Based Critical Analysis and improvement in assessment of learning. Ficht, Linda S., Employment at Will v. Social Media: The Winner is Still Unknown. One of the most significant employment law issues currently is the use of social media in the selection process. In this manuscript we will describe the two main issues employers must be aware of during the selection process. The first issue is related to employer use of social media accounts in selection. The second issue is related to employers demanding job applicants to turn over their passwords to their social media accounts for review at will. Both of these practices have pitfalls for the employer and if they intend to use these practices in selection, they must proceed with caution.
